The Twelve between two testaments : the Minor Prophets as Christian scripture in the commentaries of Theodore of Mopsuestia and Cyril of Alexandria

My thesis offers a comparison of the Minor Prophets commentaries of Theodore of Mopsuestia and Cyril of Alexandria, isolating the role each assigns (1) the Twelve Prophets in their ministry to Old Testament Israel and (2) the texts of the Twelve as Christian scripture. While the two produce radically different commentaries in terms of quantity and detail of christological interpretation, the source of their divergence cannot be reduced to Cyril's admitting messianic prophecy whereas Theodore does not. Rather, I argue that Theodore does acknowledge christological prophecies, as distinct from both retrospective accommodation and typology. Further, a careful reading of Cyril's Commentary on the Twelve limits the prospective christological revelation he ascribes to the prophets and reveals the positive role he grants the Mosaic law prior to Christ's advent. My thesis secondly explores the Christian significance both Theodore and Cyril assign to Israel's exile and restoration, the pivotal event to which the Twelve bear witness. I here argue that Theodore's reading of the Twelve Prophets, while not attempting to be christocentric, is nevertheless self-consciously Christian. Cyril, unsurprisingly, offers a robust Christian reading of the Twelve, yet this too must be expanded by his focus on the church and concern to equip the church through the ethical paideusis provided by the plain sense of the prophetic text. Revised descriptions of each interpreter lead to the claim that the label “christocentric” obscures more than it clarifies and polarizes no less than earlier accounts of Antiochene/Alexandrian exegesis. I advocate rather for an approach that takes seriously Theodore's positive account of the unity and telos of the divine economy and the full range of Cyril's interpretation, in order to move beyond a zero-sum assessment and offer instead a positive account that appreciates the strengths of each Christian reading of the Twelve.

Le cinéma français de l’après-guerre, largement apolitique, laisse pourtant surgir des questionnements autour de la remise en place de l’État de droit dans ses représentations de la justice pénale. Point de rencontre entre l’individu et l’État qui doit rétablir sa légitimité après les abus et les exactions du régime de Vichy, la justice représente un thème épineux pour les cinéastes, d’autant plus que le cinéma est à cette époque un moyen d’expression hautement surveillé, censuré et toujours associé à la propagande des régimes totalitaires. À partir d’un corpus de quarante longs métrages de fiction, l’objectif de cette étude est d’analyser les représentations des tribunaux, des forces de l’ordre, des prisons, du crime et du châtiment par le média de masse le plus important de l’époque, avant que la Nouvelle Vague n’entraîne une transformation de l’industrie et de l’esthétique cinématographiques et que la télévision atteigne un public plus nombreux encore. Les critiques dans la presse, les archives de la censure publique ou encore les bandes d’actualités qui abordent ces mêmes thèmes font partie des sources utilisées dans cette étude pour replacer dans leur contexte historique les images de la justice dans le cinéma de fiction. Souvent dépolitisés, parfois propagandistes, en quelques cas subversifs, ces films permettent de délimiter le périmètre d’expression possible autour de ce thème intrinsèquement politique dans la France des années 1940 et 1950. Ils fournissent un aperçu de la morale, des idéaux, des tabous, des espoirs et des peurs d’une société qui a rétabli la démocratie, mais qui commence à interroger la violence de ses propres pratiques de maintien de l’ordre. / Although French cinema from the period following World War Two is known for being largely apolitical, its images of criminal justice allow for a glimpse of the difficult questions that the postwar society was forced to ask itself about its return to the rule of law. As a point of conflict between the individual and the state—in a state attempting to reestablish its legitimacy—criminal justice was a delicate subject for filmmakers to address, especially since the cinematic medium, still seen as a means of propaganda and associated with totalitarian regimes, was strictly monitored and censored by public authorities. Using a corpus of 40 feature-length fiction films, this study attempts to analyze the representations of law enforcement, courts, prisons, crime, and punishment in the most important mass media of the era, before the transformation of the film industry by the New Wave and the spread of television to a substantial audience. A range of primary sources, from film reviews in the press to public censorship archives and newsreels dealing with similar themes, help to place the feature films’ images of criminal justice in their historical context. Often depoliticized, sometimes propagandistic, occasionally subversive, the films reveal the possibilities and the limits of expression on an intrinsically political topic, in the film industry and more broadly in 1940s and 1950s French society. They expose the morals, ideals, taboos, hopes and fears of a nation that had recently reestablished democracy but faced difficult questions about the violence of its own methods of maintaining order.

Sistemas modernos de comunicação móvel sem fio, como os de quarta geração (4G), têm como principais metas prover elevada capacidade e alta qualidade de serviço (QoS) para os usuários. Para prover tal aumento de capacidade e QoS, sistemas 4G empregam diversas técnicas avançadas de transmissão e maior largura de banda, combinados com algoritmos de alocação de recursos que possam explorar de maneira eficiente tais técnicas, como por exemplo aproveitando as dimensões de diversidade do sistema. Em geral, porém, é necessário também aumentar a potência de transmissão para se atingir o ganho de capacidade desejado, o que implica maior custo para os provedores de serviço, menor tempo de vida para os dispositivos móveis e impacto ambiental cada vez mais pronunciado. Dado que a expectativa é que o número de usuários e a necessidade de dados continuem crescendo rapidamente, torna-se evidente a importância de analisar a relação entre capacidade e potência dispendida pelo sistema. Essa relação pode ser vista através da métrica de eficiência energética (EE), que é dada pela razão entre o número de bits efetivamente recebidos e a energia consumida no processo, revelando quão eficientemente o sistema transforma a energia consumida em informação efetivamente recuperada no receptor. Um sistema otimizado em relação à EE é capaz de transmitir mais informação por unidade de energia consumida, resultando em utilização mais racional e eficiente dos escassos recursos energéticos. Uma segunda questão acerca das metas é em relação à distribuição dos ganhos de capacidade/ QoS pela célula, i.e., quais usuários serão capazes de usufruir da maior capacidade e QoS. Em ambientes macrocelulares urbanos, a perda de percurso pode chegar a várias dezenas de decibéis em distâncias relativamente pequenas, além dos obstáculos naturais, como relevo, e artificiais, como prédios, o que limita ainda mais o desenvolvimento de sistemas energeticamente eficientes. Em abordagens tradicionais, tais problemas exigem a utilização de potências elevadas, em geral superiores à potência que os dispositivos podem utilizar, ou então requerem o aumento da densidade de estações rádio-base (BSs), o que geralmente resulta em custos inviáveis do ponto de vista dos operadores. Assim, busca-se em sistemas 4G emular o aumento da densidade de BSs através do conceito de redes heterogêneas, que são células com menor área de cobertura instaladas em pontos críticos de cobertura da célula original, como por exemplo a região de borda de célula, atendendo de maneira eficiente os usuários. No cenário de redes heterogêneas, um dos principais paradigmas é o conceito de redes cooperativas, no qual estações retransmissoras (RSs) reenviam o sinal recebido da estação fonte para estação destino, reduzindo a potência consumida com o canal móvel sem fio. Como utilizam conexão sem fio com a BS, as RSs podem ser instaladas em regiões com pouca infraestrutura sem a necessidade de grandes modificações, resultando em implantações bastante flexíveis. Assim, este trabalho de doutorado visa investigar estratégias de alocação de recursos baseadas no incremento da eficiência energética para sistemas celulares de quarta e quinta gerações utilizando o paradigma de redes cooperativas, determinando potencialidades e também itens que necessitam ser modificados, otimizados ou mesmo redefinidos, tendo em vista um aumento substancial da eficiência energética global da rede de comunicação sem fio. Busca-se durante o desenvolvimento do modelo de sistema capturar e quantificar as principais características de importantes sistemas celulares em uso atualmente, i.e., LTE-A e WiMAX, de modo que as decisões de design considerem os esforços de padronização, porém não se limitem a eles. Como a abordagem de alocação de recursos baseada em EE pode impactar nas métricas de desempenho do sistema, investiga-se também o compromisso entre as eficiências energética e espectral (SE), de modo que o aumento da EE não seja causado apenas pela degradação da SE e que seja possível obter maior EE para uma mesma SE e QoS. / Modern wireless communication systems, such as the fourth generation (4G) ones, have as main objectives to provide high capacity and quality of service (QoS) for the users. Since the expectation is that the number of users and data necessity will continue growing rapidly, it is evident the importance of analyzing the relation between capacity and power expended by the system. This relation can be seen through the energy efficiency (EE) metric, which is given by the ratio between the number of effectively received information bits and the energy consumed in the transmission process, revealing how efficiently the system transform consumed energy into effectively recovered information at the receiver. A system optimized regarding EE is able to transmit more information per unit of energy consumed, resulting in a more rational and efficient utilization of the scarce energetic resources. A second issue is relative to the distribution of the capacity/QoS gains over the whole cell, i.e, which users will be able to take advantage of the higher capacity and QoS. In urban macrocellular environments, the path-loss can reach several tens of decibels in relatively short distances, in addition to natural obstacles, such as land relief, or artificial, such as buildings, which further limits the development of energetically efficient systems. In traditional approaches, such problems require the use of high transmission power, generally greater than the power that the devices can use, or else require increased density of base-stations (BSs), which generally results in unviable costs from the operators point of view. Thus, in 4G systems it is sought to emulate the increase in the density of BSs through the concept of heterogeneous networks, which are cells with smaller coverage area installed in critical points of the original macrocell coverage, as for example the cell-edge area, serving efficiently the users. In the heterogeneous networks scenario, one of the main paradigms is the concept of cooperative networks, in which relay stations (RSs) retransmit the signal received from the source station to the destination station, reducing the power consumed with the mobile wireless channel. As the RSs use a wireless connection to the BS, they can be installed in places with poor infrastructure without requiring major modifications, resulting in very flexible deployments. Thus, this PhD work aims to investigate resource allocation strategies based on the improvement of the energy efficiency for fourth and fifty generation cellular systems using the cooperative networks paradigm, determining potentialities and also items that need to be modified, optimized or even redefined, aiming to a substantial increase in the overall energy efficiency of the wireless communication network. It is sought during the development of the system model to capture and quantify the main features of important cellular systems currently in use, i.e., LTE-A and WiMAX, so that the design decisions consider the standardization efforts, but do not be limited by them. Since the EE-based resource allocation approach can impact the performance metrics of the system, it will be investigated also the tradeoff between energy and spectral (SE) efficiencies, so that the increase in energy efficiency is not caused by degradation of the SE and also to be possible to obtain a higher EE for a same SE and QoS.

The ongoing Fourth Industrial Revolution fundamentally changes the world of work. Recent technological innovations have a significant impact on global economy, all areas of the national economy and on our everyday life. This diploma thesis deals with these impacts on the labour market in connection with the advancing trend of automation and digitization of work. Discussion on the future development of the revolution is in the sphere of expertise highly polarized. Versions that represent a negative view of the issue include image of massive job replacement, lack of talent and the rise of socio-economic and other inequalities. On the other hand, there are concepts that emphasize the positive impact on the labour market. The aim of this diploma thesis is to classify the trends in the working relations through the comparison of these two opinion streams and the systematic arrangement of the arguments presented by them. The final part addresses the context of the Fourth Industrial Revolution in the Czech Republic. Harmless Constitutional Error: How a Minor Doctrine Meant to Improve Judicial Efficiency is Eroding America's Founding Ideals

The United States Constitution had been in existence for almost two hundred years before the Supreme Court decided that some violations of constitutional rights may be too insignificant to warrant remedial action. Known as "harmless error," this statutory doctrine allows a court to affirm a conviction when a mere technicality or minor defect did not affect the defendant's substantial rights. The doctrine aims to promote judicial efficiency and judgment finality. The Court first applied harmless error to constitutional violations by shifting the statutory test away from the error's effect on substantial rights to its impact on the jury's verdict. Over time, the test evolved even further, now allowing a court to disregard the constitutional error when a majority of justices believe that the untainted record evidence shows that the defendant is, in fact, guilty. This sacrifice of individual and institutional constitutional protections at the altar of judicial efficiency and judgment finality subverts the harmless error doctrine's purposes and strikes at the core of America's founding ideals. In particular, it allows appellate courts to invade the jury's role as the finder of fact and guilt, to sidestep their constitutional role to review and correct errors and protect the Constitution, and to incentivize government actors to commit constitutional violations with little-to-no ramifications. After conducting a comprehensive review of the harmless error doctrine and its development, this thesis traces through many substantive, theoretical, and practical problems with the doctrine's current application. It then proposes that the Constitution and the values that it protects should once again be elevated above the harmless error doctrine's pragmatic concerns of judicial efficiency and judgment finality.

GRAPHIC MATHEMATICAL MEDIATED STRUCTURE: THE LINK FOR HISPANIC/LATINO AND ENGLISH LEARNERS' MATHEMATICAL SUCCESS

This project’s goal is to promote and improve the mathematical literacy of fourth-grade Hispanic/Latino and English learners through the use of a graphic mathematical mediated structure. Current California Common Core data finds fourth-grade Hispanic/Latino and English learners significantly behind White and Asian students in mathematics, especially in understanding written word problems. Research supports the assumption that as a tool, a graphic mathematical mediated structure could: 1) foster conceptual understanding; 2) build content terminology; 3) allow students opportunities to justify their solutions; 4) integrate writing in math; and 5) provide a platform for discourse. This innovative pedagogical project specifically focused on how fourth-grade Hispanic/Latino and English learners could navigate through a graphic math organizer in order to understand how to add and subtract fractions in word problems. The work presents six teacher models of graphic mathematical mediated structures. Each model provides a fourth-grade word problem related to fractions. Respectively, teacher and student templates, lists of content vocabulary, and suggestions to teach each problem-solving exercise using the graphic mathematical mediated structures that were created and developed are included. Struggling Hispanic/Latino and English learners’ need a pedagogical structure and process to succeed in solving math word problems. Hence, the need for a graphic mathematical mediated structure to diminish the groups’ prevalent mathematical achievement gap and to increase their achievement in mathematics.

本研究的目的是希望從教科書傳播的角度去了解其中所傳遞的環境價值觀與態度訊息為何?隱含了哪些環境倫理以及呈現主題為何?更重要的是透過研究者對臺北市某國小四年級教科書內容的分析,再以開放式問卷、焦點團體訪談及個別訪談的方式了解此國小四年級全體學童對教科書中環境價值觀內容的接收與解讀情形,並初探國小中年級學童可能有的環境價值觀樣貌。 研究結果發現各領域教科書中「環境價值觀與態度」相關內容出現次數多寡依序為國語、自然與生活科技、社會、藝術與人文、綜合活動;且教科書內容偏向呈現「定位人和自然的關係」以及「關心人類行為的衝擊」兩大主題,而中年級學童對此的解讀亦大致符合,但對於呈現環境價值觀內容的認定和研究者的分析並不完全相同,這可能是因為中年級學童會依據長期從各方接收的訊息觀點,如實際生活經驗、課文情境安排、個人興趣與喜好、自然保育或迷思觀點、個人環保行動及不同環境倫理觀點等因素,進一步與教科書內容連結而歸納出其對人與自然環境關係的詮釋結果。 雖然教科書需改進其未完全達到環境教育課程綱要中希望破除人類中心價值觀的立場,但多數學童並非全盤接收教科書訊息,少部分學童亦能以批判性的觀點解讀教科書;而學童對於教科書的解讀與定位人和自然環境之間的關係則呈現三種環境倫理並陳的情況,甚至人類中心與生態中心倫理兼而有之的矛盾,這是否和教科書內容及主流社會價值觀亦存在此兩種對立的環境倫理並陳的現象有關,值得後續研究長期深入探討。 / This study investigated the environmental values and attitudes conveyed in textbooks as well as the environmental ethics implied and how they are presented. Analysis was conducted on the content of fourth grade textbooks in an elementary school in Taipei City, Taiwan. The reception and interpretation of the environmental values in the textbooks by the fourth grade students at the school was gained by using open-ended questionnaires, focus group interviews, and individual interviews. The findings of this study were as follows. The academic subjects with the most content involving environmental values and attitudes were Mandarin, science and technology, social studies, arts and humanities, and integrative activities. Relevant content in the textbooks was mostly directed at defining the relationship between man and nature and discussing concerns regarding the impact of human behavior. The interpretation of students was broadly identical to this result. Students in fourth grade link textbook content with long-term messages and points of views such as those derived from actual experience, the arrangement of scenarios in past textbooks, personal interests, nature conservation, misconceptions, personal environmental action, and environmental ethics in order to interpret for themselves the relationships between man and nature.

The Effects of a Chinese Music Curriculum on Cultural Attitudes, Tonal Discrimination, Singing Accuracy, and Acquisition of Chinese Lyrics for Third-, Fourth-, and Fifth-Grade Students.

The purpose of the study was to investigate the effect of 10 minutes of daily exposure for 10 weeks to a Chinese Music Curriculum and its effect on generating positive cultural attitudes towards the Chinese people, improving tonal discrimination skills, singing accuracy of tonal patterns, and accuracy of singing Chinese lyrics for third-, fourth-, and fifth-grade students, compared to a comparison group not receiving the Chinese Music Curriculum. In an elementary school in Miami-Dade County, Florida, 6 third-, fourth-, and fifth-grade classes were chosen and randomly assigned to either an intervention or a comparison group. A Chinese Music Curriculum was developed for the intervention group and implemented by classroom teachers. Meanwhile, the comparison group received normal academic instruction and a weekly music class by a music specialist. Pre- and post-tests were administered to both the intervention and comparison groups: (1) Children's Attitudes toward Chinese (CATC), (2) Intermediate Measures of Music Audiation-Tonal (IMMA, Gordon, 1982), and (3) Tonal Pattern Performance Measure (TPPM). The Chinese Song Performance Measure (CSPM) was administered to the intervention group only in order to measure students' abilities for accurately singing the Chinese lyrics of a simple Chinese song, "Little Rat." Data were subjected to a mixed Multivariate Analysis of Variance (MANOVA) statistical analysis, item analysis, and Pearson Product-Moment correlation. The results demonstrated that the CATC survey was a reliable and valid measure to assess children's attitudes toward Chinese people. The overall effect of the Chinese Music Curriculum was significant in combination of the three outcome measures: CATC, IMMA, and TPPM. The follow-up individual examination revealed that children's attitudes toward Chinese people and tonal pattern singing accuracy were significantly improved, but tonal discrimination skills did not improve. Grade was found to influence children's singing accuracy of tonal patterns with fifth graders outperforming the third and fourth graders. All participants in the intervention group were able to sing a Chinese song with over 70% accuracy of the Chinese lyrics.
