The impact of economic liberalisation on the spatial patterns of peasant crop farming in Zambia since 1991 : the case of Chibombo District in central ZambiaMalambo, Augrey Hicigaali 30 November 1999 (has links)
This is a comparative study of the spatial patterns of peasant crop farming in
Chibombo District between the 1980s and the 1990s. The study lists and
discusses the agricultural support system, communication infrastructure and the
crop production and patterns of the 1980s within the environment of centralised
planning and then compares these to the structures and patterns of the 1990s in
an atmosphere of economic liberalisation. This comparison in crop production,
cropping patterns, institutional support systems and the communication
infrastructure in five sampled farming wards of Chibombo District, leads to the
conclusion that there is a marked change in the structures and patterns of the
1990s from those of the 1980s. Thus, in Chibombo District, the state of the
communication infrastructure in the 1990s is generally poorer than the
communication infrastructure of the 1980s, the agricultural support system of the
1990s is largely privately owned and found in fewer farming areas while the
agricultural support system of the 1980s was state controlled and more widely
spread, and crop patterns in some farming wards are different in the 1990s from
those of the 1980s. In the 1990s, crop production in farming wards with a
supportive environment has increased than it was in the 1980s but decreased in
those where a conducive environment lacks. In this line, the study makes
several recommendations for consideration on how to mitigate the problems that
the peasant farmers are facing or how to enhance the positive changes that

La réalisation du marché intérieur de l’énergie constitue le moyen de diminuer le coût de l’énergie pour les consommateurs tout en assurant d’autres objectifs tels que la sécurité d’approvisionnement. Toutefois, les marchés européens du gaz et de l’électricité connaissent de nombreuses défaillances identifiées par la Commission dans son rapport résultant d’une enquête sectorielle lancée en 2005. Les directives de libéralisation ne suffisant pas, elle prône une application renforcée du droit de la concurrence, en particulier du droit du contrôle des concentrations. L’objet de cette étude est dès lors d’analyser l’utilisation de ces règles dans le cadre du processus de libéralisation des marchés énergétiques en Europe.Après une explication de la vague de concentrations ayant eu lieu dans le secteur énergétique sous l’impact de la libéralisation et du contexte qui l’entoure, on s’intéresse à l’utilisation des règles du contrôle des concentrations. Cette étude tente de mettre en exergue l’utilisation orientée de ses règles. Les Etats membres tout d’abord tendent à favoriser les opérations de concentrations se produisant entre des entreprises nationales tout en posant des obstacles aux opérations impliquant l’entrée sur leurs territoires d’acteurs étrangers.La Commission quant à elle favorise les concentrations de nature transfrontalière afin d’aider à la réalisation du marché intérieur et au développement de l’aspect concurrentiel de ce marché. Pour ce faire, elle a recours à un outil particulier : les remèdes. De tels rapprochements entre entreprises favorisant le marché intérieur, il n’est pas dans l’intérêt de la Commission de les interdire. Les remèdes permettent d’éliminer les effets négatifs qui pourraient résulter d’une opération de concentration. Cette étude propose une analyse des différents remèdes ayant été acceptés par la Commission afin de résoudre un problème de concurrence. / The completion of the internal energy market is the way to reduce energy costs forconsumers while providing other objectives such as security of supply. However,European gas and electricity markets are experiencing many failures identified by theCommission in its report published in 2007. The Commission advocates a strongerapplication of competition law, in particular the rules of merger control because theliberalization directives was not enough. Therefore the purpose of this study istherefore to analyze the application of those rules in the process of liberalization ofenergy markets in Europe.After an explanation of the merger wave that occurred in the energy sector under theimpact of liberalization and the environment that surrounds it, we are interested in theapplication of the rules of merger control.In this scope we will see that the Commission encourages the concentration of crossbordernature to help build the internal market and to develop the competition. Torealize this objective, the Commission uses a particular tool: the remedies. Theremedies can eliminate the negative effects that could result from a merger. Thisstudy provides an analysis of the various remedies that have been accepted by theCommission to resolve the problems of competition.

Previous issue date: 2011-06-06 / This essay addresses issues such as socio-economic system adopted by the Republican Constitution of 1988; free enterprise as a fundamental right, seen by the matrix of the economic order, and the privatization process of the Federal Government as a strategy to reform the state, to serve as a basis to elucidate, within a factual context, the negative consequences to public rail transport, transferred to private enterprise in 1998, according to the National Privatization Program of the Federal Government, caused by abuse of the exercise of free enterprise and the inefficient management of public and private agents.
It was found that the process of privatization of this service, previously performed by the Federal Railway - RFFSA occurred in studies of the National Bank of Economic and Social Development, which showed high public deficit and other causes that justified its transfer to the private enterprise.
Through bibliographies literature researches, and extensive official documentation produced by public servants of the Federal Railway Police, the National Department of Transport Infrastructure in the National Agency for Land Transport, and other federal agencies, numerous surveys on spots made along the Paulista Railway Network in the years 2008/2009, demonstrating the damage caused to all rail transport system and public coffers, pointing out its causes and actions to solve them.
The survey s results conducted on locations that have left traces (patios, garages, railway stations and substations) have been duly listed, following the investigation project and, submitted to engineering experts, computing and accounting examination, the results were analyzed and compared with the legal system and with the goals proposed by the privatization and concession of public service in question.
It demonstrates the practice of illegal conduct by public and private agents involved in the supervision and implementation of this public service, intentional noncompliance of the terms of that contract, breach of criminal law and the Law of Concessions and Permits, whose consequences are highly detrimental to Public Service and National Treasury.
At the conclusion of this paper it presents the main actions to be taken to solve the problems and to blame the culprit in order to improve the public service / Esta dissertação aborda temas como o sistema socioeconômico adotada pela Constituição Republicana de 1988; a livre iniciativa como direito fundamental, vista sob a matriz da ordem econômica, e o processo de desestatização do Governo Federal, como estratégia de reforma do Estado, para servir como base para demonstrar, dentro de um contexto fático, os reflexos negativos ao serviço público de transporte ferroviário, transferido a iniciativa privada no ano de 1998, seguindo o Programa Nacional de Desestatização do Governo Federal, causados pelo abuso no exercício da livre iniciativa e pela gestão ineficiente dos agentes públicos e privados.
Verificou-se que o processo de desestatização desse serviço, antes executado pela Rede Ferroviária Federal RFFSA, ocorreu por estudos do Banco Nacional de Desenvolvimento Econômico e Social, que apontou déficit público elevado e outras causas que justificavam a sua transferência para a iniciativa privada.
Buscou-se através de pesquisas bibliográficas, e em vasta documentação oficial, produzidas por servidores públicos da Polícia Ferroviária Federal, Departamento Nacional de Infra-Estrutura nos Transportes, Agência Nacional de Transportes Terrestres, e outros órgãos federais, além de inúmeros levantamentos in loco, realizados ao longo da Malha Paulista da Rede Ferroviária nos anos de 2008/2009, demonstrar os danos causados a todo sistema de transporte ferroviário e aos cofres públicos, apontar suas causas e medidas necessárias para saná-las.
Os resultados dos levantamentos feitos nos locais que deixaram vestígios (pátios, oficinas, estações e subestações ferroviárias) foram devidamente catalogados, seguindo o projeto de investigação, assim como, submetidos a exame pericial de engenharia, informática e contabilidade, cujos resultados foram analisados e confrontados com o ordenamento jurídico e com os objetivos propostos na desestatização e no contrato de concessão do serviço público em questão.
Ficou demonstrado a prática de condutas ilegais por parte dos agentes públicos e privados envolvidos na fiscalização e execução deste serviço público, com descumprimento intencional das cláusulas do referido contrato, violação da legislação criminal e da Lei de Concessões e Permissões, cujos reflexos são altamente prejudiciais ao serviço público e ao Tesouro Nacional.
Na conclusão deste trabalho são apontadas as principais medidas que deverão ser adotadas para sanar os problemas e responsabilizar os culpados, visando a melhoria do serviço público

Le juge administratif et les libertés économiques : contribution à la définition des libertés économiques au sein de la jurisprudence adminuistrative / Administrative judges and economic freedoms : contributing to the definition of economic freedoms in administrative case lawMarson, Grégory 25 January 2012 (has links)
L'étude a pour principal objet l'identification et la définition des libertés publiques économiques au sein de la jurisprudence administrative. Au terme de cette recherche, il apparaît que la liberté d'entreprendre constitue la seule véritable liberté publique économique utilisée par le juge administratif. Elle est en effet la seule qui a pour fondement la protection de droits ou d'intérêts subjectifs liés à la personnalité juridique, en particulier celles des personnes privées. Elle recouvre deux prérogatives essentielles : l’accès à une activité économique et l’exercice d’une activité économique. Si l'expression « liberté d'entreprendre » n'est pas apparue au sein de la jurisprudence administrative mais au sein des jurisprudences constitutionnelle et européenne, il importe de ne pas se laisser abuser par les mots employés. Celle-ci est en réalité présente au sein de la jurisprudence administrative depuis fort longtemps sous l'expression « liberté du commerce et de l'industrie ». A ce titre, elle recouvre un certain nombre d'autres appellations qui varient en fonction du contexte. Même si le juge administratif considère - à l'image du juge constitutionnel ou du juge européen - qu'il s'agit d'une liberté de second rang, il n'en demeure pas moins qu'il s'agit d'une liberté de valeur constitutionnelle. La définition et la classification de la « libre concurrence » s'avèrent plus problématiques. Celle-ci recouvre deux aspects distincts :- un aspect dans lequel elle doit être envisagée comme le respect du principe d'égale concurrence, c'est-à-dire comme celui d'une déclinaison, le cas échéant rénovée, du principe d'égalité. Dans cette optique, elle peut revêtir un aspect subjectif, c’est-à-dire qu’elle protège un droit dont le fondement se trouve dans la personnalité juridique, alors même que son objet principal reste la protection du mécanisme de marché.- un aspect dans lequel elle doit être regardée comme un ordre concurrentiel. Dans cette optique, elle ne peut être assimilée à une liberté publique mais doit être envisagée comme un objectif ou un impératif d'intérêt général correspondant au bon fonctionnement concurrentiel du marché. Les prérogatives ou intérêts que les opérateurs économiques tirent de la défense de cet ordre concurrentiel ne leur sont pas accordés en raison de leur seule personnalité. Ces prérogatives et intérêts sont défendus de manière subsidiaire puisque c’est l’atteinte au fonctionnement concurrentiel du marché qui est en premier lieu et avant tout prohibée. Les prérogatives et intérêts que les opérateurs tirent de la défense de l’ordre concurrentiel trouvent leur source et leur assise dans la liberté d’entreprendre. C’est cette liberté qui octroie aux personnes morales et physiques le droit d’accéder à l’activité économique et le droit de l’exercer. La libre concurrence a pour effet de garantir et de renforcer l’effectivité de ces deux prérogatives fondamentales. / The primary purpose of this study is to identify and define economic public freedoms in administrative case law. The research shows that free enterprise is the only genuine public economic freedom relied upon by administrative judges. It is indeed the only one based on protecting the subjective rights or interests that are related to the legal personality, especially when it comes to individuals. It covers two essential rights: access to an economic activity and the running thereof. If the expression "free enterprise" was not created by the administrative judges but by the constitutional and European judges, it has however been known for a long time by administrative judges as "freedom of trade and industry." As such, it has a number of different names, which may vary depending on the context. Even if administrative judges consider – like their constitutional and European counterparts – that is it a secondary freedom, it is still a constitutional freedom.The definition and classification of "free competition" are more problematic, since such freedom covers two different aspects:- it may first be considered the respect of equal competition, as a new version of the equality principle. In this context, it can take a subjective aspect since it protects a right based on legal personality, even though its primary purpose is to protect market mechanisms.- it may also be considered as a competition system. From this perspective, it cannot be considered a public freedom but rather a goal or a requirement of general interest in the market good competitive functioning. The rights or interests of economic actors that derive from the protection of the competition system are not granted on the basis of their legal personality alone. The protection of those rights and interests in only subsidiary; interfering with free competition on the market is first and foremost prohibited. The rights and interests of economic actors in protecting the competition system have their source and guarantee in free enterprise. This freedom gives legal and natural persons the right to access and to run a business. Free competition ensures and reinforces the effectiveness of these two fundamental rights.
