The thesis is being concerned with one of the serious criminal acts causing each year damages worth hundrends of millions Czech crowns. The main aim of the thesis is to provide a complex view of the problems. The thesis analyses the issue from both legal and economic angle of view, deals with the insurance fraud typology and proves the theory by evidence of particular cases. The thesis thereinafter discovers causations of commiting insurance frauds and describes the insurence fraud abatment. In the end the thesis tries to disclose the weak points of the system of prevention, to point at them and to come up with the improvement suggestions and recommendations.

L'opération de prévoyance / The functioning of supplementary corporate social protection

Les régimes de protection sociale complémentaire constituent des outils à la disposition des employeurs afin de fidéliser leurs salariés. S’inspirant directement des principes encadrant le fonctionnement des régimes de base de la sécurité sociale, l’opération de prévoyance se caractérise, en partie, par une forte dimension collective. La création et la mise en oeuvre des couvertures de prévoyance et de frais de santé s’accompagnent de la poursuite d’idéaux d’égalité, de solidarité et de mutualisation. L’adoption des textes fondateurs en la matière,les lois Evin et Veil, a conduit à l’institution de mécanismes propres à l’opération de prévoyance reflétant cette dimension collective. L’influence du droit des assurances est certaine et sa maîtrise indispensable pour assurer la pérennité des mécanismes de protection sociale d’entreprise. Terrain d’application de droits divers, l’opération de prévoyance se caractérise par la complexité des relations entre ses intervenants et des règles régissant son support, le contrat de d’assurance de groupe. L’optimisation de son coût pour l’employeur est au prix d’un effort de conciliation de ces différents instruments / Supplementary social protection schemes are tools which employers can decide to utilize inorder to retain their employees. Corporate social protection systems are directly based on the principles which rule the functioning of the basic social security scheme. Understandably, they are characterized by a strong collective dimension. Design and implementation of corporate social protection are therefore associated with the pursuit of ideals of equality,solidarity and risks or resources pooling. The enactment of the founding legislation in this area – i.e. the Evin and Veil Acts* – led to the setting up of mechanisms peculiar to corporate social protection systems and whose very existence is revealing of this collective dimension.The influence of insurance law is indisputable and having full command of it is naturally instrumental in ensuring the viability of corporate social protection. Corporate social protection systems indeed find themselves at the crossroad of several legal domains. They are therefore distinguished by the complexity of the relations between their actors as well as that of the rules governing the collective insurance contract through which they are implemented. Optimizing its cost is a performance employers can only achieve through a careful conciliation of these instruments.

The goal of this diploma thesis is to determine the insurance payment that should be paid to the insured person in case of fire of a detached house in Louka. The theoretical part defines basic terms related to valuation of real estates and insurance industry. The following practical part focuses on the valuation of the immovable property in Loučka using the cost approach in three different periods of time. Subsequently the expenses for repairs are determined by using the method of itemized budget, using BUILDPower S. Lastly the determined insurance payment is compared to the insurance contract.

This thesis is focused mainly on the liquidation process of damage events related to the buildings. The analysis of the whole process and recommendations for limiting of individual risk is involved. Within the insurance discurs, asset insurance is characterized by a new price and the time prize. This difference is described in the practical part of the thesis, where the partial damages caused by the storm on the family house and the overall damage to the cottage after a major fire accident. At the end of the case study, an assessment of the most serious insurance risks is described.

At the chosen property valuation is performed and the resulting values are compared with the practices of the insurance. In conclusion, given the practical outcomes and recommendations for the process of determining the insured value of the property in terms of the insurance contract.

The aim of the Thesis is to establish the height of the insurance claim for the damage caused by the fire of the family house in Ivančice. The Thesis is divided into two separate sections, the theoretical one and the practical one. The theoretical part deals with the Czech insurance market issues such as property evaluation and evaluation of construction works. In the practical part there are established two different insurance value of the property. First one relates to the condition of the property shortly after completion and the second one should reflect the state of the property shortly before the damage caused by the fire. This part of the Thesis is followed by the description of the insurance claim with the list of damage caused by the fire supplemented with calculation of cost of the adequate reconstruction. The final part of the document contains comparation of the insurance value established shortly before the damage and the insurance value of the property evaluatated after the reconstruction.

The thesis is engaged in executing the prices of three different types of houses and especially the assessment of whether insurance contract in each of them covers a potential total loss, ensuring the cost of comparable housing. Location of interest is located in the district of Blansko, namely Letovice and surroundings. The basic terminology and methods of real estate valuation is described in the thesis. In details, three selected methods are described, which are cost method, comparative method according to regulations and the comparative non-promulgation method which have been used for valuation. For the real estate insurance has been selected company Allianz, which is also described in the thesis. The conclusion is devoted to the recapitulation of prices and insurance cover risk.

The aim of this thesis is to determine the amount of indemnity for total damage caused by a falling tree during the gale on a cottage in Roudné near Nové Hrady. The theoretical part deals with basic insurance terminology and basic terminology and methods used in property evaluation. The practical part describes the original condition of the property and its evaluation before the insured event using a cost method and complying with the evaluation regulation. Furthermore, this thesis deals with determination of the costs through the itemized budget for bringing the property to its original state. The conclusion deals with the impact of reconstruction on the extent of indemnity.

Analyse comparative des conflits de lois et de juridictions relatifs au contrat d'assurance

Ce mémoire porte sur l’étude des conflits de lois et de juridictions relatifs au contrat d’assurance. Le contrat d’assurance étant un contrat des plus usité, il est intéressant d’étudier, dans un contexte de mondialisation, de globalisation des échanges, de ce qu’il en advient du contrat d’assurance dans le cadre des relations privées à caractère international. En ce sens, seront traitées des règles de conflit de lois et de juridictions relatifs au contrat d’assurance dans le cadre des instruments que sont le Règlement Rome I, le Règlement Bruxelles I Bis et la Convention de Lugano, mais également, dans celui du droit international privé québécois. Ce sera donc une approche de droit comparé qui sera adoptée au travers de cette étude. L’on verra notamment que le contrat d’assurance a donné lieu à divers traitements méthodologiques du point de vue de la résolution des conflits de lois et de juridictions. Il sera donc intéressant de comparer ces approches afin de déterminer celle qui pourrait atteindre au mieux les objectifs spécifiques du contrat d’assurance, à savoir, notamment, celui de protection de la partie faible. / This thesis is concerned with the study of the conflicts of laws and jurisdictions relating to the insurance contract. Since insurance contracts are a type of contract that is commonly used, it is worth understanding, notably in the context of economic globalization, what specifically happens to the contract of insurance within the framework of international private relations. In this sense, the rules of conflict of laws and jurisdictions relating to the insurance contract will be considered with regards to the framework of the Rome I Regulation, the Brussels I Bis Regulation and the Lugano Convention, as well as with respect to the private international law of Quebec. Therefore, a comparative law approach will be adopted through this study. It will be noticed among other things that the insurance contract has given rise to various methodological treatments with regards to the resolution of conflicts of laws and jurisdictions. It will therefore be interesting to compare these approaches in order to determine which approach could best achieve the specific objectives of the insurance contract, in particularly, the protection of the weaker party.

In Mutual and Federal Insurance v Oudtshoorn Municipality 1985 (1) SA 419 (A) it was decided to determine materiality in the eyes of the reasonable man. To avoid proving materiality of facts, the insurers required proposers to warrant the representations in the contract. This resulted in the facts automatically being material. In 1969 parliament, .however, enacted section 63(3) of the Insurance Act 27 of 1943 whereby materiality of presentations, even where it was warranted in the contract, became a requirement. Therefore insurers could in future not hide behind contractual misrepresentations. This provided more protection to the insured. Qilingele v SA Mutual Life Assurance Society 1993 (1) SA 69 (A) addresses the test for materiality as required by section 63(3).
