The evolution of the Child rights protection policy in Lithuania is analyzed in the first part of the Master’s Thesis. Lithuania, by joining the Convention of UN and by ratifying it, recognized that the protection of Child rights and interests is the main mission for the State and society. Lithuania has made enough political tools which provide the guaranty to protect the children’s rights in his social environment. The main laws protecting the child rights have been adopted and all the institutions which seek for a real and complete assistance to the child, living in the family at social risk, observe it. It is necessary to coordinate the cooperation of the institutions of Child rights protection by using the method of team work The second part of the Master’s Thesis presents the analysis on the interinstitutional cooperation by ensuring the child rights protection in the families at social risk. The purpose of this investigation was to involve the specialists providing the assistance for children living in the families at social risk. 34 specialists working in different fields have participated in this investigation: 11 social workers of neighborhoods, 8 social pedagogues working in the comprehensive schools, 8 medical workers working in the schools and medical stations of neighborhoods, 2 Child rights protection service officers and 2 officers of police commissariat. 777 problems of school age children living in the families at social risk have been revealed during the... Magistro baigiamajame darbe iškelta problema – lyginamosios analizės, susijusios su Prezidento ir Parlamento santykių aspektais trūkumas bei turimos literatūros bazės fragmentiškumas. [toliau žr. visą tekstą] / The subject of the parliamentary law and public governance institutions is relevant and new, because it was not analysed before in the scientifical publications of Lithuanian constitutionalists. This subject includes the comparative aspects not only of the constitutional status, powers and interinstitutional relations between the President and the Parliament of Lithuania but also foreign countries governmental relations, status and powers (USA, Latvia and Portugal). The problem, set out in this master thesis, is the lack of systematic comparative analysis, that is connected to the presidential and parliamental relations and the fragmentary scientifical basis on this topic. Interinstitutional Cooperation among Black Colleges in Texas

The persistent paucity of endowment monies and other funds and an attempt to minimize operating costs have led to a series of interinstitutional cooperative efforts between many historically black colleges in Texas and other institutions of higher learning. The Texas Association of Developing Colleges (TADC) is a multi-service consortium composed of Huston-Tillotson College, Jarvis Christian College, Paul Quinn College, Texas College, and Wiley College which are privately supported and church-related liberal arts colleges. The primary focus of the TADC is interinstitutional cooperation. Some general and specific problems and weaknesses endemic to many small private colleges, especially to small black private colleges, have been identified through analyses, interpretations, and inferences from a variety of data sources. The potential opportunity and success for strengthening these colleges and for solving some of their problems through self-effort, through additional support from external, nongovernmental sources, and through meaningful forms of interinstitutional cooperation are discussed and appear to be encouraging. Interinstitutional cooperation is already acceptable and functional among these five colleges through their participation in the Texas Association of Developing Colleges, and it is apparent that these five colleges, individually and collectively, have had commendable successes in meeting many of their goals and objectives through such arrangements. Basically, the recommendations made in this study call for significant forms and types of interinstitutional cooperation among these colleges in a formalized manner under the aegis of the Texas Association of Developing Colleges.

From this perspective, most researchers consider the Brazilian Innovation System inefficient and disjointed. In order to contribute to the development of the Innovation System and, consequently, to the development of the state of Paraíba, universities presents themselves as actors whose peculiarities are capable of fostering this purpose. In this sense, this dissertation intends to answer the following research problem: How do the structure and organization of the Federal University of Paraíba (UFPB) articulate with the actors of the Innovation System of Paraíba (SPI)? In order to answer this question, the present research objected to analyze the structure and organization of the Federal University of Paraíba (UFPB) in its relations with the SIP. This research is characterized as a descriptive research, with qualitative approach, having case study as investigation method. In order to achieve the desired results, was used documentary research, interview and application of structured survey as data collection technique. Referring to data analysis, analysis of content was chosen. The aim of this study is to contribute to the improvement of the structure and organization of UFPB, in particular with regard to the Development Institute of Paraíba (IDEP - UFPB) and the UFPB Agency of Technological Innovation (INOVA - UFPB), in order to leverage the leading role aimed at promoting, in local and regional level, economic and social development inherent to the institution. In this context, the research concluded that there is a convergence of diagnostics about the main problems that affect the interactions of the UFPB with the actors in the SIP: The inadequate form of planning as well as the lack of incentive, interest and teaching motivation for activities of education, research and extension focused on the socioeconomic needs of the State of Paraíba. / No contexto atual, os sistemas de inovação apresentam-se como o principal mecanismo de transformação do conhecimento em valoração econômica e em melhoria da qualidade de vida da população, possuindo relevância estratégica para as políticas públicas do Estado. Nessa perspectiva, grande parte dos pesquisadores considera o Sistema de Inovação Brasileiro pouco eficiente e desarticulado. No intuito de contribuir com o desenvolvimento do Sistema de Inovação e, consequentemente, com o desenvolvimento do Estado da Paraíba, as universidades apresentam-se como atores cujas peculiaridades são capazes de fomentar esse propósito. Nesse sentido, essa dissertação pretende responder ao seguinte problema de pesquisa: Como a estrutura e a organização da Universidade Federal da Paraíba (UFPB) articulam-se com os atores do Sistema de Inovação Paraibano (SPI)? Pretende-se, com este estudo, contribuir com a melhoria da estrutura e da organização da UFPB, em particular no que tange ao Instituto de Desenvolvimento da Paraíba (IDEP – UFPB) e à Agência UFPB de Inovação Tecnológica (INOVA – UFPB), no intuito de alavancar o papel de protagonismo voltado à promoção do desenvolvimento econômico e social local e regional inerente à instituição. The main objective of this thesis is to point out to situation of Public finance in Czech Republic and analyse it from perspective of institutional framework of budgeting system to find weak its weak points. Simultaneously the similar analysis is compiled for institutional framework and budgeting procedures of EU budget in an effort to find such components, which would be usefull for solving recognized problems in Czech parallel. Theoretical background is provided throught description of particular budgeting systems based on so called Interinstitutional Treatment in case of EU Budget and by Budgeting rule law in case of Czech institutional framework. For better comprehension of Bugeting system in Czech Republic there is incorporated part dealing its evolution since 1918 with accent to recent decades, when the distinctive changes in budgeting rule law were ammended.

Den rättsliga betydelsen av triloger i EU:s lagstiftningsprocess : en studie i den institutionella unionsrätten och aktuella händelseutvecklingar

Triloger har utvecklats till att idag utgöra en viktig del av Europeiska unionens ordinarie lagstiftningsförfarande. Dessa informella förhandlingsmöten mellan unionslagstiftarna, med deltagande av kommissionen, har förändrat den praktiska tillämpningen av fördragens bestämmelser om lagstiftningsförfarandet fastän de inte omnämns i fördragen. Samtidigt som trilogerna har gjort processen mer effektiv har de haft en negativ påverkan på insynen i förfarandet. I denna uppsats studeras hur fenomenet triloger genom åren har uttryckts juridisk i den institutionella unionsrätten. Kritiken mot trilogerna och andra aktuella händelser som möjligen kan förändra trilogernas rättsliga ställning utvärderas. / Trilogues have evolved to become an important part of the European Union’s ordinary legislative procedure. These informal negotiating meetings between the Union legislators, with the participation of the Commission, have changed the practical application of the Treaty rules on the legislative procedure without being mentioned in primary law. While the trilogue system has made the process more efficient, it has had a negative impact on the transparency of the process. This paper aims to study how the trilogue phenomenon has been legally expressed in the institutional Union law. The criticism against trilogues and other recent events are also examined in order to assess how these possibly can change the legal status of trilogues. / Les trilogues ont connu une évolution en devenant une partie intégrante et importante de la procédure législative ordinaire de l’Union Européenne. Ces réunions de négociations informelles entre les législateurs européens, avec la participation de la Commission, ont modifiées l’application pratique des règles des traités sur la procédure législative sans être mentionnées dans le droit primaire. Bien que les trilogues aient rendu le processus plus efficace, ils ont indéniablement eu un impact négatif sur la transparence de la procédure. Cette thèse vise à reconstruire comment le phénomène des trilogues a été exprimé en termes légaux dans le droit institutionnel de l’Union. Les critiques à l’encontre des trilogues et d’autres actualités sont aussi étudiées afin d’évaluer la façon dont ceux-ci éventuellement peuvent modifier le statut juridique des trilogues.

Ce travail de thèse a pour objectif d'étudier la construction de l’Europe institutionnelle en parallèle de l'émergence des questions environnementales et interroger dans le cadre d'une évolution historique, les interactions entre les décideurs, les administrations et les citoyens autour des questions de société, pour en observer les mécanismes de mutation. Il s'agit de questionner la capacité des Institutions européennes à faire intégrer à ses Etats membres des exigences environnementales. Nous observerons le glissement opéré depuis un principe de conservation de la nature à l’assurance d’un développement durable, en passant par une protection de l’environnement puis une préservation de la biodiversité où seront analysés les leviers d'action privilégiés pour imposer aux Etats des réglementations contraignantes. Les travaux développés dans cette recherche analysent les changements de « modèle », de cadrage législatif, de comportements, de conscience, de mode de vie en Europe, et leurs conséquences dans des solutions dites réalistes pour le modèle de croissance. Pour conduire à l’explication de ce phénomène, le présent ouvrage s’articulera autour de trois logiques utilisées successivement : la mise en place d’une politique de la nature, prenant en compte les contraintes des logiques existantes à travers le modèle de développement productiviste, puis une contestation caractérisée du modèle de développement proposant une protection de l’environnement, et enfin une prise en compte consciente et orchestrée des questions d’environnement par les institutions européennes vers la structuration d’un modèle caractérisé par la mise en œuvre de la Stratégie Européenne Développement Durable. / Approaching the European construction from 1949 till 2002 within environmental questions wish to bring a new prism for complex systems understanding. The present work sustain an interactional analysis between stakeholders, administrations and citizens thoughts across society matters to observe mutation mechanisms. In a Historical study of the Twentieth Century common decision making tools, we will observe how European Institutions contribute strengthening its territory. From nature conservancy to an insurance of a sustainable development, via an environmental protection then biodiversity preservation, an approach of related concepts and their evolvement wants to show presuppositions and difficulties to explain clearly what kind of empowerment tool is become Europe. Because citizen and political fights escort the discovery of environmental matters. Because painless degradation of the European natural heritage brought conflicts between countries which had contracted peace. The natural and industrial disasters management, limitations of a productivist development "model", the increase of societal individualization, urban spread and research of support and membership will drive the European Community in building operational targets before the rise of an "Environmental Economy". Facing dissimilar perceptions and trade-off in taking into account environmental questions inside community agenda, European institutions asked to develop understanding tools able to support, to control and manage its patrimony. In its successive enlargements, European Community will encourage the preservation, the protection, the improvement of environmental quality and public health, a wise use of natural resources or even international promotion of standards designed to face-off regional and planetary biodiversity matters. The European Union is finally able to suggest to the U.N. members a practical Sustainable Development Strategy Scheme ready to implement.

The study was guided by the initial assumption that networks can provide better results for the public administration, compared to those that would occur through single organizations. The literature on the subject shows that, among other advantages, networks may be more appropriate to overcome complex problems, providing more flexibility than hierarchies, complementarity in the actions and encouraging collaboration. On the other hand, they point out limitations of managerial nature or related to accountability, legal and cultural issues, conflicts of interest and power. To obtain empirical data, we interviewed Federal Chief Police Officers, Federal Criminal Experts, Federal External Control Auditors, Financial and Control Analysts and Prosecutors, all holders of management function. By categorizing the testimonies collected in the field research it was possible to synthesize the perception of respondents, which revealed that, corroborating the attributes identified in the literature, there are several benefits of working in networks. But in the same way as seen in the literature, respondents also pointed out that networks present many challenges and limitations. / Este trabalho investiga as contribuições da interação entre os órgãos públicos para a efetividade do Sistema de Justiça Criminal, à luz dos atores envolvidos e tendo como arcabouço conceitual as teorias de redes interorganizacionais, notadamente redes de políticas públicas. O estudo foi orientado pela suposição inicial de que a atuação em rede pode proporcionar melhores resultados para a administração pública, comparativamente àqueles obtidos com as instituições trabalhando isoladamente. A literatura sobre o tema apresenta que, dentre outras vantagens, redes podem ser mais apropriadas para lidar com problemas complexos, proporcionando mais flexibilidade que as hierarquias, complementaridade nas ações e incentivo à colaboração. Por outro lado, aponta limitações de ordem gerencial ou relacionadas a prestação de contas e responsabilização, a questões legais e culturais, a conflitos de interesses e ao poder. Para a obtenção de dados empíricos, foram entrevistados Delegados de Polícia Federal, Peritos Criminais Federais, Auditores Federais de Controle Externo, Analistas de Finanças e Controle e Procuradores da República, todos detentores de função de gestão. Mediante a categorização dos depoimentos colhidos na pesquisa de campo foi possível sintetizar a percepção dos entrevistados, o que revelou que, corroborando os atributos identificados na literatura, vários são os benefícios da atuação em rede. Mas, do mesmo modo que verificado na literatura, os entrevistados igualmente destacaram que redes apresentam muitos desafios e limitações.

L’offre psychothérapique aux personnes détenues en maison d’arrêt par le psychologue est importante, d’abord parce que 70 % de ces personnes sont incarcérées dans ce type d'établissement et que la majorité d’entre-elles est détenue pour des faits de violences à la personne, ensuite parce que ce travail psychique est le seul à mettre en contact avec les fondements de la personnalité. Ces soins représentent donc un enjeu de santé et sécurité mais aussi d’économiespubliques.La recherche, dans la perspective de l’analyse existentielle montre la pertinence du traitement psychanalytique pour la transformation du rapport à soi et aux autres. Mais le cadre psychothérapeutique, articulé aux soins somatiques et psychiatriques dans l’espace sanitaire, ne tient qu’en congruence avec les cadres judiciaire et pénitentiaire.Un excès de distance entre les acteurs judiciaires, pénitentiaires et sanitaires-psychothérapeutiques expose le patient à des risques et au non-sens. A l’inverse, un rapprochement excessif présente un risque de confusion.Une alliance interinstitutionnelle entre les acteurs est requise dans une éthique des limites. / The psychotherapeutic proposition made by the psychologist to people imprisoned in detention centers is significant first because 70 % of these people are imprisoned in this type of facility and most of them are detained for violence against other people, secondly because this psychic work is the only one that establishes a link with the personality foundations. This psychotherapeutic care is thus not only a health and safety issue but also a public economy issue.By using the existential analysis as methodology, the research shows the relevance of psychoanalytic treatment for the transformation of the relationship with self and others.But the psychotherapeutic framework linked to somatic and psychiatric care in the health unitcan be efficient only if it works in conjunction with the judicial and penitential frameworks.An excessive distance between judicial, penitential and sanitary-psychotherapeutic playersexposes the patient to risk and to meaninglessness. On the contrary, an excessive closeness may lead to confusion.An interinstitutional alliance between the players is necessary according to an ethics of limits.
