Parlamento teisės ir valstybės valdymo institucijų magistro baigiamojo darbo tema aktuali ir nauja tuo, jog šiame darbe pateikiama Lietuvos konstitucionalistų dar nenagrinėta tema, apimanti lyginamuosius tiek Lietuvos Prezidento bei Parlamento statuso, įgaliojimų, tarpinstitucinių santykių, tiek užsienio valstybių (šiuo atveju pasirinktos JAV, Portugalija bei Latvija) Prezidentų ir Parlamentų statuso, įgaliojimų ir santykių aspektus. Magistro baigiamajame darbe iškelta problema – lyginamosios analizės, susijusios su Prezidento ir Parlamento santykių aspektais trūkumas bei turimos literatūros bazės fragmentiškumas. Šio magistro darbo objektas – Prezidento ir Parlamento santykiai dabartiniu laikotarpiu Lietuvoje bei pasirinktose užsienio šalyse – JAV, Latvijoje ir Portugalijoje, kurie atskleidžiami per šių valdžių turimus konstitucinius įgaliojimus, statusą, funkcijas. Darbe iškeltas tikslas – sistemiškai, remiantis lyginamąja analize, pateikti Prezidento ir Parlamento santykių aspektus Lietuvoje bei pasirinktose užsienio šalyse per šių valdžių turimus konstitucinius įgaliojimus bei statusą, pateikti probleminių sričių sprendimo alternatyvas. Šio tikslo siekiama keliais pagrindiniais uždaviniais: analizuojant Lietuvos bei atskirų šalių (JAV, Latvijos, Portugalijos) Prezidentų ir Parlamentų statuso, funkcijų, įgaliojimų bei tarpinstitucinių santykių konstitucinę reglamentaciją, praktiką, pateikiant panašumus bei skirtumus visose nagrinėtose šalyse. [toliau žr. visą tekstą] / The subject of the parliamentary law and public governance institutions is relevant and new, because it was not analysed before in the scientifical publications of Lithuanian constitutionalists. This subject includes the comparative aspects not only of the constitutional status, powers and interinstitutional relations between the President and the Parliament of Lithuania but also foreign countries governmental relations, status and powers (USA, Latvia and Portugal). The problem, set out in this master thesis, is the lack of systematic comparative analysis, that is connected to the presidential and parliamental relations and the fragmentary scientifical basis on this topic. The object of this thesis is the relations between the actual President and Parliament in Lithuania and three chosen foreign countries (USA, Latvia and Portugal), also their constitutional status, powers and functions that stipulates the mentioned governmental relations. The purpose of this work is to reveal the main aspects and possible solutions of the problematical situations in the sphere of presidential and parliamential relations, constitutional status, powers in the governmental field in Lithuania, USA, Latvia and Portugal. The diploma thesis is divided into two basic topics, in which it deals in a brief outline with the origin and development of confessional and ecclesiastical law in general and with development and mutual relation between confessional and ecclesiastical law in the territory of Czech lands since the arrival of the Cyril and Methodius until the establishment of the Czechoslovak Church. Further on it presents the timeline of sources of the "First" Constitution of the Czechoslovak Church (Ústava Církve československé). These sources are divided into the periods before and after the establishment of the Czechoslovak Church. Cette recherche porte sur l'évolution de l'administration locale en Roumanie et en France depuis ledébut des années 1990. L'étude de la situation de départ différente dans les deux pays a étépoursuivie par l'analyse des grandes étapes du développement du cadre juridique relatif auxcollectivités territoriales : l'avènement (en Roumanie) ou le renforcement (en France) du statutconstitutionnel des collectivités et l'évolution du cadre législatif opérant les transferts decompétences et de moyens en faveur des collectivités. Cette analyse a mis en évidence uneconception des réformes qui présente bien des similitudes, mais aussi une mise en oeuvre parfoisdifférente. Une évaluation du niveau de décentralisation atteint dans les deux pays a été entrepriseau regard des critères de la Charte européenne de l'autonomie locale. Elle a permis de relever lesavancées enregistrées par chaque pays et d'identifier les marges de progrès possibles. Au final, on apu constater qu'au-delà d'un contexte initial différent et des particularités de la carte administrative,au-delà d'une application différente des réformes, la Roumanie et la France montrent aujourd'hui undegré de décentralisation très comparable, globalement en cohérence avec les prescriptions de laCharte. / This research focuses on the evolution of the local government in Romania and France since thebeginning of the 1990s. The study of different initial conditions in both countries has been followedby the analysis of the major developmental stages of the legal framework concerning localauthorities : the relatively recent accession to (for Romania) or reinforcement of (in France) theconstitutional status of the communities and the evolution of the law corpus operating the transferof competencies and resources for local communities. This analysis revealed a conception ofreforms that has many similarities, but also some different implementation. An evaluation of thelevel of decentralization achieved in the two countries has been undertaken in the light of thecriteria of the European Charter of Local Self-Government. It identified the progress made by eachcountry, but also the opportunities for improvement. In the end, it was found that beyond an initialcontext and particularities of the administrative map, beyond the different application of reforms,Romania and France show today a very similar degree of decentralization, broadly consistent withthe requirements of the Charter.
