Uses and Nonuses of Patented Inventions

Innovation comprises the processes of invention and commercialization. While the importance of innovation, especially commercialization, has been widely recognized, existing studies have largely overlooked the commercialization process. By examining the determinants of uses and nonuses of patented inventions from firms at the levels of technology, organization, and project/invention, this study attempts to help fill a critical gap in the literature. In doing so, it enriches theoretical understandings of innovation and, in particular, builds on the evolutionary explanation of technology development, the Teecian framework on profiting from innovation, Transaction Cost Economics (TCE), the Knowledge-Based View (KBV), and open innovation and innovation network perspectives. It also reveals an empirical reality of commercial use and strategic nonuse of patents. The study is based on a novel dataset constructed from multiple sources: inventor surveys, the United States Patent and Trademark Office online database, and COMPUSTAT, among others. After examining the factors affecting overall propensity to commercialize patented inventions, this study explores the factors that affect the organizational paths of commercialization. The empirical estimation indicates that technological uncertainty and a strong internal position of complementary assets raise the propensity for internal commercialization. The study argues that openness of innovation processes and network relationships should affect the choice of commercialization paths. Consistent with the hypotheses, empirical estimations show that external industrial knowledge increases the propensity of internal commercialization. The study also indicates that collaboration has diverging effects on the choice of commercialization paths. While collaboration with firms in vertical relationships tends to favor internal commercialization, collaboration with firms in horizontal relationships tends to favor external commercialization (licensing, start-up). Finally, the study reports findings on the strategic use of patents and then tests hypotheses about the factors driving strategic nonuse. It concludes that a significant portion of U.S. patents are indeed filed for strategic reasons. It also finds that characteristics of technology and firms are significantly associated with different strategies. In particular, firms are more likely to use a patent for strategic defensive purposes when they have larger amounts of assets. The study concludes with discussing managerial and policy implications.

O trabalho tem por objetivo verificar de que forma os avanços científicos e tecnológicos da humanidade influenciaram a obra de Edgar Allan Poe e de Machado de Assis. A análise propõe revelar o olhar desses escritores acerca das novas possibilidades que eram oferecidas à sociedade com o intuito maior de evidenciar o papel da literatura nesse processo, uma vez que o homem é capaz de enxergar todo o comportamento de uma época e, conseqüentemente, a si mesmo, através da obra literária. Essa atitude de “olhar para trás” e para “dentro de si mesmo”, acredita-se, permite que o homem avance ainda mais. Para realizar a análise proposta, a pesquisa utiliza-se de conceitos como o de intertextualidade e interdisciplinaridade, muito caros à Literatura Comparada, com o fim de promover relações entre as diferentes áreas do saber – Literatura e Ciência –, entre os diferentes escritores e, por fim, entre os diversos gêneros literários que constituem o corpus do presente estudo. Após um breve panorama da história do desenvolvimento dos avanços científicos e tecnológicos da humanidade, procede-se às análises dos textos selecionados, procurando apontar e relacionar o pensamento dos escritores, provando que idéias sobre os avanços científicos e tecnológicos estão presentes na produção literária de cada um. Por fim, após o confronto estabelecido durante todo o trabalho entre o pensamento e o posicionamento dos escritores, discutese o papel da literatura no desenvolvimento e avanço da humanidade. / The paper aims to verify how the writings of Edgar Allan Poe and Machado de Assis had been influenced by the humanity' scientific and technological advances. The analysis proposes to reveal the sight of these two writers over the new possibilities that had been offered to the society, with the main objective of emphasizing the literature role in this process, considering that the human being is able to see the behavior of an entire period of time and consequently to himself through the literary work. This action of “looking back” and of “looking inside”, believes this research, allows him advance still more. In order to do that, the research takes some concepts as intertextuality and interdisciplinarity, extremely valued to the Comparative Literature, with the main objective of promoting relations between the different areas of knowledge – Literature and Science –, between the two different writers and, in the end, among the various literary genres that take part of the corpus of this study. After a brief view of the humanity history of scientific and technological advances development, the analysis of the selected texts is performed, endeavoring to emphasize and make the relation between the ways of thinking of these writers, proving that specific ideas about science and its advances really are in the literary production of each other. In the end, after the confrontation established during all over the research between the thinking and the position of the writers, the literature role in the humanity’s development and advance is discussed.

The role of innovation in economic development

The aim of this study is to determine the role that innovation plays in economic development and how an economic environment can be created that is conducive to innovation. The urgent need for development in large parts of the world indicates the importance of the increase in innovative activities because innovation is indicated as the “engine of growth and development”. It was found that innovation takes place within an innovation system and should be studied from a system perspective. The system perspective implies that there are different participants and that these participants function individually but that they also interact (wittingly or unwittingly) with one another. The innovation system is defined as a system that includes the participants or actors and their activities and interactions, as well as the socio-economic environment within which these actors or participants function, which determine the innovative performance of the system. A system approach is therefore necessary to study the influence of innovation on development. The role that innovation plays in economic development has been established by means of the historical patterns of economic development and major innovations as well as an analysis of literature of empirical studies. The historical pattern indicates the importance of innovation for economic development, but literature revealed the complexity of the relationship due to the non-linear relationship among different actors or participants in an innovation system. The main determinants of innovation was identified and a conceptual, descriptive model for an innovation system was developed, indicating the different participants, their roles, the interaction among them, and the economic environment within which the participants function. The model was applied to the Mpumalanga province in South Africa as case study. Strengths and weaknesses were identified in the Mpumalanga innovation system and recommendations were made for the improvement of the Mpumalanga innovation system which in turn should lead to an improvement in the economic development of the province. / Economics / D.Comm. Canting the cradle : the destruction of an ancient Mesopotamian civilization

Iraq is a country of great cultural significance as it is where civilization first began. As a result of its lengthy occupation, it is virtually one large archaeological site. In spite of numerous warnings to the governments of both the United States and the United Kingdom, no efforts were made to protect the Iraqi National Museum in Baghdad when the American-led coalition unlawfully invaded Iraq. Indeed, orders were given not to interfere with the looting. During the occupation that followed, the United States failed to take steps to protect Iraqi cultural property. In terms of international law, it was obliged to protect Iraq’s cultural property. The United States also chose to exacerbate its unlawful conduct by occupying archaeological sites and damaging them further by illegal construction. As a result many significant sites have been irreparably damaged or destroyed. Their conduct was the result of complete indifference to the Iraqi cultural heritage. 生物科技之專利對於生物科技產業之重要性更是不可言喻。由於生物科技發展之特性,例如:高度不確定性、研究週期長、投資成本高等因素,許多發明人在申請生物科技專利時,都試圖擬定較廣泛的申請專利範圍。「延展性申請專利範圍」(reach-through claims)為基於目前專利說明書揭露之內容來涵蓋所有「未來」可能衍生之產物;或是某特定化合物尚未被確認前,試圖藉由一個上游基礎研究「先驅型發明」之申請專利範圍擴大延展至下游後續發明之商業產品,這非但會箝制技術後續之發展,更可對已存在之先前技術主張侵權,影響範圍極廣。從2004年University of Rochester v. G.D. Searle案 和2010年Ariad v. Eli Lilly案 ,美國聯邦巡迴上訴法院皆認為「延展性申請專利範圍」無效,歸因於專利內容未清楚揭露而不符合美國專利法第112條第1段中所規定的「可據以實施性」和「書面說明要件」。2013年德國聯邦最高法院對同是屬於「延展性申請專利範圍」之Probiodrug案與前述兩件美國相關判例有分歧之見解和判決。有鑑於此,本文以比較法觀點分析國外相關判例及實踐標準,全面性針對生物科技領域「延展性申請專利範圍」問題進行探討,嘗試建立一最適的法律模式,並期許未來可作為我國對其相關法制與解決方案之參考依據。
