A suppressio no direito civil brasileiro / Verwirkung in Brazilian private law.

O estudo é dedicado à investigação da figura da suppressio (Verwirkung), modalidade de abuso de direito fundada na violação à boa-fé objetiva, originada na prática jurisprudencial alemã. A pesquisa lança bases dogmáticas sobre a natureza jurídica da suppressio, seus pressupostos, efeitos, fundamento legal e axiológico, limites e interações com figuras análogas. Dedica-se, ainda, à análise da jurisprudência brasileira sobre o tema, em comentários a julgados específicos reputados mais significativos à fixação dos pontos controversos da disciplina. O recurso ao direito estrangeiro é frequente, dada mesmo a origem europeia da suppressio, mas a metodologia não é comparatista. O objetivo é compreender e criar um perfil tipicamente nacional da suppressio, com elevada operatividade que confira segurança jurídica em seu manejo. / The study is devoted to the investigation of the suppressio (Verwirkung), a type of abuse of rights based on the violation of the objective good faith, which originated in the German case law. The research throws dogmatic bases regarding the legal nature of suppressio, the requirements for its use, the effects arising therefrom, legal basis and axiological foundation, limits and interactions with similar figures. Further, the research dedicated itself to the analysis of the Brazilian case law on the subject, through comments specific to the precedents in which the controversial points of the discipline could be better analyzed. The use of foreign law is continuous throughout the text, mainly due to the European origin of suppressio, but the methodology is not one of comparative law. The goal is to understand and create a typically national profile for suppressio with high operability that ensures legal certainty in its management.

nÃo hà / O filÃsofo SÃren Aabye Kierkegaard dissertarà na obra Temor e Tremor de 1843 a respeito da problemÃtica do ato de fà e de suas implicaÃÃes existenciais, personificadas no relato bÃblico do GÃnesis, mas especificamente na tarefa imposta a AbraÃo, enquanto este à considerado pelo autor como o autÃntico cavaleiro da fÃ, dada a seriedade com que vivenciou em sua plenitude, o que o filÃsofo viria a nomear de o paradoxo da fÃ. Quem vive tal paradoxo, se encontraria em um estado de suspensÃo da moralidade. Isso pode ser justificado em parte pela condiÃÃo de incompreensibilidade na qual se encontra o cavaleiro da fÃ, perante aqueles que estariam ainda na esfera da moralidade. O intuito dessa dissertaÃÃo consiste em analisar os fundamentos que justificam a condiÃÃo existencial do cavaleiro da fà em relaÃÃo ao conceito de paradoxo em Kierkegaard e a sua ruptura com o domÃnio da moral objetiva, e de indagar se aquele poderia tornar-se compreensÃvel por outrem, levando em consideraÃÃo a especificidade do modo de incompreensibilidade pertencente a quem se situasse no domÃnio existencial religioso e os dois domÃnios de eticidade apontados: a moral reguladora, de matriz genÃrica e social e o que denominamos aqui de Ãtica absoluta, fundamentada exclusivamente na relaÃÃo homem-Deus. Those who live this paradox would be in a state of suspension of morality. This can be explained in part by the incomprehensibility condition in which is the knight of faith, to those who were still in the moral sphere. The purpose of this dissertation is to examine the grounds that justifying the existential condition of the knight of faith and his relation to the concept of paradox in Kierkegaard and his break with the field of objective morality, and inquire whether he could become understandable by others, taking into consideration the specificity of incomprehensibility so belonging whom were within the religious existential domain and the two domains pointed ethics: the regulatory moral, of generic and social matrix and the we call here of absolute Ethics, based exclusively on the man-God relationship. For this purpose not limit ourselves to the work mentioned, but we going to immerse in the analysis of other key works of the Danish philosopher, so that we can also define and expose the boundaries between these two ethical areas, namely, the general moral and the religious duty, and to see if in Kierkegaard is possible to think of a conciliation of both or in a reciprocal rejection.

The haplodiploidy has unique consequences to the populational ecology and social oveolutinos for the social bees. Studies have shown, in depleted popultions, that consecutive mating between indviduals with equal allele composition for the sex determination gene can cause its extinction. The sex determination genes csd (complementary sex determiner) and fem (feminizer) seems to be at the top of a regulatory cascade in which will originate the different phenotypes, which is indeed a essential way to mainten the eusociability in bees. The sex determination system as well as the several distincts caste determination systems existing among the high eusocial bess are yet poorly undertood in their genetic basis and seems to be fairly complex as diverse. The goal of this thesis was to sequence genes envolved in the sex or caste determination in the Melipona bees. Using the RACE (Rapid Amplification of cDNA Ends) technique, the gene fem (feminizer) was cloned and sequenced in M. compressipes and analysed with help of bioinformatcis tools. The analysis show in Melipona compressipes that the predict gene product have 64% of identity and 75% of similarity with its equivalent (Fem) in Apis mellifera, posesing the same protein domains: Arginime-Serine domain (RS-domain) and proline domain (proline rich dormain). The gene fem in M. compressipes as in Apis, do not have hyper variable region which characterizes its paralog gene csd Thus, as this work proposes would indicate that the fem product would have function in the activation of genes in Melipona switching on other secondary feminizer genes in contrast with the masculining genes, which are constitutive.We propose a model that that put together literature information with the new gene fem findings in Melipona, aiming a discussion about the relulatory cascade which surpass from the sex determination / A presença de castas entre as fêmeas e um sistema de produção sazonal de machos para renovação da rainha ou fundação de colônias filhas é fundamental para a vida em sociedade nas abelhas eusociais. Um sistema peculiar de determinação sexual é encontrado nesses insetos considerados organismos haplodiplóides, no quais, machos viáveis reprodutivamete são haplóides nascidos por partenogêne arrenótica (ovos não fecundados dando origem a machos), enquanto fêmeas são originadas de ovos fecundados. A haplodiploidia tem conseqüências fundamentais para a ecologia populacional e evolução social. A determinação das castas, por sua vez, em abelhas do gênero Melipona é sustentada pela hipótese do sistema genético-alimentar proposta por (KERR,1974), sendo dependente da dupla heterozigose, dos genes xa e xb (cada um com dois alelos). O objetivo desse trabalho foi o de seqüenciar genes envolvidos na determinação de sexo e ou castas em abelhas do gênero Melipona. Por meio de técnicas de isolamento gênico, utilizando o método de amplificação de extremidades para a obtenção de cDNAs completos (Rapid Amplification of Cdna Ends RACE). O gene fem (feminizer) foi clonado e seqüenciado em M. compressipes e analizado com o auxílio de ferramentas de bioinformática. Os resultados da análise mostram, que em Melipona compressipes, o produto predito do gene tem 64% de identidade e 75% de similaridade com o equivalente (fem) em Apis mellifera. Possuindo os mesmos domínios ricos em prolina (proline rich domain). Além disso, o gene fem é expresso em todos os instares imaturos e inclusive em adultos e igualmente encontrado em cDNAs de machos, operárias e rainhas, mostrando, da mesma forma que em A. mellifera, que esse é um gene expresso em todas as fases do desenvolvimento e em ambos sexos e castas, além de ser muito conservado interespecificamente. O gene fem, não possui a região hipervariada. Isso, segundo proposta desse trabalho, indicaria outros genes além de fem teria funções na ativação dos genes de castas em Melipona e dispararia outros genes feminizantes em contraposição aos genes masculinizantes, esses, por sua vez, constitutivos. É proposto um modelo, que reúne as informações da literatura com a descoberta do gene fem em Melipona

As experiências e os significados da fé e religiosidade para adolescentes em conflito com a lei / The experiences and meanings of faith and religiosity for adolescents in conflict with the law

A religiosidade tem sido estudada nas diferentes fases do ciclo vital, em especial na adolescência, como fator protetivo a prática do ato infracional. Para compreender esta dimensão da vida sob a ótica de adolescentes autores de atos infracionais, o estudo visou a investigar os significados de fé e religiosidade para adolescentes em conflito com a lei, norteado pelos conceitos de Mauro Amatuzzi. Trata-se de uma pesquisa qualitativa exploratória, realizada com seis adolescentes, com idades entre 15 e 17 anos, em cumprimento de Medida Socioeducativa, Liberdade Assistida, de uma cidade do interior do estado de São Paulo. O estudo utilizou como instrumentos de coleta de dados a entrevista semiestruturada e a fotografia. Inicialmente foi realizada uma oficina de fotografia, na qual os adolescentes receberam a questão a ser respondida em fotografias: \"Como você pode representar a sua fé em fotografias?\". Após a oficina, os adolescentes fotografaram, com o seu próprio aparelho celular, imagens do seu cotidiano que representavam a sua fé. Em seguida, foi realizada uma entrevista individual a fim de conhecer a história do participante, explorar suas expressões de fé e conversar sobre as imagens capturadas e seus respectivos significados. Por fim, foi realizado um grupo em que os adolescentes puderam ver todas as fotografias impressas, sem que fossem identificados seus respectivos autores, e manipulá-las de forma a agrupá-las conforme os sentidos, construindo categorias. As categorias foram nomeadas pelos próprios participantes como: Tudo, Fé em Deus, É o plano, Paz e Família. Os dados foram analisados por meio da Análise de Conteúdo das entrevistas individuais, que serviram de apoio para a compreensão do material fotográfico. As categorias formadas foram: Proteção, Motivação, Deus onipresente, Identificação, Sentido de ligação afetiva, Referências e Símbolos, Ações e Rituais. A partir dos resultados obtidos foi possível compreender que este grupo de adolescentes em conflito com a lei apresenta diferentes experiências e significados de fé. No entanto, todos revelam relação com o enfrentamento das adversidades cotidianas e projeto de vida, principalmente relacionado a conquistas de bens materiais. Percebemos que o instrumento fotográfico facilitou a participação dos adolescentes na pesquisa e possibilitou aos mesmos o encontro com a própria experiência, evidenciando-se como um recurso efetivo para a compreensão do significado e mediação da narrativa / Religiosity has been studied in the different phases of the life cycle, especially in adolescence as a protective factor the practice of the infraction. In order to understand this dimension of life from the point of view of adolescent offenders, the study aimed to investigate the meanings of faith and religiosity for youth in conflict with the law, guided by the concepts of Mauro Amatuzzi. This is an exploratory qualitative research carried out with six adolescents, aged between 15 and 17 years old, in compliance with the Socioeducational Measure, Assisted Liberty, of a city in the interior of the state of São Paulo. The study used semistructured interviews and photography as instruments of data collection. Initially a photography workshop was held, where the adolescents received the question to be answered in photographs: How can you represent your faith in photographs? After the workshop, the adolescents photographed, with their own mobile devices, images of their daily lives that represented their Faith. Then an individual interview was conducted to learn the story of the participant, to explore their expressions of faith and to talk about the images and their respective meanings. And finally, a group a meeting was done for the adolescents could see all the printed photographs, without identification of the respective authors, and manipulate them in order to group them into categories. The categories were named by the participants as: All, Faith in God, It is the plan, Peace and Family. The data were analyzed through the content analysis of the individual interviews, which served as support for the understanding of the photographic material. The categories formed were: Protection, Motivation, Omnipresent God, Identification, Sense of affective bonding, References and Symbols, Actions and Rituals. From the results it was possible to understand that this group of adolescents in conflict with the law presents different experiences and meanings of faith, however, all reveal relation with the confrontation of daily adversities and life project, mainly related to achievements of material goods. From the results, it was noticed that the photographic instrument facilitated the participation of the adolescents in the research and enabled them to encounter their own experience, proving themselves as an effective resource for understanding the meaning and mediation of the narrative

The phenomenology of divorce among Apostolic Faith Mission of South Africa's pastors : a practical theological perspective.

The rise in divorce cases among Christians, and among pastors in particular, has become an unsettling factor in contemporary South Africa. The Apostolic Faith Mission (AFM) of South Africa (SA) has been selected as a study sample to investigate this problem. From the above problem, the following question developed: “What are the motivations and justifications for AFM of SA (Pentecostal church) pastors indulging in the act of divorce, and what theologically educative measures can be advanced to resolve this problem…?” It has become incumbent upon researchers, especially theologians, to address this ongoing problem by employing a phenomenological study. Hence, the present researcher has employed the qualitative research methodology, in which the explorative, descriptive and contextual approaches have been applied. Consequently, phenomenological interviews were conducted among nine divorced AFM pastors. Fieldwork mainly consisted of data collection through in-person and telephonic interviews. This was followed by data analysis, through coding, categorisation and a thematic analysis to draw scientific categories from the collected data. Data analysis was conducted along two notable themes, namely, motivations and justifications/rationale with their subsequent categories and subcategories. The findings, after data analysis, show that the main motivations and justifications for pastors to divorce their spouses are as follows: ministerial incompatibility; communication breakdown; sexual incompatibility; socio-economic incompatibility; adultery; attitude or abusiveness; conflicting interests; dishonesty; cultural differences; influence of the extended family; academic incompatibility; insufficient time spent together; expired love; and jealousy. It has been noted that divorce is not a new phenomenon. Deuteronomy 24:1-4 shows that the problem of divorce existed from the days of Moses in the Old Testament. Because the men of Israel were arbitrarily divorcing their wives during Moses’ jurisdiction over Israel, he instructed that this be done in an orderly way – by issuing a certificate of divorce to the wives during the process of divorce. However, in the New Testament (Matthew 5:31-32, 19:1-9), Jesus spoke out against divorce. He stated that Moses allowed divorce because of the hard-heartedness of the men of Israel. Hence, ‘divorce’ is a theological concern that calls for a practical theological intervention strategy. Therefore, this thesis is concluded by recommending a ‘practical theological theory’ as an intervention strategy based on three aspects: firstly, the history of the AFM church on divorce; secondly, the reasons for divorce among AFM pastors as investigated in this research; lastly, the book of The Song of Songs and the incarnation of Christ were introduced as the basis of a new practical theological theory to ensure stable marriages among AFM pastors. / Dr. L.J. An Investigation into the Experience of Congregational Preaching at the Apostolic Faith Mission (AFM) in Soweto, Diepkloof Assembly Preaching is one of the main pastoral or congregational activities that takes place in all Christian congregations. The Apostolic Faith Mission (AFM), Diepkloof Assembly in Soweto has been selected as a study sample to investigate how church members experience their pastor’s preaching at church during worship services. In this study an empirical research was conducted by employing a qualitative research methodology, in which explorative, descriptive and contextual approaches have been applied. Phenomenological interviews were conducted among ten members of the AFM Diepkloof Assembly. The theory of data saturation was applied while conducting the interviews. This theory means that the researcher keeps on collecting data (e.g. by means of interviews) to obtain new data until no new information comes up. In this research, a literature study of the theoretical framework of preaching was undertaken to find out what the contemporary scholars think of congregational/pastoral preaching. There is a lack of African or black scholarship in this regard; most of the literature is from white scholars. Nevertheless, the researcher did establish a sound theoretical framework on congregational/pastoral preaching. Fieldwork mainly consisted of data collection through in-person, tape recorded interviews. This was followed by data analysis, through categorisation and a thematic analysis to draw scientific categories from the collected data. The findings, after data analysis, indicated that congregants generally regard:  the Bible as central in preaching  preaching as something that gives answers or solutions to real life problems  the preacher to be important and he/she must be in agreement with his/her message  preaching as having some influence on them to change their lifestyles for the better  preaching as a necessary activity that covers as wide range of subjects about (Christian) life. It was noted during this study that there are no empirical studies that have been undertaken on how church members in black township churches experience their pastors’ preaching. The literature control among white church members in suburban churches indicates that:  preaching must help to lead people to change (Swift,2005:18)  the person of the preacher plays a very crucial role in his/her preaching (Venter & Kim, 2004:147)  the teaching sermon should get more attention in our day (Pieterse, 2005:230)  the audience must be involved (be part of) in the preaching (Swift, 2005:230)  the preaching must be relevant to the lives of the audience (Swift, 2005:232). The above results of the literature control confirm what was gathered from the research findings. In conclusion, preaching still plays a very crucial role in the congregations, and that pastors and lay preachers need to continuously work on their preaching skills and methods to make it more effective and relevant to the contemporary church community and in society in general. / Dr. L.J. Evolution and personal religious belief: Christian biology-related majors' search for reconciliation at a Christian university

Staver / The goal of this study was to explore how Christian biology-related majors at a Christian university perceive the apparent conflicts between their understanding of evolution and their religious beliefs, and how their faith, as a structural-developmental system for ordering and making meaning of the world, plays a role in the mediating process. This naturalistic study utilized a case study design of 15 participants specified as undergraduate biology-related majors or recent biology-related graduates from a midwestern Christian university who had completed an upper-level course on evolution. Data were collected through semi-structured interviews that investigated participants' faith and their views on creationism and evolution. Fowler's theory of faith development and Parks' model of college students' faith was extensively used. Additional data were collected through an Evolution Attitudes Survey and a position paper on evolution as an assignment in the evolution course. Data analysis revealed patterns that were organized into themes and sub-themes that were the major outcomes of the study. Most participants were raised to believe in creationism, but came to accept evolution through an extended process of evaluating the scientific evidence in support of evolution, negotiating the literalness of Genesis, recognizing evolution as a non-salvation issue, and observing professors as role models of Christians who accept evolution. Participants remained committed to their personal religious beliefs despite apprehension that accompanied the reconciliation process in accepting evolution. Most participants operated from the perspective that science and religion are separate and interacting domains. Faith played an important role in how participants reconciled their understanding of evolution and their personal religious beliefs. Participants who operated in conventional faith dismissed contentious issues or collapsed dichotomies in an effort to avoid ambiguity and perceived tensions. Participants who operated in young adult and adult faith tended to confront their perceived tensions and worked towards reconciling their understanding of evolution and their personal religious beliefs. The rich description of this naturalistic study lends heuristic insight to researchers and educators seeking an understanding of the complex processes by which Christian biology-related majors approach learning about evolution and seek reconciliation between their understanding of evolution and their personal religious beliefs.

M.A. / The objective with this study was to develop a management model for assemblies in the Apostolic Faith Mission of South Africa (AFM). This model is focussed on the development of positive potential and the equipping of assembly members. A number of assemblies instituted a cell-based structure whilst others are in a process of transformation towards a cell-based assembly structure. The management possibilities of such a structure was therefore considered. An analytical and critical approach, based on the social sciences, was taken to develop a better understanding of people's latent potential. The equipping task of the church was also analysed. With the aforementioned as departing point, consideration was given as to what type of management structure would be the most suitable to develop potential and to equip assembly members. The study indicates the following: Every person has latent positive potential that should be developed. The church leadership is responsible to God for the development and equipping of assembly members. A high standard of management effectiveness could be reached through a Body-of-Christ assembly approach with cell groups as a supporting structure. A purpose-driven management approach should be adopted. The best management model is therefore achieved through a combination of a Body-of-Christ assembly model based on a purposedriven management approach. This thesis is a contribution aimed to assist the leadership in assembly management and structuring. It is hoped that this will result in the development of latent potential, and the equipping of assembly members to support them in their Godly purpose and service.
