The discipline of public employees in the United Arab Emirates : a comparison between the Gulf Cooperation Council Countries (G.C.C.)

Prior to independence, there were no clear regulations regarding the discipline of "publics office available in the United Arab Emirates and other countries of the Gulf Co-Operation Council. However, the postindependence era has witnessed great developments in political, economic, social and legal fields. Particular attention was accorded to public office as new laws regulating public office were promulgated in which the duties and rights of public servants were defined and a certain disciplinary system evolved. Against this background, the researcher examines the current disciplinary system in the United Arab Emirates with the purpose of pinpointing its deficiencies and limitations and proposing means for rectifying the same, as this would lead to a higher level of performance in the public service. The present thesis, which falls into eight chapters, begins by reviewing the developments that have taken place in the country in various fields. It then examines the Islamic perspective of the public service and reviews the early beginnings of its evolution. The study then discusses the duties and responsibilities of the public servant as per the current Public Service Law. It further deals with the various aspects of disciplinary accountability including disciplinary bodies, penalties and proceedings with special reference to the said law. This theoretical xix background is followed by an investigation of the actual implementation of the said law in particular those provisions pertaining to disciplinary accountability. For this purpose, a questionnaire was administered to a representative sample of 305 public servants of the United Arab Emirates. Personal interviews were also conducted by the researcher with a number of high-ranking government officials. The results of the questionnaire and interviews are then analyzed. Some recommendations and suggestions aimed at improving the U. A. E. Civil Service regulations and practices especially in the disciplinary domain are made in the final chapter.

O acesso ao cargo público no Estado de Bem-Estar Social sob a perspectiva da teoria da justiça de Rawls / The access to public office in the Welfare State under the perspective of Rawls theory of justice

O presente estudo tem como objetivo a análise da questão da igualdade no acesso ao cargo público sob a perspectiva da teoria da justiça de John Rawls, com o propósito de verificar se as ações afirmativas de reserva de vagas em concursos públicos são justas de acordo com a referida teoria. Trata-se de pesquisa teórica que se desdobra em quatro fases. Na primeira, analisa-se a teoria da justiça de Rawls no tocante a seus elementos centrais e às ideias políticas que podem tê-la influenciado. Na segunda, analisam-se modelos de Estado e de administração pública como um modo de subsidiar as discussões relacionadas ao cargo público. Na terceira, busca-se discutir o acesso ao cargo público mediante concurso público e sua relação com os princípios da justiça de Rawls. Na quarta, passa-se à análise da conformidade das ações afirmativas com a teoria da justiça e à análise da reserva de vagas (cotas) para negros em concursos públicos federais no Brasil. Considera-se, ao final, que as cotas, na maior parte dos casos, violam a igualdade equitativa de oportunidades segundo a perspectiva da teoria da justiça de Rawls. / The present study aims to analyze the matter of equality in the access to public office under the perspective of John Rawls theory of justice, with the intention of verifying if job reservation affirmative actions in public civil service examinations are fair according to the above mentioned theory. It is a theoretical research which unfolds in four phases. In the first one, Rawls theory of justice is analyzed regarding its central elements and the political ideas that might have influenced it. In the second one, state and public administration models are analyzed as a way of subsidizing the discussions related to public office. In the third one, it tries to discuss the access to public offices by means of public civil service examinations and their relation to Rawls principles of justice. In the fourth one, the conformity of affirmative actions with the theory of justice and the reservation for blacks (quotas) in federal civil service examinations in Brazil are analyzed. It is considered, in the end , that quotas, in most cases ,do violate fair equality of opportunity according to the perspective of Rawls theory of justice.

Esta nossa pesquisa, EDIF 60 anos de arquitetura pública, é uma simples seleção de dois momentos distintos da arquitetura (obra e pensamento), feita por arquitetos numa repartição pública da cidade de São Paulo (Convênio Escolar nos anos 1950 e EDIF nos anos 2000) e, um princípio metodológico de organização de um vasto material em deterioração e confuso, como os que existem em qualquer serviço público no Brasil. Este nosso trabalho consiste apenas na apresentação primária desses projetos e pensamentos de alguns arquitetos, sem a preocupação de chegarmos a conclusões definitivas. Para isso, escolhemos alguns arquitetos do Convênio Escolar (Hélio Duarte, Roberto Tibau, Eduardo Corona, Ernest Robert de Carvalho Mange e Oswaldo Corrêa Gonçalves) e uma obra (CEUs) da equipe de arquitetos do Departamento de Edificações (EDIF) da Secretaria Municipal de Infra-estrutura Urbana e Obras do Município de São Paulo. / This study, EDIF - 60 anos de arquitetura pública (EDIF 60 years of public architecture) is a simple selection of two distinct moments of architecture (work and thought), carried out by architects in a government office of the city of São Paulo (Convênio Escolar School Partnership in the 1950s and EDIF in the 2000s), and a methodological principle of organization of a vast material that is confused and in deterioration, like the ones that exist in any public service in Brazil. This study provides a preliminary presentation of these projects and of some architects thoughts, without aiming to reach definitive conclusions. To achieve this, we chose some architects of Convênio Escolar (Hélio Duarte, Roberto Tibau, Eduardo Corona, Ernest Robert de Carvalho Mange and Oswaldo Corrêa Gonçalves) and one work (CEUs Unified Educational Centers) of the team of architects of the Constructions Department (EDIF) of the Municipal Secretariat of Urban Infrastructure and Works of the Municipality of São Paulo.

A Descriptive Analysis of the Election of a Black Male Elite Middle Class to Public Office and its Role in Improving the Quality of Black Life in the City of Atlanta, Georgia, 1989-1996

The purpose of this case study is to conduct a descriptive analysis of the election of Black males to public office and the role they played in improving the quality of Black life in the city of Atlanta, Georgia. The study has analyzed and examined the impact that education, housing, income, and health care demographic factors have contributed to the election of these males to various committees, boards and commissions in the city of Atlanta and Fulton County Georgia. The study has also examined the political activity of college fraternities, urban voluntary associations, and community based organizations that played a role in the city council race of 1992 in electing a Black as mayor and member of the city council. To measure how effective these males were in improving the quality of Black life the following indicators will be utilized in this study, namely: (a) the improvement of the neighborhoods in Atlanta's Black community, (b) the distribution of goods and services to the Black community, (c) the sponsorship of bills and neighborhood economic development related projects through its candidates, in an attempt to exercise political influence, within the state legislature and the city council in Atlanta, Georgia, (d) the improvement of the quality of health care, housing, income, and(e) education. The principal method of analysis employed for explaining Black male political activity in the city of Atlanta, Georgia has been through the use of a research study conducted by the Clark Atlanta University Political Science Department in Atlanta, Georgia. The study was conducted by undergraduate and graduate students and several members of the faculty. The survey comprises telephone interviews with 100 respondents in the city of Atlanta, Georgia. The data are a unique resource that now makes possible an in-depth investigation of the urban issues, attitudes, and political beliefs and activity of a representative local sample of adult Black Atlanta residents. Each respondent was of voting age, but was not necessarily registered to vote. The sample for the Atlanta survey was drawn using a random-digit-dial design that selected participants disproportionately from different geographic areas within the city of Atlanta representing varying densities of Black population. The survey was inclusive of only those residents living within the (404) area code listing. The racial composition of the household was determined by including a direct question about race in the screening instrument. Members of eligible households found in the screening were eligible for the study if they were Black Americans and were at least 18 years of age.

State Police in a State of Change: Remaking the Entrepreneurial Officer

We are currently at a point in time in Australia where questions concerning how to govern police have never been more pressing or more fluid. Systemic corruption has been identified in several states; a range of new accountability mechanisms have been established internal and external to police and in Victoria police corruption has been linked with a violent 'gangland war'. This thesis locates these contemporary developments within a broader analysis of the historical circumstances shaping the changing techniques for governing state police. More specifically, this thesis engages in a detailed comparative study of the changing techniques of governing police in Queensland and Victoria. The theoretical tools to conduct this analysis are drawn from 'governmentality studies'. This refers to a broad grouping of theoretical scholarship concerned with the changing ideas - or 'political rationalities' - on how to govern some thing or some activity, and the underlying reasoning, justifications and ambitions contained within the practical tools or 'techniques' used to govern. Central to the thesis is an argument that a new politics of policing has emerged recently, one that extends the dyad of the old accountability - 'police powers' and 'external accountability' - to a pluralisation of accountability processes and structures. The thesis argues that governmentality studies offer new insights into ways of analysing the techniques for governing state police, increasingly shaped by the managerialisation of governing and embodying efforts to make police innovative, risk-taking problems-solvers. This is what I refer to as an open-ended normative project for re-making the entrepreneurial officer. However, a detailed examination of the development of governmental techniques for 'making up' the entrepreneurial officer indicates that such a governmental project is not implemented unproblematically. Nonetheless, the thesis concludes that the attempts to remake the entrepreneurial officer through the managerialisation of governing presents distinct possibilities for a new 'politics of policing' that fosters deliberative, reflective police practice within a new framework of police accountabilities.
