La Bible est présente dans bien des textes médiévaux, mais les modes de ce tissage scripturaire sont encore une terra largement incognita. Nous avons voulu ici montrer comment elle était utilisée et mobilisée dans les collections épistolaires de l’espace Plantagenêt (deuxième moitié du XIIe siècle), durant laquelle des « causes célèbres », au premier rang desquelles le conflit entre Thomas Becket et le roi Henri II, virent s’affronter des clercs « maîtres de la Parole ». Il ressort de cette étude que citer l’Écriture était un choix et non une évidence, et que ceux qui faisaient ce choix utilisaient ces références, et les ressources offertes par l’exégèse, dans leurs relations sociales et leurs prises de position politiques, avec parfois une grande sophistication. Il est également apparu que, durant la décennie où l’affaire Becket eut lieu, les textes de référence en matière droit canon qui devinrent dans les années qui suivirent des auctoritates absolues, le Décret de Gratien et les décrétales pontificales, n’avaient pas encore acquis ce statut ; la Bible pouvait donc, de façon inhabituelle, être prise comme autorité juridique à part entière. / The Bible is everywhere in medieval texts, but the ways it was precisely involved in the writing of those texts are still very much to be investigated. This dissertation sheds light on its uses in letter-collections composed within the “Angevin empire” in the second half of the 12th century. A few “causes celebres” led clerics, the “masters of the Word”, to fight one another; the conflict between Thomas Becket and Henry II is the most famous of those. Referring to Scripture was a choice, and not a reflex; those who made that choice used their biblical references, and the exegesis that illuminated their meaning, to foster their social position and relationhips and to fight their political battles, sometimes in rather sophisticated ways. The texts that would soon become the utmost authorities for canon law, Gratian’s Decretum and popes’ decretals, had not yet acquired such status, making possible for Becket and his companion to use the Bible, in an unusual and striking way, as their main legal auctoritas.

The Lost Soul of the Body Politic

The modern nation-state is the product of a gradual process in which the religiously concerned medieval political and ecclesiastical synthesis became more secular and centralized. Mirroring this external institutional development, the theoretical conception of the state changed from one of a natural organic unity of diverse corporate members to a consent-based compact among atomized individuals. This change can be traced in the Body Politic metaphor of four authors: John of Salisbury, Christine de Pizan, Johannes Althusius, and Jean-Jacques Rousseau. In this project, I argue that the Body Politic metaphor, particularly the inclusion or exclusion of a soul of the Body Politic, is uniquely appropriate for capturing the complexity of political life in general across differing levels of aggregation and for elucidating the political and religious commitments of the authors who employ it, as they critique their own contemporary political and religious institutions and describe their ideal societies. In the conclusion, I suggest that the loss of a strongly organic conception of the state has denied modern society and political theory a well established means for incorporating corporate entities and for explaining the existence of the modern nation-state in any kind of transcendental moral context, thus the lost soul of the Body Politic.

The implementation and administration of the 'New Poor Law' in Hertfordshire c1830-1847

This research presents a regional study of the implementation of the 1834 Poor Law Amendment Act (commonly known as the New Poor Law) and its operation in Hertfordshire up to 1847. It examines the economic costs of poor relief across the whole of this rural southern county but it also adopts a microhistory approach to examine in detail how the New Poor Law was implemented and administered in four poor law unions: Hatfield, Hitchin, St Albans and Watford. This study makes national and intra-county comparisons of poor relief data, policy and practice. This research focuses on people as well as place and examines how different groups influenced poor law policy and practice. It makes an important finding about the role played by the second Marquis of Salisbury (a prominent Hertfordshire resident) in the review of the poor laws and the legislation that followed. At the local level this thesis explores the process of implementation and gives new emphasis to the contribution made by the assistant poor law commissioners to both process and policy in the initial years of the New Poor Law. This study is unusual in the attention given to the middlemen of the poor law machinery - the poor law guardians and poor law officers including: medical officers, workhouse masters, relieving officers and schoolmasters and mistresses. This detailed examination of the local guardians challenges the existing historiography on the social demography of this body of men, demonstrates that the influence of elite personnel persisted and adds new data to support the argument that the operation of the poor laws was not just regionally but locally diverse. The workhouse, so symbolic of the New Poor Law and an essential component of the deterrent ideology, is considered in the context of attitudes around its construction and capacity as well as its everyday operation. This thesis adds to the poor law historiography with new data on a previously under-researched area of the country; it provides new information on the development of poor law policy, but more importantly it draws attention to the role of the middlemen and how their individual contributions influenced poor law policy and practice.

從亞里斯多德問題,團體就成為學者研究的焦點之一。歷來有關利益團體的研究即備 受爭議,特別是在利益團體的源起部分,學說層出不窮,至今仍未有定論。公益性團 體的興起,更使得團體理論愈加複雜。 近年來,我國政治情勢及社會環境的變遷,人們參與團體活動的趨勢有增無減,特別 是一些新興的公益性團體,除了消費者文教基金會,另外最惹人注目的該是一些以環 境保護為訴求反公害團體了。我們所感興趣的是,用什麼理論來解釋這些團體的發展 呢? 本文企圖由複雜的團體理論分析中,歸納出一個適合解釋反污染團體源起及維持的分 析架構,並以彰化縣公害妨治協會為個案分析對象,希望獲得一個初步的了解。 全文共分五章,計六萬餘言。 第一章緒論部分,將就本文的研究目的、研究方法、名詞界定分別闡述。 第二章理論探討,抱括杜魯門(David Truman),奧爾森(Mancur Olscn),哈定( Russell hardin),薩利伯瑞(Rcbert H.Salisbury )等人的理論要點闡述,並就 各項之優劣點予以評估而提出本文之研究架構。 第三章源起分析,就整體社會變遷、政治企業家,約定俗成及道德理性等因素探討彰 化縣公害防治協會的源起。 第四章維持分析,就組織目標、向心力、資源等方面探討彰化縣公害防治協會的維持 狀況。 第五章結論。檢討及建議。

Satire of Counsel, Counsel of Satire: Representing Advisory Relations in Later Medieval Literature

Satire and counsel recur together in the secular literature of the High and Late Middle Ages. I analyze their collocation in Latin, Old Occitan, and Middle English texts from the twelfth to the fifteenth century in works by Walter Map, Alan of Lille, John of Salisbury, Daniel of Beccles, John Gower, William of Poitiers, Thomas Hoccleve, and John Skelton. As types of discourse, satire and counsel resemble each other in the way they reproduce scenarios of social interaction. Authors combine satire and counsel to reproduce these scenarios according to the protocols of real-life social interaction. Informed by linguistic pragmatics, discourse analysis, sociolinguistics and cultural anthropology, I examine the relational rhetoric of these texts to uncover a sometimes complex and reflective ethical discourse on power which sometimes implicates itself in the practices it condemns. The dissertation draws throughout on sociolinguistic methods for examining verbal interaction between unequals, and assesses what this focus can contribute to recent scholarly debates on the interrelation of social and literary practices in the later Middle Ages. In the first chapter I introduce the concepts and methodologies that inform this dissertation through a detailed consideration of Distinction One of Walter Map’s De nugis curialium . While looking at how Walter Map combines discourses of satire and counsel to negotiate a new social role for the learned cleric at court, I advocate treating satire as a mode of expression more general than ‘literary’ genre and introduce the iii theories and methods that inform my treatment of literary texts as social interaction, considering also how these approaches can complement new historicist interpretation. Chapter two looks at how twelfth-century authors of didactic poetry appropriate relational discourses from school and household to claim the authoritative roles of teacher and father. In the third chapter, I focus on texts that depict relations between princes and courtiers, especially the Prologue of the Confessio Amantis which idealizes its author John Gower as an honest counselor and depicts King Richard II (in its first recension) as receptive to honest counsel. The fourth chapter turns to poets with the uncertain social identities of literate functionaries at court. Articulating their alienation and satirizing the ploys of courtiers—including even satire itself—Thomas Hoccleve in the Regement of Princes and John Skelton in The Bowge of Court undermine the satirist-counselor’s claim to authenticity. In concluding, I consider how this study revises understanding of the genre of satire in the Middle Ages and what such an approach might contribute to the study of Jean de Meun and Geoffrey Chaucer.
