Out of sight, out of mind : hinder för att ersätta rätten att söka asyl med enbart ett EU-gemensamt kvotflyktingsystem / Out of sight, out of mind : limitations to replacing the right to seek asylum with only a common EU resettlement system

I kölvattnet av den så kallade flyktingkrisen 2015 har allt fler röster höjts i Europa om att förändra asylrätten för skapa ett mer förutsebart och hållbart asylmottagande. Diskursen synliggör asylrättens centrala rättighetskonflikt där det allmännas intresse av reglerad invandring vägs mot den enskildes rätt till asyl. Denna uppsats utreder möjligheterna att ersätta EU:s nuvarande asylsystem med ett EU-gemensamt kvotflyktingsystem. Utgångspunkten för uppsatsen är ett förslag som Moderaterna under oktober 2017 antog i sitt partiprogram vars innebörd är att EU ska övergå till ett gemensamt asylsystem med enbart kvotflyktingmottagande. Frågeställningen är vilka hinder som föreligger för en sådan förändring med hänsyn till gällande rätt och ändamålen bakom asylrätten. Moderaterna föreslår alltså en ordning som skulle inskränka rätten att söka asyl. Rättighetsinskränkningar ska vara proportionerliga. Uppsatsen besvarar därför huvudfrågeställningen utifrån fyra delfrågor som påminner om en proportionalitetsbedömning för att avgöra om förslaget är möjligt eller lämpligt. Först diskuteras om dagens asylsystem behöver förändras med hänsyn till den så kallade flyktingkrisen 2015, sedan utreds andra brister i dagens system. Slutsatsen nås att det finns brister med dagens system som motiverar en förändring som exempelvis de höga dödstalen för migranter som reser över Medelhavet för att söka asyl i EU. Därefter undersöks vilka möjligheter en förändring till enbart ett EU-gemensamt kvotflyktingsystem skulle kunna medföra och det konstateras att förslagets största fördel är att vidarebosättning utgör en laglig och säker väg för asylsökande till EU. Kärnan i uppsatsen är utredningen av de praktiska och juridiska hinder som finns för en förändring till enbart ett EU-gemensamt kvotflyktingsystem. Där finner jag att det största hindret är svårigheten att organisera systemet på ett sätt som är förenligt med principen om non-refoulement enligt såväl folkrätten som Europakonventionen. Jag identifierar även andra allvarliga praktiska och juridiska hinder för en sådan ordning. Slutligen undersöks om det finns alternativa lösningar att tillgå som är mindre ingripande än förslaget om enbart ett EU-gemensamt kvotflyktingsystem. Jag finner att så är fallet. Till exempel kan medlemsstaterna öka sitt kvotflyktingmottagande, införa humanitära visum eller inrätta en EU-centraliserad asylprövning. Min slutsats är att rätten att söka asyl på plats i EU måste kvarstå och att de mindre ingripande lösningarna som tas upp i uppsatsen är att föredra framför ett asylsystem i EU med enbart kvotflyktingmottagande.

First person theatre : how performative tactics and frameworks (re)emerging in the digital age are forming a new personal-as-political

This study sets out to explore first person theatre as a means of opening the individual to the problems of contemporary capitalism and its increasing pervasion of the personal in an era of embeddedness enabled by networked pervasive technology. Firstly setting out key definitions and a theoretical analysis of the problems of being in the digital age in chapter 1, and then setting this against the history of interaction in performance in chapter 2. The study then goes on (in chapters 3-5) to investigate three key aspects of first person performance as personal-as-political; sound and the city, play and games, and interactive theatre. In the final chapter, The Umbrella Project develops a piece of first person theatre as practice, a method of investigation that is vital to a thesis that discusses politics, late capitalism, and the means to resist the message-sending of private interests as fundamentally only to be understood in practice. For this reason, too, chapters 3, 4 and 5 are supported by key case studies discussing other first person theatre practice. By placing the participant at the centre of the world-constituting process of theatre in the hot space between what is and what if this study suggests that first person theatre is able to open the contemporary individual to an inbetween where they might re-see, reflect and react to what is. To imagine and, if wished, act upon a what if. In an age of the disrupted near and far, the vanishing of the interface, of the false rhetoric of choice of personalisation , and the often false rhetoric of agency at the end of the era of broadcast, first person theatre offers the subject a route to individual agency, an understanding of the urban environment as construct, and to their relationship with the subjective other something which this thesis suggests is a personal-as-political practice to rival the Spectacle of late capitalism.

Literary challenges to the heroic myth of the Voortrekkers : H.P. Lamont's War, wine and women and Stuart Cloete's Turning wheels

Thesis (PhD)--University of Stellenbosch, 2001. / ENGLISH ABSTRACT: This dissertation is an interdisciplinary study of various historical novels which dealt to a greater or lesser degree with the Great Trek and were written between the 1840s and the 1930s in Dutch, Afrikaans and English but with particular emphasis on H.P. Lamont's War, Wine and Women and Stuart Cloete's Turning Wheels (1937). The analysis of all these fictional reconstructions focuses on the portrayal of the Voortrekkers found in them. Much attention is also paid to the historical contexts in which the two principal works in question were written and the great controversies which they occasioned because both of their authors had had the temerity to challenge the long-established myth of the heroic Voortrekkers, one of the holiest of the iconic cows in the barns of their Afrikaner descendants. Chapter I, "Introduction", is a statement of the purpose of the study, its place in the context of analyses of the history of Afrikaner nationalism, its structure and the sources on which it is based. Chapter II, "The Unfolding of the Myth of the Heroic Voortrekkers", traces its evolution from the 1830s to the 1930s and explores how both English-speaking South Africans and Afrikaners, especially Gustav PrelIer, purposefully contributed to it. Also highlighted in this chapter is the significance of the Great Trek Centenary and the events leading up to it in the middle and late 1930s in intensifying Afrikaner nationalism. Chapter III, "The Heroic Myth in Early Dutch and Afrikaans Novels about the Great Trek", considers especially how these works were used as vehicles for placing before Afrikaners the historic virtues of their ancestors both to provide models for emulation and to stimulate their ethnic pride. Chapter IV, "Sympathetic English Reconstructions of the Great Trek", deals with two novels, Eugenie de Kalb's Far Enough and Francis Brett Young's They Seek a Country, both of which reproduced the heroic myth to some extent. Chapter V, "Rendezvous with Disaster? The South Africa in Which Lamont Wrote War, Wine and Women" establishes the context of intensifying Afrikaner nationalism which this immigrant from the United Kingdom encountered in the late 1920s when he accepted a lectureship at the University of Pretoria and why this context was hostile to a novel which was critical of Afrikanerdom. Chapter VI, "Wa1~ Wine and Women: Its General Context and Commentary on South Africa" explores how this work, conceived as a "war book" dealing with the 1914-1918 conflict in Europe, depicted both Englishmen and Afrikaners negatively. Chapter VII, "Academic Freedom vs. Afrikaner Nationalism: The Consequential Strife over War, Wine and Women" deals with the hostile reception of Lamont's pseudonymously published novel, the physical assault on him and his dismissal from his lectureship at the University of Pretoria. Chapter VIII, "The Rhetoric of Revenge in Lamont's Halcyon Days in Africa", explores how the author, after relurning lo England, used his pen as a weapon for striking back al his Afrikaans foes in South Africa. Chapter IX, "Stuart Cloete's Portrayal of the Voortrekkers in Turning U'heels", focuses on the portrayal of various ethnic types in his gallery of characters. Chapter X, "The Con troversy over Turning U'heels", handles the hostile and apparently orchestrated reaction to Cloete's book and how it was eventually banned. La France a mis en place en juillet 2015 une réforme en vue de transposer le nouveau « paquet asile » européen alors que le Canada a renforcé depuis décembre 2012 ses procédures d’asile en adoptant des changements ayant essentiellement pour objet de lutter contre les abus du système d’asile canadien. En s’orientant vers des politiques dissimulées visant les expulsions expéditives des demandeurs d’asile déboutés et des personnes indignes de la protection, la France et le Canada, connus en tant que terre d’asile, respectent-ils toujours leur obligation international du non-refoulement ? Cette thèse s’appuie sur les lois en vigueur des deux États notamment le Code de l’entrée et du séjour des étrangers et du droit d’asile (France) et la Loi sur l’immigration et la protection des réfugiés (Canada), les jurisprudences nationales et internationales, et les textes internationaux. Elle met en lumière les pratiques et législations nationales relatives à l’octroi de l’asile et à l’éloignement des demandeurs d’asile et des réfugiés qui peuvent ou pourraient porter atteinte au principe de non-refoulement, tel que consacré par le droit international des réfugiés ainsi que par le droit international des droits de l’homme / In July 2015, France adopted an asylum reform bill in order to transpose the EU asylum legislative package. In comparison, Canada has, since 2012, strengthened its national asylum procedures by introducing a number of changes with the objective of preventing the abuse of Canada’s inland refugee determination system. In moving towards hidden policies aimed at the efficiency of removals of failed refugee claimants and persons unworthy of international protection, are France and Canada, known as safe havens, respecting their international obligations of Non-Refoulement ? This thesis focuses on the laws in force in both States in particular the Code of the Entry and Stay of Foreigners and Asylum Law (France) and the Immigration and Refugee Protection Act (Canada), national and international jurisprudence, and other relevant international documents. The present study aims at highlighting the national legislations and practices relating to the grant of asylum and the expulsion of asylum seekers and refugees which violate or could violate the Principle of Non-Refoulement as enshrined in both International Refugee Law and International Human Rights Law

Trata-se de uma pesquisa qualitativa que descreve os processos identitários da organização por um olhar interpretativista, pelo entendimento das relações simbólicas que permeiam essa organização, observados em discursos dos sujeitos. Para coleta dos dados foram utilizadas pesquisa documental e entrevistas semiestruturadas individuais. As entrevistas foram realizadas com cinco sujeitos da organização nos meses de setembro e outubro de 2014. O método de análise foi a Análise de Conteúdo (KRIPPENDORFF, 1990) que busca investigar dados textuais através de técnicas que permitam compreendê-los com seus significados, referências, valorações e intenções. Pretendeu-se contribuir, com esse estudo, para a compreensão da identidade organizacional, em uma organização pública, no contexto da defesa sanitária e inspeção agropecuária. Os resultados permitiram identificar o Idaf como único e distinto de outras organizações e como essa identificação está relacionada às transformações do contexto agropecuário.
