Contratos fiscais: viabilidade e limites no contexto do direito tributário brasileiro / Tax agreements: feasibility and boundaries in the context of the Brazilian Tax Law.

As relações entre a Administração Pública e os cidadãos modificaram-se radicalmente ao longo das últimas décadas. Essa transformação também se reflete no âmbito do Direito Tributário. A administração tributária tem buscado adotar formas consensuais de prevenção ou solução de conflitos, pois o recurso ao Poder Judiciário demonstramorosidade e o prolongamento das demandas inevitavelmente traduz prejuízos para as partes envolvidas. O presente estudo enfoca o fenômeno dos contratos fiscais, assim entendidos os acordos firmados entre o Fisco e o contribuinte para a solução de problemas controversos envolvidos no processo de apuração e determinação da obrigação tributária. Analisam-se os limites à adoção de formas consensuais em matéria tributária, enfocando seu enquadramento com relação aos princípios da legalidade, tipicidade, igualdade, capacidade contributiva e especialmente da indisponibilidade do crédito tributário. Estudam-se os fenômenos da discricionariedade e concessão de margens de apreciação, uma vez que eles fundamentam a autonomia contratual da Administração Pública. São enfocados exemplos específicos de conceitos indeterminados, cláusulas gerais e outras formas de livre atuação administrativa em Direito Tributário. Considerando que contratos fiscais remete a um gênero, uma categoria superior que congrega diferentes formas de atuação pactuada da Administração Pública, apresenta-se sua conceituação e detalhes das suas características essenciais. São examinadas também as principais teorias para identificação da natureza jurídica específicas dos contratos fiscais, em torno das figuras de contrato ou ato administrativo. Enfocam-se ainda os principais fatores envolvidos na formação de tais contratos, bem como limites para sua revisão e anulação. São ressaltados detalhes específicos do papel da vontade do contribuinte nesse processo. Por último faz-se análise circunstanciadas das características de cinco espécies de contratos fiscais do Direito Tributário Brasileiro: acordos de fixação, regimes de quantificação padronizada dos tributos, soluções de consulta, contratos de isenção e transações em sentido estrito. / The relationship between public administration and citizens have changed radically over the past decades. This transformation is also reflected in the Tax Law. The tax administration has sought to adopt consensual ways of preventing or resolving conflicts, since the recourse to the judiciary demonstrates delays and prolongation of the demands inevitably translates into losses for the parties involved. This study focuses on the phenomenon of tax contracts, understood as the agreements between the IRS and the taxpayer to resolve controversial issues involved in the assessment and calculation of the tax liability. It examines the limits to the adoption of consensus regarding tax forms, focusing its framework with regard to the principles of legality, typicality, equality, ability to pay and especially the unavailability of the tax credit. We study the phenomena of discretion and margins of appreciation, since they underlie the contractual autonomy of the Public Administration. Particular attention is given to specific examples of indeterminate concepts, general clauses and other forms of administrative freedom of action in Tax Law. Whereas tax contracts is an expression that refers to a genre, a higher category that combines different forms of action agreed Public Administration, this study presents its concept and details of their essential characteristics. Also examined are the main theories to identify the specific legal nature of contracts tax, around the figures of contract or administrative act. Focus is still the main factors involved in the formation of such contracts, as well as limits for your review and annulment. It highlights specific details of the role of the will of the taxpayer in this process. Finally this study presents a detailed analysis of the characteristics of five species of contracts of the Brazilian Tax Law: agreements for the fixation of vagueness, contracts for standardized quantification of taxes, tax rulings, exemption contracts and transactions.

Annotation The diploma thesis deals with the description and analysis of tax and administrative management in terms of deadlines. The aim of the thesis is to find a practical basis when applying an inconsistent setting of deadlines in the tax and administrative procedures. It was important to determine whether the concept of deadlines in the legislation is different, how the concept of time is regulated in the legislation and how this issue can actually affect us. The analysis of individual management was based on actual data. I was provided the data related to the tax procedure by a particular tax subject. The data related to the administrative procedure were requested from a specific administrative authority. The practical part of the thesis deals with a detailed analysis of individual management in terms of deadlines. The tax procedure was about determining the preclusion of the deadline for a tax assessment and the identification of the factors which had an impact on the course of this period. In the case of administrative proceeding, the time limits which are necessary for discussion of the minor offense and the administrative offense were analyzed. The thesis contains tables with data for better clarity within individual management.

Indirect administrative costs associated with tax assessment and its proceedings are too high and the whole process is inefficient. During the tax procedure both primary documents and proper evidence are handled inefficiently which makes the tax system unnecessarily costly. In order to examine economic properties of the tax procedure in practice I used questionnaires and archive research. In order to store a quality outputs, in the form of properly assessed taxes in the shortest possible time, it is necessary to process the input data in the most efficient way possible. In my thesis, I propose austerity measures which will increase tax efficiency. Only good information system and a complete, clear systematic archiving of all transaction can guarantee productive work with low costs. Only those tax consultants or accountants who have complete documentation have a control mechanisms which allows them to offer high quality services which ultimately makes the whole tax system more efficient.

Time limits in tax administration Time limits have an irreplaceable role in law. They are of a crucial importance especially in situations where a certain act (exercise of a right or a fulfillment of obligation) is limited by time so that after a certain time expiration it is possible to state that such an act was not performed and thus to draw legal consequences hereof. The main purpose of a time limit is the demarcation of the state of uncertainty as to whether the act will be performed or not and thus to determine either the legal consequence of the performance of the act or the consequences of the default of time. It is clear that the tax proceedings legislation also needs its time limits. Quite frequently it is necessary to set a certain time period for the performance of an act. This time period is set by a time limit. Otherwise it would be only possible to state that an act has already been performed or not yet been performed. It would however not be possible to state that the act was supposed to be performed, i.e. if a person who could have acted or was supposed to act, in fact did not act, the whole process of administration of taxes would come to a deadlock. At the second moment, it examines the Law n. 10.705/2000 of the São Paulo State to verify if it is compatible with the constitutional profile of this tax. Further on, the São Paulo legislation comes back to be the focus, to analyse the tax exemption phenomenon. Later, it concerns about the tax assessment, evidencing the peculiar aspects of this tax. The final topic intends to face two intricate questions: the decadence and the prescription of the ITCM / O trabalho trata do imposto sobre transmissão causa mortis de quaisquer bens ou direitos (ITCM) e tem entre seus objetivos construir a sua regra-matriz de incidência, a partir do exame das normas constitucionais que disciplinam esse tributo, identificando as duas equações que a compõem: o antecedente (hipótese tributária), descrevendo os seus critérios material, espacial e temporal; e o conseqüente (relação jurídica tributária), identificando os seus critérios pessoal (sujeitos ativo e passivo) e quantitativo (base de cálculo e alíquota). Construída a regra-matriz de incidência tributária, examina as normas da Lei n. 10.705/2000 do Estado de São Paulo, objetivando verificar em que medida elas são compatíveis com o perfil constitucional desse tributo. A seguir, a legislação paulista volta a ser o foco, com a finalidade de se analisar o fenômeno da isenção do imposto sobre transmissão causa mortis. Posteriormente, trata do lançamento tributário do ITCM, constatando os traços peculiares a esse tributo, sobretudo quando apurado no âmbito de processos judiciais. This study discusses South Africa’s tax incentives for small businesses and identifies shortcomings and areas of concern within the tax incentive regimes. A comparison of small business tax incentives provided by Australia, India, and the United Kingdom is made with South Africa’s small business tax incentives to identify similarities and differences, and new lessons are learned from the approaches of other countries. As a result of the comparison with the tax dispensations available to small businesses in other countries, the study recommends additional tax incentives that could be implemented by South Africa. Only those tax incentives that are available in other countries but not in South Africa that were deemed worthwhile were recommended to be introduced in the Republic.
