Legal Status of Police Officers / Policijos pareigūnų teisinis statusas

Misiūnas, Eimutis 01 September 2010 (has links)
The thesis addresses legal status of police officers by scrutinizing efficiency of the institution, identifying the key determinants of the efficiency and modeling legal measures that would allow prompt reaction to the unstable environment of the police service. Efficiency of Legal Status is analyzed via assessment of elements of the legal status and classification of those into four correlative segments. The work comprises an eight year evolution of the efficiency, its sociological indexes in police services exercising patrolling of public places, control of traffic safety and protection of secured objects. The thesis evaluates effects of social environment (community) and political and economic factors upon efficiency of legal status in general and, by scrutinizing legal regulation in each segment individually, identifies faults and shortcomings in the efficiency and evaluates readiness of police officers to exercise their functions by comparison of training programs for primary pack police officers in Lithuania, Ireland and Finland. The thesis ends with a range of proposals on legal regulation of individual segments of the legal status that would allow enhancement of efficiency of legal status and on compensatory mechanisms to maintain restored efficiency of legal status. Conclusions of the survey reveal that the legal status of police officers regulated in accordance with positivistic legal theories is inefficient and neither meets demands of police officers nor the needs... Teisinio statuso veiksmingumas tiriamas vertinant teisinio statuso elementus, klasifikuojamus į keturis tarpusavyje koreliuojančius segmentus. Vertinama veiksmingumo pokyčio dinamika aštuonių metų laikotarpyje ir jo sociologiniai rodikliai policijos tarnybose, vykdančiose viešųjų vietų patruliavimą, eismo kontrolę ir objektų apsaugą. Disertacijoje įvertinama socialinės aplinkos (visuomenės), politinių ir ekonominių veiksnių įtaka teisinio statuso veiksmingumui apskritai ir kiekvienam teisinio statuso segmentui, analizuojamas segmentų teisinis reguliavimas, nustatant jo nepakankamumą ar ydingumą, vertinama policijos pareigūnų parengtis funkcijoms vykdyti, analizuojant ir lyginant Lietuvos Airijos ir Suomijos pirminės grandies policijos pareigūnų mokymo programas. Disertacijoje pateikiami pasiūlymai dėl teisinio statuso segmentų teisinio reguliavimo, sudarančio prielaidas didinti teisinio statuso veiksmingumą, ir dėl kompensacinių mechanizmų, skirtų palaikyti atkurtą statuso veiksmingumą. Tyrimo išvados atskleidžia, jog pagal pozityviosios teisės tradiciją reglamentuojamas ir įgyvendinamas policijos pareigūno teisinis statusas nėra veiksmingas, netenkina nei policijos pareigūnų, nei... Krupová, Tereza January 2015 (has links)
This dissertation thesis Shaping of Legal Consciousness of non-law University Students aims to explore the process of forming legal literacy and consciousness of non-lawyers mainly via education. Premise or audited issue is that didactics and methodology of law and hence connected cultivation of legal consciousness of individuals are not very effective. Thereof the starting point is the anticipated inefficiency of teaching law for non-lawyers. The thesis firstly looks for the purpose of university education today as well as the position of its students. Further the concept of legal consciousness is presented. The last two chapters confirm some hypothesis using results of researches made for this thesis. The first research focuses on university teachers of law to non- lawyers, the second one deals with universities' students and graduates.

A construção do enfoque nas teorias jurídicas: subsídios para repensar o debate em torno da racionalidade no direito / The formulation of focus in legal theories: a contribution to rethinking the debate over rationality in law

Costa, Carlos Eduardo Batalha da Silva e 30 July 2010 (has links)
The relation between reason and law is part of the Western thought tradition. In the modern period, this relation served as basis for the emergence of an autonomous legal culture, within which the ideas of \"subjects of law\" and \"legal system\" were elaborated. However, modernity has also created conditions for the birth of the so-called legal theories, which were constituted as a new form of legal discourse (distinct from the legal dogmatics and philosophical theories of law), for they do not present the traditional model of rationality associated with the conception of natural law. A peculiar method is proposed in this doctoral thesis, in order to understand the rationality in this new sphere of legal discourse: on the one hand, legal theories which have become reference within the Anglo-Saxon world i.e., theories outside the usual landmarks of rationalization in modern continental Europe are taken as object; on the other hand, the interpretive approaches (focuses) formulated as legitimate by these theories are considered as expressions of rationality, instead of rationality as originated from divisions by schools of thought or epistemological matrices. By means of this method, three new distinct models of legal reasoning are revealed. These models are the outcome of different concepts of \"point of view\" which were defended throughout the dialogue which took place between the theories of John Austin, Oliver W. Holmes Jr., Hans Kelsen, Herbert L. A. Hart, Ronald Dworkin and Robert Alexy. These three models, in turn, contribute to highlighting the heuristic limits of the opposition legal positivism vs. non-positivism in the debate over rationality in contemporary law.

Validação do instrumento de Análise da Impressão e do Impacto do Prejuízo Estético (AIPE) para uso em Odontologia Legal / Validation of the instrument Analysis of Aesthetic Damage Impression and Impact (AIPE) for use in Forensic Dentistry

Fernandes, Mário Marques 09 November 2015 (has links)
In the last decades, the elevated number of victims of traffic accidents, urban violence, sports-related trauma, occupational injuries, and professional-related errors increased the concern with the expert aspect, whether in the criminal or civil context, because of the sequelae associated with these injuries and trauma, also to the maxillofacial region. In this sense, this study aimed to translate into Brazilian Portuguese and culturally adapt for use in Brazil the Spanish instrument called Analysis of Aesthetic Damage Impression and Impact (AIPE) proposed by Cobo Plana (2010), and to validate the instrument among dentists working in forensic dentistry. After translation and cultural adaptation, fake scars (moulage) were placed on the maxillofacial region of two models, a male and a female. Dentists specializing in forensic dentistry were selected to make the assessments. These students used the instrument, which consists of four tables, on a sequence of ten randomized images, showing models with and without facial scars. The intraclass correlation coefficient measured observer reliability to verify instrument validity. In general the method was satisfactory for one scar and excellent for two scars of the three repeated scars. Regarding intertester error, descriptive analysis of the results showed a variation coefficient of the scores of 40.12% when all the coefficients were considered, demonstrating that the scores were relatively homogeneous. The four tables translated into Brazilian Portuguese and culturally adapted for Brazil have the potential to increase the objectivity of aesthetic damage assessment.

Řízení o svéprávnosti / Legal capacity proceedings

Machová, Miroslava January 2019 (has links)
This thesis examines legal capacity and its restriction. The legal capacity of a person makes along with his legal personality an inherent and inalienable component of his personality that enables him to act legally. It is therefore a prerequisite of his self-realization and active participation in society. Legal capacity and legal personality are components so significant, that they cannot be relinquished. Not even partially. Unlike legal personality, a person's legal capacity can be restricted by a court order. And it is the very legal capacity proceeding, this thesis focuses on. In view of the fact, that procedural law is reflected in substantive law, part of this thesis also concerns with the analysis of legislation contained within the Civil Code (Act. No. 89/2012 Coll.). The thesis thoroughly analyses individual stages of a legal capacity proceeding and the subsequent legal provisions and court decisions. The thesis is divided into two parts and eight chapters. The first part discusses substantive regulations of legal capacity. In the introduction to the first chapter, I draw attention to an alteration in legal terminology and a new conception of legal capacity restriction according to the legal regulation that came into force on the 1st of January 2014. Subsequently I define the concept of...
