Reclamações éticas contra cirurgiões dentistas que deram entrada no CRO-SP durante o ano de 2007

O crescente aumento do número de ações contra cirurgiões dentistas no Brasil, quer seja ética, civil ou penal, está tornando-se um fato preocupante, no entanto, várias são as causas que levam os profissionais a serem acionados. Os pacientes ou tomadores de serviços odontológicos têm assumido uma postura diferente, não mais baseada na confiança, e quando se sentem lesados em seus direitos buscam o auxílio. O objetivo do presente estudo foi realizar um levantamento e análise das reclamações e dos motivos que levaram os pacientes a procurarem o Conselho de Odontologia de São Paulo, bem como, qual a especialidade do profissional e procedimento contratado, constante nos processos éticos que deram entrada neste órgão durante o ano de 2007. Para tanto, analisamos todos os processos, ou seja, 104 processos de 2007. A análise foi realizada de maneira quali-quantitativa. De acordo com os resultados, 64% das denúncias eram provenientes da capital e da grande São Paulo. Grande parte (44%) foi editada em computador e apresentavam características de peças processuais. A maioria dos reclamantes foi do sexo feminino e dos reclamados do masculino. As especialidades mais reclamadas foram: Prótese Dentária, Ortodontia e Implantodontia. Dentre os motivos da reclamação destacam-se o erro profissional, insatisfação com o tratamento e a falta de esclarecimento sobre o tratamento. É cada vez mais freqüente o número de processos éticos envolvendo cirurgiões-dentistas. Este fato se deve a vários fatores tais como: a falta de informação, comunicação inadequada, mudança de postura dos pacientes, antes submissos e... / Every activity that causes damage has as consequence the problem of professional responsibility, which expresses the idea of restoration of equilibrium or damage repair. The growing number of lawsuits against dental surgeon in Brazil, ethical, civil or penal, has becoming a worrying fact, however, there are many reasons for professionals be sued. The patients or insured dental services have taken a different stance, not based on reliance any more, and when they fell their rights were violated they have looked for assistance. The objective of this study was to carry out a survey and an analysis of claim and reasons why patients looked for the Regional Council of Dentistry-São Paulo State (CRO-SP), as well as the type of professional expertise and contracted procedure, present in the ethical process that was recorded in this agency during year 2007. All lawsuits were analyzed, being 104 trials in 2007. A quali and quantitative analysis was conducted. According to the findings, 64% of complaints were from the city of São Paulo and surroundings. Most of them (44%) were edited in computer and presented characteristics of lawsuits. The majority of claimants was female and of defendant was male. The main sued types of professional expertise were Dental Prosthesis, Orthodontics and Implantology. Among the reasons of claims were the professional error, unsatisfaction with the treatment and lack of explanation about the treatment. It has become more frequently the number of ethical process involving dental surgeons. A relação entre razão e direito faz parte da tradição do pensamento ocidental. No período moderno, essa relação serviu de base para o surgimento de uma cultura jurídica autônoma, dentro da qual foram elaboradas as idéias de sujeito de direito e sistema jurídico. No entanto, a modernidade também criou condições para o nascimento das chamadas teorias jurídicas, que se constituem como uma nova forma de discurso jurídico, distinta das teorias filosóficas e das dogmáticas jurídicas, por não manifestarem o modelo de racionalidade tradicional, associado à concepção de lei natural. Para compreender a racionalidade nesse novo âmbito do discurso dos juristas, é proposto, nesta tese de doutoramento, um caminho peculiar: por um lado, tomam-se por objeto teorias jurídicas que se tornaram referência no contexto anglo-saxônico, ou seja, fora dos marcos habituais da racionalização na Europa continental moderna; por outro lado, são considerados como fio condutor para esta investigação os enfoques interpretativos construídos como legítimos por essas teorias, em vez de configurar sua racionalidade a partir de divisões escolares ou matrizes epistemológicas. Essa delimitação permite revelar três modelos novos e distintos de racionalidade jurídica, que resultam do desenvolvimento de diferentes concepções de pontos de vista no contexto do debate entre as teorias jurídicas de John Austin, Oliver W. Holmes Jr., Hans Kelsen, Herbert L. A. Hart, Robert Alexy e Ronald Dworkin. Esses três modelos, por sua vez, contribuem para ressaltar os limites heurísticos da contraposição positivismo vs. antipositivismo para tratar da racionalidade no direito contemporâneo. / The relation between reason and law is part of the Western thought tradition. In the modern period, this relation served as basis for the emergence of an autonomous legal culture, within which the ideas of \"subjects of law\" and \"legal system\" were elaborated. However, modernity has also created conditions for the birth of the so-called legal theories, which were constituted as a new form of legal discourse (distinct from the legal dogmatics and philosophical theories of law), for they do not present the traditional model of rationality associated with the conception of natural law. A peculiar method is proposed in this doctoral thesis, in order to understand the rationality in this new sphere of legal discourse: on the one hand, legal theories which have become reference within the Anglo-Saxon world i.e., theories outside the usual landmarks of rationalization in modern continental Europe are taken as object; on the other hand, the interpretive approaches (focuses) formulated as legitimate by these theories are considered as expressions of rationality, instead of rationality as originated from divisions by schools of thought or epistemological matrices. By means of this method, three new distinct models of legal reasoning are revealed. These models are the outcome of different concepts of \"point of view\" which were defended throughout the dialogue which took place between the theories of John Austin, Oliver W. Holmes Jr., Hans Kelsen, Herbert L. A. Hart, Ronald Dworkin and Robert Alexy. These three models, in turn, contribute to highlighting the heuristic limits of the opposition legal positivism vs. non-positivism in the debate over rationality in contemporary law.

Validação do instrumento de Análise da Impressão e do Impacto do Prejuízo Estético (AIPE) para uso em Odontologia Legal / Validation of the instrument Analysis of Aesthetic Damage Impression and Impact (AIPE) for use in Forensic Dentistry

Nas últimas décadas o grande número de vítimas de acidentes de trânsito, violência urbana, traumas pela prática desportiva, acidentes de trabalho e do próprio erro profissional aumentou a preocupação com os aspectos periciais, seja no âmbito criminal ou sede civil, em razão das sequelas oriundas desses ferimentos e traumas, incluída nessa perspectiva a região maxilofacial. Nesse sentido, este estudo objetivou traduzir e adaptar culturalmente as questões constantes no instrumento espanhol de Análise da Impressão do Impacto do Prejuízo Estético (AIPE) proposto por Cobo Plana (2010) para ser utilizado no Brasil, e validar esse instrumento junto a cirurgiões-dentistas da área de Odontologia Legal. Após o processo de tradução e adaptação cultural, foram simuladas com maquiagem lesões cicatriciais na região maxilofacial de dois modelos, um masculino e outro feminino. Selecionaram-se cirurgiões-dentistas em formação na Especialidade de Odontologia Legal para serem avaliadores. Esses aplicaram o método constituído de quatro quadros numa sequência de dez imagens randomizadas que mostraram modelos sem lesão e com lesões (cicatrizes) na face. A validação do instrumento foi verificada através da medida da confiabilidade dos observadores, através do Coeficiente de Correlação Intraclasse, mostrando-se no geral satisfatória para uma e excelente para outras duas lesões, dentre as três repetidas. No que versa sobre o erro interexaminador, a análise descritiva dos resultados mostrou um coeficiente de variação dos escores em 40,12% ao considerarmos todos os coeficientes, o que mostra uma relativa homogeneidade dos escores. Os quatro quadros traduzidos e adaptados culturalmente para língua portuguesa mostraram-se com potencial de oferecer maior objetividade na valoração do dano estético. / In the last decades, the elevated number of victims of traffic accidents, urban violence, sports-related trauma, occupational injuries, and professional-related errors increased the concern with the expert aspect, whether in the criminal or civil context, because of the sequelae associated with these injuries and trauma, also to the maxillofacial region. In this sense, this study aimed to translate into Brazilian Portuguese and culturally adapt for use in Brazil the Spanish instrument called Analysis of Aesthetic Damage Impression and Impact (AIPE) proposed by Cobo Plana (2010), and to validate the instrument among dentists working in forensic dentistry. After translation and cultural adaptation, fake scars (moulage) were placed on the maxillofacial region of two models, a male and a female. Dentists specializing in forensic dentistry were selected to make the assessments. These students used the instrument, which consists of four tables, on a sequence of ten randomized images, showing models with and without facial scars. The intraclass correlation coefficient measured observer reliability to verify instrument validity. In general the method was satisfactory for one scar and excellent for two scars of the three repeated scars. Regarding intertester error, descriptive analysis of the results showed a variation coefficient of the scores of 40.12% when all the coefficients were considered, demonstrating that the scores were relatively homogeneous. The four tables translated into Brazilian Portuguese and culturally adapted for Brazil have the potential to increase the objectivity of aesthetic damage assessment.

College Students’ Perceptions of Law Enforcement and Legal Careers

Recent events have given attention to the public perception of criminal justice field in the United States. Although there has been much political debate about problems in the criminal justice field, attention should be turned to the prospective employees who will soon be seeking out these debates: college students seeking to enter the criminal justice field. The current study did that through survey data obtained from 112 students enrolled in criminal justice courses at East Tennessee State University during the Fall 2020 semester. Analysis revealed much about student interest in various criminal justice occupations, their perceived ability to perform the duties associated with them and the factors that motivated their decision-making. It also indicated that certain characteristics may influence desire to enter the policing and legal fields. Each of these findings is discussed.

Implementing Plain Language Into Legal Documents: The Technical Communicator's Role

This thesis discusses the benefits of using plain language in legal documents and the role technical communicators can play to help implement plain language. Although many definitions for plain language exist, it is best described as reader-focused communication that presents information in a manner that makes it easy for a reader to find, understand, and use the information. Plain language facilitates comprehension by using shorter, less complex sentences; active voice; and common words. All these elements aid in processing and understanding information, especially unfamiliar concepts. Laypeople, unversed in the law, frequently have difficulty understanding traditional legal writing. The complex sentences, wordiness, and redundancy that characterize traditional legal writing often inhibit comprehension and become barriers to understanding. To demonstrate how plain language can improve legal writing, this thesis reviews before-and-after versions of documents that were revised to incorporate plain language as well as common documents that laypeople might encounter. The studies and research discussed in this thesis demonstrate that readers achieve greater comprehension with plain language documents. Technical communicators, the language experts, can work with legal professionals, the content experts, to help encourage plain language use in legal writing. By emphasizing plain language use in legal formbooks, law school courses, and continuing legal education courses, plain language will become more dominant. Technical communicators can work with governments and law firms to develop and run in-house writing programs. When organizations realize how plain language can benefit them, both economically as well as in improved consumer relations, they will be motivated to adopt plain language into their legal writing.

Normative Political Communities: Foundations for a Hartian Theory of State and Non-State Law

This dissertation outlines a theory of law capable of explaining both the legal systems of domestic states and other types of legal phenomena different from state law that I will call non-state legal phenomena. Central examples of non-state law include indigenous and customary laws, the international legal order, the European Union, and transnational commercial law. This theoretical framework aims to formulate and resolve questions about the common features shared by different types of legality and the distinctive legal character of non-state legal phenomena. It also sets the stage for doctrinal and politico-moral inquiries about these phenomena. My account draws liberally from central themes of HLA Hart’s theory of state law that I deem applicable outside the domestic context. One key idea is the notion of normative order or unified complexes of interrelated rules that regulate specific domains of action. The refined Hartian view that I develop here distinguishes between two kinds of normative orders, sets and systems, which differ in their characteristic features and that allow for different doctrinal and moral inquiries. While these tools can be used to explain both state and non-state normative phenomena, I shall consider as law the normative orders of political communities, i.e. groups whose participants efficaciously employ intense forms of social pressure to secure conformity to norms that regulate pressing politico-moral issues. With these elements in place, the legal domain can be characterized as a constellation of sets and systems that constitute political communities at the state, non-domestic, international, supra-national, and potentially global levels. The argument proceeds as follows. Chapter 1 sets the stage of this inquiry. Chapter 2 explicates the key insights of the Hartian framework. Chapter 3 defends the applicability of this framework to non-state contexts. Chapter 4 illustrates its explanatory virtues by applying it to two regimes of international trade law. Snuw'uyulh: fostering an understanding of the Hul'qumi'num legal tradition

One cannot begin to understand the nature of Hul’qmi’num legal tradition without first acknowledging and understanding the relationship between culture and law. The Coast Salish people have a vibrant culture, influenced heavily by the nature of their relationships with their ancestors, their kin and their lands. These relationships permeate their legal tradition. Influencing not only regulatory aspects of law, but also dispute resolution processes. Trying to understand and appreciate this tradition outside of this worldview would be detrimental to the tradition itself, as I believe it would result in a transformation of the laws and practices. In thinking about the relationship between law and culture, this research has identified two fundamental categories of law within the Hul’qumi’num legal tradition: 1) snuw’uyulh and 2) family laws. Snuw’uyulh refers to a condition generated by the application of seven teachings: 1) Sts’lhnuts’amat (“Kinship/Family”); 2) Si’emstuhw (“Respect”); 3) Nu stl’I ch (“Love”); 4) Hw’uywulh (“Sharing/Support”); 5) Sh-tiiwun (“Responsibility”); 6) Thu’it (“Trust”); and 7) Mel’qt (“Forgiveness”). Accordingly, universal teachings seek to foster harmony, peacefulness, solidarity and kinship between all living beings and nature in the world. In a sense, snuw’uyulh is a state or condition and Hul’qumi’num legal tradition encompasses all the animating norms, customs and traditions that produce or maintain that state. As a result, Hul’qumi’num law functions as the device that produces or maintains the state of snuw’uyulh. There is another fundamental category of law present within the Hul’qumi’num world – family laws. Family laws encompass the norms, customs and traditions, or customary laws, which produce or maintain the state of snuw’uyulh. Law is a practice – an activity. Arguably, much of the practice of law takes places in the form of regulation and conflict and dispute resolution. Similar to how law cannot be separate from its surrounding culture, nor can the processes developed to resolve conflicts in the law. Since time immemorial the Hul’qumi’num Mustimuhw have utilized processes and practices to resolve conflicts and disputes both within their communities and with other communities in the Coast Salish world. Enkele voorstelle vir regshervorming word verskaf. / The purpose of the article is to ascertain which legal consequences follow when a "common law" marriage is dissolved. Firstly, the position in England is evaluated with specific reference to inheritance, family violence, a delictual action for loss of support, division of assets and minor children. Thereafter the position in Sweden is evaluated on the same basis. Lastly, the position in South Africa is discussed. It is concluded that participants to a common law marriage in South Africa do not enjoy the same protection as in most other Western countries. The Courts have given little assistance in this regard.
