The Factor of Human Rights in the Sino-US Relations

In 1989, the Tiananmen Square massacre shocked the world. Under the heavy pressure from Congress and the public opinion, the government of the United States, which regarded human rights as one of its most cherished values, was forced to reexamine its relations with the PRC and to pay more attention to the PRC¡¦s human rights issues. However, the Cliton administration chose to de-link the human rights issue from its consideration whether to give the PRC the MFN status. To Beijing, the human rights issue is only a tool in Washington¡¦s foreign policy. China regards human rights as its domestic affairs. It had always questioned Washington¡¦s purpose and motivation to intervene mainland China¡¦s domestic affairs. This thesis studies the factor of human rights in the U.S.-China relations. U.S. Congress used MFN as an annual check about China¡¦s human rights situation. Before 2000, U.S. Congress members had long time questioned the administration that grantee PNTR would lead to the destruction of China¡¦s motivation about human right improvement. The author intends to review the ¡§Human Right Report¡¨ in the period of Cliton¡¦s administration, trade relations, UN human right debate and bills. Besides, the progress of China¡¦s human rights situation will be evaluated in the thesis. Through the review of the human right factor in the Sino-US relations, we can find that how the strategy of human right been used by U.S. government. However, the human right issue still is one of the important factors which could affect the future Sino-US relations.

McLuhan「地球村」與聯合國「世界鄰居」概念所洞見出世界的新景象,可讓人覺察到各國日益綿密之聯結。此種快速發展、且彼此牽動的網路系統,在國際間思想和價值傳遞上的影響更是迅速於過往,當我們將台灣目前的教育人權置於此一脈絡下檢視,更可發覺在國際人權法典的普世價值下,是必然要面對與追尋的道路-本研究計畫企圖以教育人權的哲學和法性格論證為分析基礎,演繹國際人權法典的教育概念與保障,對照台灣的教育法保障,進而反思全球普遍性價值與台灣在地價值的轉化。本研究論文擬以六個章節進行,先就國內現況、教育法學需求與普世化內涵疑義作為研究問題意識,從教育人權的脈絡與理論基礎開始理解,詮釋國際人權法典中的教育涵義,進而比較台灣教育人權法制中的現況與轉化,以後兩者為分析的兩大軸線,綜合論證各層面之癥結問題。嘗試就教育哲學與教育法學的跨領域對話方式建構出人權教育實踐的整全面向。 / From the concepts of global village by M. McLuhan and our global neighborhood by UN, the connections of ideas and values between nations are closer than ever. Under the influence of globalize tendency, this research tries to take philosophy and jurisprudence of the right to education as basis, analyzes the educational concepts from the international bill of human rights and comprises to the education law in Taiwan. This research, contains six chapters, begins from the critics to universal human rights and present education law in Taiwan, following by the historical development and theories of the right to education, and then analyze to international bill of human rights which connect to education. Lastly, with the intercources between the educational philosophy and law, this study provides full ranges of stretigies in emplementing human right education.

L’accord d’association Algérie-Union Européenne, paraphé à Bruxelles le 19 décembre 2001 et entré en vigueur le 1er septembre 2005, fonde un partenariat en matière des droits de l’homme. Déclenché par la Déclaration de Barcelone du 27 et 28 novembre 1995, il fournit aujourd’hui le modèle le plus complet pour une meilleure mise en œuvre réelle et effective des droits de l’homme dans le cadre des accords d’associations. Inspiré, d’une politique euro-méditerranéenne qui a pour objectif la promotion et la protection des droits de l’homme, tel qu’énoncée dans la Déclaration universelle des droits de l’homme, inspire les politiques internes et internationales des parties et constitue un élément essentiel pour la mise en œuvre de l’accord d’association Algérie-UE. Y’a-t-il une réelle mise en œuvre de l’accord d’association Algérie-Union Européenne dans les perspectives du respect des droits de l’homme ? Et quels sont les moyens mis en place? / The Algerian-European association, signed on 19 December 2001 in Brussels and enforced on 1 September 2005, represents a partnership in terms of human rights. Sett off by the Barcelona Declaration of 27 & 28 November 1995, it nowadays serves as the best model for a genuine implementation of human rights in the field of assocation agreements. Inspired by Euro-Mediterranean policy whose objective is the promotion as well as protection of human rights, as stated in the universal declaration of human rights, it affects the parties, domestic and international policies and represents and essential element in the implementation of the Algerian-European association agreement. Is there a genuine implementation of the Algerian-European association agreement in the perspective of the respect of human rights? And what are the means used for that propose?
