266562.pdf: 706947 bytes, checksum: 67f2d0a21980a734299576c8e2ab7d4d (MD5) / O International Centre for Settlement of Investment Diputes (ICSID) corresponde a uma organização de direito internacional criada pela Convenção de Washington de 1965, a partir da idéia de proporcionar aos investidores e aos Estados hospedeiros do investimento um mecanismo confiável, neutro e eficaz para dirimir conflitos decorrentes de investimentos, e com isso proporcionar o aumento do fluxo investimentos para os países menos desenvolvidos e em desenvolvimento. O ICSID possui características peculiares como a admissão de pessoas físicas e jurídicas em demandas diretas contra um Estado, a obrigatoriedade de reconhecimento automático, pelos Estados Contratantes, dos laudos emitidos pelos tribunais arbitrais, possibilitando a execução direta da decisão, além do caráter autônomo e exclusivo em relação às legislações nacionais. A competência do centro, no entanto está ligada ao atendimento de três pré-requisitos, que juntos, determinam a jurisdição do centro para analisar as demandas que lhe são apresentadas, quais sejam, em relação à matéria, em relação às partes envolvidas e em relação ao consentimento expresso dessas partes de submeter o conflito às regras do centro. O consentimento das partes é tratado como um dos pré-requisitos mais importantes e fundamental para o sistema de solução de controvérsias, principalmente em se tratando do Estado, que além de ratificar o tratado, precisa aceitar a jurisdição especificamente, de forma expressa e por escrito. Neste sentido, o trabalho se propõe a analisar o consentimento de Estados Latino Americanos, que aderiram à Convenção de Washington, ante a evolução da interpretação do consentimento do Estado, considerando a jurisprudência que teve origem nos casos PIRÂMIDES e AAPL v. SRI LANKA. / The International Center for Settlement of Investment Disputes (ICSID) is an International Law organization created by the Washington Convention of 1965 with the idea of providing investors and the host of an investment a reliable, neutral and effective mechanism to solve conflicts arising from investments, and thereby providing an increasing of investment to the least developed and developing countries. The ICSID has peculiar characteristics such as the admission of individuals and companies in direct demands against a State, the requirement for recognition of the reports issued by arbitral tribunals by Contracting States, allowing the direct execution of the decision, and also the autonomous and unique character in relation to national laws. The center competency however is linked to three pre-conditions which together determine the jurisdiction of the center to examine the demands that are presented, in relation to the subject, to the parties and in relation to the consent of the parties to submit the conflict to the rules of the center. The consent of the parties is treated as one of the most important and fundamental pre-requisite to the system of settlement of disputes, especially in the case of the State, which in addition to ratify the treaty, must accept the jurisdiction specifically, expressly and in writing. The study aims to analyze the consent of Latin American States, which acceded to the Convention of Washington, faced with the evolution of the interpretation of the consent of the State, considering the case law that originated in Pyramid and AAPL v. SRI LANKA cases.
