Etika a etické kodexy v personální práci / Ethic and Codes of Ethics in Personnel Work

The goal of this thesis will be to analyze ethical tools in organizations and the breadth of application of ethical codes in personnel work. First, attention will be paid to ethics, morality and law, then to professional ethics and the anti-discrimination law. The work will further deal with ethics in the context of organizational culture, standards of conduct, codes of ethics and ethical aspects of individual personnel activities. The diploma thesis will include a quantitative survey, which will be carried out in the form of online questionnaires. The respondents will be HR professionals working in approximately thirty selected large organizations in the Czech Republic. The aim of the survey will be to analyze the application of codes of ethics in these organizations, ie the use of codes of ethics governing the activities of personnel departments, the existence of professional codes of ethics for HR professionals, the influence of organizational culture on the use of ethical tools. It focuses on the basic characteristics of these professions and especially their codes of ethics - Code of Ethics for Professional Accountants, Code of Ethics of the Chamber of Tax Advisers of the Czech Republic and the Code of Ethics of the Chamber of Ceritified Accountants. It also includes a comparison of these ethical codes. Finally, the results of the survey on the topic "Ethics and ethical codes of selected professions" are analyzed.

This work deals with professional ethical reflection and analysis of the code of ethics of social workers to join in the broader context of the social work profession and human rights principles. The introduction deals with disabilities, the basic concepts of ethics and social work with regard to the specifics of the social work profession and the requirements of professional social worker. Based on professional ethical reflection theoretical work also analyzes the document Code of Ethics of Social Workers of the Czech Republic in comparison with the International Social Work Code of Ethics and the Code of Charity Czech Republic with an emphasis on the interpretation of the principles of human rights and social justice. At the end of the work in relation to analysis tries to summarize the importance of criticism and also updated the Code of Conduct, including an indication of other possible paths to explore this issue.

CHARACTERISTICS AND ETHICS OF E-THERAPY WEBSITES WITH MARRIAGE AND FAMILY THERAPISTS

The current survey of 83 e-therapy websites with marriage and family therapists examined what consumers seeking online therapy or therapy over the phone might find on the Internet. The study explored how e-therapy websites characterize their services and comply with the ethical guidelines of the American Association for Marriage and Family Therapy. Furthermore, differences in compliance with ethical guidelines among the three types of the websites (individual practice websites, group practice websites, and independent contractor websites) were analyzed. Results indicated that a majority of the websites lack information regarding several major areas (e.g., crisis resources, terms of service, procedures to treatment of minors, procedures to provision of therapy across borders). In support of previous findings, compliance to ethical guidelines was low and uneven. The websites focused mostly on positive aspects of e-therapy and in some cases, used suggestive or misleading language. When the three groups were compared, the independent contractor websites demonstrated statistically significantly higher compliance than the other two groups. This study points out several disturbing patterns and calls for clear e-therapy guidelines, which are currently lacking.

Le code d'éthique dans les organisations du réseau de la santé: outil de régulation des conduites?

Au Québec, la Loi sur les services de santé et les services sociaux, Chapitre S-4.2, à son article 233, demande à ce que chacun des établissements de santé, dispose d’un code d’éthique qui essentiellement demande de préciser les droits des usagers et de fixer les conduites attendues du personnel. Le législateur souhaitait améliorer les conduites du personnel dès le début des années 1990 et envisageait désigner un organisme de surveillance pour s’en assurer. Cette contrainte ne fut pas retenue et 20 ans plus tard, la volonté d’assurer des conduites attendues n’est toujours pas assujettie de contraintes ou de contrôles même si elle est toujours souhaitée. En 2003 toutefois, le Ministre a mis en place un processus de visites ministérielles dans les milieux d’hébergement et à ce jour quelques 150 établissements ont été visités. Ces équipes se sont préoccupées entre autre de la fonction du code d’éthique pour soutenir les directions de ces établissements. Elles ne réussissent pas à pouvoir s’appuyer sur le code d’éthique pour qu’il soit l’assise pour baser les décisions cliniques, organisationnelles et de gestion de chacune des organisations du réseau de la santé et des services sociaux du Québec. Il faut à ce moment-ci faire le constat que le code d’éthique, obligatoire, figure au nombre des nombreuses contraintes rencontrées par les organisations. Les établissements doivent passer un processus d’agrément aux trois ans et le code d’éthique n’est pas davantage un élément dynamique retenu à ce processus de validation de normes de qualité. De plus, une revue québécoise spécialisée en gestion de la santé a consacré un numéro complet de 15 articles sur « éthique et comportements » et le code d’éthique y est absent sauf pour deux articles qui s’y attardent spécifiquement. Est-ce une question d’éthique dont il est question par ce code, ou si ce n’est pas davantage de la déontologie, d’autant que le législateur veut avant tout s’assurer de comportements adéquats de la part des employés et des autres personnes qui exercent leur profession. Est-ce qu’un code de conduite ne serait pas plus approprié pour atteindre les fins visées? Cette question est répondue dans ce mémoire qui regarde les concepts d’éthique, de déontologie, de codes, de régulation des comportements. De plus, des analyses détaillées de 35 codes d’éthique actuels de divers établissements et de diverses régions du Québec iv sont présentées. La littérature nous donne les conditions de réussite pour un code et outre l’importance à accorder aux valeurs énoncées dans l’organisation, il est également question des sanctions à prévoir au non-respect de ces valeurs. Elles se doivent d’être claires et appliquées. Enfin, beaucoup d’organisations parlent maintenant de code de conduite et ce terme serait tout à fait approprié pour rejoindre le souhait du législateur qui veut assurer des conduites irréprochables des employés et autres personnes qui y travaillent. C’est la conclusion de ce travail, énoncée sous forme de recommandation. / Quebec’s Health and Social Services Law, ch. S-4.2, art. 233, requires that every health institution have a code of ethics that, in essence, sets out the rights of patients and the manner in which staff are expected to conduct themselves. The legislator had hoped that improvements in the conduct of personnel would begin to be seen at the start of the 1990s, and wanted to set up a watchdog body to ensure that progress was made. In the end, no such body was created, and 20 years later, even though they are still very much wished for, constraints and controls over staff conduct remain sorely lacking. In 2003 the Minister of Health and Social Services began a series of official visits to hospitals which to date have covered 150 institutions, and in each of these visits the minister’s teams have, with the backing of the hospitals’ administrators, made a point of looking at how each institution’s code of ethics is working. The general consensus of administrators, however, is that no health institution in Quebec has been able to use the ethics code as a basis for making clinical, organizational or managerial decisions. On the contrary, having a mandatory ethics code is seen by many as a hindrance, one among many that the institutions have to deal with. Every three years each institution goes through a process of re-accreditation to ensure it complies with government standards of quality, but its ethics code is not considered an important and dynamic element in this re-evaluation. One example of this blind spot: When a Quebec periodical specializing in health-care management published a special issue on “ethics and behaviour,” only two of its 15 articles specifically mentioned the notion of a code of ethics. This raises the question: Is “ethics” too general a term? Given that the legislator’s goal is to ensure proper behaviour on the part of staff and others who exercise their profession in the institutions – in other words, a preoccupation with professional ethics – would it not be more appropriate to instead refer to a “code of conduct”? This question is addressed in this thesis, through an examination of the concepts of ethics, professional ethics, codes and regulation of behaviour. As well, a detailed analyses of 35 ethics codes in diverse institutions throughout Quebec is presented. The vi academic literature provides ways of measuring the success of a code of ethics, and besides the importance given to institutional values, there is also the question of sanctions to impose when those values are not respected. Values must be clear to be properly applied. Finally, many organizations now refer to “codes of conduct” – a highly appropriate term, given that the legislator’s goal is to ensure that the conduct of employees and other personnel in health establishments is beyond reproach. This, in fact, is my conclusion, spelled out in the form of a recommendation.

Etika překladatelské činnosti / Translation Ethics

The topic of this thesis is translation ethics. The theoretical part provides definitions of key concepts in the field of normative ethics, as well as an overview of the existing research into ethics in translation studies. Three possible ways of approaching this topic are presented and the main themes of translation ethics identified. The thesis then describes the history of codes of ethics with special attention to problems regarding these written ethical norms. With focus on their content, the thesis provides a detailed description of translators' individual rights and obligations, as defined in various codes of ethics, which deem a translator's behaviour ethical or unethical. The thesis also explores how translators can be affected by the unethical decisions of other people. The end of the theoretical part focuses on translation ethics in connection with CAT tools and machine translation. The empirical part analyses data collected through questionnaire research, the aim of which was to study translators' behaviour in ethically challenging situations. First, research methods and individual parts of the questionnaire are described. The thesis is concerned with the presence of news journalists and news institutions on social media sites. Mentioned modern technology had large effect on the development of the field as well as everyday journalistic routine. Social media not only brought brand new possibilities, it was also accompanied by modern age dilemmas and ethical conundrums that journalists have to face. Most of the Czech news institutions however still ignore the option of internal regulation via ethical code of any sorts which alienates them from the western media current praxis. In the sake of requiring information necessary to describe functioning of social media content production in Czech news media, the author carried out a qualitative research questioning members of social media departments of mentioned institutions. Based on the research, the thesis answers questions about personnel responsibilities in managing company social media profiles and introduces ethical codes and official internal rules they have to follow whereas the conclusion is that most of Czech news institution haven't implemented any of those yet.

Psychoanalytic parent-infant psychotherapy in South Africa : opening ports of entry and flexing the frame.

Parent-infant psychotherapy is a small but growing field in South Africa. Its potential to contribute to mental health services in South Africa is, by contrast, vast. This thesis contributes towards much-needed research on the state of the field in the country and its potential applications across different sectors. Drawing on Daniel Stern’s concept of ports of entry, it is argued that an expansion of ports of entry offers an important integrating tool through which different aspects of parent-infant psychotherapy can be examined and adapted to the South African context. A history of parent-infant psychotherapy in South Africa is offered, together with an analysis of the experiences of current practitioners in the field. These aspects of the thesis draw on interviews with key stakeholders. The dominant context of private practice is then explored through two case study based papers. The first explores the meaning of symptoms in parent-infant psychotherapy. The second introduces the ‘grandmaternal transference’ as an important but under developed port of entry. These different aspects of parent-infant psychotherapy in South Africa are then considered through the prism of ports of entry in order to argue for a flexing of the psychoanalytic frame. Implications for the growth of the parent-infant psychotherapy field in South Africa are considered.

[pt] O objetivo central dessa dissertação é analisar as concepções dos assistentes sociais acerca dos direitos humanos a partir dos princípios que os fundamentam no Código de Ética do Serviço Social e no Estatuto da Criança e do Adolescente. No intuito de alcançar este objetivo, realizei uma ampla pesquisa bibliográfica acerca das categorias de estudo e analisei alguns documentos normativos da profissão e dos direitos da criança e do adolescente. Utilizei ainda, como método de abordagem, a pesquisa qualitativa e a técnica de entrevista semi-estruturada, orientada por um roteiro contendo perguntas abertas, direcionadas aos assistentes sociais, que atuam em instituições na área da criança e do adolescente no Espírito Santo. O referencial teórico adotado foi o método crítico-dialético, o que possibilitou analisar os direitos humanos enquanto um processo contraditório e de luta entre as classes que compõem a sociedade. Através do embate entre as classes, em vários momentos históricos, a classe trabalhadora avançou no sentido de inserir nas leis os direitos coletivos; porém, o controle do Estado está nas mãos dos que precisam expandir o capital. Assim, os direitos não são materializados em sua plenitude. A partir deste estudo, indico a necessidade de os profissionais terem clareza crítica dos fundamentos e funcionalidades da realidade posta, permitindo, assim, observar de forma mais nítida a não- efetivação dos direitos das crianças e dos adolescentes, e ainda avançar, juntamente com a luta geral dos trabalhadores, na materialização do Código de Ética em prol de uma sociedade mais justa. / [en] This study aims mainly at analyzing the conceptions of social workers about human rights based on the principles on which they are founded in the Social Work Code of Ethics and the Brazilian Statute for Children and Adolescents. Intending to achieve this objective, I carried out and extensive bibliographical research about the categories of study and analyzed some normative documents about the profession and about the children and adolescents` rights. As approach method, I also used qualitative research and semi-structured interview technique, which was guided by a script containing open ended questions, addressed to social professionals working in children and adolescents institutions in Espírito Santo. The theoretical basis adopted was the critical-dialectic method, which allowed analyzing human rights and as a contradict and social class struggle process. Through class struggle in several historical moments, the working class advanced towards inserting collective rights into the law. However, the control of the State is in the hands of those who need to expand capital therefore, rights are not fully materialized. From this study, I point out that these professional should be clearly critical about the fundaments and functionality of the posed reality, allowing thus, observing more clearly the non exercise of children and adolescents` rights, and also advance, together with the working class general struggle, towards the materialization of the Code of Ethics, for a fairer society.
