Para a consecução deste estudo, optou-se em realizar uma pesquisa bibliográfica e documental nas Delegacias de Polícia existentes no município, onde 1.828 boletins de ocorrência foram consultados, totalizando 2.512 adolescentes, no período de 1999 a 2003. A partir desta pesquisa quantitativa, objetivou-se conhecer o perfil desses adolescentes, buscando identificar: número de boletins de ocorrência por delegacia, número de adolescentes envolvidos quanto a gênero, cor da pele, faixa estaria, situação familiar, procedência por região, grau de escolaridade, delitos mais cometidos, atividades ocupadas, destino dos boletins de ocorrência. Apurando os dados e analisados os resultados, é possível constatar que a opinião pública era sustentada por um mito. / This work tell a research that had per motivation the interest to analyse the profile of the infractor adolescents in the municipal district of Ourinhos and, specifically, to obtain answear to the hypothesis based in the popular knowledge than habitational group Orlando Quagliato would be the neighborhood more violent of the city ( or wold be that a myth? ) to the attainment this study, was chosen to realyse a research bibliographical and documental in the police stations there are in the municipal district, where 1.828 occurrence reports were consulted, totaled 2.512 adolescents, in the period of 1999 to 2003. Starting from this research quantitative and qualitative, aim at in to know the profile this youngs, looking for to identify: number of occurrence reports per police station, number of adolescents involved as the gender, color of skin, age group, familiar situation, origin per region, step of education, offenses more commited, activities occupied, destination of occurrence reports. Raising the facts and analyzing the resulted, is possible to confirm that the public opinion was sustained per a myth.

[pt] Esta dissertação tem como objetivo analisar a experiência desenvolvida num espaço de escuta oferecido dentro do Judiciário a jovens que cometeram ato infracional. Numa vida em meio à violência e à pobreza, como pensar em subjetividade nesse território? Como jovens marginalizados em sua condição e vistos como marginais podem existir numa cultura que os desloca? O que fazer com os jovens delinquentes? A psicanálise nos aponta que eu existo a partir do olhar do outro. A experiência nos indica que a busca por existir e ocupar um lugar na cultura passa, sim, pelo reconhecimento através do olhar do Outro, quando ele pode falar e ser escutado. Levando em consideração que o jovem que delinque pede ajuda, entendemos como importante que ele responsabilize-se pelo seu ato, o que implica mudança subjetiva, possível apenas através do discurso. / [en] The purpose of this dissertation is to present some preliminary results of an experience developed in a space/place within the Judiciary with the objective of listening to youngsters that committed a legal infraction. How can one reflect upon subjectivity in a territory where violence and poverty is commonplace? How can youngsters that are marginalized and perceived as outcasts exist in a society that avoids them? What is to be done with the young delinquents? Psychoanalysis states that To exist is to be seen. Experience suggests that existing and occupying a place in a particular society unquestionably involve the acknowledgement of the Other; acknowledged, an individual can speak and be heard. Since the youngster that breaks the law asks for help, we think it is important that he feels responsible for his actions, which implies a subjective change that is only possible by means of discourse.

A pesquisa servirá como manual para o Aconselhamento Psicológico Pastoral do Adolescente Infrator Interno com base no Estatuto da Criança e do Adolescente. A primeira parte aborda o antigo Código de Menores e suas restrições. Em seguida a inovação do Estatuto quanto a proteção integral do Adolescente, principalmente do infrator interno. A nova visão global e a intenção do legislador, avançada para o tempo em que foi lançado, para a defesa e a reeducação do infrator. O fato da proteção e prioridade integral do adolescente ser matéria constitucional e o Estatuto sua regulamentação. O aconselhamento psicológico pastoral do adolescente infrator interno com base na Constituição e no ECA que garantem seu direito à assistência religiosa. O aconselhamento psicológico pastoral sob o enfoque jurídico e a viabilidade de efetuá-lo. Algumas idéias de como aperfeiçoar esta arte de aconselhamento pelo amor, dedicação e vocação. Todos os envolvidos na reeducação do adolescente infrator, direta ou indiretamente, podem fazer a diferença. Evitar a construção de novos presídios e sua superlotação. É o que se almeja com o trabalho de aconselhamento psicológico pastoral. Há um forte enfoque jurídico da assistência religiosa como princípio Constitucional, regulamentado no Estatuto da Criança e do Adolescente e a maneira de realizá-la pelo Aconselhamento Psicológico Pastoral. / This paper will be useful as manual for the Pastoral Psychological Counseling of Internal Infractor Adolescents based on the Statute of the Child and the Adolescent (ECA). The first part approaches the old Juveniles Code and its restriction. Next the Statute innovation as for the adolescent full protection, mainly the internal infractor protection. The new global vision and the legislator intention improved to the time when it was launched, for the infractor defense and reeducation. The fact of the adolescent protection and full priority being constitutional topic and the Statute regulation. The pastoral psychological counseling of internal infractor adolescents based on the Constitution and on ECA that guarantee their right to religious assistance. The pastoral psychological counseling under juridical focus and the possibility of accomplishing it. Some ideas of how to improve this art of counseling by love, dedication, vocation. All the people involved on the infractor adolescent reeducation, directly or indirectly, can make a difference. Avoiding the building of new penitentiaries and its super filling. That is what is wanted with the work of pastoral psychological counseling. There is a strong juridical focus from the religious assistance, constitutional and regulated principle in the Statute of the Child and the Adolescent and the way of accomplishing it by the Pastoral Psychological Counseling.

It is a work out of the responsibility idea, that is understanding, by a lot of people, like a expected effect in the application and performing a social educative measure. For that we get opinions about the subject with the academics of the laws of the childhood and adolescence in the Brazil and with academics of the psychoanalyse, because it refer a subject surround with the Law and the Crime and can contribute with the criminology, precisely about the conception of a human being and the responsibility. Finally we promoted, from some practical experiences with the tennagers, a dialog between law and psichoanalytic, about the differents notions of responsability / Este estudo resulta de um trabalho junto a adolescentes autores de ato infracional, inseridos no sistema socioeducativo. Trata-se de uma investigação sobre a idéia de responsabilidade, que é entendida, por muitos, enquanto o efeito esperado na aplicação e cumprimento de uma medida socioeducativa. Para tanto, buscou-se opiniões a respeito do tema entre os teóricos do direito da infância e adolescência no Brasil e também da psicanálise, visto que essa última refere-se a um sujeito às voltas com a Lei e o Crime e pode, pois, colaborar com a criminologia, precisamente quanto a uma certa concepção de homem e de responsabilidade. Ao final, tentou-se promover, a partir de algumas experiências práticas com os jovens, um diálogo entre o direito e a psicanálise, acerca das diferentes noções de responsabilidade
