L'approche juridique du trouble mental / Legal approach of mental disorder

Les personnes atteintes de troubles mentaux, en tant que personnes dotées de la personnalité juridique, sont titulaires de droit. Les maladies mentales et déficiences intellectuelles ayant des incidences sur la perception de la réalité, la conscience et/ou les capacités intellectuelles de la personne, entraînent inévitablement des conséquences sur la capacité de vouloir ou de décider. Répondant à ce constat, le législateur a mis en place des mesures assurant la protection de la personne et de ses biens, tout en veillant à respecter son autonomie. Il existe également des dispositions favorisant l'autonomie des personnes handicapées mentales. En outre, l'altération du discernement de la personne a des répercussions sur les mécanismes de la responsabilité civile et pénale. Par ailleurs, en tant que personne vulnérable, la personne atteinte de troubles mentaux a besoin de protection. Au nom du principe du respect de la dignité, le Droit assure une protection particulière du corps et de la personne. Il encadre également les mesures d'hospitalisation sous contrainte nécessaires à la prise en charge du trouble mental. / The persons affected by mental disorders and illnesses, as persons given the legal personality, have rights. The mental illnesses and the intellectual deficiencies having incidences on the perception of the reality, the consciousness and/or the intellectual abilities of the person, entail inevitably consequences on the capacity to will or to decide. Taking this acknowledgement into consideration, the legislator has set up rules providing the protection of the person and of his goods, while respecting the person's autonomy. There are also legal provisions facilitating the autonomy of the disabled persons. Moreover, the change in judgment of the person has consequences on the person's civil and penal liability. Furthermore, as vulnerable person, the person affected by mental disorders and illnesses needs protection. In accordance with the principle of the respect of dignity, laws and regulations guarantee a specific protection of the body and of the person. Laws and regulations also cover the hospitalization under constraint required by the care of mental disorders.

Právní otázky ochrany zvukových záznamů hudebních děl / Legal issues of protection of sound recordings of musical compositions

In my diploma thesis i deal with legal aspects of the protection of sound recordings of musical compositions in the Czech Republic and the Russian Federation. In connection with the development of modern technoligies that facilitate access to copyright works, for example the internet, protection of copyright and rights related to copyright is becoming a very important and should be corresponding. The first chapter deals with the definition of the basic concepts of copyright. The second chapter focuses on the issue of copyright infringement and infringement of related rights in the Czech Republic and Russia. In the following section copyright's international treaties (TRIPS, ACTA and others) are analyzed and liabilities, which arise from them. The fourth chapter deals with the issue of enforcement of copyright. In the last chapter, I compare effectiveness of Czech and Russian legal norms for the protection of copyright, based on anonymous sociological research among university students relatively to the origin of audio recordings of musical compositions.

Another aim is to identify the reasons that lead elderly to attend sales events, or use the services of door-to-door seller. Next, I will try to make recommendations to public authorities and elderly how to prevent unfair trade practices. The thesis also deals with legal regulations, the demographic situation and development, and manipulation.

Právní ochrana spotřebitele se zaměřením na reklamu a regulaci užívání alkoholických nápojů / The legal protection of the consumer focused on regulation of alcoholic beverages advertising and usage

Thesis deals with problems in legal as well as non legal regulations of alcohol usage in Czech Republic. I analyse the development of laws and current version of legal regulations on alcohol availability for young people in Czech Republic. I compare the Czech legislative to legislative in other countries. I analyse different approach to alcohol drinking in varied societies. During work on the diploma thesis, the Czech government declared a prohibition on alcohol trade. I evaluate the Czech approach and compare this prohibition with prohibitions in other countries. Finally, I evaluate Czech regulations of alcohol advertisments, and describe several court decisions (and self-regulatory board decisions) in alcohol advertising. The aim of thesis is to find the positive and negative aspects of legal and non-legal regulations in individual countries and propose new solutions to current alcohol problems.

Die Dissertation befasst sich mit dem vergaberechtlichen Primärrechtsschutz unterhalb der EU-Schwellenwerte, welcher in der Praxis als nicht vorhanden bzw. als unterentwickelt bezeichnet werden muss. Dabei werden insbesondere die vom Freistaat Sachsen entwickelten Regelungen des § 9 SächsVergabeDVO untersucht, die in der Literatur vereinzelt als „Rechtsschutz light“ bekannt sind. Es werden Regelungslücken aufgezeigt sowie Verbesserungsmöglichkeiten für die sächsischen Regelungen vorgeschlagen. Für einen vollwertigen Rechtsschutz wäre aber eine Umsetzung auf Bundesebene notwendig und wünschenswert.

This thesis deals with the education of children after a separation of their parents. It focuses on the fact how the parents handle education of children even after such a difficult situation that all the family members have passed. The theoretical part is divided into five main chapters. This part focuses on family, education and family problems arising in connection with the disintegration of the family. The practical part of the thesis deals with the research itself. Interview and document analysis were chosen as the main research methods. Interview was conducted with parents with underage children. The interview was focused on coping of the situation in the family after the parents' separation, how separation of parents can impact the further development of minor children, child behavioral problems at school or at home. Subsequently, an evaluation of the above materials was made.

I choose this topic because I had the opportunity to live and study for several months on my study stay in Norway, so I was bold to use this opportunity to describe and to compare for us and especially for the lay public the controversial child protection system in Norway towards the CZ. As has already been shown, my main objective will be to describe and compare the two social protection systems mentioned above, her overall approach and the perception of the child and the family. The partial goals will then assess the performance and differences of the individual systems, the definition of approaches, methods and possibilities of working with families and especially with the child, while also focusing on the country's legislative arrangements, the competencies of staff at child protection bodies, cooperation with other authorities, or other factors influencing the current form of child protection. (in English): The diploma thesis examines the system of accompanying of foster families as a profession, which is done by the so called Key workers. The first part of the thesis focuses on foster care, its typology and the overview of foster care benefits. The accompanying system is presented in detail, including a legislative overview and the content of the foster care agreement. The theoretical part specifies the roles, prerequisites and working conditions of the Key workers and discusses the limits of this profession. The aim of the thesis is to find out how these workers evaluate the current system of accompaniment in selected organizations which are authorized to conclude foster care agreements in Prague and Central Bohemia. The empirical part includes research, analysis, and evaluation. Methodology of the research is qualitative and the data is collected by semi-structured interviews.

The present diploma thesis focuses on the reflective practice in the context of Social and Legal Protection of Children. The purpose of this work, which​'s ​design is empirical, is to respond the following research question: in what way the reflecting practice is applied by the social workers in the field of Social and Legal Protection of Children, what external resources can the social workers take advantage of and what obstacles are blocking their reflective practice. The research study part of this thesis aims to provide the description of the environment of the social work in this domain and, consequently, to define the term reflective practice for the research purposes. The following research is designed as a qualitative case study which identificates the forms of reflection used by the social female workers, its supportive factors as well as the restraining ones. In the final part of this thesis, based on the results of the case study, the recommendations for development of the reflective practice in the Social and Legal Protection of Children institutional departments are formulated.

The topic of my diploma thesis is - a social worker, life experience. In the text of the thesis I focused mainly on a social worker, on the social worker who does this work for the Child Social and Legal Protection Authority. In my diploma thesis, I elaborated five chapters on the basis of academic literature. The sixth chapter of my work deals with methodological research. In the first chapter I dealt with the history of social work. This chapter is included in my work due to the experience acquired from my practice. What social work looks like today is thanks to the history and the lessons taken from it. It is the basis for the further development of new experience for new social workers. In the second chapter, I focused on the aspects that are needed in order to become a social worker. What should be the prerequisites to be able to do this work, and what ethical rules should the worker follow. In the third chapter, I focus on a particular OSPOD worker, and on his most common job content. There I describe the job, which is the most demanding for the worker. The first contact with the child, social investigation and individual planning. The fourth and fifth chapters follow each other.
