Le Wisconsin et ses prisons : entre resocialisation et enfermement

La présente thèse étudie le développement du système carcéral moderne aux États-Unis en général et dans l’État du Wisconsin en particulier. Alors que, traditionnellement, l’administration pénitentiaire du Wisconsin n’a que rarement éveillé l’intérêt de la communauté scientifique nous démontrerons le rôle fondamental joué par l’État durant les années 1980 et 1990, celles du tout-carcéral. Pendant des années, le Wisconsin respecta son image de laboratoire de la démocratie acquise sous l’ère Roosevelt. Cependant, pour des raisons principalement politiques, des mesures de plus en plus punitives furent votées à partir du milieu des années 1970 qui eurent pour effet de voir émerger de nouvelles politiques pénales. L’approche resocialisante, connue sous le nom de Wisconsin Approach, allait laisser la place à une politique répressive dont une des représentations demeure les transferts de prisonniers vers d’autres États. Le Department of Corrections connut pendant des années un des taux d’incarcération les plus élevés du pays et fut à l’avant-garde, dès les années 1970, des philosophies conservatrices en matière de politique judiciaire. Cette étude se concentre sur l’évolution du DOC à cette période afin d’en évaluer les conséquences sur les institutions et de voir comment ces changements ont pu affecter le concept de démocratie qui se trouve au cœur du commonwealth, fondement philosophique de l’État du Wisconsin. Grâce à l’étude de documents officiels, d’articles de presse et de lettres de détenus que l’auteur a réunies pendant plusieurs années, une image de la pénitentiaire actuelle, jusque-là ignorée, sera ainsi présentée. Cette recherche se propose ainsi d’analyser les différents programmes et les politiques mises en œuvre par l’administration pénitentiaire, et que le DOC défend avec fierté. / This work examines the development of the modern prison in the United States focusing on the state of Wisconsin because of certain unique specificities. While the Wisconsin Department of Corrections has traditionally attracted little interest but we will present some evidence that its case is indeed significant in the context of the prison boom of the 1980s and 1990s. Politically, for many years, the state had been known as the «laboratory» for democracy. However, mostly because of political reasons mostly, increasingly severe measures were ratified in the mid seventies which overturned previous correctional policies and gave a new direction to penal philosophies in the state. The Wisconsin Approach to corrections would gradually disappear and the state became one of the first to implement out-of-state incarceration. The Department of Corrections (DOC) experienced one of the highest national rates of incarceration for many years, being, in the field of criminal policies, at the forefront of the conservative revolution starting in the 1970s. We will analyze the development of the DOC and see how this trend has affected the institutions and the concept of democracy at the heart of the commonwealth in Wisconsin. This work relies on official documents and on the letters of prisoners the author has received for many years, revealing a firsthand account of the reality of prisons today in Wisconsin. Thanks to these narratives, this study will attempt to evaluate the varied programs, policies and missions that the Wisconsin DOC is still proud to defend today.

Haute police, surveillance politique et contrôle social sous le Consulat et le Premier Empire (1799-1814) / "High police", political surveillance and socil control under the Consulate and the First Empire (1799-1814)

Au-delà des fantasmes persistants qui entourent la police napoléonienne et son ministre Fouché, aucune étude d'ensemble n'avait encore été consacrée à la «haute police» entre 1799 et 1814. La période du Consulat et de l'Empire est capitale. Elle voit en effet la naissance d'une «haute police», qui ne constitue pas une entité policière spécifique, mais une mission : assurer la survie de l'État et de son chef, par la mise à l'écart des individus perçus comme dangereux. Les «mesures de haute police» prennent une triple forme : surveillance préventive, détention sans jugement, et envoi en «surveillance spéciale» (résidence surveillée). Les discours des autorités justifient l'existence de ces mesures extrajudiciaires et extralégales par la mise en scène d'une menace présentée comme exceptionnelle, et par la nécessité de rassurer, stabiliser et unifier. La «haute police» prend alors une place centrale dans le processus de contrôle de l'esprit public et de renforcement du pouvoir. Napoléon occupe ainsi un rôle croissant dans le contrôle et l'orientation d'une action policière tout entière tournée vers la sauvegarde de sa propre personne. L'élaboration policière de critères de dangerosité en partie nouveaux, imbriquant contrôle politique et contrôle social, permet de construire une surveillance à l'intention panoptique. Cette recherche croise histoire des représentations et histoire «par le bas», au plus près du terrain. Elle remet en cause la vision verticale d'un régime policier, puisque la surveillance préventive s'appuie aussi sur une participation populaire, et que, d'autre part, son efficacité peut être nuancée, à l'échelle de l'Empire. / Beyond the enduring fantasies surrnunding the Napoleonic police and its Minister Fouché, no overall study had yet been devoted to the "high police" between 1799 and 1814. The period of the Consulate and the Empire is crucial, with the birth of a "high police", which did not consist in a specific police entity, but a mission: to ensure the survival of the State and its leader by removing individuals seen a dangerous. "High police measures" took three forms: preventive surveillance, detention without trial, and placing under "special surveillance" (house arrest). The authorities' speeches justified the existence of these extrajudicial and extra-legal measures by staging a threat - presented as exception. - and by introducing the need to reassure, stabilize and unify people. The "high police" then took a central place in the process of controlling the public mind and strengthening the power. Napoleon thus occupied an increasing role in the control and orientation of a police action entirely aiming at protecting his own person.The police development of partially new criteria on dangerousness, intertwining both political and social control, made it possible to build a surveillance with a panoptic purpose. This research combines history of representations and history "from below", studied at ground level. It challenges the vertical interpretation of a police regime, since preventive surveillance is also based on popular involvement, and its effectiveness can be qualified, on the scale of the Empire.

BACKGROUND. Substance use is a widespread phenomenon in prisons, with a numberous associated problems, for instance high incidence of infectious diseases, recidivism, poor physical and mental health and high costs of repressive measures, which still do not eradicate drug use in prison facilities. In 2016, the first addictologist was admitted to the prison system in Czechia. Two years later, 14 more table places were established. The thesis brings an overview at this period (2018 - 2021). AIMS. The aim of the thesis is to provide an information about starting and forming of specialized addiction services in prison seeting from the perspective of addictologists. The theoretical part of the thesis also presents the results of foreign research on the effectiveness of selected interventions and strategies and recommendations for good practice. RESEARCH QUESTIONS. The research questions address the experience of addictologists and are focused on four main areas: workplace formation, clientele, quality assurance and the impact of Covid-19 on the workplace. METHODS. To meet the aims, the method of semi-structured interviews with selected informants who entered prisons in 2018 was used along with document analysis. RESULTS. DISRUPTING THE PRISON-TO-PRISON PIPELINE: DOING RESTORATIVE IDENTITY WORK WITH OFFENDER-LABELED YOUTH

The purpose of this qualitative ethnographic study was to addresses how the existence of counterspaces influences the psychological well-being of offender-labeled youth transitioning back into society. A counterspace has been defined as a social setting where two or more individuals come together to challenge deficit notions. No longer is recidivism solely being placed on offender-labeled youth that reside within juvenile correctional facilities, therefore the need for innovative programs that help develop resistance narratives and promote reengagement with the educational system are needed. In this 12-week qualitative ethnographic study the two concepts of restorative practices and narrative identity work are blended together and reconceptualized to create something new Restorative Identity Work. From an ontological perspective, the educational experiences within the counterspace (Room 21) was shared utilizing a musical playlist. The playlist is used to provide a thick description of the 12-session leadership group that was designed to be a resource for offender-labeled youth to become eligible for the high school Student Council within the correctional facility. Through the use of journals, theme songs, restorative practices, and narrative identity work, offender-labeled youth gradually gained a deeper understanding of their role in social narratives. The leadership group resulted in six out of nine offender-labeled youth becoming members of the Student Council and fostered the development of resistance narratives for all nine students.

Orientador: Oswaldo Francisco de Almeida Júnior / Resumo: A ideia amplamente disseminada pela Ciência da Informação (CI) sobre a existência de uma suposta “Sociedade da Informação” – em que todos os jovens que nasceram nos últimos vinte anos, período em que houve o surgimento e popularização da internet, seriam membros de uma geração que sabe lidar facilmente com tecnologias – pode ser uma proposição bastante perniciosa à sociedade, tendo em vista que muitos grupos sociais aparentemente não fazem parte deste cenário. Um desses grupos é formado pelos jovens encarcerados, pois grande parte deles chega ao cárcere com graves carências vinculadas à estrutura familiar, à educação básica e ao letramento. Diante desse cenário, este estudo é norteado pelo problema acerca de como são as práticas informacionais dos jovens encarcerados no Centro de Detenção Provisória de Serra Azul, no que se refere à mediação e à apropriação dos dispositivos informacionais. Radikalizace ve věznicích: Přístupy k problematice / Radicalization in Prison: Approaching the Issue

In recent years Europe experienced several terrorist attacks on its soil. Some of these were committed by Jihadists radicalised in prisons. An issue already identified by scholars has thus become publicly known and attracted attention of policy makers. The combination of Islamic propaganda with jails imprisoning substantial amount of vulnerable inmates and incarceration of returning foreign fighters create a mixture threatening to produce more violent extremists. The aim of this thesis is to describe how Germany approaches the issue and connect its solution with existing radicalisation models and prison regime concepts. Because of the federal structure of Germany, this description is based on analysis of three levels: institutional analysis of the German framework (macro); comparison of state projects tackling the issue (meso); and a case study of practitioners of one federal state (micro). The thesis comes to a conclusion, that the German strategy is strongly decentralised, still not in its final form, applies the concept of dynamic security as its prison regime and approaches the issue from a holistic perspective, involving also non-state actors and other areas of radicalisation.

The thesis Prison Privatization in the United States: The Limits and Consequences of the Transfer of Public Power into Private Hands analyzes selected consequences of prison privatization in the United States. Although the prison privatization in the US is considered a modern phenomenon, the private sector was involved in corrections from the very early history of the US. Therefore, the thesis introduces the history and philosophy of private sector involvement in corrections. The thesis then examines the factors that led to the decision to privatize prisons, namely overcrowding of prisons, other political factors, and so-called PIE-program that enabled interstate trade with prisoner-made goods. Further, it provides detailed statistics to illustrate the steep rise in the prison population. It also addresses the question of cost-savings and efficiency and it provides examples of specific factors that influence economic performance of private prisons. Important part is dedicated to the growth of prison-industrial complex characterized by the overlapping interests of bureaucracy, politicians and private prison companies that lead to increased pressure to maintain or increase the prison population. The aim of this qualitative study is to investigate correctional officers’ perception of themeaning of manliness for inmates in a swedish high security prison, and how gender plays arole when working close to inmates. The study also explores how the officer’s own genderplays a role in their interactions with the inmates. Data from seven interviews withcorrectional officers has been analyzed using three concepts from different gender theories -the ‘hegemonic masculinity’ and ‘subordinated masculinity’ concepts by Connell(1995/2008), as well as the concept of ‘hypermasculinity’ by Toch (1998). The researchshows that correctional officers believe that a hypemasculine ideal is important amonginmates. The perception was that hegemonic qualities result in a higher status and position inthe prison’s hierarchical structure, while subordinated characteristics result in a lower rank.However, the meaning of manliness greatly varied depending on the situation and socialsettings. Officers adapted different strategies when dealing with the inmates’ expressions ofmanliness and the study demonstrates that an interaction between an inmate and acorrectional officer is influenced by the officer’s gender.

A Restorative Environmental Justice for the Prison Industrial Complex: a Transformative Feminist Theory of Justice

This dissertation provides a feminist restorative model of environmental justice that addresses the injustices found within UNICOR’s e-waste recycling operations. A feminist restorative environmental justice challenges the presupposition that grassroots efforts, law and policy, medical and scientific research, and theoretical pursuits (alone or in conjunction) are sufficient to address the emotional and relational harm of environmental injustices. To eliminate environmental harms, this model uses collaborative dialogue for interested parties to prevent environmental harm. To encourage participation, a feminist restorative model accepts many forms of knowledge and truth as ‘legitimate’ and offers an opportunity for women to share how their personal experiences of love, violence, and caring differ from men and other women and connect to larger social practices. This method of environmental justice offers opportunities for repair, reparation and reintegration that can transform perspectives on criminality, dangerous practices and structures in the PIC, and all persons who share in a restorative encounter.
