O uso de medidas antidumping como mecanismo de barreira à entrada no mercado brasileiro / The use of antidumping measures as entry barrier mechanism in the Brazilian market.

As medidas antidumping são uma exceção ao livre comércio e como tal deveriam ser usadas com restrição. No entanto, desde o GATT 1947 há preocupação com o uso abusivo de tais medidas, podendo ser o mecanismo utilizado não apenas para possibilitar a recuperação da indústria doméstica prejudicada pelas importações objeto de dumping, objetivo do Acordo Antidumping (AAD), mas com o fim de proteger a indústria nacional da concorrência estrangeira. Desta forma, o objetivo do presente trabalho é apresentar as principais características do AAD firmado ao final da Rodada Uruguai que culminou na constituição da Organização Mundial do Comércio (OMC), incluindo seus antecedentes históricos e a possibilidade de aplicação discricionária, demonstrando como uma norma surgida no plano internacional em decorrência de um acordo multilateral vem sendo utilizada pelo Brasil, com a finalidade de se demonstrar a possibilidade de uso das medidas antidumping como barreira à entrada no mercado brasileiro. Confirmada a possibilidade de uso abusivo desse instrumento de defesa comercial, ainda que no plano teórico, uma vez que não é possível analisar os efeitos reais das medidas aplicadas, serão apresentadas as formas de contrabalanço ao protecionismo atualmente existentes no próprio AAD e sua incorporação e utilização pelo Brasil bem como a possibilidade de questionamento de tais medidas como práticas anticompetitivas com fundamento na legislação antitruste perante as autoridades de defesa da concorrência. Serão ainda analisadas outras possibilidades de contrabalanço ao uso exacerbado das medidas antidumping em debate e viabilidade das mesmas no cenário atual em que se verifica, de um lado, o aumento de uso de tais medidas pelos países Membros da OMC, destacando-se o Brasil e, de outro lado, impasse nas negociações multilaterais, cabendo aos Membros tomarem decisões unilaterais sobre a aplicação de tais medidas, seu grau de intensidade e forma de aplicação a depender da proteção que se pretende garantir à indústria nacional. / Antidumping measures are an exception to the free trade and as such they should be used with restrictions. However, since GATT 1947 there is a concern regarding the abuse in the use of such measures, being possible the use of the instrument not only to make possible the recovery of the domestic industry that was injured by the dumped imports, purpose of the Antidumping Agreement (ADA), but also with the purpose of protecting the domestic industry of the foreign competition. Thus, the purpose of this Masters Thesis is to present the main aspects of the ADA signed as a result of the Uruguay Round, that led to the establishment of the World Trade Organization (WTO), including its historical background and the possibility of discretionary application, being demonstrated how a rule emerged in an international level as part of a multilateral agreement has been used by Brazil. The purpose is to demonstrate the possibility of the use of the antidumping measures as a barrier to entry in the Brazilian market. Being confirmed the possibility of the abusive use of this trade defense instrument, even if only in theory, since it is not possible to analyze the actual impacts of the applied measures, it will be present the possibilities to counterbalance the protectionism that are established in the ADA, namely the public interest clause and the lesser duty rule, and their adoption and use by Brazil and possibility of challenging such measures as anticompetitive practices based on the antitrust law before the Brazilian Antitrust Authority. Additional possibilities under debate and their feasibility to counterbalance the abuse in the use of the antidumping measures will also be analyzed in the actual scenario where, on one hand, there is the increase of such measures by WTO Members in general and mainly Brazil and, on the other hand, there is an impasse in the multilateral negotiations. The Members will have to unilaterally decide on the implementation of such measures, the level of its intensity and form of application depending on the intended protection to ensure the domestic industry.

O trabalho trata do interesse público nas sociedades de economia mista enquanto tipo societário que agrega participação estatal e privada em seu capital social, e que se constitui em instrumento do Estado para a implementação de políticas públicas. Analisa os elementos que as caracterizam e os problemas internos e externos que delas decorrem, buscando demonstrar que toda sua estrutura gravita em torno do interesse público que lhes dá causa. Em um segundo momento, percorre os meandros da expressão interesse público, investigando seus aspectos ideológicos e a compreensão do conceito no decorrer da evolução histórico-cultural do pensamento jurídico-político. Assegura que sua essência de conceito jurídico indeterminado não retira a possibilidade de sua melhor aplicação a cada caso concreto, tendo em vista que seu núcleo permanece aberto à realidade. Entende que, com a instituição do Estado Democrático de Direito pela Constituição Federal de 1988, que erigiu a dignidade da pessoa humana como princípio fundamental da ordem econômicasocial, o interesse público passou a constituir uma forma de garantir a satisfação dos interesses privados, pelo que não se pode incorrer no erro de afirmar que o interesse público coloca em risco os direitos fundamentais, conferindo à expressão um caráter autoritário que, em verdade, ela não contém. Aduz sobre a propalada idéia de supremacia do interesse público sobre o interesse privado, não contemplada explicitamente pelo texto constitucional, mas amplamente admitida pelo Direito Administrativo como princípio que consagra uma finalidade imperativa e indisponível da Administração e de seus agentes. Apresenta o embate atual na doutrina brasileira entre a corrente de juristas que propugna pela reconstrução do princípio da supremacia do interesse público, com base na nova roupagem que lhe foi conferida pela Constituição Federal, de garantidor dos direitos fundamentais, frente à corrente que defende a desconstrução do princípio que, a seu ver, colocaria em risco os interesses privados, o que demandaria um juízo de ponderação entre os interesses conflitantes. Em seguida, passa a analisar o interesse público como elemento fundamental da atividade estatal e combate que a participação do Estado na exploração direta de atividade econômica tenha caráter subsidiário; o Estado não só pode, como deve intervir no domínio econômico, visando assegurar o melhor interesse público a ser realizado. Em sua parte final, o trabalho traz, especificamente, a compreensão do interesse público nas sociedades de economia mista com base nas questões clássicas que derivam da atuação do Estado em um contexto macroeconômico, sob a perspectiva do poder de controle, da função social da empresa, do lucro e da concorrência. Conclui que o interesse público nas sociedades de economia mista se confunde com sua própria finalidade e deve ser compreendido tanto como elemento que norteia todos os aspectos de sua constituição, tanto como elemento que direciona a atuação estatal na atividade econômica. / The paper discusses the public interest in joint ventures as a type of company that combines state and private participation in its capital stock, and that it constitutes in an instrument of the State for the implementation of public policies. It analyzes the elements that characterize them and the internal and external problems resulting thereon, seeking to demonstrate that their whole structure revolves around the public interest that gives them rise. Then it goes through the intricacies of the term public interest by investigating its ideological aspects and understanding the concept in the course of historical and cultural evolution of the legal and political thought. It ensures that its essence of indeterminate legal concept does not remove the possibility of its best application in each specific case, given that its core remains open to reality. It considers that, with the establishment of the Democratic Rule-of-law State by the Federal Constitution of 1988, that raised the human dignity as a fundamental principle of social-economic order, public interest began to be a way to ensure satisfaction of private interests, by that you cannot make the mistake of asserting that the public interest endangers the fundamental rights, giving the expression an authoritarian character that, in fact, it does not have. It brings forward the divulged idea about supremacy of the public interest over the private interest, not covered explicitly by the Constitution, but widely accepted by the Administrative Law as the principle that elects a mandatory and unavailable purpose of the Administration and its agents. It presents the current resistance in Brazilian doctrine between the jurists current who advocates the reconstruction of the public interest supremacy principle, based on the new look given to it by the Federal Constitution, of guarantor of fundamental rights, and the current that defends the deconstruction of the principle that, in their opinion, endanger the private interests, which would require a court to deliberate between conflicting interests. Then it analyzes the public interest as a fundamental element of the state activity and it combats that the States participation in the direct exploitation of economic activity has subsidiary nature; the State not only may, but must intervene in the economic order, in order to ensure the best interest public. In its final part, this paper brings, specifically, the understanding of the public interest in joint ventures based on the classic questions that arise from the actions of the State in a macroeconomic context, from the perspective of controlling power, companys social function, profit and competition. Its conclusion is that the public interest in joint ventures is confounded with its own purpose and should be understood both as an element that guides all aspects of its constitution, and as an element that directs the State action in economic activity.

This work aims to demonstrate the unsustainability of this paradigm of thoughtless procedural resistance, revealing the fragility of its theoretical foundations and the increasing adverse effects of its practice. It will be demonstrated that, often, it is not the judicial contesting that performs the best public interest. There will be a particular analysis of how certain bureaucratic disfunctions have been functioned as an instrument of manutency of the traditional profile of public advocates's performance. Design/Build in Architectural Education: studying community-focused curriculum

Design/Build education in architecture schools is growing in popularity across North America. I have researched the development of this movement, particularly as it has influenced educational programs. This paper begins with a review of the history of design/build at the University level. These historical precedents chart the course of several major benchmarks that have influenced design/build in the United States over the past 100 years. The second part of the study features a matrix highlighting seven current academic programs with long-term success in design/build. Then, I highlight my own design/build experiences within this format. After determining successful design/build programming, I used this information to develop a new curriculum. To test this new system, I led the development and realization of a local design/build project involving a Five College undergraduate team. This small-scale project was chosen in January and the physical build occurred in March, 2015. Completion of this project allowed for a critical analysis of this new method. This paper compares my results with the initial definition of program successes in an attempt to determine best practices for design/build curriculum moving forward.

Basic related terms such as ownership, property, a building, public works etc. are defined in the first part. The second part deals with the historic development of expropriation. The third part discusses the purposes and aims of expropriation, the term “public interest” and harmony of the aims and tasks of zoning. A special part is devoted to the expropriating proceedings, the principles of the expropriating proceedings, the participants of the proceedings etc. The last part deals with the possibility of expropriation for the purpose of construction of traffic infrastructure and the specifics related to this issue.

First are analyzed the basic related concepts of this thesis, the continuence of expropriation process and historical background of expropriation. Attention is also paid to the protection and limitation of proprietary rights. The second part deals with expert activity and status in the expropriation process. The final part of the thesis is a purely practical one. The content is related to the creation of a practice expert judgement for expropriation purpose, from which describe its structure.

Public interest litigation as practised by South African human rights NGOs : any lessons for Ethiopia?

"It is against this backdrop of unsatisfacotry enforcement of fundamental human rights enshrined in the Constitution that the role of human rights NGOs in Ethiopia should come to the fore. Thus, apart from monitoring violations and conducting legal awareness programs, there is a need for human rights NGOs in Ethiopia to engage in public interest litigation with a view to facilitating the judical enforcement of fundamental rights representing those who, for various reasons, can not access courts. A number of reasons could be provided to justify why the South African system has been chosen for a lesson to Ethiopia. One reason could be the legal framework put in place to address issues of acces to justice in South Africa. Standing is a crucial question in any venture of public interest litigation. Section 38(d) of the South African Constitution entitles anyone acting in the public interest to approach a competent court and seek remedies when they feel that a fundamental right is infringed or threatened. This very liberal approach to standing is not common in many legal systems. For countries like Ethiopia where there is an extremely tight requirement of standing to institute civil proceedings in courts, such a liberal approach could be an inspiration. In addition to the guarantees given by the Constitution, in South Africa there exists a relatively advanced and dynamic system of subsidiary legislation that could facilitate the full utilisation of the constitutionally recognised rights of access to justice. More relevant to this dissertation are the human rights NGOs in South Africa that are engaged in human rights lawyering in general and public interest litigation in particular. Much could be learnt from the experiences of prominent human rights NGOs such as the Legal Resources Centre and Lawyers for Human Rights. In all, Ethiopia, where the activities of human rights NGOs have not yet gone further than the monitoring of violations and fragmented attempts of awareness raising campaigns, could indeed draw lessons from the South African experience in this regard. ... The study has five chapters. The first chapter deals with introductory matters such as objective, methodology and literature survey. In the second chapter, a working definition of the concept of public interest litigation, the rationale behind it, issues such as access to justice and locus standi will be discussed. The third chapter is devoted to the analysis of public interest litigation as employed in different legal systems. With a view to providing a broad perspective to the practice the cases of France, the United States and Canada are presented. However, the chapter will focus more on the Indian and South African systems, mainly because of the nature of the problems public interest litigation addresses in the two countries. There will be a fourth chapter dedicated to the examination of the existing legal and institutional framework in Ethiopia in light of the background presented in the previous chapters. The goal of this thesis is to examine the term of public interest within the framework of the 'shale gas' issue in the Czech Republic. The theoretical section is divided into two basic parts. The first part defines the term public interest from the point of view of political science, sociology and economy. The second one describes the issue of shale gas extraction in global context. The examination is focused on the context of administrative procedures defining the prospecting exploration area of unconventional hydrocarbon resources in the Trutnov region and around the Berounka River The intention of private companies to extract shale gas in the Czech Republic caused a big discussion. In its core there is the dispute between the economic development of the country connected with energy security on one hand and the environment protection on the other. Within this debate the term public interest appears in many different contexts. The way it is used by the people involved and their interests are described through interviews with them and analysis of the gained material.
