Defining environmental justice in the context of investment arbitration is a challenge. This question arises primarily in circumstances in which foreign investment has an actual or potential impact on the host state population's health, environment, or socio-cultural values. Under normal circumstances, the right of access to justice should be guaranteed by the law and the justice system of the host state. However, the right of access to justice declines when the controversy is taken to investment arbitration.  While the problem of environmental protection has been addressed in ISDS from the State perspective and its power to regulate, the rights of non-disputing parties and their legitimacy have been relegated. Awards in investment arbitration qualify as environmental decisions. Therefore, more than the traditional approach to Amicus participation in dispute resolution proceedings is needed under the perspective of procedural environmental rights recognised under several international environmental law instruments. This includes the scope of access to the information generated within the arbitration procedure, which should be available proactively and the possibility of remedies when there is a breach of environmental obligations of the investor who brings up its claim in the Investor-State Dispute Settlement system. To address this issue, developing a new model that considers environmental justice as part of investment arbitration is needed to achieve greater consistency and procedural certainty while safeguarding access to environmental justice.

The sub judice rule is a media law practice that is currently often in the spotlight. Editors and journalists are constantly furiously speaking out against this rule that limits their freedom of expression in an attempt to assure the accused's fair and proper trial. Practitioners of the law, on the other side, say the sub judice rule is indispensable to the proper administration of justice. The rule, which much prevents the media from interfering with a pending case, causes confusion under journalists, as it is not consistently applied. Judges often warn the media against the violation of the rule during a high profile case, but those who do break the rule are not charged with contempt of the court. The aim of this study is to determine how Beeld, the Afrikaans daily newspaper, applies the sub judice rule in his reporting. The way in which this leading paper handles the rule is of importance to other journalists as well as the readers. The origin, development and function of the rule are also examined. It was established that Beeld did not contravene the sub judice rule as unceremoniously as a few other newspapers. Beelds violations of the rule were different experts' nuanced interpretations thereof. O uso de medidas antidumping como mecanismo de barreira à entrada no mercado brasileiro / The use of antidumping measures as entry barrier mechanism in the Brazilian market.

As medidas antidumping são uma exceção ao livre comércio e como tal deveriam ser usadas com restrição. No entanto, desde o GATT 1947 há preocupação com o uso abusivo de tais medidas, podendo ser o mecanismo utilizado não apenas para possibilitar a recuperação da indústria doméstica prejudicada pelas importações objeto de dumping, objetivo do Acordo Antidumping (AAD), mas com o fim de proteger a indústria nacional da concorrência estrangeira. Desta forma, o objetivo do presente trabalho é apresentar as principais características do AAD firmado ao final da Rodada Uruguai que culminou na constituição da Organização Mundial do Comércio (OMC), incluindo seus antecedentes históricos e a possibilidade de aplicação discricionária, demonstrando como uma norma surgida no plano internacional em decorrência de um acordo multilateral vem sendo utilizada pelo Brasil, com a finalidade de se demonstrar a possibilidade de uso das medidas antidumping como barreira à entrada no mercado brasileiro. Confirmada a possibilidade de uso abusivo desse instrumento de defesa comercial, ainda que no plano teórico, uma vez que não é possível analisar os efeitos reais das medidas aplicadas, serão apresentadas as formas de contrabalanço ao protecionismo atualmente existentes no próprio AAD e sua incorporação e utilização pelo Brasil bem como a possibilidade de questionamento de tais medidas como práticas anticompetitivas com fundamento na legislação antitruste perante as autoridades de defesa da concorrência. Serão ainda analisadas outras possibilidades de contrabalanço ao uso exacerbado das medidas antidumping em debate e viabilidade das mesmas no cenário atual em que se verifica, de um lado, o aumento de uso de tais medidas pelos países Membros da OMC, destacando-se o Brasil e, de outro lado, impasse nas negociações multilaterais, cabendo aos Membros tomarem decisões unilaterais sobre a aplicação de tais medidas, seu grau de intensidade e forma de aplicação a depender da proteção que se pretende garantir à indústria nacional. / Antidumping measures are an exception to the free trade and as such they should be used with restrictions. However, since GATT 1947 there is a concern regarding the abuse in the use of such measures, being possible the use of the instrument not only to make possible the recovery of the domestic industry that was injured by the dumped imports, purpose of the Antidumping Agreement (ADA), but also with the purpose of protecting the domestic industry of the foreign competition. Thus, the purpose of this Masters Thesis is to present the main aspects of the ADA signed as a result of the Uruguay Round, that led to the establishment of the World Trade Organization (WTO), including its historical background and the possibility of discretionary application, being demonstrated how a rule emerged in an international level as part of a multilateral agreement has been used by Brazil. The purpose is to demonstrate the possibility of the use of the antidumping measures as a barrier to entry in the Brazilian market. Being confirmed the possibility of the abusive use of this trade defense instrument, even if only in theory, since it is not possible to analyze the actual impacts of the applied measures, it will be present the possibilities to counterbalance the protectionism that are established in the ADA, namely the public interest clause and the lesser duty rule, and their adoption and use by Brazil and possibility of challenging such measures as anticompetitive practices based on the antitrust law before the Brazilian Antitrust Authority. Additional possibilities under debate and their feasibility to counterbalance the abuse in the use of the antidumping measures will also be analyzed in the actual scenario where, on one hand, there is the increase of such measures by WTO Members in general and mainly Brazil and, on the other hand, there is an impasse in the multilateral negotiations. The Members will have to unilaterally decide on the implementation of such measures, the level of its intensity and form of application depending on the intended protection to ensure the domestic industry.

O trabalho trata do interesse público nas sociedades de economia mista enquanto tipo societário que agrega participação estatal e privada em seu capital social, e que se constitui em instrumento do Estado para a implementação de políticas públicas. Analisa os elementos que as caracterizam e os problemas internos e externos que delas decorrem, buscando demonstrar que toda sua estrutura gravita em torno do interesse público que lhes dá causa. Em um segundo momento, percorre os meandros da expressão interesse público, investigando seus aspectos ideológicos e a compreensão do conceito no decorrer da evolução histórico-cultural do pensamento jurídico-político. Assegura que sua essência de conceito jurídico indeterminado não retira a possibilidade de sua melhor aplicação a cada caso concreto, tendo em vista que seu núcleo permanece aberto à realidade. Entende que, com a instituição do Estado Democrático de Direito pela Constituição Federal de 1988, que erigiu a dignidade da pessoa humana como princípio fundamental da ordem econômicasocial, o interesse público passou a constituir uma forma de garantir a satisfação dos interesses privados, pelo que não se pode incorrer no erro de afirmar que o interesse público coloca em risco os direitos fundamentais, conferindo à expressão um caráter autoritário que, em verdade, ela não contém. Aduz sobre a propalada idéia de supremacia do interesse público sobre o interesse privado, não contemplada explicitamente pelo texto constitucional, mas amplamente admitida pelo Direito Administrativo como princípio que consagra uma finalidade imperativa e indisponível da Administração e de seus agentes. Apresenta o embate atual na doutrina brasileira entre a corrente de juristas que propugna pela reconstrução do princípio da supremacia do interesse público, com base na nova roupagem que lhe foi conferida pela Constituição Federal, de garantidor dos direitos fundamentais, frente à corrente que defende a desconstrução do princípio que, a seu ver, colocaria em risco os interesses privados, o que demandaria um juízo de ponderação entre os interesses conflitantes. Em seguida, passa a analisar o interesse público como elemento fundamental da atividade estatal e combate que a participação do Estado na exploração direta de atividade econômica tenha caráter subsidiário; o Estado não só pode, como deve intervir no domínio econômico, visando assegurar o melhor interesse público a ser realizado. Em sua parte final, o trabalho traz, especificamente, a compreensão do interesse público nas sociedades de economia mista com base nas questões clássicas que derivam da atuação do Estado em um contexto macroeconômico, sob a perspectiva do poder de controle, da função social da empresa, do lucro e da concorrência. Conclui que o interesse público nas sociedades de economia mista se confunde com sua própria finalidade e deve ser compreendido tanto como elemento que norteia todos os aspectos de sua constituição, tanto como elemento que direciona a atuação estatal na atividade econômica. / The paper discusses the public interest in joint ventures as a type of company that combines state and private participation in its capital stock, and that it constitutes in an instrument of the State for the implementation of public policies. It analyzes the elements that characterize them and the internal and external problems resulting thereon, seeking to demonstrate that their whole structure revolves around the public interest that gives them rise. Then it goes through the intricacies of the term public interest by investigating its ideological aspects and understanding the concept in the course of historical and cultural evolution of the legal and political thought. It ensures that its essence of indeterminate legal concept does not remove the possibility of its best application in each specific case, given that its core remains open to reality. It considers that, with the establishment of the Democratic Rule-of-law State by the Federal Constitution of 1988, that raised the human dignity as a fundamental principle of social-economic order, public interest began to be a way to ensure satisfaction of private interests, by that you cannot make the mistake of asserting that the public interest endangers the fundamental rights, giving the expression an authoritarian character that, in fact, it does not have. It brings forward the divulged idea about supremacy of the public interest over the private interest, not covered explicitly by the Constitution, but widely accepted by the Administrative Law as the principle that elects a mandatory and unavailable purpose of the Administration and its agents. It presents the current resistance in Brazilian doctrine between the jurists current who advocates the reconstruction of the public interest supremacy principle, based on the new look given to it by the Federal Constitution, of guarantor of fundamental rights, and the current that defends the deconstruction of the principle that, in their opinion, endanger the private interests, which would require a court to deliberate between conflicting interests. Then it analyzes the public interest as a fundamental element of the state activity and it combats that the States participation in the direct exploitation of economic activity has subsidiary nature; the State not only may, but must intervene in the economic order, in order to ensure the best interest public. In its final part, this paper brings, specifically, the understanding of the public interest in joint ventures based on the classic questions that arise from the actions of the State in a macroeconomic context, from the perspective of controlling power, companys social function, profit and competition. Its conclusion is that the public interest in joint ventures is confounded with its own purpose and should be understood both as an element that guides all aspects of its constitution, and as an element that directs the State action in economic activity.

The first chapter focuses on the study of the constitutional right of freedom in the private and public rights, especially in civil procedure. We identify the historical basis that originated the dichotomy between private and public rights. We observe that this distinction does not show up in specific studies, but have rather been repeated without a consistent basis to support it. We show that in a Democratic Legal Estate there is no reason to separate legal branches to the point that one constitutional right - of freedom - gets two different interpretations, one if public right is concerned and a different one if private right is concerned. We present the procedural contract as a juridical experience in the second chapter, in which we propose its study from the concepts of legal situation and legal relationship and from a caused fact. We present the structure and the essential elements of the procedural contract and identify it as a way the parties can create rules concerning the procedure. In the last chapter we study the role of the judge towards the procedural contract. We propose a constitutional and philosophical focus, adequate to the activity of controlling the procedural contract and we also present some peculiarities of the institute / Dividido em três capítulos, este trabalho pretende analisar o negócio jurídico processual à luz da garantia fundamental à liberdade a partir do paradigma pós-positivista. O primeiro capítulo traz as leituras do direito fundamental à liberdade nos ambientes de direito privado e de direito público, em especial o processo civil. Identificamos as bases históricas da elaboração de dicotomia entre direito público e privado. Observamos que tal distinção não aparece com clareza entre os estudiosos do tema, tendo sido repetida sem fundamentos consistentes que a suportem. Mostramos inexistir razão para no Estado Democrático de Direito pretender a separação dos ramos do direito a ponto de atribuir opostas interpretações a uma mesma garantia constitucional – à liberdade – conforme se transite no direito público ou privado. O negócio jurídico processual como experiência jurídica é tema do segundo capítulo, em que propomos o seu estudo a partir dos conceitos de situação e relação jurídica, a partir do fato causado. Apresentamos a estrutura e os elementos essenciais do negócio jurídico processual e o identificamos como forma de autorregramento das partes no processo. Por fim, o último capítulo investiga a atuação do juiz frente o negócio jurídico processual. Symbolic regulation : human rights provisions in preferential trade agreements

While the multilateral trading system views human and labour rights issues as outside of its remit, states increasingly incorporate regulation in these areas into their bilateral reciprocal preferential trade agreements, "HR-PTAs. This dissertation investigates the emergence of HR-PTAs, testing alternative explanations derived from conventional "public interest" and "private interest" theories of regulation against a new theory of "symbolic regulation." According to the public interest theory of regulation, regulation is motivated by benevolent legislators' commitment to correcting market or social problems. The private interest theory of regulation instead views regulation as the result of private interest groups capturing the regulatory apparatus in order to regulate in their own self-interest. Unlike its counterparts, the symbolic theory of regulation suggests that regulation may also be created for the primary purpose of reassuring regulatory advocates that their demands have been heard, rather than to regulate a given issue area. This dissertation argues that for the states behind them, HR-PTAs are primarily a symbolic form of regulation. Legislators create HR-PTAs to appease domestic human and labour rights organizations, while defending their trade interests through the non-enforcement of their provisions. Using longitudinal network analysis to analyse original data from 415 preferential trade agreements in force from 1989 to 2009, paired with case study evidence from the EU, US, and Canada, this dissertation finds support for the symbolic regulation explanation of HR-PTAs. It shows that a state's commitment to HR-PTAs depends less on the public interest or the desires of private interest groups than on its need to accommodate human and labour rights advocates. Symbolic regulation however should not be dismissed. It sets precedents, creates policy space, facilitates softer forms of cooperation, and can fuel political accountability politics. When this occurs, states may use HR-PTAs or other forms of symbolic regulation to achieve their seeming purpose.

This thesis discusses the role of institutions in promoting public interest within the context of cultural and natural heritage conservation. Due to the fact that the concept of public interest is controversial and may differ from one context to another, and that there are numerous institutions, the role of institutions in public interest promoting process limited to the context of conservation. A large number of public institutions develop policies that have significant implications for the conservation of cultural and natural resources in Turkey. The aim of these policies is to promote public interest by safeguarding natural and cultural assets. Moreover conservation institutions adopt different public interest approaches based on their establishment laws, therefore they carry out different activities to attain the objectives of their institutions. Consequently, promotion public interest by such institutions becomes even more ambiguous under these circumstances. Within this context, the G&ouml / kova case provides a good basis for the investigation of the ways in which public institutions conduct their activities in the quest to promote public interest.
