Bases cérébrales des processus de compétition et de hiérarchisation sociales / -

Le cerveau humain n'est pas seul face au monde. Il nait, grandit et vieillit, entouré par d'autres cerveaux qui poursuivent des buts similaires aux siens : survivre et s'accomplir. Dans cette quête, le cerveau humain apprend tôt l'immense valeur de la coopération et de la mise en commun des compétences, dont le total excède presque toujours la somme des parties. S'élever au-dessus de la nature, la comprendre et la maitriser ; ensemble. Mais la nature du cerveau est d'être égoïste, car ses subtiles machineries n'ont pas été sélectionnées par l'évolution pour permettre la perpétuation d'autres gènes que ceux qu'il porte en lui. Si l'émergence de la conscience constitue peut-être une promesse d'affranchissement vis-à-vis de cette contrainte en lui permettant de se conformer à des valeurs morales ou spirituelles, une multitude de mécanismes inconscients ou préconscients veillent à empêcher qu'autrui n'entrave l'accomplissement de sa finalité biologique. Lorsque deux individus visent une ressource indivisible, telles que les faveurs sexuelles d'un tiers, et plus généralement quand la possibilité du partage est supprimée par une urgence homéostatique qui réveille l'égoïsme tapi au fond de leurs natures, la coopération laisse place à la compétition sociale. C'est alors une affaire de compétence, de motivation et peut-être, de chance. Qu'il prenne la forme d'une lutte à mort, d'une guerre de mots, ou d'un simple combat de regards, ce conflit se résout dans un double évènement – la victoire de l'un et la défaite de l'autre – qui constitue la brique élémentaire de toute hiérarchie sociale biologique. L'issue d'un conflit social est avant tout une information, qui en dit long au perdant sur sa capacité à poursuivre ses buts en présence de l'autre. Son cerveau apprend qu'au milieu de cette nature qu'il peut espérer maitriser, il existe un autre cerveau qui peut le maitriser, lui. Ainsi, les hiérarchies sociales biologiques sont avant tout des hiérarchies de contrôle. Contrôle de certains individus par d'autres individus, auquel s'associent la préséance de certains buts sur d'autres et probablement une vulnérabilité variable face à certaines maladies mentales et somatiques. Les neurosciences sociales commencent seulement à se pencher sur la manière dont les informations relative aux hiérarchies sociales et aux conflits interindividuels est perçue, traitée et intégrée par le cerveau humain. A ce jour, seules quelques publications pionnières – poursuivant souvent des objectifs différents du notre – ont jeté les premières lumières sur les mécanismes neurobiologiques qui permettent à un être humain d'évaluer le niveau de contrôle ou le rang hiérarchique dont disposent ou pourraient disposer les autres individus de son groupe social. Dans cette thèse, nous exposons un certain nombre de résultats expérimentaux qui apportent chacun un éclairage nouveau sur les bases cérébrales des processus de hiérarchisation et de compétition sociales. Tout d'abord, l'utilisation de l'imagerie par résonance magnétique fonctionnelle (IRMf) nous a permis de localiser les processus impliqués dans l'apprentissage des aptitudes compétitives qui accompagne l'expérience des victoires et des défaites sociales. Cette première étude ayant entre autres mis en exergue l'importance du cortex préfrontal dorsomédian pour cet apprentissage « par renforcement » des relations de dominance sociale, nous avons ensuite utilisé la stimulation électrique transcranienne directe pour révéler le rôle causal joué par cette structure dans la régulation des comportements de compétition sociale... [etc] / The humain brain is not facing the world alone. It grows and ages, surrounded by other brains which pursue goals similar to his owns: survive and achieve. In this quest, the human brain soon learns the great value of cooperating and uniting competences, whose whole is almost always greater than the sum of the parts. Standing above nature, understanding it and mastering it ; together. But the nature of the brain is to be selfish, because its subtle machinery was not selected by evolution to allow others’ genes to spread, but only the ones it carries itself. While the emergence of consciousness may well constitute a promise of freeing from this heritage by allowing the compliance with moral and spiritual values, a myriad of unconscious or preconscious mechanisms make sure that others do not hinder the achievement of its biological ends. When two individuals desire an indivisible resource – such as the sexual favors from a third party – and more generally when the possibility of sharing is made impossible by a homeostatic urgency, latent egoisms wake up and social competition appears at the expense of cooperation. Then, it becomes a matter of competence, motivation and chance maybe. Be it a struggle to death, a war of words or a gaze fight, this conflict ends up with a double-event – one’s victory and other’s defeat – which constitute the core building block of any biological social hierarchy. The outcome of a social conflict is first information, which speaks volumes about the ability of the loser to pursue his own goals when the other is present. His brain learns that within this nature which may be mastered, another brain exists which may master him. Thus, biological social hierarchies are control hierarchies. Control of some individuals over others, which corresponds to the priority of some goals over others and, possibly, to the variable vulnerability in front of a subset of mental and somatic disorders. Social neurosciences only begin to investigate how information relative to social hierarchies and conflicts is perceived, processed and integrated by the human brain. Only a few studies have shed light on the neurobiological mechanisms which enable humans to evaluate the degree of control or the hierarchical status of other members in his social group. In this dissertation, we report several experimental results which may advance our understanding of how the brain process social competition and social hierarchy. First, functional magnetic resonance imaging (fMRI) allowed us to localize the processes involved in learning the competitive skills of other individuals from the experience of social defeats and victories. Having highlighted the importance of the dorsomedial prefrontal cortex for the “reinforcement-learning” of social dominance relationships, we have then used transcranial direct current stimulation to demonstrate the causal role played by this structure in the regulation of competitive social behaviors. In a third study – also using fMRI, we showed that the neural sensitivity to asymmetries of competitive skills underlie political preferences of individuals regarding social hierarchy, the higher this sensitivity the more prone subjects were to legitimate socioeconomics inequalities and the domination of some social groups over others. In a fourth study, we explored the reaction of the amygdala to the perception of facial dominance and we found that this evolutionary ancient structure was able to distinguish dominant from subordinate individuals very rapidly. Finally, in our last behavioral study, we revealed that men and women differ in how they compare their own intellectual competence to those of other people and that these gender differences may derive from a sex-dependent mental representation of social hierarchies

La subordonnée participiale au participe passé en Français : de la phrase au discours / Participial subordinate clause : from sentence to discourse

L’intégration du contexte dans l’analyse de la subordonnée participiale au participe passé permet d’établir plusieurs catégories de cette construction, selon qu’elle est employée seule, qu’elle contient un marqueur temporel ou l’auxiliaire étant. Lorsqu’elle n’a pas ces éléments, la construction est toujours en relation de coréférence événementielle avec son contexte d’apparition. Elle est toujours composée de verbe résultatif, borné à gauche et à droite, et est séparée de la proposition qui l’héberge par un intervalle. Deux types de constructions participiales se dégagent de cette catégorie. La première n’apporte aucune information nouvelle dans le discours. Elle indique une Généralisation du contexte antérieur et est en relation de Consécutivité avec la proposition qui l’héberge. Elle peut être un connecteur ou un introducteur de cadre temporel. La seconde est rhématique par l’aspect de son procès. C’est une Particularisation du contexte antérieur qui est souvent en relation de Narration avec la PH. La construction qui contient un marqueur temporel se rapproche de celle qui n’en a pas dans plusieurs aspects. Mais elle diffère de celle-ci parce que le marqueur peut servir à conférer au participe le caractère résultatif s’il n’en a pas, ou une autonomie syntaxique. En ce qui concerne celle qui est composée de l’auxiliaire étant, elle se distingue des deux autres dans plusieurs angles. D’abord, si elle est contextuelle, son procès est souvent distinct de celui de son contexte d’apparition. Ensuite, théoriquement, elle peut contenir n’importe quel participe passé, avec un procès borné seulement à droite, mais pas à gauche. Enfin, elle entretient avec ce contexte et avec la proposition qui l’héberge plusieurs types de relations de discours qu’on ne peut avoir avec les autres types de subordonnées participiales. / The typology of French subordinate participial clauses studied here is grounded in their context, which is shown to partially determine their distribution (‘pure’ or naked, introduced by a temporal adverbial, or yet containing the auxiliary étant ‘being’). When naked, the clause always entertains a relationship of coreference with the events denoted in the preceding context, and its verb is resultative, yielding a temporal interval between the two eventualities. In some cases, the participial clause does not introduce any new information : it simply generalises the contents of the (not necessarily immediately) preceding sentence, indicates that the main clause is consequent upon it, and functions like a discursive connective or a pure temporal adjunct. In other cases, it is rhematic, at least in so far has it provides aspectual specifications, and thus play anundeniable narrative rôle. When a temporal expression (une fois, sitôt…) introduces the clause, the semantic value of the participle is also specified, and the clause acquires a form of syntactic autonomy it does not have otherwise. Finally, when the auxiliary étant occurs, the subordinate clause can denote a hitherto unknown eventuality, whose aspectual properties are distinct from the aforementioned cases ; in particular, reference is only made to the end point, never to the beginning of the action thus described. This third type of participial clause is also shown to entertain textual and/or discursive relations with the context that are crucially different from the other types.

Morphosyntaxe et sémantique des auxiliaires et des connecteurs du tibétain littéraire : étude diachronique et synchronique / Morphosyntax and semantics of literary Tibetan auxiliaries and clause linking : diachronic and synchronic study

L’étude du système verbal du tibétain littéraire présente un intérêt typologique à plus d’un titre. D’une part, elle permet d’observer l’évolution du système verbal, notamment les constructions avec un auxiliaire et les connecteurs verbaux, sur une période de plus de mille ans. Cette langue classique a l’avantage d’avoir quasiment préservé la même orthographe au cours de cette très longue période. J’ai choisi de me concentrer sur la période du quinzième siècle en choisissant pour corpus principal une œuvre très célèbre : la biographie de Milarépa. J’ai ensuite comparé le système verbal de cette période avec le tibétain littéraire contemporain. La principale raison qui a motivé cette étude, est l’émergence en tibétain moyen d’un système d’auxiliaires indiquant l’évidentialité, c'est-à-dire la grammaticalisation de la source épistémologique et de l’accès à l’information. Le tibétain est la seule langue littéraire d’Asie ayant une grande ancienneté qui ait développé un système verbal évidentiel complexe. Outre l’étude de la sémantique grammaticale, la deuxième motivation à l’origine de cette étude est la syntaxe des constructions avec un auxiliaire et des connecteurs du tibétain moyen et leur évolution en tibétain littéraire contemporain. Les données du tibétain littéraire et les analyses synchronique et diachronique sont susceptibles d’apporter une contribution à la typologie aussi bien en ce qui concerne l’évidentialité et les modalités épistémiques qu’en ce qui concerne la syntaxe des auxiliaires et des connecteurs. / The analysis of the literary Tibetan verb system is an object of typological interest for several reasons. Firstly, it allows us to look at the evolution of the verb system notably auxiliary verb constructions and clause linking during a period of more than a thousand years. Classical Tibetan has the advantage of having preserved almost the same orthography during this very long period of time. I decided to focus on the fifteenth century by selecting a well-known book as a main corpus: the Life of Milarepa. I then compared the verb system of this period with contemporary literary Tibetan. The main reason for this study is to better understand the emergence of an auxiliary verb system in middle Tibetan which marks evidentiality, that is to say the grammaticalization of the epistemological source and the access to information. Literary Tibetan is the only language in Asia with an ancient history which has developed a complex evidential verb system. Apart from the analysis of grammatical semantics, the second reason for this study is my interest in the syntax of auxiliary verb constructions and of clause linking in middle Tibetan and their evolution in contemporary Tibe! tan. My data on literary Tibetan and my synchronic and diachronic analysis may make a significant contribution to the typological studies of evidentiality and epistemic modality as well as of the syntax of auxiliary verb constructions and clause linking.

La question de la responsabilité du salarié demeure essentielle encore aujourd'hui. En raison de la subordination qui caractérise le travail salarié, des aménagements semblent nécessaires pour organiser les rapports que le travailleur entretient avec l'employeur et les tiers. Deux logiques président à la responsabilité du salarié. Une logique de protection d'abord, qui permet de soustraire le salarié du droit commun. L'ordonnancement d'une protection s'analyse en un impératif dont la finalité est de rétablir le déséquilibre inhérent au contrat de travail. L'effectivité de cet impératif se traduit avec force par l'octroi d'une immunité d'origine légale et jurisprudentielle. Cette protection ne se veut pas absolue pour autant. Certains comportements justifient la réapparition du droit commun et la sanction du salarié du point de vue pénal et civil. Sa protection suscite alors une question : qu'advient-il de l'indemnisation des dommages qu'il aura causés à l'occasion de son travail ? Dans un premier temps, cette logique de protection semble mal s'articuler avec l'indemnisation de la victime. En écartant l'application du droit commun, on prive en effet la victime d'un débiteur. C'est sans compter sur la diversité des mécanismes offerts par le droit positif et qui assurent l'efficacité de la logique indemnitaire. Efficace, elle n'est pas infaillible et présente des limites qui ne pourront pas toujours être corrigés et conduiront à priver d'indemnisation la victime du salarié. / The matter of employee's liability still remains essential. Because of the subordination underlying paid labor, some adjustments seem necessary to set up the worker's relationship with his employer and a third party. Two main ideas rule the worker's liability. First, a protectionist point of view, allowing the employee to shield him from common-law. Organizing the worker's protection is commanding and its goal is to bring in balance the work contract. To be effective, this shield needs to have immunity through a legal source and a case law. This protection, however, isn't unerring. Some behaviors justify the reappearance of common law and the penal and civil sanction of the employee. Second, this protection gives rise to a question: what about compensating the damages the employee may have caused while working. First of all, this protectionist's logic doesn't seem to function well. By ignoring the common law, we rob the victim of a debtor. Let's not forget about the vast diversity of techniques that the law offers, which also provides efficient reparation. Efficient though, this kind of logic is not absolute, it has its limitations that we won't be able to adjust, and these limitations will leave the victim with no compensation.

Analyse juridique de la mobilisation des facultés mentales du salarié / Legal analysis of the mobilization of the employee's mental faculties

L'expression « facultés mentales », il est bon de le souligner dès l'abord, sera ici utilisée dans l'acception que lui donne le Vocabulaire juridique de Gérard Cornu : « ensemble des moyens psychiques gouvernant la capacité de comprendre et de vouloir ».Juridiquement, c'est la pleine possession de ses facultés mentales qui confère à l'individu la qualité de sujet de droit agissant. Mais en droit du travail la problématique prend une dimension particulière: le lien de subordination caractéristique du contrat de travail repose d'un point de vue théorique sur l'aliénation des facultés mentales du salarié au service de l'employeur. Ainsi, si le salarié use de façon autonome de ses facultés mentales au moment de la conclusion du contrat de travail, ces dernières se trouvent en quelque sorte spoliées au stade de l'exécution du contrat, le rapport de soumission et de direction induit par le lien de subordination impliquant précisément que le salarié renonce à toute volonté propre. Il y a donc, dans l'essence du concept de subordination, l'idée d'une dépossession des facultés mentales de l'individu, qui se métamorphose en simple « objet» du contrat, et se trouve temporairement privé de ses capacités personnelles de penser, de créer, d'agir.Pourtant, il apparaît clairement que le salarié d'aujourd'hui ne peut se réduire à ce rôle de pur exécutant dénué d'âme. La mondialisation de l'économie, l'essor du secteur tertiaire et la révolution numérique ont transformé significativement le monde de l'entreprise. Dans cet univers nouveau, le salarié est de plus en plus amené à utiliser ses moyens psychiques propres, non seulement dans l'élaboration des conditions et de la durée du travail, mais aussi dans son exécution elle-même. L'esprit est devenu la nouvelle force de travail, dont l'usage est difficile à quantifier, donc à limiter.Situation qui pose au droit des problématiques inédites : comment appréhende-t-il le phénomène protéiforme de la mobilisation des facultés mentales au travail? Quelles conceptions le guident ? / To begin with, it should be noted that the expression «mental faculties» shall take on the meaning given in the Vocabulaire juridique by Gérard Cornu: namely, «all mental and psychological faculties that control the ability to understand and want».Legally speaking, only individuals in full possession of their mental faculties are entitled to rights and duties. However, in the field of labour law, a specific dimension has to be taken into account with regard to this issue. Indeed, the usual relationship of subordination between employer and employee theoretically lies upon the alienation of the employee's mental faculties when the employment contract is concluded. In other words, employees may initially enjoy the autonomous use of their mental faculties when the contract is signed, they are nevertheless dispossessed of these mental faculties as soon as the contract comes into force, for managing and subjugating people entailed by the relationship of subordination precisely imply that the employees give up their own free will. Thus, at the core of the concept of subordination, lies the idea that individuals become mere «objects» of the contract, and are temporarily left without their own capacities to think, create, and act.Yet it clearly appears that today's workers can't be reduced to the role of mere task performers with no soul or feelings. The ever-increasing globalization of markets, the rise of the tertiary sector, and the booming digital revolution have dramatically changed the business world. In this new environment, employees have to resort to their own mind faculties more and more, not only to elaborate work conditions and hours but also to perform the tasks themselves. The mind has become the new workforce, a workforce which is difficult to measure and therefore to limit.This situation rises new issues in the field of law: how should this multifaceted phenomenon about mobilising mental faculties at work be dealt with? La subordination de créance : analyse de la subordination à l'épreuve de la procédure collective / Debt subordination : analysis of debt subordination in the context of insolvency proceedings

La subordination de créance est l’opération par laquelle un créancier, junior, accepte de n’être payé qu’après l’extinction de la dette d’un autre créancier, senior. L’efficacité du mécanisme dans la procédure collective dépend de l’analyse retenue. Il est possible de considérer que la subordination modifie la créance du junior sur le débiteur, ou bien qu’elle ne l’affecte qu’indirectement. A l’examen, il apparaît que l’effet de la subordination sur une créance n’est qu’exogène et ne consiste que dans l’adjonction d’obligations personnelles à la charge du junior envers le senior : la subordination n’affecte pas le droit au paiement, mais seulement sa priorité. Il en résulte un déséquilibre dans la consultation des créanciers, un euro de créance junior conférant le même droit de vote qu’un euro de créance senior : tant qu’une réforme des comités de créanciers n’est pas réalisée, le maintien de la subordination est assuré par une convention de vote entre créanciers, dans des limites qu’impose le maintien de la créance junior. Du point de vue du débiteur, la subordination ne crée pas non plus une modalité de son obligation, mais de paiement, de sorte qu’en principe, et sauf accord des créanciers, la clause d’ordre des paiements impose le respect d’une règle de la priorité absolue, puisque cela ne rompt pas l’égalité entre les créanciers. Certaines dérogations peuvent être admises en cas de conflit entre créanciers, en vue de favoriser le sauvetage du débiteur, lorsqu’elles respectent la structure de la subordination. L’effet exogène se retrouve dans l’absence de modification du rang même de la créance, et explique qu’un liquidateur judiciaire ne puisse, de lege lata, appliquer la subordination dans la répartition de l’actif, alors que la violation de la priorité conventionnelle dans le plan laisse peu de recours au senior. Globalement, l’efficacité de la subordination de créance est incertaine en raison de l’effet exogène de la subordination sur la créance, ce qui nécessite, tant dans les consultations des créanciers, que dans l’élaboration du plan et dans les répartitions de la liquidation, qu’il soit fait une place, dans la loi, pour la subordination de créance. / Debt subordination is the operation whereby a junior creditor agrees to be paid only once the senior creditor has been fully paid. The efficiency of the mechanism in bankruptcy depends on the chosen analysis. It is possible to consider that it changes the claim itself, or that it affects it indirectly. Our research shows that subordination affects a claim exogenously as it is built on the addition of personal liens impending on the junior vis-à-vis the senior creditor: subordination does not alter the right to payment but only its priority. Hence, an imbalance appears in the solicitation of creditors, since one euro of junior debt confers the same voting rights as one euro of senior debt: until a reform of the system of creditors committees, the survival of the subordination will only be made possible by voting agreement between creditors when these maintain the junior claim. From the debtor’s perspective, subordination does not modify the structure of a debt, but only changes the rules of payment. Unless an agreement is found between creditors, the waterfall payment should therefore force the respect of the absolute priority rule in the plan, because it does not violate any rule of equality between creditors. Exceptions should be accommodated in case of conflict between creditors, in order to optimize the rescue of the debtor, but still in respect of the structure of subordination. The indirect alteration of the junior claim accounts for the neutrality of subordination on the ranking itself of the claim, and explains that the liquidator cannot, de lege lata, apply the subordination agreement in the distribution of the assets, while the inapplication of the mechanism in the plan will offer little defense for the senior. Overall, the efficiency of debt subordination is uncertain because the mechanism affects a claim exogenously: this requires, upon solicitating the creditors, but also during the elaboration of the plan and in the distribution of the assets, that subordination passes into law in order to give effect to the mechanism.

Masculinity, gender, and power in a Mayan-Kaqchikel community in Sololá, Guatemala

How do self-identified heterosexual Kaqchikel men in the rural areas of Sololá attain status and power in their relationships with women? This question is explored here by analyzing different masculine roles in various social spaces. The complexity of masculine identity requires a meticulous analysis to assess the extent to which the masculine role and identity has been or not a determinant factor in the social and personal development of both women and men in the communities. This exploration also allows us to see the different expressions of masculine identities and evaluate their current role in society. I learned that the Kaqchikel men I interviewed find their social power and status in part through well-established, old ideologies and belief systems, as well as their perception of a biological superiority, which they justify by their hard work in agricultural activities. Based on this socially constructed beliefs and practices, men emphasize the passivity of the women and their social absence – their subordinate status in society. However, the authority of the men is not limited to their remarkable role as leaders and head of the households; it also encompasses pernicious acts such as domestic violence, which is still highly prevalent in contemporary Sololá. This project also explores these men’s perceptions about: (1) the women living in their communities, (2) the low level of education of these women, and (3) the justice system that is still weak and flawed. While all of these are indeed prevailing problems in the communities, women are challenging to an extent all the practices and beliefs associated with the authority of the men. / text

Clause linkage in southeastern Tepehuan, : a Uto-Aztecan language of Northern Mexico

Linguistics / This dissertation examines the complexity of complementation in O’dam, also known as Southeastern Tepehuan (SET), based on a corpus of twenty-seven hours of naturally recorded speech (105 texts). This complexity is due in part to the fact that the same subordinate marker, na, encodes complements, adverbial and relative clauses, and, in some instances, non-embedded clauses. That is, distributional patterns indicate that na is a polyfunctional marker in SET. In addition to using the na marker, SET conveys adverbial and complement clauses through using non-embedded clauses (i.e., juxtaposition), supporting the notion that subordination does not always involve an embedded association (Cristofaro 2003). Crucially, juxtaposition is used as a coordination strategy. Therefore, investigating clause linkage in SET highlights the formal and semantic categories in which SET differentiates embedded clauses. It further suggests that SET has a continuum of features that distinguish these dependent relationships (e.g., aspect, second position clitics, inherent control, an overt subordinate marker, negation, and focus); thus, this research contributes to recent work on the typology of complementation. All embedded clauses in SET can be distinguished by means of a second position clitic and by the morphology attached to the embedded predicate or to the subordinate marker. More specifically, complements and relative clauses require second position clitics, but adverbials only use them if they are marking switch-reference. This behavior is unique, because adverbials use second position clitics as an indicator of thematic continuity for subjects, suggesting that the development of these clitics evolved independently with the function of marking switch reference. Relações de trabalho em plataformas digitais: desafios ao modelo tradicional do Direito do Trabalho / Labor relations in digital platforms: challenges to the traditional model of Labor Law

O Direito do Trabalho estabelece normas e princípios que regulam a relação de emprego, além de outras relações de trabalho legalmente equiparadas, quando houver a concorrência de todos os requisitos exigidos pela lei para sua incidência, dos quais se destaca, para este estudo, a subordinação. Tal requisito é identificado a partir de critérios que se confundem com a própria matriz do Direito do Trabalho, típica da sociedade industrial, os quais, todavia, vêm sofrendo transformações diante das novas formas de exercício do poder diretivo do empregador, surgidas, sobretudo, pelo avanço da tecnologia na área da comunicação e pelo crescimento do setor de serviços em detrimento do trabalho na indústria. O presente trabalho busca identificar quais os principais desafios ao modelo tradicional do Direito do Trabalho, fundado no conceito clássico de subordinação, considerando os serviços prestados sob demanda por meio de plataformas digitais. Para tanto, buscou descrever a evolução das classificações tradicionais das relações de trabalho e identificar as principais características do trabalho prestado por meio de plataformas digitais. Após, foi realizado levantamento de decisões dos Tribunais Regionais do Trabalho da 2ª e 3ª Regiões, referentes a reclamações trabalhistas, cujo pleito consistia no reconhecimento de vínculo empregatício pelos motoristas em relação à empresa Uber, dada a representatividade desta plataforma, dentre outras prestadoras desse tipo de serviço; também foram analisadas decisões paradigmas no Direito Comparado sobre o tema. A partir da sistematização das decisões analisadas, foi possível identificar os principais critérios utilizados pelos julgadores para a decisão da existência ou não de trabalho subordinado, bem como as tendências de mudanças interpretativas e adoção de novos critérios. Por fim, foram colocados os pontos sensíveis para a regulação do tema, como limitação da jornada de trabalho, segurança e discriminação, concluindo-se que para enfrentar tais desafios é necessária a superação da visão fundada nos requisitos tradicionais de identificação da subordinação, e, portanto, da própria relação de emprego, rumo a uma interpretação que leve em conta as novas formas e instrumentos de atuação do poder diretivo do empregador. / Labor Law is governed by norms and principles that regulate the employment relationship between employee and employer, in addition to other legally equivalent relations. For this study, subordination stands out from the other elements, being traditionally identified from criteria that are part of the established matrix of Labor Law itself, typical of industrial society. However, transformations due to the development of technology in communications and the growth of the service sector have led to new forms of exercizing the employer\'s directive power in relation to those exercied in the employment in industry. The present work aims to identify the main challenges to the traditional model of Labor Law, based on the classic concept of subordination (prior to the advent of the digital economy) but now having to consider the services provided on demand through digital platforms. To do so, it seeks to describe the evolution of the traditional classifications of labor relations and to identify the main characteristics of the work performed through digital platforms. An investigation was then made on the decisions of the Regional Labor Courts of the 2nd and 3rd Regions, regarding labor claims, that sought to recognise the employment relationship between drivers working for Uber and the company. Given the representativeness of this platform among other providers of this type of service, paradigm decisions in Comparative Law were also analyzed. From the systematization of the analyzed decisions, it was possible to identify the main criteria used by the judges to decide whether or not subordinate work is present, as well as the tendencies of interpretative changes and adoption of new criteria. Finally, sensitive points were set for the regulation of the subject, such as limitation of working hours, security and discrimination, and it was concluded that, in order to face such challenges, it is necessary to overcome the vision based on the traditional requirements of subordination, towards an interpretation that takes into account the new forms and instruments of action of the directive power of the employer.

Only when the servant or wife is abruptly removed from the household and the well-oiled wheels of domestic machinery grind to a halt does the superior realize just how important such services really are. This quote shows how important domestic services are, it also points out who executes it and that society and people, at least the superior, tend to take it for granted. The quote also gives a hint to the aim of this study which is to analyze the arguments behind the policy proposal presented in Promemorian Skattelättnader för hushållstjänster from 2006. The study focuses on the social problems behind the policy proposal and if there were problems left unproblematized. Another aim is to study if assumptions on gender and class can be seen in the policy proposal. Two methods have been used; primarily argumentation, but to some extent (theoretically) also Carol Lee Bacchi’s approach ”what’s the problem represented to be?”. Bacchi’s approach is useful because the presented solutions to a problem depend on the representation of problems and how they are formulated. The results show, among other things, that the interpretation of women’s role in household and society, which also contain a representation of problems, line up the solutions of the problems. They also show that gender equality, as well as gender and class, has been left unproblematized in the policy proposal.
