[pt] A presente tese é um estudo sobre a transexualidade no Direito brasileiro. A partir de questões centrais ligadas à dignidade da pessoa humana o estudo analisa a construção do conceito da transexualidade ao longo da História, especialmente da História da Medicina, em busca de uma explicação do tratamento discriminatório que os transexuais são constantemente submetidos no meio social. Busca-se a origem da visão da transexualidade como algo anormal, doente, que precise de conserto, para então desconstruir esse estereótipo que se firmou com o tempo e que predomina até hoje, inclusive no meio jurídico. Os princípios constitucionais de Igualdade, Dignidade, e Direito à Intimidade são usados como base na elaboração de uma proposta de tratamento respeitoso às pessoas que apresentam esse comportamento tido como desviante, mas que nada mais é que a expressão de sua identidade. A ausência de atuação do Poder Legislativo, a atuação discrepante do Poder Judiciário em situações fáticas idênticas, e a insuficiência das medidas do Poder Executivo servem para mostrar a urgência do enfrentamento do tema pelo Direito pátrio. O exame de outros ordenamentos jurídicos é feito para a elaboração de sugestões para a superação enfrentada pelos problemas acima, especialmente no que diz respeito à mudança do registro civil. / [en] The current thesis is a study about the transsexuality in the Brazilian Law. Based on central issues related to the dignity of the human person, the study analyzes the construction of the concept of transsexuality throughout history, especially of the Medicine History, searching for answers about the discriminatory treatment that the transsexuals are constantly submitted in the social environment. The origin of the vision of transsexuality is sought as something abnormal, sick, in need of repair, to finally deconstruct this stereotype that was established over time and that prevails nowadays, including in the legal environment. The constitutional principles of Equality, Dignity and the Right to Intimacy are used as the basis in the elaboration of a respectful treatment proposal to the people who present this behavior as deviant, but which is nothing more than the expression of its identity. The lack of actions of the Legislative Power, the discrepant action of the Judiciary in identical factual situations and the insufficiency of the Executive Power measures serve to show the urgency of the confrontation of the subject by the Brazilian Law. The examination of other legal systems is done for the elaboration of suggestions aiming the overcoming of the above problems, especially regarding the change of civil registry.

[pt] Práticas didáticas realizadas são ditas como invisíveis e misteriosas. Professores críticos e reflexivos são o objetivo máximo de qualquer curso de formação de professores. O objetivo deste estudo é investigar se o trabalho de documentação do professor pode ser considerado como um instrumento que promove reflexão, e que revela as cenas pedagógicas (Margolinas e Rivière, 2005), e o conteúdo utilizado para o planejamento e o ensino. O estudo foi realizado na cidade do Rio de Janeiro (Brasil). Visitamos 80 escolas públicas de ensino fundamental II de todas as 11 corregedorias regionais de educação (CREs), falamos com cerca de 200 professores, coletamos 78 questionários de uma amostra intencionalmente selecionada, e conduzimos um grupo focal e 12 entrevistas semi-estruturadas. Utilizamos grounded theory para analisar os dados de acordo com os conceitos fundamentais do nosso referencial teórico: reflexão, documentação pedagógica e TIC na educação. Os resultados indicaram uma interação entre professores e recursos disponíveis (foco nos recursos digitais) para organizar, criar, expandir (extend), transformar, remixar, e compartilhar conteúdo, sugerindo uma atitude reflexiva por parte dos professores durante o seu trabalho de gênese documental. Nós investigamos especificamente o trabalho de documentação do professor, o que o compõe: motivações, intenções e uso. O material observado (oral, concreto, e virtual) indicou que a motivação do professor é mais instrumental e pragmática, com poucas intenções transformadoras; além disso, houve pouca evidência de uma reflexão proativa, deliberada e intencional, como por exemplo um olhar retroativo para as práticas recém realizadas. No entanto, suas atitudes e opiniões sugeriram um interesse genuíno na melhora de suas práticas e uma crença de que esta melhora pode ser promovida através de ferramentas digitais; no caso o trabalho de documentação sendo reconhecido como um caminho promissor. Nossa discussão indica as limitações do nosso referencial teórico para explicar a gênese documental do professor e como ela se relaciona com uma postura reflexiva. Nós reconhecemos a necessidade de uma teoria que reconheça e explique a agência da matéria (no nosso caso, das tecnologias digitais), como a Teoria Sócio Material (Material Engagement Theory - MET). / [en] Enacted teaching practices are invisible and mysterious. Critical reflective teachers are the ultimate goal of any teacher training. The goal of this research is to investigate whether teaching documentation work can be considered an instrument for fostering reflection, and to reveal pedagogical scenes (Margolinas and Rivière, 2005) and the contents used for planning and teaching. The study was carried out in the city of Rio de Janeiro - Brazil. We visited 80 public middle schools in all 11 educational districts, we talked to about 200 teachers, conducted 78 surveys based on an intentionally selected sample, and conducted one focus group and 12 semi-structured interviews. We used grounded theory and results were analyzed in light of the fundamental concepts in our theoretical framework such as reflection, documentation work, and ICT in education. Our results indicated an interaction between teachers and available resources (focus on technical, digital resources) to organize, create, extend, transform, remix, and share content, suggesting teachers reflective attitude during documentation genesis. We specifically investigated pedagogical documentation work and what it entails: motivations, purpose and use. The (oral, concrete, and visual) materials observed indicated that teachers motivation was more instrumental and pragmatic, with few transformative intents; moreover, there was little evidence of proactive, deliberate and intentional reflection such as retrospection on the practices just realized. Nevertheless, their attitudes and opinions suggested their genuine interest in improving their practices, and they believe that this can be stimulated through digital tools, recognizing documentation as a powerful one. Our discussion points to the limitations of our theoretical framework in explaining teachers documental genesis and its relation to reflective attitude. We acknowledge the need for a theory that recognizes and explains material agency (in our case, of digital technology), such as the Material Engagement Theory (MET).

[pt] O registro tardio de nascimento é o tema que norteia o trabalho. A pesquisa social tem caráter qualitativo e indutivo, apoiada teórico-metodologicamente no materialismo histórico-dialético, onde foram realizadas entrevistas narrativas à quatro pessoas, entre 19 e 62 anos, que iniciaram seu processo judicial de registro tardio de nascimento no ano de 2019, pela Justiça Itinerante Especializada em Subregistro no Estado do Rio de Janeiro. O estudo objetivou compreender as relações sociais, que pessoas não registradas civilmente estabeleceram para sua reprodução social numa sociedade em que a existência do sujeito está submetida à formalidade legal. Foi utilizado o recurso da triangulação de técnicas em pesquisa, incluindo a análise documental, produção de dados quantitativos a partir de consulta em questionário da instituição participante e observação. O método de interpretação dos sentidos, sob a perspectiva hermenêutica dialética, foi adotado para a análise das narrativas. Os resultados apontam para a determinação do processo de formação sócio-histórico brasileiro, e a emergência de uma população sem documentação básica, no pós-abolição da escravatura no Brasil. Ademais, indicam a necessária relação entre questão racial e a questão social brasileira; a centralidade do trabalho nas relações sociais e resistências forjadas para a sobrevivência de uma vida não documentada. / [en] The civil register of late births is the thme that directs the work. The social research has classed as qualitative and indutive, based theorical and methodologically on the historical and dialectical materialism where had been realized narrative interviews to four people between 19 and 62 year old that iniciate their legal action of civil register of late birth on 2019 by The Specialized Itinerant Justice in under-registration of State of Rio de Janeiro. The study purpose to comprehend the social relations that people non-civil registrated established for your social reprodution in a society where the individual existence is submitted to legal formality. Was employed the triangulation feature of techniques in research, including documental analysis, production of quantitative data from consultation questionnaire from participating institution and observation. The interpretation method of sense under the hermeneutical dialectical perpective was embraced for a analysis of narratives. The results indicate the determination of the Brazilian sociohistorical formation process and the growth of a population without basic documentation after the abolition of slavery. Furthermore, it indicates the necessary relationship between the racial issue and the expressions of the Brazilian social matter; the centrality of the research in social relations and resistence to survive a undocumented life.

[pt] O presente trabalho analisa de que maneira o município do Rio de Janeiro implementou sua política de preservação do patrimônio cultural local e utilizou os instrumentos jurídicos disponíveis à tutela dos bens de natureza imaterial, notadamente, a partir de 2013, com a criação de um novo Livro de Registro: o das Atividades Econômicas Tradicionais e Notáveis. Parte-se do debate acerca das nuances da concepção do patrimônio cultural imaterial (PCI) como categoria analítica, para reconhecer que o PCI carrega um potencial contestador capaz de respaldar as lutas dos grupos e sujeitos historicamente subalternizados, evidenciando, assim, o caráter essencialmente político dessa categoria. Após realizar uma análise das principais construções normativas nacionais e internacionais sobre o assunto, utiliza-se a metodologia do caso-referência para investigar o rebatimento da utilização do Patrimônio Cultural Imaterial na cidade do Rio de Janeiro. Para tanto, empreende-se dois recortes: um temporal e outro territorial, que correspondem, respectivamente, à região central da cidade do Rio de Janeiro e ao período da gestão do Prefeito Eduardo Paes (2009-2016). O desenvolvimento da pesquisa permitiu demonstrar que o patrimônio imaterial carioca, nos casos referência analisados, foi capturado pela lógica empreendedora, neutralizando a potência contestadora dessa categoria e, consequentemente, dando início ao processo de apagamento da memória dos referidos sujeitos e grupos historicamente subalternizados. / [en] This thesis focuses on the means by which the City Hall of Rio Janeiro implemented a policy for the preservation of local cultural heritage and used legal instruments available to the protection of intangible goods, notably from 2013, as of the creation of a new category: The Traditional and Notable Economic Activities s Book of Registry. The research is based on the debate about the conception of the Intangible Cultural Heritage (ICH) as an analytical category, in order to recognize that the ICH carries a challenging potential capable of supporting the struggles of historically subalternized groups and subjects, thus revealing the essentially political nature of this category. After conducting an analysis of the main national and international normative constructions on the subject, the thesis concentrates on the study of a selected case in order to investigate the repercussions of the use of Intangible Cultural Heritage in the city of Rio de Janeiro. To do so, two approaches are undertaken: one temporal and one territorial, corresponding respectively to the central region of the city of Rio de Janeiro and the administration of Mayor Eduardo Paes (2009-2016). The development of the research intends to demonstrate that Rio s intangible heritage was captured by the entrepreneurial thinking, which led to the neutralization of the challenging power of this category and permitted the beginning of the memory deletion process of those historically subalternized subjects and groups.
