[pt] O Brasil passou, em 2016, por um processo de ruptura institucional. Esta dissertação examina o papel desempenhado pelo Supremo Tribunal Federal no processo que culminou com o impeachment da ex-presidente Dilma Rousseff à luz do conceito de Judicialização da Megapolítica, do cientista político Ran Hirschl. Através da análise das decisões do STF e do contexto político em que elas foram tomadas, busco demonstrar que esta corte adotou uma postura ativista que foi decisiva para a queda da ex-presidente. Esta postura ativista do STF contou com o apoio das elites políticas, econômicas e sociais nacionais, dado que abria caminho para viabilizar, de forma encoberta, uma agenda política que fora seguidamente derrotada ao se apresentar mais abertamente nas disputas eleitorais nacionais. Tal desfecho sugere que as leituras positivas do fenômeno da judicialização da política na literatura nacional - no período em que ele se associava à expansão de direitos nos marcos da democratização do país - podem ter subestimado os riscos que esse processo representava para o próprio regime democrático ao se deslocar para temas da megapolítica. / [en] Brazil faced a major institutional rupture in 2016. This dissertation examines the role played by the Brazilian Supreme Court (STF) in the process that led to the impeachment of President Dilma Rousseff, based on Ran Hirschl s concept of the Judicialization of Megapolitics. I discuss the Court s decisions and the political context in which they were taken. Based on these, I argue that STF s activist stance had a decisive influence on the President s dismissal from office. The Court s activist stance had the support of Brazil s political, economic and social elites, who saw in it an opportunity to forward, in a hidden fashion, a political agenda that had faced successive defeats in the more open terrain of national elections. This outcome suggests that the more favorable initial interpretations of the Judicialization of Politics in Brazilian Social Sciences literature (when the phenomenon was generally associated to the expansion of citizen rights in the context of democratization) might have underestimated the risks it entails for democratic regimes when it penetrates the realm of Megapolitics.

[pt] O escopo do trabalho é verificar e analisar possíveis incoerências no resultado das decisões e nas fundamentações dos ministros do Supremo Tribunal Federal. A partir de obras e artigos que indicam inexistir uma jurisprudência genuína no STF, elaborou-se uma pesquisa embasada nos informativos mais recentes do Supremo e em algumas decisões esparsas. O exame englobou decisões com trânsito em julgado em sede de controle difuso de constitucionalidade, controle concentrado de constitucionalidade e habeas corpus. Nos casos selecionados, observou-se que a Segunda Turma apresentou uma postura incoerente em casos parecidos, de desrespeito aos autoprecedentes, não sendo verificada a ocorrência de overruling, overriding, distinguishing ou transformation. Desse modo, a pesquisa aborda aspectos do processo decisório do Supremo, da deliberação entre os Ministros, dos votos e da estruturação das ementas dos acórdãos. Em vias de conclusão, apontam-se objeções ao perfil decisório do Supremo Tribunal Federal. / [en] The scope of work is to identify and to analyze possible inconsistencies in the results of the decisions and the reasoning of the Federal Supreme Court. From books and articles that indicate inexistence of a genuine jurisprudence in the Supreme Court, a research was elaborated based on the latest newsletter from the Supreme and some sparse decisions. The examination encompassed decisions with res judicata in the seat of diffuse control of constitutionality, concentrated control of constitutionality and habeas corpus. In selected cases, it was observed that the Second Chamber showed an inconsistent approach in similar cases, disregarding self-precedents, with no occurrence of overruling, overriding, distinguishing or transformation. Thus, the research addresses aspects of the decision making process of the Supreme, the deliberation between the Justices, the votes and the structure of entry of judgment. Nearing conclusion, objections to the profile decision-making of the Supreme Court were raised.

[pt] Nos últimos anos, o Supremo Tribunal Federal ganhou destaque no cenário político-jurídico mediante as oscilações do arranjo institucional brasileiro, com a crise de representatividade do poder legislativo e com a sua atuação em processos politicamente sensíveis. A partir do momento em que a Corte é instada a imiscuirse de maneira mais ativa, do ponto de vista macro, no diálogo interinstitucional frente aos demais poderes, há que se verificar sob o ponto de vista micro, o diálogo intrainstitucional na própria Corte. Isto é: faz-se mister compreender a formação da decisão do Tribunal, e como o diálogo dos pares caminha no percurso da deliberação. O recorte pretendido na presente dissertação tem por objetivo analisar as situações em que a Corte manifesta seu poder decisório de forma colegiada e como a individualização tem ganhado espaço no quantitativo da produção do Tribunal. Para isso, pretende-se verificar se o modelo decisório atual atende ao processo deliberativo afeto à Corte. Em sequência, busca-se identificar quais os poderes são conferidos aos Ministros de forma individualizada, bem como, o cabimento das decisões monocráticas, com destaque às figuras do Ministro Presidente e do Ministro Relator. / [en] In recent years, the Federal Supreme Court has gained prominence in the political-legal scenario due to the oscillations of the Brazilian institutional arrangement, with the crisis of representativeness of the legislative power and with its performance in politically sensitive processes. From the moment the Court is urged to become more actively involved, from a macro point of view, in the interinstitutional dialogue with the other powers, it is necessary to verify, from a micro point of view, the intra-institutional dialogue within the Court itself . That is: it is essential to understand the formation of the Court s decision, and how the dialogue between peers goes along the path of deliberation. The aim of this dissertation is to analyze the situations in which the Court manifests its decision-making power in a collegial manner and how individualization has gained ground in the Court s quantitative production. For this, it is intended to verify whether the current decision-making model meets the deliberative process assigned to the Court. In sequence, we seek to identify which powers are conferred to Ministers individually, as well as the appropriateness of monocratic decisions, with emphasis on the figures of the Minister President and the Minister Rapporteur.
