[pt] O presente trabalho propõe uma investigação de algumas das condições de possibilidade quanto ao conceito de Genocídio. Buscando entender alguns dos limites políticos e sociais na utilização do termo Genocídio – no Internacional ou não -, estabelece-se uma análise que tenta conciliar as bases que tornam possível a invenção do conceito em 1944 pelo jurista polonês Raphael Lemkin, bem como sua recepção, abordagem, e disputas quanto ao que o conceito deve(ria) significar entre 1944 e dezembro de 1948, quando a Convenção para a Prevenção e a Repressão do Crime de Genocídio foi aprovada pela Assembleia Geral das Nações Unidas. Mais do que apenas determinar a politização (Politisierung) do Conceito, argumenta-se que um entendimento sobre o que Genocídio é ou deveria ser, seja no recorte temporal proposto, seja nos debates que se seguem no Campo de Estudos sobre Genocídio, requer uma abordagem que reflita as múltiplas temporalidades que cada reinvindicação de significado do Conceito traz em si. / [en] This work seeks to investigate a few of the conditions of possibility for a concept of Genocide. By establishing an analysis that tries to reconcile the basis under which the creation of the concept in 1944, as well as its reception, take and dispute of what the concept must (have) mean(t) between 1944 and December 1948, when the Convention on the Prevention and Punishment of the Crime of Genocide was approved by the United Nations General Assembly, this work aims for an understanding of a few of the political and social limits on the employment of the term Genocide. More than just considering the politicisation (Politisierung), it is argued that a certain understanding of what Genocide is or ought to be, be it through the proposed temporal frame or through the debates that follow in the Field of Genocide Studies, requires an approach that reflects on the multiple temporalities that each claim for a certain meaning that is brought within the Concept.

[pt] A interferência da mídia no animus dos jurados em decisões proferidas pelo Tribunal do Júri é nítida, principalmente por ter como juízes o próprio povo. Um dos casos mais emblemáticos é o caso Eliza Samúdio, em que uma jovem teria sido assassinada brutalmente a mando do pai do próprio filho, um jogador de futebol famoso. Atuando em tempos e com discursos diferentes, mídia e judiciário seguiram seus caminhos. Caso complexo, repleto de enigmas e o envolvimento de uma pessoa famosa no meio popular apresentou-se perfeito à imprensa por concentrar em si os três assuntos que mais prendem a atenção popular: o crime, esporte e sexo. Além do enigma: onde estariam os restos mortais da jovem? Dia a dia, momento a momento, a imprensa seguia os passos do inquérito policial e do processo penal com o intuito de passar a notícia e com isso perceber os seus lucros, sendo notório que essa cobertura privilegiou a fase de inquérito e do julgamento, sempre enfatizando a personalidade de Bruno Fernandes como fora
dos padrões normais. A mídia assim, autoafirmava como autoridade moralizadora, utilizando da narrativa para tanto. Ao fim, viu-se a ratificação de um veredicto já proferido pela mídia muito tempo antes do julgamento, tendo em vista o populismo penal midiático em que Bruno Fernandes fora condenado à reprimenda maior do que no direito se admitiria, principalmente porque o julgamento pelo Tribunal do Júri é feito através do povo, que confirmou o que escutou durante quase três anos. / [en] The interference in the media animus of jurors in decisions made by court s jury is clear, mainly because the judges were their people. One of the most emblematic cases is the Eliza Samúdio, where a young woman had been brutally murdered at the behest of the father of his own son, a famous soccer player.
Acting upon different times and speeches, media and judicial branches went their ways. Complex case replete with enigma and the involvement of a famous person in the popular medium presented the perfect press to focus itself on three issues that mostly catches the popular attention, being crime, sport, sex. Besides the enigma: where were the remains of the young woman? Day by day, moment by moment the press followed the steps of the police investigation and criminal procedure in order to pass the news and thus realize their profits, being clear that this coverage favored the stage press inquiries and judgment, always emphasizing the personality of Bruno Fernandes and outside the normal range. The media so,
self claimed authority as moralizing, using the narrative to do so. At the end, found itself ratification of a verdict already delivered by the media long before the trial, in view of the penal populism media where Bruno Fernandes was sentenced to reprimand larger than the right would admit, mainly because the trial by jury is made through the people, which confirmed that heard for almost three years.

[pt] A presente dissertação explora a sombra que o Tribunal Penal Internacional faz sobre a Colômbia, por meio de sua persistente não-decisão. Usa do trabalho de Koskenniemi para analisar a abordagem positiva do Gabinete da Procuradoria à complementariedade, identificando-a como uma manifestação da cultura do formalismo. Em seguida, analisa como atores representam o envolvimento do Tribunal com principais figuras nacionais no caso colombiano, durante o longo período de tempo desde a abertura de um exame preliminar. Partindo da teoria crítica e de estudos de assombração, a autora então pergunta: Como o/a impacto/sombra da não-decisão da Procuradoria (sobre a abertura de uma investigação) é representada/sentida na Colômbia? Argumenta, a partir de uma análise estética de documentos, charges políticas e do filme Manos Súcias, por uma abordagem alternativa na política do direito internacional. Por fim, oferece uma crítica das Relações Internacionais enquanto prática. / [en] This thesis explores the shadow cast by the International Criminal Court over Colombia through the means of a persisting non-decision. It uses the work of Koskenniemi to characterize the Office of the Prosecutor s positive approach to complementarity as an attempt to employ a culture of formalism. It then analyzes how actors involved represent the Court s engagement with key figures the country during the long time it has been under preliminary examination. Taking critical theory and hauntology studies as a starting point, the author then proceeds to ask: How is the impact of the impact/shadow of the Prosecutor s nondecision (pursuant to the opening of an investigation) portrayed/felt in Colombia? How does it come to be? She argues, departing from an aesthetic analysis of documents, political cartoons and the movie Manos Sucias, for a different approach on the politics of international law. Finally, she offers a critique of International Relations as a practice.

movimento feminista, o reconhecimento da misoginia estrutural como causa dessas

do sistema de justiça no julgamento desses crimes, anteriormente realizados com
base na culpabilização da vítima, no julgamento moral de sua conduta e,

Feminista do Estado de Catharine Mackinnon e dos parâmetros instituídos pela Lei

incorporação da perspectiva de gênero nos julgamentos de feminicídios nos
Tribunais do Júri da Cidade do Rio de Janeiro, ocorridos após a entrada em vigor
da referida lei. / [en] The adoption of feminicide in Brazilian legislation represents, for the
feminist movement, the recognition of structural misogyny as the cause of these
violent deaths of women, enunciative of gender oppression through the law.
Furthermore, this naming would promote an essential change in the acting of the
justice system in the judgment of these crimes, previously held on the basis of
blaming the victim, on the moral judgment of her conduct and, consequently, on
gender discrimination. Therefore, based on Catharine Mackinnon s Feminist
Theory of the State and the parameters established by Law 13.104/15 and the
National Guidelines on Feminicide, the work intends to investigate the
incorporation of the gender perspective in feminicide trials in the Jury Courts of the
City of Rio de Janeiro, which occurred after the entry into force of that law.

como um fenômeno que se manifesta nos diferentes níveis de instituições da
sociedade internacional. A análise é desenvolvida a partir do estudo de caso do
processo contra Omar Al Bashir, presidente em exercício do Estado do Sudão, no
Tribunal Penal Internacional. Esse caso evoca uma discussão acerca da autoridade
desempenhada pelo Conselho de Segurança das Nações Unidas nas instituições do
pós-1945, em especial, no direito internacional penal. Considerando que normas e
regras possuem um papel social nas múltiplas relações existentes em meio a
agentes e a estrutura, ou seja, elas transformam as relações no sistema
internacional, o trabalho investiga as disposições e princípios presentes tanto no
âmbito do Tribunal Penal Internacional, quanto também da Organização das
Nações Unidas, que autorizam uma discriminação entre os Estados. Essa distinção
implica a imposição de regras internacionais para alguns atores e, ao mesmo
tempo, a manutenção de certas prerrogativas soberanas para outros. Mais
especificamente, a justiça internacional penal é caracterizada pela seletividade nos
julgamentos, uma vez que é conferida a alguns países certa autoridade sobre o
regime. Nesse sentido, defende-se que a (des)igualdade soberana que está presente
no direito internacional penal é, simultaneamente, manifestação e condição de
possibilidade da hierarquia na arquitetura social, e portanto normativa
institucional, e política do sistema internacional. Argumenta-se, assim, que a
presença dessa (des)igualdade soberana pode ser identificada nos diferentes níveis

umas às outras, de sorte que as características de uma refletem-se nas demais. / [en] This work carries out an investigation of sovereign (in)equality as a
phenomenon that manifests itself in the different levels of institutions of the
international society. The analysis departs from the case study of the process
against Omar al-Bashir, acting President of the State of Sudan, at the International
Criminal Court This case evokes a discussion about the authority exercised by the
United Nations Security Council over post-1945 institutions, especially
international criminal law. Considering that rules and norms have a social role in
the multiple relations existing between agents and the structure, that is, they
transform the relations in the international system, the work investigates the
dispositions and principles present both in the scope of the International Criminal
Court, as well as of the United Nations, which authorize a discrimination between
States. This distinction implies the imposition of international rules for some
actors and, at the same time, the maintenance of certain sovereign prerogatives for
others. More specifically, international criminal justice is characterized by
selectivity in judgments, as some countries are given certain authority over the
regime. In this sense, it is defended that the sovereign (in)equality, which is
present in international criminal law is simultaneously a manifestation and
condition of possibility of hierarchy in the social, and therefore institutionalnormative,
and political architecture of the international system. It is argued,
therefore, that the presence of this sovereign (in)equality can be identified at
different levels of the institutions of international society, insofar as they influence
each other, so that the characteristics of one are reflected in the others.

[pt] Esta tese analisa o processo de contestação iniciado pelos Estados africanos
em relação ao Caso Al Bashir no Tribunal Penal Internacional. A promulgação por
esses Estados de práticas de contestação representou um momento sem precedentes
na prática do direito penal internacional. Não apenas os Estados se engajaram com
o Tribunal por meio de uma vasta gama de práticas, mas também essa participação
gerou um nível alto de escrutínio de estudiosos e profissionais do direito
internacional. Ao longo da resposta ao envolvimento africano com o TPI, esteve
constantemente presente a conhecida mobilização da fronteira entre direito e
política. Uma posição frequente nas reações dos praticantes foi a de que a política
não deveria ocorrer no ambiente do Tribunal e a prática do direito internacional
deve ser capaz de transcendê-la. A análise desta tese centra-se nestes dois
elementos: as práticas de contestação realizadas pelos Estados africanos e as
respostas dadas pelo Tribunal. Nesta tese, questiono se a forma como o Tribunal
deu sentido a essas práticas por meio da divisão do trabalho entre direito e política
afetou a capacidade desses Estados contestadores de provocar mudanças no direito
internacional. Por meio dessa pergunta, procuro capturar os aspectos mais
significativos que estão velados não apenas nas práticas de contestação, mas na
atribuição de significados em resposta a elas. Esse esforço requer um exame dos
padrões de significado subjacentes a essas práticas e narrativas, pois apontam para
as condições que permitem que certos atores questionem a autoridade. Argumento
que a criação de uma fronteira entre o que pertence à esfera do direito e à esfera da
política é em si uma postura política que tem consequências na forma como o direito
internacional é praticado. A forma como o direito e a política são mobilizados nas
práticas argumentativas do direito internacional criam um conjunto de barreiras
para que certas práticas de contestação realizadas pelos Estados africanos em relação ao Caso Al Bashir no TPI, quando enquadradas como política, não tenham
chance de provocar a mudança em primeiro lugar. / [en] This thesis works through the process of contestation embarked by African
States in relation to the Al Bashir Case in the International Criminal Court. The
enactment by these States of practices of contestation represented an unprecedented
moment in the practice of international criminal law. Not only were States engaging
with the Court through a vast array of practices, but also this participation generated
an enormous level of scrutiny from scholars and practitioners of international law.
Throughout the response to the African engagement with the ICC was the familiar
mobilization of the frontier between law and politics. A frequent position in the
practitioners reactions was that politics should not take place in the environment of
the Court, and the practice of international law should be able to transcend it. The
analysis of this thesis focuses on these two features: the practices of contestation
performed by African States and the responses it engendered from the Court. In this
thesis, I question whether the way the Court made sense of these practices through
the division of labour between law and politics affected the ability of these
contesting States of engendering change in international law. Through this question,
I seek to grasp the more significant aspects that are veiled not only in the practices
of contestation but in the attribution of meanings in response to them. This
endeavour requires an examination of the patterns of meaning underlying these
practices and narratives, as they point to the conditions that allow certain actors to
question authority. I argue that the creation of a boundary between what belongs to
the realm of law and the sphere of politics is itself a political stance that has
consequences on the way international law is enacted. The way law and politics are
mobilized in the argumentative practices of international law creates a set of barriers
so that certain practices of contestation being performed by African States in relation to the Al Bashir Case in the ICC, when framed as politics, do not stand a
chance to provoke change in the first place.
