Lietuvos Respublikoje įgyvendinant teisinę reformą, vykstant spartiems socialiniams pokyčiams, šeimos teisinių santykių reguliavimas taip pat patiria pokyčius. Įsigaliojus naujajam Civiliniam kodeksui didelės permainos įvykdytos ir šeimos santykių reguliavime. Ieškinio senaties šeimos teisėje reguliavimas taip pat ne išimtis. Šiame magistro baigiamajame darbe nagrinėjama šeimos teisės samprata ir vieta teisės sistemoje, ieškinio senaties samprata ir funkcijos, ieškinio senaties šeimos teisėje reguliavimas galiojant Santuokos ir šeimos kodeksui bei įsigaliojus naujajam Civiliniam kodeksui, apžvelgiama Lietuvos Aukščiausiojo Teismo praktika ieškinio senaties šeimos teisėje taikymo klausimais. Ieškinio senaties institutas žinomas visų pasaulio valstybių todėl šiame darbe trumpai apžvelgiama ieškinio senaties reguliavimas kai kuriose užsienio valstybėse (Rusijos Federacijoje, Prancūzijoje, Anglijoje ir Velse). Minėti klausimai nagrinėjami siekiant nustatyti praktines ieškinio senaties šeimos teisėje taikymo problemas bei pateikti siūlymų dėl ieškinio senaties taikymo šeimos teisėje nuostatų, kurios padėtų siekti visokeriopos šeimos teisini���� santykių dalyvių teisių ir interesų apsaugos. / A lot of relations have been newly regulated by the new Civil Code (2000) which came into force on the 1st of July, 2001. The greatest alternations involve matrimonial and family relations. There is no separate Matrimonial and Family Code left as such. After the 1st of July, 2001 matrimonial and family relations are regulated by the 3rd book of Civil Code (2000) which is intituled Family Law. Great changes were also made in regulation of extinctive prescription in family law. Essentially was innovated the general rule anticipating to apply extinctive prescription for claims arising from matrimonial and family relations. This master’s study analyses the conception of family law, the conception of extinctive prescription, norms regulating application of extinctive prescription for the claims arising from matrimonial and family relations. Also compares the norms regulating extinctive prescription settled in Matrimonial and Family Code (1969) and in new Civil Code (2000), analyses the practise of Highest Court. These questions are analysed in order to realize what changes were made in regulation of extinctive prescription implementing law reform, what problems do arise in application of extinctive prescription in family law and how it is possible to solve them. Extinctive prescription is law institute known in all countries. This master’s study briefly overlooks the regulation of extinctive prescription in some foreign countries (Federation of Russia; France; England and Wales).

Šio darbo tikslas – remiantis mokslinės literatūros, teisės aktų ir teismų praktikos analize atskleisti šeimos santykių teisinio reguliavimo socialinį veiksmingumą. Darbą sudaro trys dalys. Pirma dalis – Šeimos teisės socialinio veiksmingumo samprata. Joje išanalizuota mokslinė literatūra, siekiant atskleisti šeimos, šeimos teisės ir socialinio veiksmingumo sampratas. Antra dalis – Šeimos santykių teisinis reglamentavimas. Atlikta Lietuvos ir tarptautinių teisės aktų, reglamentuojančių santuokos sudarymo ir nutraukimo, asmeninius ir turtinius sutuoktinių bei asmeninius ir turtinius tėvų ir vaikų santykius, analizė. Trečioje dalyje – Šeimos teisės įgyvendinimo socialinės ir teisinės problemos - išanalizuoti teismų praktikos, Statistikos departamento ir Centrinės hipotekos įstaigos pateikiami duomenys, atskleistos socialinės ir teisinės problemos, mažinančios šeimos teisės socialinį veiksmingumą. Pateikta šeimos pokyčių per pastaruosius penkiolika metų analizė. Daugiausiai dėmesio skirta santuokos sudarymo ir nutraukimo, sutuoktinių turtinių santykių reguliavimo bei tėvų ir vaikų tarpusavio išlaikymo santykių socialinių ir teisinių problemų tyrimui. Darbo pabaigoje pateikiamos gautos tyrimo išvados ir rekomendacijos, kaip gerinti šeimos teisės socialinį veiksmingumą. / The aim of the present research is to find out the legal proceedings of family relations social performance on the grounds of science literature, legislative acts and the analysis of case-law. The research paper consists of three parts. In the first part, based on the anglysis of various scientific literature, the conceptions of family, family law and social performance are presented. The second part is about legal regulation of family relations. The background for that research has been Lithuanian and International legislative acts of entering into marriage and dissolution of marriage, property personal rights of spouses, property personal rights between parents and children. The social and legal problems of implemintation of family law are defined in the third part of the research paper. The problems which diminish family law social performance were revealed on the basis of material taken from Deparmanent of Statistics, Central Mortage Office and case-law. At the end of the research paper there are conclusions made and recomendations on how to improve family law social performance. Šiame darbe atliekama lyginamoji LTSR ir LR vykdytos šeimos politikos analizė. Analizuojamos tokios sritys, kaip šeimos ir šeimos politikos sampratos pokyčiai, aptariama kaip pakito šalies ekonominė – politinė sąranga. Taip pat išskiriama kokios egzistavo pagrindinės demografinės problemos LTSR ir kokios demografinės problemos yra aktualios LR, kaip pasikeitė vertybinės nuostatos šeimos atžvilgiu. Analizuojant pačią šeimos politiką apimamos tokios sferos, kaip šeimos paramos priemonės ( išmokos, pašalpos, pensijos, būsto įsigijimo ir darbinės lengvatos, atostogos), jaunosios kartos ugdymas ( vaiko teisių užtikrinimas, ugdymas ikimokyklinėse įstaigose ir mokykloje), aptariami šeimos teisės pokyčiai ( santuokos, ištuokos, turtinių ir asmeninių santykių tarp tėvų ir vaikų bei kitų artimų giminaičių reglamentavimas). / This paper presents the comparative analysis of the family policy of the Lithuanian Soviet Socialist Republic and the Republic of Lithuania. It analyses such fields as the changes in the conception of family and family policy, discusses what changes the national economic and political framework underwent. Morcover, the paper determines what major demographic problems existed in the Lithuanian Soviet Socialist Republic and what demographic problems are current in the Republic of Lithuania and, in addition, how value-related attitudes changed in respect of family. The analysis of the family policy itself covers other spheres, such as family assistance instruments (benefits, allowances, pensions, privileges for housing acquisition and occupational privileges, vacations), education of the young generation (sefeguarding the chlidren’s rights, education at the pre-school establishments and schools), and overviews the changes in the family policy (regulation of marriage, divorse, property and personal relations betwee the parents and children or other close relatives).
