Europos Parlamento ir Tarybos direktyva 2004/48/EB dėl intelektinės nuosavybės teisių gynimo yra pirmasis teisės aktas Europos Bendrijoje, skirtas pašalinti esminius valstybių narių nacionalinių įstatymų reguliavimo skirtumus intelektinės nuosavybės teisės gynimo srityje. Šiame darbe analizuojamos Direktyvos 2004/48/EB nuostatos, susijusios su intelektinės nuosavybės teisės gynimo būdais, priemonėmis ir procedūromis, bei vertinamas šių nuostatų įgyvendinimas ES valstybių narių nacionalinėje teisėje. Analizei pasirinkta Lietuva ir ES valstybės narės, turinčios didžiausias šios srities tradicijas ir esminius egzistavimo skirtumus: apsiribota Jungtine Karalyste, Vokietija bei Prancūzija. Darbe nesiekiama nagrinėti visų teisinių gynimo būdų ar išsamiai gvildenti teisių gynimo nuostatas ir jų taikymo praktiką analizuojamose valstybėse: pagrindinis dėmesys skiriamas atskirų teisių gynimo būdų ir priemonių esmei atskleisti bei atskirų Direktyvos nuostatų įgyvendinimo vertinimui minėtų valstybių teisėje. Darbe remtasi tarptautiniais ir regioniniais teisės aktais, nagrinėjamų valstybių įstatymais, teismų praktika, teisės doktrina, Direktyvos ir įstatymų parengiamaisiais darbais; daug dėmesio skirta monografijoms, Lietuvos ir užsienio leidiniuose išspausdintiems moksliniams straipsniams. / The Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights is the very first EU legislation aiming to approximate the legislative systems and to assimilate disparities in the field of intellectual property rights enforcement. In this paper we analyze the provisions of Directive 2004/48/EC related to the measures, procedures and remedies of intellectual property rights enforcement. Also, we evaluate the implementations of these provisions into the national legislatures of the EU Member states. The analysis focuses on Lithuania and some of the EU member states that have old traditions and essential differences on the matter: the United Kingdom, Germany and France. We do not attempt to examine all the civil remedies nor to describe thoroughly the practices of application of the civil remedies in the Member States in question; instead, the main attention in this paper is focused on the revelation of the legal nature of corresponding measures, procedures and remedies, and evaluation of appropriate implementations of Directive’s provisions into the selected legislature systems. The paper references various international, regional and national legislations of the four states, judiciary practices, travaux préparatoires, jurisprudence; as well as various studies, papers and publications of Lithuanian and foreign authors.

Synthesis and Characterization of Ordered Mesoporous Silica with Controlled Macroscopic Morphology for Membrane Applications

abstract: Ordered mesoporous materials have tunable pore sizes between 2 and 50 nm and are characterized by ordered pore structures and high surface areas (~1000 m2/g). This makes them particularly favorable for a number of membrane applications such as protein separation, polymer extrusion, nanowire fabrication and membrane reactors. These membranes can be fabricated as top-layers on macroporous supports or as embedded membranes in a dense matrix. The first part of the work deals with the hydrothermal synthesis and water-vapor/oxygen separation properties of supported MCM-48 and a new Al-MCM-48 type membrane for potential use in air conditioning systems. Knudsen-type permeation is observed in these membranes. The combined effect of capillary condensation and the aluminosilicate matrix resulted in the highest separation factor (142) in Al-MCM-48 membranes, with a water vapor permeance of 6×10-8mol/m2Pas. The second part focuses on synthesis of embedded mesoporous silica membranes with helically ordered pores by a novel Counter Diffusion Self-Assembly (CDSA) method. This method is an extension of the interfacial synthesis method for fiber synthesis using tetrabutylorthosilicate (TBOS) and cetyltrimethylammonium bromide (CTAB) as the silica source and surfactant respectively. The initial part of this study determined the effect of TBOS height and humidity on fiber formation. From this study, the range of TBOS heights for best microscopic and macroscopic ordering were established. Next, the CDSA method was used to successfully synthesize membranes, which were characterized to have good support plugging and an ordered pore structure. Factors that influence membrane synthesis and plug microstructure were determined. SEM studies revealed the presence of gaps between the plugs and support pores, which occur due to shrinking of the plug on drying. Development of a novel liquid deposition method to seal these defects constituted the last part of this work. Post sealing, excess silica was removed by etching with hydrofluoric acid. Membrane quality was evaluated at each step using SEM and gas permeation measurements. After surfactant removal by liquid extraction, the membranes exhibited an O2 permeance of 1.65x10-6mol/m2.Pa.s and He/O2 selectivity of 3.30. Le syndrome de vibration main-bras (HAVS) est généralement provoqué par l'utilisation d'outils électriques portatifs sur le long terme ; il se manifeste après une exposition au froid, en provoquant une forte et anormale vasoconstriction des vaisseaux sanguins. L'objectif de la thèse est d'établir un nouveau modèle prédictif des changements géométriques et structurels des parois des capillaires causés par l'exposition des membres supérieurs aux vibrations. Le contexte médical du HAVS est rappelé en premier lieu, en particulier les mécanismes pathologiques sous-jacents. Les modèles constitutifs des tissus mous de la pulpe de doigt et de la paroi du vaisseau en croissance issus de la littérature sont rappelés. Dans la troisième partie de la thèse, les paramètres élastiques et visqueux de la pulpe du doigt sont identifiés par le recalage des résultats de la simulation d'un modèle 2D d'une section transversale du bout du doigt avec des données expérimentales. La dernière partie de la thèse aborde la modélisation de la croissance des capillaires induite par la vibration de l'outil, en considérant des échelles spatiales et temporelles macroscopique et microscopique. Le problème spatial multi-échelles est résolu par une méthode de zoom structural, le champ de déformation calculé à l’échelle macroscopique définissant la condition limite appliquée ensuite à l’échelle microscopique. Le problème multi-échelle de temps est résolu en transformant le problème dynamique en un problème équivalent quasi-statique. Les résultats obtenus montrent que les vibrations induisent l'épaississement de la paroi du capillaire, l’effet étant maximum au voisinage de la fréquence de résonance. Des analyses paramétriques sont réalisées pour étudier la relation entre la croissance des capillaires en fonction de la localisation dans la pulpe du doigt, la fréquence de la vibration, l’amplitude de la pré-charge statique, et la dose de vibrations / Hand-Arm Vibration syndrome (HAVS) is usually caused by long-term use of hand-held power tools. It typically occurs after exposure to cold, causing an abnormally strong vasoconstriction of blood vessels. A model predicting the geometrical and structural changes of the arterial walls caused by vibration exposure is developed for the first time in this thesis. The medical context of HAVS is first recalled, especially the underlying pathological mechanisms. The constitutive models for the finger pulp and the growth of the vessel wall from the literature are used as a basis for the modeling of the arterial wall remodeling under exposure to vibration. The elastic and viscous parameters of the fingertip have been identified by adjusting the simulation results of a 2D model of fingertip cross-section to available experimental data. The last part of the thesis develops a first attempt to build the growth model of capillary induced by the tool vibration, considering multiscale spatial and temporal aspects. The two-scale spatial problem is solved by a structure focus, the deformation field computed at the macro level defining the boundary condition next applied at the microscopic level. The two-scale time problem is solved by transforming the dynamic problem into a quasi-static problem. The results obtained show that vibration induces an increase of the thickness of the capillary's wall. Parametric analyses were carried out to study the relationships between the capillary growth and their localization within finger’s pulp, the vibration frequency, the magnitude of the static preload and the vibration dose

Das Ziel der vorliegenden Dissertation war die Erweiterung der Betrachtungseinheit des Abstammungskoeffizienten von einzelnen Loci auf Chromosomensegmente der Länge x in Morgan. Das neue Maß mit der Bezeichnung epistatische Kinship beschreibt die Wahrscheinlichkeit, dass zwei zufällig gezogene Chromosomen-segmente herkunftsgleich sind. In einer Simulationsstudie wurden die genetischen Eigenschaften von Chromosomensegmenten theoretisch untersucht. Im Weiteren wurde die markergestützte Schätzung der epistatischen Kinship untersucht, da Abstammungsinformation in kleinen Nutztieropulationen oft nicht verfügbar ist. Abschliessend wurden die Eigenschaften der epistatischen Kinship anhand von praktischen Daten untersucht. Dazu wurden DNA-Proben aus drei Subpopulationen des Göttinger Minischweines für sechs Chromosomensegmente mit Mikrosatelliten typisiert. Die markergestützte epistatische Kinship variierte zwischen den einzelnen Segmenten. Durch die Verwendung eines Korrekturfaktors für zustands- jedoch nicht herkunftsgleiche Segmente wurde die Variabilität zwischen den Segmenten kleiner. Zur Abschätzung der genetischen Diversität wurde ein genetisches Distanzmass hergeleitet, in welchem die genetischen Diversität zwischen wie auch innerhalb Populationen berücksichtigt wird. Die Reihenfolge der genetischen Distanzen für die markergestützten Schätzungen stimmte mit der Reihenfolge der pedigreebasierten Erwartungswerte überein. Basierend auf den Ergebnissen wird die epistatische Kinship als neues Maß zur Bestimmung der genetischen Diversität in Nutztierpopulationen mit kurzem Entwicklungszeitraum vorgeschlagen.
