Rozhodnutí správního orgánu ve správním řádu a soudním řádu správním / The decision of the administrative authority as described in the Administrative Procedure Code and in the Judicial Administrative CodeZlesáková, Kateřina January 2021 (has links)
82 The decision of the administrative authority as described in the Administrative Procedure Code and in the Judicial Administrative Code Abstract This diploma thesis concerns the difference in the definition of the decision of the administrative authority in the Administrative Procedure Code and in the Judicial Administrative Code. Its aim is, on the one hand, to describe the features of the concept of the decision of administrative authority according to the Administrative Procedure Code and according to the Judicial Administrative Code. on the other hand to define these concepts from a practical point of view and provide insight into the case law definition of these institutes. The aim is to provide a certain orientation in the issue and point out the pitfalls that may arise in the conflict of theoretical and practical definition. The diploma thesis is focused on the summary of the theoretical concept of the decision of the administrative authority and on the positive legal definition of this institute, on the other hand on the definition of the decision of the administrative body taking into account selected case law. At the end of the chapters dealing with selected case law, the author tries to synthesize the knowledge gained during the study of selected case law and thus to define the features of the...

Veřejnoprávní smlouvy / Contracts under public lawHáleková, Ivana January 2015 (has links)
in English The main topics of my thesis are public law contracts. Public law contracts can be defined as bilateral or multilateral legal operations, which establish, change or repeal rights or duties in the area of public law. I tried to give a complete point of view on them, including their history, the actual legal regulation and I also tried to present the single types of public law contracts. Public law contract is one of the forms of public service. It is an institute, which was already commented by legal theorists in the period of Austria-Hungary and also in the beginning of 20th century. The importance of this institute was shaded during the Second World War and during the period of communism. The democracy and then the general legal regulation in form of the normative act No. 500/2004 called the Rules of Administrative Procedure give the institute importance again. Public law contracts can be considered as instruments, which help to involve private entities in the sphere of public services. The thesis is divided into chapters, but it is possible to say, it is divided into two big parts. The first one concerns the definition of the public service in general, because I suppose it is necessary to understand the whole system for determining the public law contracts issues. It also concerns the...

Le gouverneur civil au portugal / The Portuguese Civil GovernorNabais Ramos, Manuel 23 November 2012 (has links)
The role of the Portuguese Civil Governor remains a constant source of interrogation for lawyers, politicalscientists and historians. It was established in 1832 by José Xavier MOUZINHO da SILVEIRA, under the title ofPrefeito then in 1835 at the time of the creation of the district as an administrative division of the territory, the titlebecame the “Civil Governor”. It was initially inspired by the French Prefect. The institution was founded in anattempt to separate the jurisdictional and administrative functions within the districts. Similarly, the goal was toprovide the royal power with a real political structure at local level. Accordingly, before the advent of the New Stateand the Political Constitution of 1933, the revised and adopted administrative codes, resulting from any politicalchange, did not fundamentally alter the powers of the institution as a local representation of the central power. TheCivil Governor only became a key player in the administration and local politics following the Administrative Codeof 1940. After the democratic transition following the Carnation Revolution (April 25, 1974) and the adoption of theConstitution of the Portuguese Republic in 1976, the Civil Governor, who was always appointed by the centralgovernment, has remained in a transitory state for four decades, more than a third of a century. Since the referendumof November 8th 1998 relating to the administrative regionalization of the territory failed, the complex relationshipsbetween the political class and the central institution of the district have always wavered between the prospect ofsuppression, the desire for reform and indecisiveness. As such these relations revealed the prevarications andparadoxes of the political class which wanted an in depth reform of the Civil Governor’s role while maintaining theinstitution in an ambiguous situation. The organic law n° 1/2011 of November 30th 2011 states that the CivilGovernor is abolished. In the absence of the local representative of the central power, a theoretical reform is proposedwhere the regional Prefeito represents the State in the administrative regions once they are established.
