The goal of this diploma thesis is to introduce the intellectual property rights protection in the member states of the World Trade Organization and the main agreement that regulates this area, i.e. Agreement on Trade-Related Aspects of Intellectual property Rights. The only discussed topic in the current round of negotiations are geographical indications and the creation of multilateral system for notifying and registering geographical indications for wines and spirits. Moreover, the thesis deals with the work of the TRIPS Council and several disputes related to TRIPS fulfillment.

Based on the two-level model proposed by Robert Putnam, it considers the impact of domestic actors in the decision-making process of the US foreign trade policy. From this perspective, we analyze how the pharmaceutical industry lobby is organized and its strategies to assert their interests and influence the formulation of the country's foreign policy, by using its financial resources and channels of influence with governamental institutions responsible for the definition of trade policy to pressure the US government in its international negotiations for regulations that would benefit the sector. Thus, the case study of the TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) negotiations under GATT (General Agreement on Tariffs and Trade) demonstrates how the pharmaceutical lobby strategy proved to be efficient / A presente pesquisa tem como objetivo analisar a participação de grupos de interesse na definição da política externa norte-americana ao defenderem seus interesses econômicos. Com base no modelo do jogo de dois níveis proposto por Robert Putnam, considera-se o impacto dos atores domésticos no processo de tomada de decisão na política externa comercial dos Estados Unidos. Sob tal perspectiva, analisaremos como lobby da indústria farmacêutica norte-americana se organizou e quais estratégias foram adotadas por eles para fazer valer os seus interesses e influenciar a formulação da política externa do país, utilizando seus recursos financeiros e influência política junto a instituições governamentais responsáveis pela definição da política comercial para pressionar o governo norte-americano em suas negociações internacionais por regulamentações que beneficiassem o setor. 民用航空器貿易之「AB大戰」,係指歐盟空中巴士公司(Airbus)與美國波音公司(Boeing)為了爭取訂單,聯合其母國政府,對民用航空器採購商之政府施加壓力,因而引發的貿易爭端,這也正是WTO民用航空器貿易協定(Agreement on Trade in Civil Aircraft )制定之背景。 我國自二○○二年二月一日正式簽署上述協定,自應遵守該協定第4條禁止使用不合理壓力與誘因影響購機決定之規定。不料同年華航中程客機之採購,卻引發歐盟指控有違前述規定。事件最後在華航宣佈同時向波音、空中巴士購機後落幕,但也顯見AB大戰並未因民用航空器貿易協定之出爐而停息。 由於民用航空器產業目前最大者即為歐美之A、B兩大生產廠商,一旦一造在爭取訂單時,採取了違反民用航空器貿易協定第4條之手段,且得以因控方難以舉証其之違反而免於任何後果,則根據賽局理論,另一造必也會採取相仿之謀略。 根據上述的發現,華航未來的購機,難免會再度陷入腹背受脅、受誘的困境,不過由於舉證責任之困難,美、歐應不致對我國訴諸爭端解決,愈發突顯民用航空器貿易協定第4條規範功能之有限。 / Airbus and Boeing have long been in trade conflict, also known as the “AB War”, under which both companies unite their respective governments to exert pressure on the governments of countries which procure civil aircraft, all for the purpose of securing contracts. It is also the background behind the adapt of the Agreement on Trade in Civil Aircraft. Taiwan became official signatory of the Agreement on Trade in Civil Aircraft on Feb.1, 2002. As a signatory, Taiwan should obey the rules of Article 4 which forbids using unreasonable pressure and inducement to affect decisions on aircraft procurement. However, the procurement of aircraft by China Airlines at the same year was accused by the EU of violating the rule discussed above. The dispute ended finally after China Airlines announced that it would procure aircraft from both of these companies. It also reveals that this war has not been finished even with the existence of the agreement. Airbus and Boeing are the biggest manufacturers in world’s civil aircraft industry. If one of them adopts measures violating Article 4 of the agreement, and is relieved from any consequences because the plaintiff cannot prove the disobedience, the rival side would undoubtedly, at the time, according to the game theory, the take the same strategy. According to the discovery above, in the future the China Airlines will unavoidably fall into same dilemma of being threatened and induced by the manufacturers. However, It is believed that U.S and EU would not easily seek settlement of controversies considering the difficulty in producing proof. It also discloses that the function of Article 4 is obviously limited.

技師服務具有高度專業性與技術性,且與一國基礎建設具重大關係,攸關人民生命財產安全,往往受到各國政府之管制。各國為確保技師服務提供之品質,通常對於技師服務進行證照管制,令技師服務之提供限於取得該國技師資格與執業執照者始得為之。有關技師資格與核發執業執照之規定通常散落於各國國內規章中,該等國內規章之適用勢必將對技師服務貿易產生影響。 在世界貿易組織(World Trade Organization,以下簡稱WTO)之服務貿易總協定下(General Agreement on Trade in Services),WTO會員基於自願性之基礎對各項服務部門之市場開放提出承諾,技師服務屬於專業服務之範疇,亦包含於會員可能提出開放承諾之範圍內。由於各會員國內規章之規定並不須納入會員服務貿易特定承諾表內,因此若欲了解技師服務貿易自由化之情形,除須檢視各國對於技師服務所為之開放承諾外,亦應瞭解國內規章對於技師服務貿易所造成之限制。 本文以技師資格相關之國內規章為出發點,探討國內規章對於技師服務貿易自由化所產生之影響,並針對目前國際間有關技師資格之相互認許進行討論,最後對於未來技師服務貿易自由化提出建議。 / Engineering services, with high professional specialty and technical background, plays an essential role in national infrastructure and is fatal to public security. To ensure the quality of the services provided, national governments usually implement the license regulation on engineering services. Only those who obtain the engineer qualification and acquire the license can practice their own specialty. The requirement for engineer qualification and license issuing, containing in the domestic regulations, will definitely have the impact on trades of engineering services. Under the General Agreement on Trade in Services of the World Trade Organization (hereinafter the “WTO”), WTO members make market-access commitments on a number of service sectors on the basis of voluntary. Since engineering services belongs to the category of professional services, it may also be the subject included in the commitments made by members. Since members have no obligations to inscribe domestic regulations in their schedules of specific commitments, with the purpose to understand the practical trade liberalization of engineering services, we should not simply focus on the commitments made by members, the limitation to trade of engineering services caused by domestic regulations should also be taken into consideration. This thesis initiates with the relevant domestic regulations of engineer qualification, observing how those regulations would affect the trade liberalization of engineering services. It accordingly discusses the nowadays international mutual recognition system of engineer qualification, and ends with some suggestions and thoughts regarding the future trade liberalization of engineering services.

Η συμφωνία TRIPS, υπό την ομπρέλα του Παγκόσμιου Οργανισμού Εμπορίου και εξυπηρετώντας τα συμφέροντα που την εμπνεύστηκαν και την επέβαλαν, συνέδεσε για πρώτη φορά την πνευματική ιδιοκτησία με το εμπόριο και έθεσε τα ελάχιστα επίπεδα για την προστασία της, συμπεριλαμβανομένου του τομέα των πατεντών στα φαρμακευτικά προϊόντα και τις διαδικασίες παραγωγής τους. Στην παρούσα εργασία, αφού αναλυθούν τα βασικότερα άρθρα που αφορούν στην προστασία των πατεντών και των αποτελεσμάτων δοκιμών, οι «TRIPS flexibilities», οι προσπάθειες περιορισμού του πεδίου εφαρμογής τους, σκιαγραφείται η νέα τάξη πραγμάτων που διαμορφώνεται κάτω από τις πιέσεις των κυρίαρχων συμφερόντων για πιο επεκτατική και αυστηρή προστασία της πνευματικής ιδιοκτησίας. Οι επιπτώσεις της TRIPS και των διμερών και περιφερειακών TRIPS-plus συμφωνιών στην πρόσβαση στα φάρμακα, περιγράφονται υπό το πρίσμα της διαμόρφωσης των τιμών τους και της αδυναμίας να καλυφθεί το χάσμα χρηματοδότησης R&D για ασθένειες που πλήττουν το 90% του παγκόσμιου πληθυσμού (10/90 gap), παρά τις προς του αντιθέτου υποσχέσεις του ανεπτυγμένου κόσμου. Συμπεραίνουμε ότι το μοντέλο “one-size-fits-all” για την προστασία της πνευματικής ιδιοκτησίας, παραβλέπει τις διαφορετικές ανάγκες και δομές κάθε κοινωνίας και ενισχύει τις ανισότητες του πλανήτη. Οι προτάσεις μας συντείνουν στην αναγκαιότητα ανάληψης συντονισμένων δράσεων εκ μέρους των κυβερνήσεων των κρατών, των διεθνών οργανισμών, της επιστημονικής κοινότητας και των πολιτών ώστε το αναπαλλοτρίωτο ανθρώπινο δικαίωμα στη ζωή και την υγεία, να τύχει του σεβασμού που του αξίζει. / --
