Com base no modelo do jogo de dois níveis proposto por Robert Putnam, considera-se o impacto dos atores domésticos no processo de tomada de decisão na política externa comercial dos Estados Unidos. Sob tal perspectiva, analisaremos como lobby da indústria farmacêutica norte-americana se organizou e quais estratégias foram adotadas por eles para fazer valer os seus interesses e influenciar a formulação da política externa do país, utilizando seus recursos financeiros e influência política junto a instituições governamentais responsáveis pela definição da política comercial para pressionar o governo norte-americano em suas negociações internacionais por regulamentações que beneficiassem o setor. Assim, o estudo de caso das negociações do acordo TRIPS (Trade-Related Aspects of Intellectual Property Rights) no âmbito do GATT (General Agreement on Tariffs and Trade) demonstra como a estratégia do lobby farmacêutico se revelou eficiente. / The present work aims to analyze the participation of interest groups in the definition of the American foreign policy when defending their interests. Based on the two-level model proposed by Robert Putnam, it considers the impact of domestic actors in the decision-making process of the US foreign trade policy. From this perspective, we analyze how the pharmaceutical industry lobby is organized and its strategies to assert their interests and influence the formulation of the country's foreign policy, by using its financial resources and channels of influence with governamental institutions responsible for the definition of trade policy to pressure the US government in its international negotiations for regulations that would benefit the sector. Thus, the case study of the TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) negotiations under GATT (General Agreement on Tariffs and Trade) demonstrates how the pharmaceutical lobby strategy proved to be efficient.

O estudo foi realizado através de pesquisa bibliográfica e legislativa e culmina com a comparação entre TPP e TRIPS. O estudo será focado no período pós-TRIPS, no qual a governança do comércio internacional passa por grandes transformações e a regulamentação da propriedade intelectual fora do âmbito da OMC cresce, cada vez mais, com a formulação de regras consideradas TRIPS-plus e TRIPS-extra. Esta realidade do período pós-TRIPS pode afetar a função social da propriedade intelectual e torná-la um óbice para o desenvolvimento econômico. A implementação da agenda 2030 para o desenvolvimento sustentável exige solidariedade global através da cooperação internacional, envolve o debate multilateral do comércio internacional centrado na OMC e a facilitação da transferência de tecnologia. O debate multilateral e mais democrático sobre temas atinentes ao comércio internacional, propiciado pela OMC, está ameaçado. / The thesis aims to study the effects of trade mega-agreements, specifically the Transpacific Treaty (TPP) on pharmaceutical patents and, consequently, on access to medicines. The study was carried out through bibliographical and legislative research and culminates in the comparison between TPP and TRIPS. The study will focus on the post-TRIPS period in which international trade governance undergoes major transformations and the regulation of intellectual property outside the WTO is increasingly being developed by the formulation of TRIPS-plus and TRIPS- extra. This reality of the post-TRIPS period can affect the social function of intellectual property and make it an obstacle to economic development. Implementing the 2030 agenda for sustainable development requires global solidarity through international cooperation, involves the multilateral debate on international trade centered on the WTO and facilitating technology transfer. The multilateral and more democratic debate on issues related to international trade, provided by the WTO, is threatened.

Tripping over our own feet : a critical discussion of Trade Related Intellectual Property Rights (TRIPS) with specific reference to their impact on South Africa's ability to combat HIV and AIDS

This thesis aims to look at the agreement on Trade Related Intellectual Property Rights (TRIPS) with specific reference to their impact on South Africa's ability to combat HIV and AIDS. It begins by looking at the history of patents and intellectual property rights and illustrates why and how the TRIPS Agreement came into existence. The TRIPS Agreement exemplifies the disparities between developed and developing countries and this can clearly be seen with regard to the provision of anti-HIV and AIDS drugs. The developing world deals with the bulk of the HIV and AIDS epidemic whilst the developed world holds most of the patents on the medication needed to treat those living with HIV and AIDS. This situation lends itself to a rift between patient rights on the one hand, and patent rights on the other. Traditionally the state has been the provider of rights such as health, but TRIPS alters this to include strong patent protection that is in line with neo liberal doctrine. The thesis examines these tensions with specific reference to South Africa's ability successfully to implement programmes to combat HIV and AIDS.

The exceptions to patent rights under the WTO-TRIPS Agreement : where is the right to health guaranteed?

"The thesis of this study is that the flexibility within the exceptions to patent rights protecton under the TRIPS Agreement has not sufficiently been exploited at the national level. The study conceptualises the regimes for the protection of the right to health and IPRs not as mutually exclusive but as potentially reinforcing. The contention is therefore that the obligations in respect to the right to health limit the manner in which states can exercise the flexibilty within the patent regime of the TRIPS Agreement. Eventually the study seeks to answer the question: Where does the guarantee for the right to health lie in light of the TRIPS regime? ... The study is divided into three chapters preceded by an introduction. The introduction lays the background for te discussion. Chapter one deals with the definition of important concepts and provides the context in which the study is set. The chapter also discusses the background to the creation of the TRIPS Agreement, with an emphatic discussion on the involvement or lack thereof of Africn and other least developed and developing countries in this process. Chapter two discusses the patent rights exceptions clause under the TRIPS Agreement. Against this background, compuslory licensing, government use and parallel importing as means of making accessibility to drugs a reality under the TRIPS Agreement will be discussed. Chapter three identifies other means of making drugs more accessible and identifying places where they have worked well. In this chapter, generic substitution, establishemnt of a pricing committee, therapeutic value pricing, pooled procurement, negotiated procurement and planned donations will be discussed. Access to medicines under the World Trade Organisation TRIPS Agreement: a comparative study of select SADC countries

Despite the adoption of the Doha Declaration on the TRIPS Agreement and Public Health in 2001, which unequivocally affirmed WTO members’ rights to use compulsory licences and other TRIPS flexibilities to access medicines, thirteen years on, developing countries and least developed countries are still grappling with access to medicines issues and a high disease burden. Despite some well researched and eloquent arguments to the contrary, it is a trite fact that patents remain an impediment to access to medicines by encouraging monopoly prices. The WTO TRIPS Agreement gives members room to legislate in a manner that is sympathetic to access to affordable medicines by providing for exceptions to patentability and the use of patents without the authorisation of the patent holder (TRIPS flexibilities). This study focuses on access to medicines under the TRIPS Agreement from a SADC comparative perspective by interrogating the extent of the domestication of TRIPS provisions promoting access to medicines in the SADC region with specific reference to Botswana, South Africa and Zimbabwe. After establishing that all SADC members, including Seychelles which is yet to be a WTO member have intellectual property (IP) laws in their statute books, this study confirms that while most of the IP provisions may be used to override patents, they are currently not being used by SADC members due to non-IP reasons such as lack of knowledge and political will. The study also engages in comparative discussions of topical occurrences in the context of access to medicines litigation in India, Thailand and Kenya and extracts useful thematic lessons for the SADC region. The study’s overall approach is to extract useful lessons for regional access to medicines from the good experiences of SADC members and other developing country jurisdictions in the context of a south-south bias. The study draws conclusions and recommendations which if implemented will in all likelihood lead to improved access to medicines for SADC citizens, while at the same time respecting the sanctity of patent rights. The study recommends the adoption of a rights-based approach, which will ultimately elevate patient rights over patent rights and urges the region to consider using its LDCs status to issue compulsory licences in the context of TRIPS Article 31 bis while exploring the possibility of local pharmaceutical manufacturing to produce generics, inspired by the experiences of Zimbabwe and current goings on in Mozambique and the use of pooled procurement for the region. The study embraces the rewards theory of patents which should be used to spur innovation and research into diseases of the poor in the SADC region. Civil society activity in the region is also identified as a potential vehicle to drive the move towards access to affordable medicines for all in the SADC region. / Mercantile Law / LL.D.

The trade, development and cooperation agreement between the Republic of South Africa and the European Union : an analysis with special regard to the negotiating process, the contents of the agreement, the applicability of WTO law and the Port and Sherry Agreement

Thesis (LLM)--University of Stellenbosch, 1999. / ENGLISH ABSTRACT: This thesis deals with the Trade, Development and Cooperation Agreement (TDCA) between the European Union and the Republic of South Africa, which was concluded in October 1999. In particular, the agreement is analysed in the light of the negotiating process between the parties, the contents of the agreement, the applicability of WTO law and the compatibility of the agreement with it and the Port and Sherry Agreement. Since the EU emphasised its aim to commence economic and development cooperation with other African, Caribbean and Pacific (ACP) countries on a reciprocal basis during the negotiations for a successor of the Lomé Convention, the TDCA between the EU and South Africa had to be seen as a "pilot project" for future cooperation agreements between countries at different levels of development. The TDCA between the EU and South Africa is therefore not only very important for the two concerned parties, but could serve as an example for further negotiations between the EU and other ACP countries. Thus the purpose of this thesis is to examine the TDCA between the EU and South Africa from a wider global perspective. The thesis is divided into six Chapters: The first Chapter provides an introduction to the circumstances under which the negotiations between the EU and South Africa commenced. It deals briefly with the economic situation in South Africa during the apartheid era and presents reasons why the parties wanted to enter into bilateral negotiations. The introductory part furthermore presents an overview of the contents of the thesis. The second chapter contains a detailed description of the negotiating process that took place between the parties and shows why it took 43 months and 21 rounds of negotiations to reach a deal. South Africa's partial accession to the Lomé Convention and the conclusion of separate agreements such as the Wine and Spirits Agreement, are also analysed. Chapter three presents the various components of the TOCA and illustrates what the negotiators achieved. This chapter on the TOCA concludes with an evaluation of the Agreement and shows the potential benefits to South Africa and the EU. Since the Agreement had to satisfy international rules, the provisions of the General Agreement on Tariffs and TradelWorld Trade Organisation (GATTIWTO) were of major importance. The EC Treaty, however, does not contain any provision that indicates whether, or how, an international agreement like the GATTIWTO penetrates the Community legal order. In Chapter four, accordingly, questions are raised regarding the extent to which the bilateral agreement between South Africa and the EU was influenced by the GATTIWTO provisions and how these rules were incorporated into the agreement. Furthermore, since the parties agreed on the establishment of a free trade area, this chapter deals with the question of in how far the TOCA is in line with Article XXIV GATT. In addition to the GATT provisions, the TOCA is also affected by the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs). Therefore Chapter five deals with TRIPs in connection with the TOCA. The use of the terms "Port" and "Sherry" as the major stumbling block to the conclusion of the TOCA is analysed more closely. The final part, namely Chapter six, provides a summary of the results of the investigation. Furthermore, a conclusion is provided with regard to the question of whether the TOeA can be seen as an example for further trade relations between the EU and other ACP countries. / AFRIKAANSE OPSOMMING: Hierdie tesis is gerig op die Handels-, Ontwikkelings- en Samewerkingsooreenkoms (TDGA) tussen die Europese Unie (EU) en die Republiek van Suid Afrika wat in Oktober 1999 gesluit is. Die ooreenkoms word veral in die lig van die onderhandelingsproses tussen die partye, die inhoud van die ooreenkoms, die toepaslikheid van Wêreldhandelsorganisasiereg en die versoenbaarheid daarvan met die ooreenkoms en die Port en Sjerrie-ooreenkoms ontleed. 美國與歐盟在航空產業的補貼爭議已有數十年之久,雙方互相指控對方補貼其國內民用航空器製造業,此一爭議雖經雙方談判協商,但終究談判破裂而進入世界貿易組織(WTO)爭端解決機構,成為WTO歷史上涉案金額最大的一次貿易糾紛案。雖然美國與歐盟就航空器補貼爭議相互於WTO下提出訴訟,總計成立了四個爭端案件,在如此複雜的情況下,目前僅歐盟航空補貼案(DS316)已進入至言詞辯論程序,其他爭議案均未進入實質審理程序,尚無資料可得分析,因此僅就DS316一案而為討論。 / 在該案中,美方指控歐盟以開發補助、基礎設施、研發技術補助等措施為空中巴士進行補貼,提升空中巴士之市場競爭力,對美國波音公司產生不良影響。上述措施是否違反WTO規定,著實進一步分析探討之必要,因此本文將介紹補貼及民用航空器的相關規定,由SCM協定下之補貼構成要件-政府財務補助、利益及特定性之要件,判斷歐盟是否構成補貼,而其中尚須檢驗美國與歐盟首次書狀中論點之合理性、考量過去小組類似判斷之見解與顧及1992年美歐航空器的雙邊協定,最後嘗試預測未來小組判斷中,對補貼之構成與否及其法律效果之意見。 / Subsidy dispute of aviation between the US and EU has been lasting over the past decades. Both sides accused each other of subsidizing domestic civil aircraft industry. In spite of having made efforts to solve the trade clash through negotiations, they eventually took the subsidy dispute before Dispute Settlement Body of the World Trade Organization(WTO) after the negotiations had failed. In the biggest case ever to come before WTO, US and EU separately filed legal complaints against each other at the WTO, which set up four dispute cases. However, except the oral arguments were held in the European Communities-Measures Affecting Trade in Large Civil Aircraft(DS316), the three other cases have not yet entered into substantial procedures. Therefore, this thesis intends to focus on the DS316 due to no related data available to analyze the rest of the cases. / In DS316, the US argued that EU subsidized Airbus by way of such measures as Launch Aid, Infrastructure & Regional Aid and Research & Technology to improve Airbus’s competitiveness in the aviation market and put its US rival Boeing at disadvantage. Given that whether the EU subsides are against the trade rules of the WTO needs further studies, this thesis would like to interpret related rules which regulate subsidy and civil aircraft industry. It would also like to decide if the EU involved in subsidizing by examining the constitutive requirements of subsidy under the Agreement on Subsidies and Countervailing Measures(SCM agreement)including financial contribution, benefit and specificity. This thesis will review the rationality of arguments in the first written submissions both by the US and EU, and then deliberate the opinions of similar decisions from the WTO panel in the past as well as take into account the Agreement between the European Economic Community and the Government of the United States of America concerning the Application of the GATT Agreement on Trade in Civil Aircraft on Trade in Large Civil Aircraft in 1992. Finally, this article tries to forecast the opinions about what is regarded as subsidy and the related legal effects in future decisions by the WTO panel.

聯合國教科文組織於二○○五年十月二十日通過文化多樣性公約。從談判歷史觀之,「文化多樣性」似乎是歐盟會員國於烏拉圭回合時在GATS下倡議「文化例外」之延續,也因此公約通過後,主張貿易自由化之一方擔心公約將限制貿易,而與GATS產生衝突;另一方面,主張文化保護之一方則認為公約可助其在GATS下續行推動「文化例外」,亦即將視聽服務排除GATS之適用。 本文研究之目的係在探討文化多樣性公約對於GATS視聽服務之影響。首先,本文就文化多樣性公約下的重要規定進行研析,並以視聽服務為論述核心,探討公約與GATS間的可能衝突。在綜合考量規範衝突及談判現況後,本文最後試評估公約對於GATS視聽服務之影響,並提出對未來視聽服務談判之展望。 公約下的義務,由於締約國在履行上多保有裁量權,解釋上尚難構成貿易限制或具歧視性;另一方面由於GATS規範極具彈性,WTO會員國本不負絕對的特定承諾義務。依此,公約與GATS發生衝突發生之可能性並不大。至於公約的權利規定,或有違反GATS義務之虞,惟由於締約國可選擇不行使公約權利而履行GATS義務,因此公約權利與GATS義務的衝突得以事先避免。 由於公約對GATS之衝擊有限,再加上公約將可提供一個文化議題協商之平台,公約或可紓解WTO會員國對於文化保護之關切,進而摒除彼等國家在GATS下基於文化保護而不願開放之疑慮。依此,本文研判公約對於GATS視聽服務自由化將是助力,有助於視聽服務談判之進行。鑒於GATS下並無文化一般例外以調和兩套規範,本文建議未來在WTO下可透過增訂「部長決議」,要求WTO會員國於解釋並適用GATS規定時應將公約之相關規定列入考量,俾達成公約與GATS間相互支持之目標。 / On 20 October 2005, the UNESCO General Conference approved the “Convention on the Protection and Promotion of the Diversity of Cultural Expressions.” Judging by the negotiating history, “cultural diversity” appears to be the continuation of “cultural exception” invoked by the European Communities under the GATS negotiations during the Uruguay Round. Therefore, after the Convention is approved, free trade supporters worry that the convention might restrict trade and conflict with the GATS rules. On the other hand, cultural protectionists argue that the Convention has merits in moving forward “cultural exception,” i.e. to prohibit the application of the GATS rules on the audiovisual services. The objective of the thesis is to analyze the impact of the Convention on the audiovisual services under the GATS. The thesis first studies the rules under the Convention and discusses potential conflicts between the Convention and the GATS in terms of audiovisual services. Considering both the conflicts of norms and current negotiations, the thesis attempts to assess the impact of the Convention on the audiovisual services and forecast the future of negotiations on the audiovisual services under the GATS. The obligations of the Convention may not be easy to be interpreted as trade restrictions or discriminations because States Parties can mostly reserve their rights to perform. On the other hand, GATS rules is so flexible that WTO Members need not make specific commitments under the GATS. Accordingly, the possibility of conflicts is not high. Though the rights of the Convention might be contradictory to the obligations of the GATS, States Parties can choose to perform their obligations of the GATS rather than exercise their rights of the Convention in order to preclude the existence of the conflicts. The Convention only has limited impact on the GATS. In addition, the Convention provides a forum of negotiations on cultural issues so that it might smooth over WTO Member’s concern with cultural protection and remove their doubts of liberalization on the basis of cultural protection. Judging from this, the Convention can give a boost to the liberalization of audiovisual services and facilitate the negotiations. In light of the fact that there is no general exception clauses of cultural protection under the GATS to harmonize the two international instruments, this thesis suggests that “Ministerial Decision” be adopted to request WTO Members to take relevant rules of the Convention into consideration when interpreting and applying the GATS rules in order to achieve the goal of mutual supportiveness between the Convention and the GATS.

Harmonization of International Securities Markets Regulation: A Trade Perspective

Widespread cross-border securities trading have led to the internationalization of securities markets. No one seriously disputes that such securities dealings require regulation, but there is no academic consensus on the best normative approach to such regulation. The academic debate initially focused on whether regulatory competition or cooperation constitutes the better model. However, the debate seems to have evolved to adopt a hybrid model combining the virtues of these two approaches. ‘Harmonization’ constitutes the dominant hybrid model. Nevertheless, the implementation of the harmonization model has barely received any attention in the literature. The aim of this thesis is hence two-fold: first, justify why harmonization should be the preferred model for the regulation of international securities markets; and second, develop, applying an international trade regulation perspective, a regulatory framework to implement the harmonization model using the World Trade Organization and General Agreement on Trade in Services (WTO/GATS) framework.
