O presente estudo analisa as estratégias de resistência em uma assessoria jurídica em direitos sexuais e de gênero. A análise é feita a partir das vivências no grupo G8-Generalizando do Serviço de Assessoria Jurídica da Universidade Federal do Rio Grande do Sul (SAJU-UFRGS), tensionando as lógicas instituídas e buscando formas possíveis de operar para além dessas. A proposta metodológica para essa pesquisa foi a de pesquisa-intervenção e de intervenção fotográfica, utilizando-se de ferramentas da análise institucional tais como a construção de analisadores, a análise de implicação e o diário de campo. Partindo do pressuposto teórico foucaultiano de que vivemos em uma sociedade imersa em relações de poder, e compreendendo que a possibilidade de resistir está intrínseca a essas relações, buscamos nesse estudo visibilizar os momentos em que o grupo G8-Generalizando rompe com instituído em busca de práticas que transversalizem as formas de trabalhar. A imagem enquanto intervenção possibilitou provocar deslocamentos no grupo, funcionando como um dispositivo de tornar visível o invisível do visível. Assim, as imagens permitiram que os integrantes do grupo olhassem para as mais diversas fotografias produzidas ao longo dos anos de 2013 e 2014 e analisassem suas práticas. Dessa forma, colocamos em análise os momentos em que o grupo consegue transver, enquanto uma potência de criação e imaginação. Para esse percurso focaremos em três fluxos que oportunizaram pensar as estratégias de resistência dentro do grupo: a transdisciplinariedade, o acolhimento e a militância. Esses analisadores surgiram ao longo das reuniões que participei enquanto pesquisadora e da problematização através das inúmeras fotografias que habitavam o campo de intervenção. As estratégias de resistência aqui pensadas mostram uma forma de transformação nas práticas do G8-G.Essas transformações tornam-se possíveis por constantes tensionamentos que são postos quando o grupo opera para fora da lógica normativa, tendo em vista que o Direito, a Psicologia e outras tantas disciplinas não dão conta de serem efetivas no acolhimento de sujeitos que desviam da norma. Observa-se na presente dissertação um conflito social perene nas sociedades: o choque entre discurso legitimado pelo campo jurídico de gênero e o discurso cotidiano de gênero. A partir da experiência etnográfica no grupo de Assessoria Jurídica Universitária G8- Generalizando (SAJU/UFRGS), vivencia-se o contexto em que há uma intersecção jurídica e de gênero, na qual seus significados modificam-se no tempo. Para contextualizar a existência do campo de pesquisa observam-se significados de gênero na história da legislação brasileira (como o Estatuto da Mulher Casada e a Lei Maria da Penha). Da mesma forma, precedentes de tribunais demonstram significados de interpretação das leis (misturam-se a linguagem do direito e a do cotidiano), ressignificando o direito legitimado pelo campo. Por fim, apresentase a vivência no campo de pesquisa, buscando relatar o que acontece com alguns problemas de gênero e jurídicos que chegam ao G8-Generalizando. Busca-se apontar os diferentes significados das conflitualidades de gênero dentro e nas margens do campo jurídico. / The present dissertation observes an enduring social conflict in today society: the clash between the legal understanding of gender and the average person concept of gender. From the ethnographic experience in the group of University Counsel G8-Generalizando (Assessoria Jurídica Universitária G8-Generalizando – SAJU/UFRGS) the context in which there is a legal and gender discourse, in which their meanings change in time. The present dissertation also studies the history of the research field that observes the understanding of gender in the history of Brazilian legislation (such as the Statue of Married Women and the Maria da Penha Statute). The work also presents the courts understanding of laws that interprets gender issues and shows the daily clash of law and everyday meaning of gender. Finally, the dissertation shows the experience in the case-by-case research, seeking to demonstrate what happens to legal issues concerning gender that are represented by G8- Generalizando. That way the thesis demonstrates the different meanings of gender on different levels of society and the problem that it brings to the legal system.

A estratégia metodológica utilizada é a intervenção fotográfica, inserida no âmbito da psicologia social e da pesquisa-intervenção, tendo por base o acompanhamento do grupo e utilizando-se de ferramentas oriundas da Análise Institucional. As experiências do G8-G se configuram como práticas de si onde um trabalho de si sobre si mesmo se coloca enquanto um trabalho ético que aponta na direção de uma estética da amizade que convoca outras maneiras de operar em assessoria jurídica universitária, através da horizontalização, descentralização, parceria, lidando com a complexidade e instabilidade na direção de uma singularização do trabalho e de uma composição da vida como uma obra de arte. / This study examines the practices in university legal counsel, questioning the experience of Generalizing Group-G8 (G8-G) workers of the Office of Legal Counsel of Rio Grande do Sul Federal University (UFRGS-SAJU) working with gender rights. The study investigates how the practice of university legal counsel arises as an ethic that enhances the production of an aesthetic of friendship between G8-G workers. The methodological approach is photographic intervention, embedded within social psychology and research intervention, based on monitoring the group and using tools derived from the institutional analysis. The photographic intervention allows the analysis of what is utterable and visibilities present in G8-G using the tools of analysis of implication, research diary, restoration and photography workshops. The photographic intervention is based on the concept of the photographic act where not only the images are important, but the entire process involved in producing, looking, contemplating, thinking and dealing with the photographs. Discussions provoked by the intervention, analyzed in the light of the notions of self, ethics and aesthetics in Foucault and which embody the concept of aesthetics of friendship, indicate G8-G as a collective in flow composed of movements that produce subjectivity, being these movements advice, gender and disciplines. G8-G experiences are configured as a practice where a work by itself on itself stands as a work ethic that points towards an aesthetic of friendship that summons other ways to operate in university legal counsel, by flattening, decentralization, partnership, dealing with the complexity and instability towards a singularity of the paper and a composition of life as a work of art.

Para contextualizar a existência do campo de pesquisa observam-se significados de gênero na história da legislação brasileira (como o Estatuto da Mulher Casada e a Lei Maria da Penha). Da mesma forma, precedentes de tribunais demonstram significados de interpretação das leis (misturam-se a linguagem do direito e a do cotidiano), ressignificando o direito legitimado pelo campo. Por fim, apresentase a vivência no campo de pesquisa, buscando relatar o que acontece com alguns problemas de gênero e jurídicos que chegam ao G8-Generalizando. Busca-se apontar os diferentes significados das conflitualidades de gênero dentro e nas margens do campo jurídico. / The present dissertation observes an enduring social conflict in today society: the clash between the legal understanding of gender and the average person concept of gender. From the ethnographic experience in the group of University Counsel G8-Generalizando (Assessoria Jurídica Universitária G8-Generalizando – SAJU/UFRGS) the context in which there is a legal and gender discourse, in which their meanings change in time. The present dissertation also studies the history of the research field that observes the understanding of gender in the history of Brazilian legislation (such as the Statue of Married Women and the Maria da Penha Statute). The work also presents the courts understanding of laws that interprets gender issues and shows the daily clash of law and everyday meaning of gender. Finally, the dissertation shows the experience in the case-by-case research, seeking to demonstrate what happens to legal issues concerning gender that are represented by G8- Generalizando. That way the thesis demonstrates the different meanings of gender on different levels of society and the problem that it brings to the legal system.

But in the context of the university where it happens nowadays, we speak of practice as a university extension, a mark of its political transformative intention, and we identify it with the popular movement of the extension. This characterization, as a practice, highlights the requirement for production of socially useful knowledge in the extension. This characterization emphasizes the popular education as a methodology, but with the multiplicity of meanings that the term includes nowadays, it is necessary understand at the methodological moments the implementation of this practice, our real approximation of the union between theory and practice. In this sense, the systematized experience show us the one hand, the outline of their own way of doing popular extension popular with the Law: a practice with a greater community insertion, where the research is not a preview, but part of the same action, and recognizes that other legal sociability, besides the official ones. But the systematized experience also shows us, however, our difficulties even in this dialogic exercise with the people, in this work guided by an emancipator ethical sense. Thinking practices in an ethical sense is to recognize that every practice brings a social theory (as a way of being, being and knowing), and produces knowledge and transformation (albeit conservatively) in the reflexivity of these modes of relating in the world and with the world. In other words, our practices, as well as the knowledge we produce because of them, are closely related to a model of civilization. It is here that talk about AJUP as a popular extension in law, and about the necessary production of useful knowledge in this practice, takes up the debate on the values in the knowledge. The experiences demonstrate a useful knowledge, produced in the social practice, in relational way in the existential situations of life. And it's acknowledging rationalities different from the rationality of modern science that the popular extension questions deeply the university. The understanding of our difficulties is the recognition that our practices often reproduce the dominant and dominating ethic we criticize, especially when we don t reflect on our cultural conditioning that we are also immersed. In our case, the AJUP, it is important to recognize the limits of our "vision of law", and also the vision of "our law". In this sense, a practice in an ethical-liberator sense means more an attitude of constant questioning of ourselves and our relations with the world, than the reproduction of any model of "emancipatory" practice. It's in fact, an exercise of a profound self-criticism, of ourselves and our practices, that guides us to bridge the gaps between our say and our doing, for the concrete realization of a liberating practice and in a University Popular Juridical Assessory. / Fazemos aqui uma reflexão de uma prática social denominada Assessoria Jurídica Universitária Popular (AJUP). Das nossas próprias práticas ajupianas, naquilo que as falas dos seus membros explicitam sobre sua característica principal: sua capacidade crítica e emancipatória do direito, da universidade e da sociedade. Resgatamos seu marco teórico na experiência histórica dos movimentos teórico-práticos críticos do direito da década de 1980 e 1990. Mas no contexto da universidade em que se realiza hoje, falamos da prática enquanto uma extensão universitária e, marca de sua intencionalidade política transformadora, a identificamos com o movimento da extensão popular. Caracterização que, como uma práxis, ressalta a exigência de produção de conhecimento socialmente útil na extensão. Esta caracterização enfatiza a educação popular como metodologia, mas na pluralidade de sentidos que o termo abrange hoje torna necessário perceber nos momentos metodológicos de implementação dessa práxis nossa real aproximação da unidade teórico-prática. Nesse sentido, as experiências sistematizadas nos mostram por um lado, o esboço de um modo próprio de fazer extensão popular em direito: um fazer com uma maior inserção comunitária, em que a investigação não é uma prévia, senão, parte mesma da ação, e que reconhece sociabilidades jurídicas outras, além das oficiais. Mas mostram-nos também, por outro lado, nossas dificuldades ainda nesse exercício dialógico com o povo, nesse trabalho orientado por um sentido ético libertador. Pensar nas práticas em sentido ético é reconhecer que toda prática social traz consigo uma teoria (como modo de ser, estar e conhecer), e produz conhecimento e transformação (ainda que conservadora) na reflexividade desses modos de se relacionar no mundo e com o mundo. Ou seja, nossas práticas, assim como o conhecimento que produzimos nelas, estão intimamente relacionadas a um modelo civilizatório. É aqui que falar em AJUP como extensão popular em direito, e da necessária produção de conhecimento útil nesta prática, retoma o debate do valor no conhecimento. As experiências demonstram um conhecimento útil, produzido na prática social, de modo relacional nas situações existenciais da vida. E é reconhecendo racionalidades diversas da racionalidade da ciência moderna que a extensão popular questiona profundamente a universidade. A compreensão das nossas dificuldades está no reconhecimento de que nossas práticas reproduzem muitas vezes a ética dominante e dominadora que tanto criticamos, especialmente quando não refletimos sobre os condicionados culturais em que também estamos imersos. No nosso caso da AJUP, é importante reconhecer os limites do nosso olhar do direito , e também, do olhar do nosso direito . Nesse sentido, uma prática em sentido ético-libertador significa mais uma postura de questionamento constante de nós próprios e nossas relações com o mundo, que da reprodução de qualquer modelo de prática emancipatória . É no fundo um exercício de profunda autocrítica, de nós mesmos e de nossas práticas, que nos orienta para diminuir as distâncias entre nosso dizer e nosso fazer, para a realização concreta de uma prática libertadora e em Assessoria Jurídica Universitária Popular.
