Les contributions de la pratique de l'arbitrage d'investissement en Amérique latine au développement de l'arbitrage international / From the contributions to Arbitration practices in Investment in Latin America to development to International Arbitration

Depuis les années deux-mille, les Etats latino-américains ont activement participé aux arbitrages d’investissement administrés par le Centre international pour le règlement des différends relatifs aux investissements (CIRDI). Ainsi, la pratique arbitrale de ce Centre trouve son origine dans les très nombreuses affaires latino-américaines qui ont permis d’encadrer la procédure et d’entériner certaines pratiques liées aux questions de fond de l’arbitrage. Les affaires latino-américaines ont enrichi la procédure en consacrant notamment la participation des tiers à la procédure arbitrale par le biais de l’amicus curiae (l’ami de la Cour). Cette innovation démontre la prise en compte de l’impact des questions d’intérêt public sur les populations concernées. Les divers standards juridiques insérés dans les accords d’investissement ont également été invoqués par les investisseurs afin de voir engagée la responsabilité internationale des Etats. Ainsi, les arbitres ont pu s’exprimer sur le caractère imprécis de certains standards comme celui du traitement juste et équitable. Les tribunaux ont dégagé certains étalons de mesure qui permettent d’évaluer et de comparer les éléments de l’affaire. Deux étalons de mesure semblent être pertinents dans le cas latino-américain. Il s’agit du respect de la stabilité du cadre juridique puis de la protection des attentes légitimes de l’investisseur. C’est dans ce cadre que les Etats latino-américains ont réagi différemment face au contentieux arbitral auprès du CIRDI, ce dernier ayant fait l’objet de critiques quant à sa légitimité et quant aux différentes condamnations prononcées par les tribunaux à l’encontre des Etats. Certains Etats ont pris l’initiative de dénoncer les accords internationaux donnant compétence au CIRDI et de créer un nouveau centre d’arbitrage sur le continent, capable de connaître les différends en matière d’investissement. Ceci dit, les décisions et sentences arbitrales rendues dans le contexte latino-américain constituent une source d’inspiration précieuse pour les arbitrages internationaux en cours et futurs. / Since 2001, Latin American Countries have actively participated in investment arbitrations administered by the International Centre for Settlement of Investment Disputes (ICSID). Because of that the way to arbitrate in this Centre base itself on a great number of Latin American affairs which helped to delimit the procedures and endorse some practices linked to the very founding principles of arbitration.The procedure of arbitration has been improved by Latin American affairs, by example with the help of the Amicus Curiae, which is the participation of a third party to the arbitral process. This innovation shows how much these questions of public interest are important for the populations concerned.The multiple juridical standards inserted in the investment agreements have often been brought forward by the investors in order to see the responsibility of some countries engaged in an international way. Arbitrators have been able to emphasize on the inaccuracy of some of these standards, such as the the fair and equitable treatment.Different ways to measure the elements of an affair have been brought to light by the tribunals. Two of them are present in the case of Latin American affairs: the compliance with the juridical framework stability and the protection of the investor's legitimate expectations.Latin American countries did take action differently in front of the arbitrations brought to the ICSID which was criticized for its lack of legitimacy and for its decisions in a great number of cases against these countries. Some countries renounced the international treaties giving the ICSID its arbitration rights and created a new arbitration center on the continent capable of giving a ruling in the matter of investment affairs. In spite of this the arbitral decisions and the arbitral awards in the Latin American context should be able to be inspirations for the future of arbitration.

Três cenários reais foram utilizados no estudo de caso. Em cada cenário foi proposta a utilização de uma tecnologia ou mais combinadas para transmissão da informação, levando em consideração, alguns parâmetros como infraestrutura existente, distância entre usuários finais, taxa de transmissão, dentre outros. Algumas tecnologias de acesso, utilizadas neste trabalho, são comparadas com as soluções disponibilizadas pelas concessionárias prestadoras dos serviços existentes e atuantes nos cenários descritos. / This master’s dissertation proposes a comparative study related to the bit cost generated between NAVEGAPARÁ program and the telecommunications companies provided services in the related county Several studies are conducted analyzing only the performance of such systems taking into consideration some metric ones of evaluation performance, however, do not relate the real cost for the final user. Three real sceneries had been used as a case study. In each scenery was proposed the use of one or more combined technology for transmission of information taking into account some parameters such as pre-existing infrastructure, distance between end users, rate transmission, among others. It was compared the proposed solutions from this work with the solutions available by the existing and acting telecommunications companies on the sceneries analyzed.

L'évolution vers de nouveaux services, comme la TV à la demande, nécessitant de grosses bandes passantes remet en question les débits transportés par chaque canal optique d'un réseau WDM. Les débits des canaux ont atteint aujourd'hui les 100 Gbit/s. Cette montée en débit doit être accompagnée par de nouvelles fonctionnalités au sein des réseaux de transport optiques. Améliorer la flexibilité et assurer la transparence des réseaux optiques sont des défis très importants auxquels les opérateurs doivent faire face aujourd'hui. Un réseau optique est dit transparent, si les signaux optiques transportés ne subissent aucune conversion optoélectronique sauf au moment de leur insertion et de leur extraction dans le réseau optique. La flexibilité, quant à elle, concerne principalement les fonctions d'agrégation et de désagrégation optiques. Aujourd'hui ces fonctions d'agrégation et de désagrégation sont réalisées dans le domaine électronique, ce qui avec la montée du débit, va engendrer un coût important pour les opérateurs. Une manière d'y remédier serait de trouver une technologie adaptée à la montée du débit et offrant la possibilité de faire de l'agrégation et de la désagrégation optique des flux de trafics. Dans cette thèse nous proposons d'étudier une technique de commutation tout-optique offrant la possibilité de faire de la commutation optique intra-canal. Cette technique, baptisée multi-bande OFDM, consiste à diviser un canal WDM en plusieurs entités appelées sous-bandes. Le nombre de ces entités dépend des contraintes technologiques des équipements utilisés pour générer le canal multi-bande (les filtres optiques, les convertisseurs analogiques/numérique et numériques/analogiques). Nous comparons la technologie multi-bande OFDM par rapport à des technologies tendancielles mono-bande : le cas mono-bande opaque et mono-bande transparent. Nous démontrons que la technologie multi-bande OFDM peut être un compromis entre ces deux technologies pour les futurs réseaux de télécommunications optiques. Pour ce faire, nous calculons les performances en termes de blocage. Nous étudions l'impact de la conversion de longueurs d'onde sur les réseaux multi-bande OFDM ainsi que l'impact d'augmenter les nombres de sous-bandes sur les performances du réseau. Nous dégageons les limites technologiques de cette approche. Dans une autre partie de l'étude, nous montrons l'intérêt économique de la technologie multi-bande OFDM. Nous exposons le gain en coût des émetteurs/récepteurs obtenu grâce au déploiement de la technologie multi-bande OFDM sur un réseau cœur et un réseau métropolitain. / The evolution of new telecommunication services, which requires large bandwidth, challenges bit-rates transported by each optical channel of a WDM network. Bit-rates of optical channels have now reached 100 Gbit/s. This increase in bit-rate must be supported by new features in optical network. Improve flexibility and ensure transparency of optical network, are very important challenges that telecom operators face today. An optical network is called transparent, if the transported optical signals are not converted in electrical domain except at the time of their insertion and extraction in/from the optical network. Flexibility concerns mainly the aggregation / disaggregation processes. Today, the functions of aggregation/disaggregation are made on the electrical domain. This generates a significant cost for operators. One way to avoid this would be to find a technology which offers high bit-rates and enable the aggregation and disaggregation functions in the optical domain. In this thesis, we propose to study all-optical switching technology at the sub-wavelength granularity. This technique, called multi-band OFDM, consists in dividing a WDM channel into multiple entities, called sub-bands. The number of sub-bands depends on the technological constraints of optical components used to transport the optical signal (optical filters, digital analogical converters, analogical digital converters, optical transponders, optical multiplexers, etc.). We compare the multi-band OFDM technology to two legacies scenarios: mono-band opaque and mono-band transparent WDM technologies. We demonstrate that the multi-band OFDM technology can be a trade-off between these two legacies scenarios. To do that, we studied the performance in terms of blocking ratio of the multi-band OFDM technology and mono-bands WDM technologies. We study the impact of increasing the number of sub-bands on network performances. We also investigate the technical limits of this technology. Moreover, we demonstrate the economic interest of the multi-band OFDM. We expose the gain on the number of transponders when the multi-band OFDM technology is deployed on metro and core network.

Etude et Amélioration de Turbo-Codage Distribué pour les Réseaux Coopératifs

Dans les systèmes radio mobiles, la diversité représente une technique efficace pour lutter contre l’évanouissement dû aux multi-trajets. La pleine diversité spatiale est atteinte dans les systèmes multiple-input multiple-output (MIMO). Mais, souvent l’intégration d’antennes multiples au niveau de l’émetteur ou du récepteur est coûteuse. Comme alternative, dans les réseaux sans fil multi-hop, la diversité coopérative garantit des gains de diversité spatiale en exploitant les techniques MIMO traditionnelles sans avoir besoin d’antennes multiples. En outre, la diversité coopérative fournit au réseau : un débit important, une énergie réduite et une couverture d’accès améliorée.Dans ce contexte, l’objectif de cette thèse est de concevoir des schémas de codage pour le canal à relais afin de réaliser une meilleure performance en termes de gain de diversité et de gain de codage. D’abord, nous étudions un système de turbo-codage distribué à L-relais en mode soft-decode-and-forward. Ensuite, nous proposons un système de turbocodage coopératif distribué à L-relais en utilisant la concaténation en parallèle des codes convolutifs. Enfin, afin d’améliorer la fiabilité de détection au niveau du noeud relais, nous proposons la technique de sélection d’antenne/relayage-soft. Pour une modulation BPSK, nous dérivons des expressions de la borne supérieure de la probabilité d’erreurbinaire où les différents sous-canaux sont supposés à évanouissement de Rayleigh, indépendants et pleinement entrelacés avec une information instantanée d’état de canal idéal. Une validation des résultats théoriques est également menée par la simulation. / Diversity provides an efficient method for combating multipath fading in mobile radio systems. One of the most common forms of spatial diversity is multiple-input multipleoutput (MIMO), where full diversity is obtained. However, embedding multiple antennas at the transmitter or the receiver can sometimes be expensive. As an alternative to collocated antennas, cooperative diversity in wireless multi-hop networks confirms their ability to achieve spatial diversity gains by exploiting the spatial diversity of the traditional MIMO techniques, without each node necessarily having multiple antennas. In addition, cooperative diversity has been shown to provide the network with importantthroughput, reduced energy requirements and improved access coverage.In light of this, the objective of this thesis is to devise coding schemes suitable for relay channels that aim at showing the best compromise between performance of diversity and coding gains. Firstly, we investigate a distributed turbo coding scheme dedicated to L-relay channels operating in the soft-decode-and-forward mode. Then, we present a proposed distributed turbo coded cooperative (DTCC) scheme, called parallel concatenated convolutional-based distributed coded cooperation. Finally, we investigate antenna/soft-relaying selection for DTCC networks in order to improve their end-to-end performance. Assuming BPSK transmission for fully interleaved channels with ideal channel state information, we define the explicit upper bounds for error probability inRayleigh fading channels with independent fading. Both theoretical limits and simulation results are presented to demonstrate the performances.

Qubit control-pulse circuits in SOS-CMOS technology for a Si:P quantum computer

Microelectronics has shaped the world beyond what was thought possible at the time of its advent. One area of current research in this field is on the solid-state Si:P-based quantum computer (QC). In this machine, each qubit requires an individually addressed fast control-pulse for non-adiabatic drive and measure operations. Additionally, it is increasingly becoming important to be able to interface nanoelectronics with complementary metal-oxide-semiconductor (CMOS) technology. In this work, I have designed and demonstrated full-custom mixed-mode and full-digital fast control-pulse generators fabricated in a silicon-on-sapphire (SOS) CMOS commercial foundry process ?? a radio-frequency (RF) CMOS technology. These circuits are, fundamentally, fast monostable multivibrators. Initially, after the design specifications were decided upon, I characterized NFET and PFET devices and a n+-diffusion resistor from 500 nm and 250 nm commercial SOS-CMOS processes. Measuring their conductance curves at 300 300 K, 4.2 2 K, and sub-K (30 30 mK base to 1000 1000 mK) showed that they function with desirable behaviour although exhibiting some deviations from their 300 300 K characteristics. The mixed-mode first generation control-pulse generator was demonstrated showing that it produced dwell-time adjustable pulses with 100 100 ps rise-times at 300 K, 4.2 2 K, and sub-K with a power dissipation of 12 12 uW at 100 100 MHz. The full-digital second generation control-pulse generator was demonstrated showing accurately adjustable dwell-times settable via a control-word streamed synchronously to a shift-register. The design was based on a ripple-counter with provisions for internal or external clocking. This research has demonstrated that SOS-CMOS technology is highly feasible for the fabrication of control microelectronics for a Si:P-based QC. I have demonstrated full-custom SOS-CMOS mixed-mode and full-digital control circuits at 300 300 K, 4.2 2 K, and sub-K which suitable for qubit control.

Autour de l'évaluation numérique des fonctions D-finies

Les fonctions D-finies (ou holonomes) à une variable sont les solutions d'équations différentielles linéaires à coefficients polynomiaux. En calcul formel, il s'est avéré fructueux depuis une vingtaine d'années d'en développer un traitement algorithmique unifié. Cette thèse s'inscrit dans cette optique, et s'intéresse à l'évaluation numérique des fonctions D-finies ainsi qu'à quelques problèmes apparentés. Elle explore trois grandes directions. La première concerne la majoration des coefficients des développements en série de fonctions D-finies. On aboutit à un algorithme de calcul automatique de majorants accompagné d'un résultat de finesse des bornes obtenues. Une seconde direction est la mise en pratique de l'algorithme " bit burst " de Chudnovsky et Chudnovsky pour le prolongement analytique numérique à précision arbitraire des fonctions D-finies. Son implémentation est l'occasion de diverses améliorations techniques. Ici comme pour le calcul de bornes, on s'attache par ailleurs à couvrir le cas des points singuliers réguliers des équations différentielles. Enfin, la dernière partie de la thèse développe une méthode pour calculer une approximation polynomiale de degré imposé d'une fonction D-finie sur un intervalle, via l'étude des développements en série de Tchebycheff de ces fonctions. Toutes les questions sont abordées avec un triple objectif de rigueur (résultats numériques garantis), de généralité (traiter toute la classe des fonctions D-finies) et d'efficacité. Pratiquement tous les algorithmes étudiés s'accompagnent d'implémentations disponibles publiquement.

Experimental multiuser secure quantum communications

We are currently experiencing a rapid development of quantum information, a new branch of science, being an interdisciplinary of quantum physics, information theory, telecommunications, computer science, and many others. This new science branch was born in the middle of the eighties, developed rapidly during the nineties, and in the current decade has brought a technological breakthrough in creating secure quantum key distribution (QKD), quantum secret sharing, and exciting promises in diverse technological fields. Recent QKD experiments have achieved high rate QKD at 200 km distance in optical fiber. Significant QKD results have also been achieved in free-space. Due to the rapid broadband access deployment in many industrialized countries and the standing increasing transmission security treats, the natural development awaiting quantum communications, being a part of quantum information, is its migration into commercial switched telecom networks. Such a migration concerns both multiuser quantum key distribution and multiparty quantum secret sharing that have been the main goal of my PhD studies. They are also the main concern of the thesis. Our research efforts in multiuser QKD has led to a development of the five-user setup for transmissions over switched fiber networks in a star and in a tree configuration. We have achieved longer secure quantum information distances and implemented more nodes than other multi-user QKD experiments. The measurements have shown feasibility of multiuser QKD over switched fiber networks, using standard fiber telecom components. Since circular architecture networks are important parts of both intranets and the Internet, Sagnac QKD has also been a subject of our research efforts. The published experiments in this area have been very few and results were not encouraging, mainly due to the single mode fiber (SMF) birefringence. Our research has led to a development of a computer controlled birefringence compensation in Sagnac that open the door to both classical and quantum Sagnac applications. On the quantum secret sharing side, we have achieved the first quantum secret sharing experiment over telecom fiber in a five-party implementation using the "plug & play" setup and in a four-party implementation using Sagnac configuration. The setup measurements have shown feasibility and scalability of multiparty quantum communication over commercial telecom fiber networks.

Linear MMSE Receivers for Interference Suppression & Multipath Diversity Combining in Long-Code DS-CDMA Systems

This thesis studies the design and implementation of a linear minimum mean-square error (LMMSE) receiver in asynchronous bandlimited direct-sequence code-division multiple-access (DS-CDMA) systems that employ long-code pseudo-noise (PN) sequences and operate in multipath environments. The receiver is shown to be capable of multiple-access interference (MAI) suppression and multipath diversity combining without the knowledge of other users' signature sequences. It outperforms any other linear receiver by maximizing output signal-to-noise ratio (SNR) with the aid of a new chip filter which exploits the cyclostationarity of the received signal and combines all paths of the desired user that fall within its supported time span. This work is motivated by the shortcomings of existing LMMSE receivers which are either incompatible with long-code CDMA or constrained by limitations in the system model. The design methodology is based on the concept of linear/conjugate linear (LCL) filtering and satisfying the orthogonality conditions to achieve the LMMSE filter response. Moreover, the proposed LMMSE receiver addresses two drawbacks of the coherent Rake receiver, the industry's current solution for multipath reception. First, unlike the Rake receiver which uses the chip-matched filter (CMF) and treats interference as additive white Gaussian noise (AWGN), the LMMSE receiver suppresses interference by replacing the CMF with a new chip pulse filter. Second, in contrast to the Rake receiver which only processes a subset of strongest paths of the desired user, the LMMSE receiver harnesses the energy of all paths of the desired user that fall within its time support, at no additional complexity. The performance of the proposed LMMSE receiver is analyzed and compared with that of the coherent Rake receiver with probability of bit error, <i>Pe</i>, as the figure of merit. The analysis is based on the accurate improved Gaussian approximation (IGA) technique. Closed form conditional <i>Pe</i> expressions for both the LMMSE and Rake receivers are derived. Furthermore, it is shown that if quadriphase random spreading, moderate to large spreading factors, and pulses with small excess bandwidth are used, the widely-used standard Gaussian Approximation (SGA) technique becomes accurate even for low regions of <i>Pe</i>. Under the examined scenarios tailored towards current narrowband system settings, the LMMSE receiver achieves 60% gain in capacity (1. 8 dB in output SNR) over the selective Rake receiver. A third of the gain is due to interference suppression capability of the receiver while the rest is credited to its ability to collect the energy of the desired user diversified to many paths. Future wideband systems will yield an ever larger gain. Adaptive implementations of the LMMSE receiver are proposed to rid the receiver from dependence on the knowledge of multipath parameters. The adaptive receiver is based on a fractionally-spaced equalizer (FSE) whose taps are updated by an adaptive algorithm. Training-based, pilot-channel-aided (PCA), and blind algorithms are developed to make the receiver applicable to both forward and reverse links, with or without the presence of pilot signals. The blind algorithms are modified versions of the constant modulus algorithm (CMA) which has not been previously studied for long-code CDMA systems. Extensive simulation results are presented to illustrate the convergence behavior of the proposed algorithms and quantify their performance loss under various levels of MAI. Computational complexities of the algorithms are also discussed. These three criteria (performance loss, convergence rate, and computational complexity) determine the proper choice of an adaptive algorithm with respect to the requirements of the specific application in mind.

Under the examined scenarios tailored towards current narrowband system settings, the LMMSE receiver achieves 60% gain in capacity (1. 8 dB in output SNR) over the selective Rake receiver. A third of the gain is due to interference suppression capability of the receiver while the rest is credited to its ability to collect the energy of the desired user diversified to many paths. Future wideband systems will yield an ever larger gain. Adaptive implementations of the LMMSE receiver are proposed to rid the receiver from dependence on the knowledge of multipath parameters. The adaptive receiver is based on a fractionally-spaced equalizer (FSE) whose taps are updated by an adaptive algorithm. Training-based, pilot-channel-aided (PCA), and blind algorithms are developed to make the receiver applicable to both forward and reverse links, with or without the presence of pilot signals. The blind algorithms are modified versions of the constant modulus algorithm (CMA) which has not been previously studied for long-code CDMA systems. Extensive simulation results are presented to illustrate the convergence behavior of the proposed algorithms and quantify their performance loss under various levels of MAI. Computational complexities of the algorithms are also discussed. These three criteria (performance loss, convergence rate, and computational complexity) determine the proper choice of an adaptive algorithm with respect to the requirements of the specific application in mind.

Low-power discrete Fourier transform and soft-decision Viterbi decoder for OFDM receivers

The purpose of this research is to present a low-power wireless communication receiver with an enhanced performance by relieving the system complexity and performance degradation imposed by a quantization process. With an overwhelming demand for more reliable communication systems, the complexity required for modern communication systems has been increased accordingly. A byproduct of this increase in complexity is a commensurate increase in power consumption of the systems. Since the Shannon's era, the main stream of the methodologies for promising the high reliability of communication systems has been based on the principle that the information signals flowing through the system are represented in digits. Consequently, the system itself has been heavily driven to be implemented with digital circuits, which is generally beneficial over analog implementations when digitally stored information is locally accessible, such as in memory systems. However, in communication systems, a receiver does not have a direct access to the originally transmitted information. Since the received signals from a noisy channel are already continuous values with continuous probability distributions, we suggest a mixed-signal system in which the received continuous signals are directly fed into the analog demodulator and the subsequent soft-decision Viterbi decoder without any quantization involved. In this way, we claim that redundant system complexity caused by the quantization process is eliminated, thus gives better power efficiency in wireless communication systems, especially for battery-powered mobile devices. This is also beneficial from a performance perspective, as it takes full advantage of the soft information flowing through the system.
