This graduation thesis describes the personality of the Czech controversial poet, journalist, historian, pedagogue and writer Jaromír Hořec. He was born in Chust in present Ukraine. His original name was Jaromír Halhubner. The author of this study tries to collect the most important points of his life from the perspective of journalism. His life was full of opinion turns. The author tries to follow Horec's evolution of opinion over the course of his life. For one part of Czech society Jaromír Hořec was a demagogic leftist, hypocrite and opportunist, for another part Hořec was a major poet, writer and journalist. Both of these are somewhat true. The study tries to find answers for both opinion streams through the use of contemporary documents, the memories of witnesses and vocational literature.

Dissertation "A thought journey of a philosopher-disident Bohumír Janát" deals with the life and work of a Christian philosopher and spokesman of Charter 77. The work is not divided into two parts, but each chapter includes both his personal and professional life as well as analysis of Janáts texts. The work begins with Janáts childhood and his studies at the Faculty of Arts at Charles University in Prague and continues with the period from graduation until the year 1989 when his texts already contain motifs he was developing for the rest of his life. Year 1988 was particularly important as at this time he was the spokesman for Charter 77. The third section is the period from 1989 to Janáts death in November 1998 when he produced most of his work. The work is especially pointing out that Bohumir Janát was always a critic of present, he ran against the spirit of the time - during and even after a totalitarian regime end in November 1989. He saw the coup as a revelation of God's power, not as a revolution. He hoped for a change in the mindset of the nation, for a turnover to the sphere of ethics and spiritual deepening. The first part will describe ten urban charters which have influenced current conception of spatial planning. Experts from Spatial Planning and Development Departments of the statutory cities of Prague, Brno, Ostrava and Plzen were approached in order to better comprehend the spatial planning in practice.

Die Kompetenzabgrenzung in der Rechtsprechung von EGMR und EuGH

EGMR und EuGH stehen grundsätzlich gleichberechtigt und autonom nebeneinander. Beide verstehen sich als Hüter der Grund- und Menschenrechte auf europäischer Ebene und als Kontrollinstanzen. Sie urteilen aber beide auch auf Grundlage der EMRK. Für den EGMR ist dies die originäre Rechtsgrundlage, während der EuGH mangels eines geschriebenen Grundrechtskatalogs aus ganz unterschiedlichen Rechtsquellen schöpft. Zudem ist er nicht zwingend an eine vom EGMR gewählte Auslegung einer EMRK-Norm gebunden. Diese Situation begünstigt die Möglichkeit divergierender Entscheidungen beider Gerichtshöfe bezüglich ein- und derselben EMRK - Norm und letztendlich auch die Entwicklung unterschiedlicher Grundrechtsschutzniveaus in Europa. Diese Arbeit möchte einen Weg aufzeigen, wie eine derartige Entwicklung vermieden werden kann. / ECHR and ECJ stand in principle equally and autonomously side by side. Both courts understand themselves as guardians of the basic rights and human rights on a european level. However, they both judge also on the basis of the European Charta on Human Rights. For the ECHR, this is the original legal-basis, whereas the ECJ, due to the lack of a written privilege-catalog, developes basic rights from quite different legal-sources. Moreover, it is not necessarily tied to an interpretation of an ECHR-Norm chosen by the EGMR. This situation favors the possibility of diverging decisions of both courts concerning the same ECHR - norm and ultimately the development of different privilege-protection-levels in Europe. This work would like to show a way how a such a development can be avoided.
