O presente trabalho buscou entender como se dá a formação em direitos humanos dos policiais civis do Estado de São Paulo no atual contexto democrático, identificando algumas ações e limitações existentes para uma transformação da instituição nesse sentido. Desprovida de qualquer tentativa no sentido de detectar efeitos porventura gerados com essa formação, a investigação buscou apenas entender como acontece o processo de educação em direitos humanos na polícia civil de São Paulo e sentir se isso incomoda, inova ou cria novas possibilidades de atuação no cotidiano desses agentes. Para que isso fosse possível, foi utilizada uma série de instrumentos de pesquisa, dentre eles o estudo bibliográfico em livros, periódicos, sítios da internet, entre outros, para o levantamento e análise do que já se produziu sobre o tema; a análise do plano de ensino do curso de formação técnico profissional para investigador de polícia e para escrivão de polícia, ambos do ano de 2010, disponibilizados pela diretoria da ACADEPOL; e algumas falas de pessoas que trabalham pela formação em direitos humanos dentro da polícia. A dissertação está dividida em três grandes partes, sendo a primeira um estudo necessário sobre a polícia, incluindo um breve histórico e alguns apontamentos sobre os contornos atuais, mostrando um pouco mais sobre a instituição policial e a Academia de Polícia Civil do Estado de São Paulo. O segundo bloco trata de documentos importantes que colocaram a relação da segurança pública com os direitos humanos na agenda governamental e que direcionaram Estados a tomarem medidas em prol da formação de suas polícias. Por fim, o terceiro bloco consiste no estudo mais específico da educação em direitos humanos e da formação do policial, bem como na análise dos conteúdos programáticos disponíveis e das entrevistas realizadas no trabalho de campo. / The present work attempted to understand in which means the teaching of human rights for civil police officers takes place in São Paulo State in the current democratic context, considering some subsistent actions and restrictions for a possible institution transformation. Unprovided of any effort to detect possible effects caused by the mentioned teaching, the investigation simply undertook to understand how the human rights education process happens in the civil police of São Paulo, and tried to realize if this process generates discomfort, innovates or creates new possibilities of actuation in this agents routine. For this objective to be achieved, it was taken advantage of a range of research instruments such as bibliographical study on books, periodicals, websites among others, for the collecting and analysis of the material published so far concerning the theme; teaching plan analysis of the technical and professional course of formation for police investigator and police clerk, both from the year 2010 provided by the directory of ACADEPOL; and speeches from a few characters whose work is based on the teaching of human rights for police officers. The dissertation is divided in three big parts. Firstly, a necessary study about the police, including a brief historical and some notes about the current outlines, showing a little more about the police institution and the Police Academy of São Paulo. The second part concerns important documents that brought to the official governmental agenda the alliance between the public safety and the human rights, besides influencing States to take measures in favour of their police officers education. Finally, the third part consists in a more specific study about the human rights education and the police teaching, as well as the analysis of the programmatic content available and interview accomplished in the field research.

Firstly, it begins from the historical development about Human Rights identifying the Human Dignity as a presystemic principle and points out illegal police performance thorough torture practice outer element searching for the real truth unprovided of performance organization. It still analyses the Human Dignity and Human Rights custody, specially those which fall upon the Police performance and knowledge. Furthermore, it establishes a linking between the public safety policy in São Paulo State, in Brazil and in Mercosul. This study deepens in the role of Police Academy and its teaching staff, in collecting data about the teachers, what is taught in teachers training and development and what is practiced by Civil Police. Finally, the thesis brings out the perspectives to be faced and proposes actions that culminate in Human Dignity custody pointing out that the investigation police needs to aim the Human Rights performance / A tese examina o papel da Academia de Polícia de São Paulo no ensino da disciplina Direitos Humanos e o impacto desse conteúdo programático na realidade da atuação Policial Civil de São Paulo. Parte de um escorço histórico sobre os Direitos Humanos, identificando a Dignidade Humana como um princípio présistêmico. Aponta os traços mais visíveis da atuação policial ilegal por meio da prática da tortura elemento mais exterior de uma atuação de busca da verdade real desprovida de meios organizados de atuação. Analisa ainda os instrumentos de tutela da Dignidade Humana e dos Direitos Humanos, em especial aqueles que incidem sobre a atuação policial e que também devem ser de conhecimento do policial civil. Na mesma esteira, estabelece uma ligação entre as políticas de segurança pública em São Paulo, no Brasil e no Mercosul. O estudo aprofunda-se ainda no papel da Academia de Polícia de São Paulo e do seu corpo docente ao levantar, em pesquisa de campo, dados sobre o que conhecem os professores, o que ensinam os cursos de formação e de aperfeiçoamento e o que praticam os policiais civis. Finalmente, a tese aponta desafios e perspectivas a serem enfrentados e propõe ações que culminam na tutela da Dignidade Humana, apontando que a polícia de investigação necessita ter como escopo de atuação os Direitos Humanos
