The diploma thesis deals with the new legal legislation on the field of protection of the bank client as a consumer in the legal system of Czech Republic and evaluation of the level set by regulation. The theses itself provides a complex view on particular areas of the protection of the consumer on the field of commercial banking, which has undergone major amendments during last years, such as consumer loans, payments, insurance claims from deposits and financial arbiter. Particular areas of the protection of the consumer are amended by the results of the researches concentrated on financial literacy of consumers, evaluation of the possible impacts on the consumer and banking institution and moreover there is outlined possible development in the stated area.

Evropský platební rozkaz / European Order for Payment

The topic of the thesis is Regulation (EC) No 1896/2006 of the EP and of the Council of 12 December 2006 creating a European order for payment procedure. Regulation established an additional and optional means for the claimant, with the purpose to simplify, speed up and reduce the costs of litigation in cross-border cases concerning uncontested pecuniary claims and to permit the free circulation of European orders for payment throughout the Member States without any intermediate proceedings prior to recognition and enforcement. The aim of the thesis is to analyze the current shape of legislation, its interpretation by the ECJ and existing practical experiences with the application of the tool in the Czech Republic. Chapter one is devoted to the development in the field of judicial cooperation in civil matters, called as well as European civil procedure, and to the summary of the existing regulations. Chapter two deals with the thorough analysis of the laid down proceedings and its consecutive phases. It also contains the evaluation of these regulatory efforts. Chapter three focuses on the analysis of a reference for a preliminary ruling in the Case C-215/11 Szyrocka which is not yet decided. The reference depicts problematic points of coordination between the Regulation and civil procedures of Member States. Last chapter pursues the application of the European order for payment in the Czech judicial system. It summarizes the statistical data about usage of the procedure in the Czech Republic. Moreover, it presents the findings of the qualitative research carried out at thirty district and regional courts.

On some damage processes in risk and epidemic theories

Cette thèse traite de processus de détérioration en théorie du risque et en biomathématique. En théorie du risque, le processus de détérioration étudié est celui des sinistres supportés par une compagnie d'assurance. Le premier chapitre examine la distribution de Markov-Polya comme loi possible pour modéliser le nombre de sinistres et établit certains liens avec la famille de lois de Katz/Panjer. Nous construisons la loi de Markov-Polya sur base d'un modèle de survenance des sinistres et nous montrons qu'elle satisfait une récurrence élégante. Celle-ci permet notamment de déduire un algorithme efficace pour la loi composée correspondante. Nous déduisons la famille de Katz/Panjer comme famille limite de la loi de Markov-Polya. Le second chapitre traite de la famille dite "Lagrangian Katz" qui étend celle de Katz/Panjer. Nous motivons par un problème de premier passage son utilisation comme loi du nombre de sinistres. Nous caractérisons toutes les lois qui en font partie et nous déduisons un algorithme efficace pour la loi composée. Nous examinons également son indice de dispersion ainsi que son comportement asymptotique. Dans le troisième chapitre, nous étudions la probabilité de ruine sur horizon fini dans un modèle discret avec taux d'intérêt positifs. Nous déterminons un algorithme ainsi que différentes bornes pour cette probabilité. Une borne particulière nous permet de construire deux mesures de risque. Nous examinons également la possibilité de faire appel à de la réassurance proportionelle avec des niveaux de rétention égaux ou différents sur les périodes successives. Dans le cadre de processus épidémiques, la détérioration étudiée consiste en la propagation d'une maladie de type SIE (susceptible - infecté - éliminé). La manière dont un infecté contamine les susceptibles est décrite par des distributions de survie particulières. Nous en déduisons la distribution du nombre total de personnes infectées à la fin de l'épidémie. Nous examinons en détails les épidémies dites de type Markov-Polya et hypergéométrique. Nous approximons ensuite cette loi par un processus de branchement. Nous étudions également un processus de détérioration similaire en théorie de la fiabilité où le processus de détérioration consiste en la propagation de pannes en cascade dans un système de composantes interconnectées.

Attitudes Towards Television Commercials with an Underlying Health Claim

Health and eating healthy has become increasingly popular during the recent decades. On television, countless numbers of food commercials claim their products to be healthy, and fit good looking people propagate for the benefits of the products. At the same time, there are many studies showing these marketing messages to be highly misleading. Consequently, a great extent of existing research within this field treats the subject of consumers, children in particular, and television in relation to eating habits. However, in this study, we are not interested in confirming these facts; instead we focus on the attitudes that consumers have towards these marketing messages with underlying health claims shown in TV commercials. Today, many new types of communication channels exist, nevertheless, watching TV is an increasing activity, especially among young consumers. It was found that research including young adult consumers was scarce, why the segment of university students belonging to the generation Y was chosen for this study. The purpose of this thesis is to identify the attitudes that Swedish generation Y university students have towards TV commercials with underlying health claims. The aim is also to investigate why these consumers react to the commercials the way they do. In this thesis both a quantitative and a qualitative method was used, where the qualitative method was the most dominating. Thus, it can be considered a mixed methods approach. However, the quantitative part is dominating. For the empirical study we conducted tests where a number of persons in focus groups were exposed to different TV commercials, all with an underlying health claim. The respondents answered an in-group questionnaire and thereafter during the group discussion they were asked to describe their reactions to the TV commercials. Finally, the respondents were also asked what factors they believed important to them when they consider buying a product. The Swedish generation Y university students presented a number of attitudes towards the chosen television commercials. The students did recognize the underlying health claims and furthermore indicated other factors noticed within the commercials. Also, we could see that factors such as memory, unconscious influence as well as positioning of thecommercials had an influence on the attitudes. The results also specified that factors influencing these consumers in their purchasing decision, except the TV commercial itself, were; whether they had bought the product before, what family and friends used and recommended, as well as price and quality. The above features also had an influence on how these consumers reacted to the marketing messages. The study shows that the model of the emotional process by Holbrook and O‟Shaughnessy (1984) could be followed. We furthermore built on Bagozzi et al.‟s (1999) classification of advertisements by introducing the multi message ad. To conclude, it can be stated that factors influencing these consumers‟ attitudes of TV commercials with underlying health claims had different aspects and explanations, although common patterns could be seen. / Hälsa och att äta hälsosamt har blivit alltmer populärt under de senaste decennierna. På tv hävdar ett oräkneligt antal reklaminslag för matprodukter hur hälsosamma de är och vältränade, snygga människor propagerar för fördelarna med produkterna. Samtidigt finns det många studier som visar att dessa reklambudskap är vilseledande. Följaktligen handlar en stor del av forskningen i ämnet om sambandet mellan konsumenter - i synnerhet barn, och TV i relation till matvanor. I denna studie är vi inte intresserade av att bekräfta dessa fakta, utan fokus är istället inriktat på hur tittarna tolkar reklambudskap med underliggande hälsopåståenden. Idag finns många nya typer av kommunikationskanaler, men trots det ökar TV-tittandet, i synnerhet bland unga konsumenter. Forskning kring generation Y och deras syn på TV-reklam med underliggande hälsobudskap är hittills begränsad. Syftet med denna uppsats är att identifiera de attityder som svenska universitetsstudenter tillhörande generation Y har gentemot TV reklam med underliggande hälsobudskap. Syftet är också att undersöka varför dessa konsumenter tolkar reklamen som de gör. I rapporten användes både kvalitativa och kvantitativa metoder, där den kvalitativa var mest dominerande. Man kan därför säga att en blandad metod användes för att få fram bästa resultat. För den empiriska studien gjordes ett test där ett antal personer i fyra fokus grupper fick se olika TV-reklaminslag, alla med ett underliggande hälsobudskap. Gruppmedlemmarna fick individuellt svara på ett antal frågor ur ett formulär och därefter i gruppen diskutera sina reaktioner på reklaminslagen. Hur dessa påverkade dem och vad de anser som viktigt när de själva ska köpa en produkt var andra frågor som diskuterades. Det visade sig att reklaminslagen uppfattades på olika sätt av studenterna i fokus grupperna. De identifierade de underliggande hälsobudskapen i reklamerna och även andra uppfattningar om reklambudskapen kunde utläsas. Ur resultaten kan utläsas att faktorer såsom minne, undermedvetet inflytande och även reklaminslagens position i förhållande till varandra var av vikt för hur de uppfattades. Resultatet visar också att studenterna påverkades av många fler faktorer än själva reklamen i sig, exempelvis huruvida de köpt produkten innan, vad familj och vänner använde och rekommenderade, samt pris och kvalité. Dessafaktorer påverkade även hur studenterna tolkade reklammeddelandena. Dessutom visar vi hur Holbrook och O‟Shaughnessy‟s (1984) Model of the Emotional Process, stämmer överens med resultaten i denna studie. Vi bygger även vidare på Bagozzi et al.‟s (1999) två klassificeringar av reklam och introducerar en tredje; multimeddelande-reklam. Sammanfattningsvis kan konstateras att många olika faktorer påverkade dessa konsumenters attityder gentemot TV-reklam med underliggande hälsobudskap. Trots det kunde ändå vissa gemensamma mönster utläsas.

Compensation in cases of infringement to aboriginal and treaty rights

This paper discusses the legal principles which are relevant in determining the appropriate level of compensation for infringements to aboriginal and treaty rights. This issue has been left open by the Supreme Court of Canada in the seminal case of Delgamuukw. The nature of aboriginal and treaty rights as well as the fiduciary relationship and duties of the Crown are briefly described. The basic constitutional context in which these rights evolve is also discussed, including the federal common law of aboriginal rights and the constitutional position of these rights in Canada. Having set the general context, the paper then reviews the legal principles governing the infringement of aboriginal and treaty rights, including the requirement for just compensation. Reviews of the legal principles applicable to compensation in cases of expropriation and of the experience in the United States in regards to compensation in cases of the taking of aboriginal lands are also carried out. Six basic legal principles relevant for determining appropriate compensation in cases of infringement to aboriginal and treaty rights are then suggested, justified and explained. Development ethics and the Canadian North : a case study analysis of the Churchill-Nelson Rivers Hydro Diversion Project

This thesis argues that economic development, in both theory and practice, is inevitably based on moral questions. These questions have been explored in recent years by "development ethicists," a multidisciplinary group of scholars and practitioners committed to evaluating the policy implications of economic development. Chapter 1 engages this body of literature, arguing that the capability ethic articulated by Amartya Sen and Martha Nussbaum can provide a valuable ethical framework for evaluating economic development in the Canadian north. Their approach is considered in conjunction with other ethical proposals, and, in particular, how theological insights provide an additional dimension for a more comprehensive development ethic. / Chapter 2 investigates the ethical assumptions in the theories and models of economic development proposed for the Canadian north, and how public policy based on these theories and models has infringed on the claims and aspirations of Aboriginal peoples. The chapter then shifts from the larger Canadian context to Manitoba, and explores the story of how two hydro development projects impacted several Aboriginal communities. / This story provides the context for understanding why four church denominations became involved in defending the rights and aims of five Aboriginal communities in northern Manitoba. Chapter 3 examines the moral vision of the four Christian churches and their rationale for sponsoring four days of public hearings on the Churchill-Nelson Rivers hydro diversion project. The public hearings provide an opportunity to analyse how development affects the lives of a people group when it is thrust upon them without consideration of their economic, cultural, and social value systems. / The final chapter examines the issue of the loss of cultural identity for Aboriginal communities as economic development occurs. A major issue pertaining to the loss of cultural identity is whether a development ethic should be based on a universal ethic, or on local traditions, for example, the traditions of the five Aboriginal communities in northern Manitoba. The efforts of the Interchurch Task Force are investigated as a particular type of response to these issues.

Land reform in the Limpopo Province : a case study of the Elias Motsoaledi Local Municipality / Harry Mantaneng Phaahla

My interest in this research was to interview leaders and members of the three communities within the Elias Motsoaledi Local Municipality as well as officials of the Regional Land Claims Commission (RLCC). The purpose of the discussions was to find out how the communities involved Government when lodging land claims. The three communities are, Bakwena Ba- Kopa, Bakgaga Ba-Kopa and Masakaneng. The research yielded the following findings: 1. All the three communities followed the correct procedures regarding the relevant legislation and policies when they lodged their land claims. 2. Government played its role through the RLCC by assisting the communities in their endeavor to have their land restored. 3. In the interaction between Government and the communities challenges were encountered that at times led to the delay of the settlements. 4. When the communities keep patient during the land claim processes and Government officials are dedicated to assist the communities, the chance of positive outcomes is maximised. There is evidence that Government made progress to ensure that the affected communities have the dispossessed land restored. However, there is still a lot to be done in addressing the outstanding issues. To handle these matters, as indicated below, co-ordination and interaction between Government and the communities is crucial. One can point out these obstacles by focusing on the three affected communities respectively. Masakaneng: There is a need to tackle the challenge of the concerned group that led to the emergence of another committee in the process. This delays the formal negotiations with the municipality to help facilitate the delivery of the necessary services. Bakwena Ba-Kopa: The role-players missed the time-frames that were targeted for settlement. Government will have to speed up the matter and finalise the settlement, seeing that the beneficiaries have been waiting for many years. Bakgaga Ba-Kopa: Only portion one of RietKloof was restored to the community. The community is eagerly awaiting Government to help facilitate the restoration of the remaining portion. This community also needs to play its part in ensuring that the other sections of the land are restored. It is important that they go back to the drawing board as beneficiaries and tackle the prevailing differences so that they end up with a unanimous stand on this matter. To conclude: It is quite evident that the democratic government post-1994 is committed and prepared to restore the dignity of the black people who were forcibly removed from land they and their ancestors occupied. Government is assisting in this matter by providing all the necessary resources to ensure that land restoration is a success. For Government to succeed, the affected communities must also play their role within the parameters of the relevant legislation. Constructive dismissal and resignation due to work stress / Estie Smit

In terms of section 186(1)(e) of the Labour Relations Act 66 of 1995 constructive dismissal occurs where an employee terminated a contract of employment with or without notice because the employer made continued employment intolerable. Work stress is becoming more and more imminent in the workplace. Some employees feel that the amount of work stress also makes their continued employment intolerable, and then they claim constructive dismissal. This raises the question whether the courts should apply the same tests they apply in constructive dismissal cases as well as in cases where the employee resigns because of work stress. But, if the same tests that are used to determine if there has been a constructive dismissal are used in a case where an employee resigns because of work stress, a real danger exists because then it can lead to the misuse of a claim of constructive dismissal by employees who cannot handle a minimum amount of work stress. Over the years the courts have indicated that they apply an objective test in cases of constructive dismissal. This leads to the argument whether subjectivity should play a role, and whether one should look at the subjective perspective of both the employer and the employee. This research looks at numerous court decisions, from both the South African legal system as well as the United Kingdom legal system, in order to determine which tests the South African courts need to apply when they are confronted with a constructive dismissal claim where the employee resigned due to work stress.
