Embora o mercado de crédito imobiliário no Brasil tenha se expandido nos últimos anos, sua participação no Produto Interno Bruto (PIB) está muito abaixo do percentual encontrado em outros países em desenvolvimento. Com isso, o país continua apresentando déficits habitacionais significativos, problema este que tem maior impacto nas famílias de menor renda. Este estudo pretende analisar o impacto da Lei no 10.931, de agosto de 2004, que incluiu a figura jurídica de alienação fiduciária do bem imóvel no ordenamento jurídico nos contratos de financiamento habitacional do Brasil, avaliando a evolução destes para diferentes grupos de mutuários. É consenso na literatura que o mercado de crédito apresenta certas particularidades, como os problemas de informação e comprometimento limitado, especificidades estas que podem gerar racionamento de crédito. Avanços institucionais que alterem os parâmetros dos contratos, e que aumentem a segurança jurídica dos credores podem ajudar no desenvolvimento do mercado de crédito, amenizando estes problemas, e tornando o crédito mais acessível para todos os tipos de mutuários, / Although the real estate market in Brazil has been expanding in recent years, its share in Gross Domestic Product (GPD) is significantly below the percentage found in other developing countries. Because of this, the country continues to present significant housing deficits. This study aims to analyze the impact of the Law no 10.931, from august 2004, which included the legal concept of fiduciary property in the legal system in contracts for the real estate market, comparing the evolution of these contracts for different groups of borrowers. There is a consensus that the credit market has certain peculiarities, such as information problems and limited commitment, which can generate credit rationing. Institutional improvements that alter the parameters of the contracts, and increase legal certainty for creditors may help in the development of the credit market, mitigating these problems, and making credit more accessible for all kinds of borrowers,

Strategies to Access Business Loans for Small and Medium Enterprises in Jordan

Abstract Business financing is crucial to the development and performance of small and medium enterprises (SME) in developing countries. Obtaining loans by SMEs in Jordan is vital for creating employment, reducing poverty ratio, and augmenting SMEs growth. The purpose of this qualitative multiple case study was to discover strategies SME owners use to access credit. The population comprised of 3 SME owners in Jordan who successfully accessed credit. The conceptual frameworks for this study were the social capital theory and the pecking order theory. Data were gathered using semistructured interviews and companies' archived records. Data were analyzed using thematic analysis; three themes emerged to include sources of finance, education and skills, and social networking. The implications for positive social change include the potential to help SME leaders develop strategies to stabilize and grow their businesses. Business growth can create jobs and decrease poverty in Jordan.

"We Are All Collateral Damage": Understanding Nuclear Family Members' Experiences of Criminal Justice Intervention

Historically, “offender”-focused discourses have dominated the field of criminology while overlooking those family members who become subject to justice intervention by virtue of their familial bonds. In this qualitative study, unstructured interviews were conducted with eight nuclear family members of criminalized persons in Ontario and Quebec. Participant accounts reveal that the interviewed family members self-imposed significant moral and legal responsibilities for their relatives following criminal justice intervention and simultaneously experienced negative role re-evaluation driven by feelings of guilt, failure, and self-blame. Participants’ inherent lack of control over their criminalized relatives’ behaviours and the criminal justice system’s decisions exacerbate negative impacts of criminalization on non-criminalized relatives’ self-concepts. This lack of control increases the stress of criminal justice intervention while straining family resources. When relatives are justice-involved for prolonged period, the family becomes stuck in a constant state of stress and uncertainty, which may have lasting consequences on the family if left unmanaged. Criminal justice intervention as a disruptive event then reconfigures the family in ways that often leave lasting impacts on nuclear family relationships. This thesis engages with Boss’ (1999, 2006) theory of Ambiguous Loss to analyze participants’ experiences and demonstrate the consequences of criminalization on various nuclear family members in a Canadian context. To mitigate certain limitations of Boss’ (1999, 2006) theory, criminal justice intervention is first defined as a disruptive event that transforms family members’ known realities into threatening and uncertain environments. This thesis then explores the stress and strain that justice intervention places upon the family and applies the theory of Ambiguous Loss to understand criminalization as a source of ambiguous loss. Further, this thesis expands the scope of Boss’ (1999) theory beyond the experiences of certain populations (i.e. children of incarcerated parents) and discovers the limitations of this theory in the context of criminological research. It also opens the door for future research to apply this theory to criminalized populations.

The Impacts of Arterial Occlusion, Sex, and Exercise on Arteriogenesis and Functional Vasodilation

The most frequent clinical presentation of peripheral arterial occlusive disease (PAOD) is intermittent claudication, which may be caused by impaired vasodilation. Patients demonstrate both local and systemic impairments in vasodilation, but as the collateral circulation is the primary site of resistance to the ischemic zone, impaired collateral vasodilation would have the greatest potential to induce claudication. Collateral function following arterial occlusion is not well defined, but immature collaterals may demonstrate impaired vasodilation in animal models, although this is potentially improved with exercise training. Furthermore, as females exhibit poorer physical function with ischemia and less improvement with therapeutic exercise, there appears to be a sexually dimorphic response to PAOD, warranting a comparison in collateral vasodilation between sexes. In this study, the femoral artery was ligated to induce chronic ischemia in sedentary and exercise-trained mice, and at 7 or 28 days post-surgery, the diameter of the gracilis collateral arteriole was measured at rest and after gracilis muscle contraction using intravital microscopy. No major sex differences were observed in any group. At day 7, both the resting and dilated diameters were increased, while vascular reactivity was minimal. By day 28, resting diameter decreased while maximal diameter was unchanged, causing an increase in functional vasodilation. Exercise training also improved vasodilation by decreasing collateral resting diameter. These results are consistent with reported trends in endothelium-dependent and smooth muscle-dependent vasodilation, which are impaired in immature vessels and improved with maturation and exercise, but the significance of the observed variations in resting diameter remains unclear. Large resting diameters at day 7 could be due to a loss of sympathetic tone or the proliferative and non-contractile state of smooth muscle cells, while decreased resting diameters at day 28 could indicate that a smooth muscle contractile phenotype has been restored, or that the gracilis collateral is no longer the primary collateral. However, the further research is required to determine the functional relevance of collateral resting diameter and its importance in the ischemic limb circulation.

Then there is comparison of the best options. In conclusion of this part there are analysis and all the results of current situation of getting loans for entrepreneurs in Czech republic.

The impact of socio-economic factors and attributes on repayment ability in Microfinancing : A study of microfinance programs in the Amhara region

An insufficient financial market means that poor individuals cannot access financial capital, making it difficult for them to generate a stable income. Formal banks see these individuals as unreliable customers because of their financial background and see a risk that these potential customers will not repay their loans, which would put the bank at risk. Banks usually use the borrower’s assets as collateral for their loans. Unfortunately, not many of these poor people have any assets. Microloans can solve these problems by opening up the opportunity for financial capital that enables poor people to make the investments needed to create or develop some form of production and thus increase employment. This research was carried out to analyze if the collected variables can determine the repayment ability of those who got a microloan from the Amhara Credit and Savings institution. Since the borrowers received their loans through two different processes, this study divided the data into two groups. Group 1 received their microloan based on a personality test and the individuals in group 2 received their microloan based on group lending. This division is done in order to be able to eliminate that the lending process itself may have affected the repayment ability. This study is based on random sample data from the Amhara Credit and Savings institution. Regression analyses were performed using the STATA-15 software. The results are not entirely consistent with previous studies because some variables did not get the expected outcome linked similar to previous studies. Some of the variables in this study appear to have an effect on the repayment ability, but not all. Thus, the conclusion is that the results are insufficient and further research needs to be made to reject or confirm the influence of the socio-economic factors and structure of the microloan on the repayment ability for Ethiopian borrowers. / En otillräcklig finansmarknad innebär att fattiga individer inte kan få tillgång till finansiellt kapital vilket gör det svårt för dem att generera en stabil inkomst. Formella banker ser dessa individer som opålitliga kunder på grund av deras ekonomiska bakgrund och ser en risk med att dessa potentiella kunder inte kommer att återbetala sina lån, vilket skulle sätta banken i risk. Banker använder vanligtvis låntagarens tillgångar som säkerhet för sina lån. Tyvärr så har inte många av dessa fattiga människor några tillgångar. Mikrolån kan lösa dessa problem genom att öppna upp möjligheten för finansiellt kapital som gör det möjligt för fattiga människor att göra de investeringar som behövs för att skapa eller utveckla någon form av produktion och därmed öka sysselsättningen. Denna forskning genomfördes för att analysera om våra insamlade variabler kan förklara återbetalningsförmågan hos de som fick ett mikrolån från Amhara Credit and Savings Institution. Eftersom låntagarna fick lån genom två olika processer delade vi upp dem i grupp ett, som fick sitt mikrolån genom ett personlighetstest och grupp två, som fick sitt mikrolån via en grupp med andra individer. Detta för att kunna eliminera att själva processen till hur de har fått lånet kan ha påverkat återbetalningsförmågan. Studien är baserad på slumpmässiga provdata från Amhara Credit and Savings Institution. Regressionsanalyser utfördes med användning av Stata 15-programvaran. Resultaten är inte helt i överensstämmelse med tidigare studier, i och med att vissa variabler inte har det förväntade utfallet kopplat till tidigare studier. Några av variablerna i denna studie visar sig ha en påverkan på återbetalningsförmågan, men inte alla. Således är vår slutsats att resultaten är otillräckliga och behöver ytterligare undersökning för att kunna avvisa eller bekräfta denna uppsats variablers påverkan på återbetalningsförmågan.

1 Abstract Compensation for non-pecuniary harm in the event of personal injury and death in collateral proceedings The topic of the diploma thesis is the issue of compensation for non-pecuniary harm in the event of personal injury and death in collateral proceedings. This issue is currently often debated due to, among other reasons, a change in the legal regulation of compensation for pecuniary and non-pecuniary harm effective from January 1, 2014. The specificity of this subject lies in the combination of two legal branches - criminal and civil law, as collateral proceedings are part of criminal proceedings and decide on claims which are of a civil nature. The thesis deals with the criminal law institutes of the injured party and the collateral proceedings themselves. An extensive space is then devoted to the private law regulation of compensation for non-pecuniary harm in the event of personal injury and death, especially in accordance with Sections 2958 and 2959 of the Civil Code with regard to legal practice and court decisions. Curve Building and SwapPricing in the Presence of Collateral and Basis Spreads

The eruption of the financial crisis in 2008 caused immense widening of both domestic and cross currency basis spreads. Also, as a majority of all fixed income contracts are now collateralized the funding cost of a financial institution may deviate substantially from the domestic Libor. In this thesis, a framework for pricing of collateralized interest rate derivatives that accounts for the existence of non-negligible basis spreads is implemented. It is found that losses corresponding to several percent of the outstanding notional may arise as a consequence of not adapting to the new market conditions. / I samband med utbrottet av 2008 års finansiella kris vidgades många basisspreadar till ej tidigare skådade nivåer. Därtill krävs i dagsläget att säkerhet finns tillgänglig vid initieringen av en majoritet av alla räntekontrakt, vilket innebär att en banks finansieringskostnad kan avvika substantiellt från den inhemska interbankräntan. I detta examensarbete implementeras ett ramverk för prissättning av räntederivat som beaktar existensen av basisspreadar samt krav på säkerhet. Resultaten visar att förluster motsvarande flera procent av det nominella beloppet kan uppstå som konsekvens av att inte anpassa sig till det nya tillståndet på räntemarknaden.
