Problémy institutu vazby / The issue of the concept of criminal custody

The diploma thesis deals with the issues of the concept of criminal custody. The aim is to discuss the appropriate effective legislation, point out some problematic issues related to it and provide a broader look at the institution of custody. The work is divided into 10 chapters, which are divided into two parts. Part 1 focuses mainly on the analysis of detention rules contained in Section 1 of Chapter 4 of the Criminal Procedure Code. Preceding this, personal freedom is defined, summarized from the perspective of constitutional law and the definition of personal freedom in international law, and an examination of the institution of custody and subsequently its general character in terms of criminal law is undertaken. The second part is then devoted to the four chosen issues in some way connected with the institution of custody and that in terms of the issue of the right to be heard in the remand proceedings, custody in juvenile proceedings, control mechanisms for upholding of the rights of persons in custody and a prisoner's right to vote.

This article examines the close relationship between criminal procedure and constitutional law within a democratic State framework as well as the guarantees provided from a constitutional point of view in accordance with the current context of human rights globalization. Then, the author approaches us to criminal procedure main principles and guarantees, procedural models historically formed. Finally, it presents an interesting Criminal Procedural Code analysis describing guarantees, principles and procedural models recognized in our country. / Este artículo reflexiona sobre la estrecha relación entre el proceso penal y el derecho constitucional en el marco de un Estado democrático, así como sobre las garantías que debe brindar desde la óptica constitucional y en el actual contexto de globalización de los derechos humanos. A continuación nos aproxima a los principales principios y garantías del proceso penal, y a los modelos procesales históricamente configurados. Finalmente, el artículo nos presenta un interesante análisis de Código Procesal Penal, describiendo las garantías, principios y modelo procesal reconocido de nuestro país.

Remedial measures in criminal law are set mainly to eliminate and correct mistakes, which have occurred in the course of the trial. It acts as a review and a remedy of law and legal defects. It can be divided into regular and special ones. Amid the regular remedial measures belong appeal, complaint and protest, to a group of special remedial measures belong apart from a renewal of proceedings, a review of an appeal and a complaint for the breach of law. Renewal of proceedings is a special remedial measure, which brings with itself interference into legal power. Renewal of proceedings with which one can contest only some legitimate decisions, in which criminal prosecution has already finished, is used for a removal of shortcomings in factual findings, because at that time all the decisive facts had not been known and the evidence, which came up only after the former decision has come into legal force. New evidence or facts underlying this extraordinary breach into inalterability and binding of judgments made in criminal proceedings are only the facts that were not part of evidence or survey or were not applied by any of the parties engaged in the proceedings and the only evidence that was not designed nor made by either party during the proceedings. However, the problem takes another relevance when we analyze the criminal investigation in depth in accordance with the democratic principles and constitutional values. We pass, then, to realize that the shortcomings of the investigation procedures are not structural in nature but rather due to interpretive paradigms built under the aegis of political exception regimes. This reveals the need to put in place a contemporary criminal procedure hermeneutics, in which proper criminal investigation, constitutional and legally produced, is regarded as fundamental rights protection instrument, unfolding as real tool for promoting human dignity. Grounded on these assumptions should follow the doctrinal and jurisprudential construction and legislative reforms aiming to improve the extra-judicial phase of the criminal prosecution, consolidating the police investigation as true procedural criminal procedure of a garantista nature, aimed at achieving the constitutional ideal of due process, a principle of the Democratic State of Law / A crise que acomete o sistema de Justiça Criminal brasileiro muitas vezes é imputada à ineficiência da Polícia Judiciária e à ineficácia do inquérito policial como meio de apuração de fatos delituosos. Contudo, a problemática toma outro relevo quando analisamos a fundo a investigação criminal à luz dos princípios e valores constitucionais democráticos. Passamos, então, a perceber que as deficiências do procedimento investigatório não são de cunho estrutural, mas sim decorrentes de paradigmas interpretativos edificados sob a égide de regimes políticos de exceção. Isso nos revela a necessidade de colocar em prática uma hermenêutica processual penal contemporânea, em que a devida investigação criminal, constitucional e legalmente produzida, seja encarada como instrumento de proteção de direitos fundamentais, desvelando-se como verdadeira ferramenta de promoção da dignidade humana. Alicerçadas nessas premissas devem seguir as construções doutrinárias e jurisprudenciais e as reformas legislativas que visem aprimorar a fase extrajudicial da persecução criminal, consolidando o inquérito policial como verdadeiro procedimento processual penal de cunho garantista, voltado a concretizar o ideal constitucional de processo justo, princípio este basilar do Estado Democrático de Direito

A humanização da pena de prisão marcou a transição entre a cárcere funcionando como uma sala de espera para a aplicação de castigos corpóreos ou mesmo a morte, passando a funcionar como uma sanção propriamente dita. Entretanto, apesar dos esforços do Iluminismo, as penitenciárias não perderam a feição de masmorras, sendo verdadeiros depósitos de seres humanos, os quais acabam sendo privados de saúde, dignidade e respeito, gerando um verdadeiro fator de dessocialização, tendo em vista que inúmeras facções criminosas disputam, por meio de sangue, parcelas do mercado da ilegalidade. Agravando o problema, o Brasil enfrenta, nos últimos quatorze anos (2000 a 2014) o encarceramento em massa, tanto que a população prisional praticamente dobrou neste período. Além disso, cerca de 40% dos encarcerados são presos provisórios, ou seja, ainda não foram condenados de forma definitiva. Diante deste quadro, a audiência de custódia, instituto caracterizado pela apresentação pessoal do preso a uma autoridade competente para resolver seu status libertatis foi erigida como uma possível solução à crise do sistema penitenciário, o qual foi declarado, no ano de 2015 pelo STF, um estado de coisas inconstitucional. Diante da mora legislativa em implementar tal instituto, os Tribunais de Justiça e, posteriormente, o CNJ, amparados pela Convenção Americana de Direitos Humanos, editaram resoluções administrativas determinando a realização das audiências de custódia. Logo, a presente dissertação objetiva abordar os fundamentados do instituto, sua origem histórica, as principais questões procedimentais e, por fim, responder à seguinte pergunta: Quais as consequências jurídicas da não realização da audiência de custódia? / The humanization of the prison sentence marked the transition between the jail functioning as a waiting room for the application of corporal punishment or even death, starting to function as a sanction itself. However, despite the efforts of the Enlightenment, penitentiaries did not lose the feature of dungeons, being real deposits of human beings, which end up being deprived of health, dignity and respect, generating a true factor of desocialization, since countless criminal factions They dispute, through blood, parcels of the illegality market. Aggravating the problem, Brazil faces, in the last fourteen years (2000 to 2014), mass incarceration, so much that the prison population has practically doubled in this period. In addition, about 40% of those incarcerated are provisional prisoners, that is, they have not yet been definitively condemned. Because of this situation, the first appearance hearing, an institute characterized by the prisoner\'s personal presentation to a competent authority to resolve his libertatis status, was established as a possible solution to the crisis in the penitentiary system, which was declared, in the year 2015 by the STF, an Unconstitutional state of affairs. In view of the legislative delay in implementing such an institute, the Courts of Justice and, subsequently, the CNJ, under the American Convention on Human Rights, issued administrative resolutions determining custody hearings. Therefore, the present dissertation aims to address the institute\'s grounds, its historical origin, the main procedural issues and, finally, answer the following question: What are the legal consequences of not holding a custody hearing?

- The issue of pre-trial detention in criminal procedure The topic of this diploma thesis is the issue of pre-trial detention in criminal procedure. The institute can be described as a securing institute of criminal procedural law that significantly affects the right to personal freedom of the individual, which conflicts with other human rights. In light of these violations of fundamental rights, it is not surprising that the institute is often discussed and is thus a sensitive topic. It is therefore often the subject of disputes, which are held in front of the Constitutional Court of the Czech Republic and other international courts. This thesis is divided into six chapters, wherein, the first part deals with the description of the institute of pre-trial detention itself, and discusses the principles that are related to it. The second chapter briefly describes the historical development of the institute of pre-trial detention on the territory of the Czech Republic since 1961, when the new Criminal Procedure Code was adopted. It emphasises the amendments No. 265/2001 Coll., and No. 459/2011 Coll., which both brought a significant change in the legal system of pre-trial detention. Procédure pénale de droit commun et procédures pénales spéciales / Ordinary criminal procedure and special criminal procedures

La procédure pénale est le théâtre de réformes législatives incessantes qui aboutissent à une multiplication sans précédent des régimes spécifiques à certaines catégories de délinquants ou d'infractions. Il en résulte un éclatement du système procédural pénal qui accroît la complexité de la matière et fait perdre de vue le sens même de l'adaptation des règles. L'analyse de la procédure pénale sous l'angle de la dialectique du droit commun et du droit spécial permet de prendre conscience de l'importance qu'il convient d'attacher, d'une part, à la distinction entre un régime applicable à toutes les affaires pénales et des régimes applicables à certaines d'entre elles, d'autre part, à la gestion des rapports entre ces différents types de régimes. Mise à l'épreuve de la procédure pénale, la distinction entre droit commun et droit spécial souffre d'une méconnaissance profonde en l'état actuel du droit. Celle-ci est traduite par la difficulté à situer les frontières du droit commun et du droit spécial, mais surtout attestée par la marginalisation progressive du droit commun face à l'expansion continue du droit spécial. La reconnaissance de la distinction entre droit commun et droit spécial n'en apparaît que plus nécessaire tant elle est, en réalité, consubstantielle à l'organisation de la procédure pénale. Mise à l'épreuve des rapports entre droit commun et droit spécial, la procédure pénale souffre, quant à elle, du désordre qui règne en ce domaine. Le désintérêt du législateur pour les rapports entre procédure pénale de droit commun et procédures pénales spéciales impose, dès lors, de chercher les moyens propres à assurer la maîtrise des relations entre ces ensembles. / Incessant legislative reforms in criminal procedural law produce an astonishing multiplication of specific procedures for certain categories of offenders or offences. Criminal procedural system is torn apart, increasing the complexity of law and clouding the very meaning of rules' adaptation. The dialectic of ordinary and special rules of law casts a new light on the evolution of criminal procedural law. On the one hand it is important to make a distinction between a common procedural framework that is applicable to every criminal case and specific procedures only applicable to some of them. On the other hand it becomes vital to manage the connections between these two types of law. Regarding the first point, there is a profound misunderstanding of the distinction in contemporary law. Indeed, it is difficult to determinate the frontiers of ordinary and special rules of criminal procedural law. Moreover, it is obviously attested by a progressive marginalization of ordinary criminal procedure facing an ever-expansion of special criminal procedures. A new understanding of the distinction appears even more necessary because the distinction between ordinary and special rules of law is essential to organize the criminal procedural system. Regarding the second point, criminal procedural law suffers from the resulting disorder from the mismanagement of the connections between ordinary and special rules. While the lawmakers seem not to pay much attention, the actual disorder cries out for appropriate means to control the connections between ordinary criminal procedure and special criminal procedures.

Esta pesquisa foi realizada mediante averiguação bibliográfica de legislação, doutrina e jurisprudência pátrias e estrangeiras, em âmbito processual civil e penal, sob o enfoque comparativo no que diz respeito à persuasão racional e às limitações probatórias incidentes em ambas as sedes analisadas. O estudo adota como referencial teórico a concepção de Dworkin do direito como integridade, em compatibilização com a doutrina da prioridade local que determina o respeito aos limites das subdivisões do direito, delineadas na prática pela comunidade , ao analisar a diversidade de princípios morais, políticos e jurídicos subjacentes ao sistema de apreciação das provas no direito processual civil e no direito processual penal. As limitações ao livre convencimento, (traduzido na fórmula da persuasão racional), são avaliadas na medida em que influenciem ou contribuam para a análise dos sistemas de apreciação adotados, sem pretensão de esgotamento do tema das limitações probatórias. A comparação dos sistemas de persuasão racional civil e penal é realizada sob a perspectiva das tendências a um processo ideal e garantista em cada uma destas esferas. A partir desta avaliação, é demonstrado que, embora seja usual a assertiva de que ambos os sistemas se guiem pela livre persuasão racional do juiz quanto à apreciação das provas, a aplicação desse princípio se materializa de maneira diversa no processo civil e no processo penal, devido às distintas finalidades e estruturas de cada um dos processos que, por sua vez, são determinadas por princípios morais, políticos e jurídicos de ordem diversa. / The present study was conducted based on a bibliographic examination of Brazilian and international legislation, doctrine and jurisprudence comparing civil and criminal procedures in respect of rational persuasion and probative limitations occurring to the two areas under analysis. The theoretical reference for this study was based on Dworkins concept of the right as integrity compatible with the local priority doctrine which establishes respect to the limits of Law subdivisions, outlined in practice by the community, when analyzing the diversity of moral, political and legal principles that underlie the system for evidence consideration in civil procedural Law and in criminal procedural Law. Limitations of free persuasion, (translated into the rational persuasion formula) are evaluated in as much as they influence or contribute to the analysis of the consideration systems adopted without intending to exhaust the theme of probative limitations. Comparison of the systems of civil and criminal rational persuasion is made from the perspective of trends to an ideal and assured procedure in each one of these spheres. From this evaluation, we demonstrate that, although it is an usual assertion that both systems are guided by the Judges free rational persuasion as to evidence consideration, application of this principle to civil or criminal procedure differs due to distinct purposes and structures of each one of the procedures which, in turn, are determined by moral political and legal principles of a different order.

The study starts with a research on the value of the dignity of the human person; then, it proposes that priority attention is given to children and adolescents, due to the condition of development and state of vulnerability of these individuals. Subsequently, a protection of personal dignity in the context of international trafficking of children and adolescents is investigated by a two-fold approach. Firstly, it is addressed the international system of protection and fight against trafficking, highlighting the influence of the external environment in the development of domestic law. Secondly, it is pointed out the recent inclusion of the human trafficking in Brazilian legal order, mainly stressing the existing lack of tutelage of children and adolescents. The study briefly shows the legal protection in force in Mercosur’s member states (Argentina, Paraguay and Uruguay), the United States of America, Portugal and the United Kingdom. From the point of view of material law, it deals with the constitutional guideline of the criminalization of the conduct of human trafficking, the legal instruments to confront it in Brazil, and, finally, analyzes the typology of this crime (article 149- under drafting of Law n.13.344 / 2016). The thesis points out the failure of the contemporary Brazilian legal system in providing adequate solutions to define the typology of human trafficking crime and proposes the improvement and development of the system in order to make effective the legal instruments in this area. This issue demands further attention that goes beyond the legal scope, requiring inter and transdisciplinary studies that cover the law and its interaction with several fields of knowledge, including anthropology, education, social sciences, sociology, philosophy and criminology / A tese analisa o tratamento jurídico dado ao combate ao tráfico internacional de crianças e adolescentes no Brasil, especialmente sob o aspecto instrumental. Inicialmente, aborda o valor da dignidade da pessoa humana, propondo uma atenção prioritária a crianças e adolescentes, em virtude da situação de desenvolvimento e de vulnerabilidade destas pessoas. Em seguida, analisa sob dois aspectos a proteção da dignidade pessoal em situações de tráfico internacional de crianças e adolescentes. O primeiro deles aborda o sistema internacional de proteção e o combate ao tráfico, ressaltando a influência da conjuntura externa no desenvolvimento do direito interno. O segundo aponta a inserção do tráfico de pessoas no ordenamento jurídico brasileiro, destacando a insuficiência da tutela ora existente. Posteriormente, é analisado o impacto jurídico relativo ao combate ao tráfico internacional de crianças e adolescentes nos sistemas estatais com base nos impactos dos tratados internacionais na soberania dos Estados e na necessidade de integração e cooperação penal internacional. Sob a perspectiva de direito material, a pesquisa trata da diretriz constitucional de incriminação da conduta do tráfico de pessoas.
