Úpadkové trestné činy / Insolvency Crimes

This thesis deals with the special category of crimes related to the bankruptcy of the debtor and to the insolvency proceedings. The first and second parts of the thesis are devoted to the general introduction into the both law branches, i. e. into the insolvency law and criminal law. The third part of the thesis focuses on interconnection of the mentioned law branches reflected in the category designed as insolvency crimes. The thesis analyses particular crimes utilizing the legal acts, technical literature and judicature. The fourth part handles the available statistical data regarding the insolvency criminality provided by the Czech Police. At last the thesis evaluates the social harmfulness of the insolvency crimes, its legal regulation and the protection against it.

Gegen niedergelassene Kassenärzte wurden Ermittlungsverfahren wegen Bestechlichkeit im geschäftlichen Verkehr seit dem obiter dictum des Oberlandesgerichts Braunschweig im Jahr 2010 eingeleitet. In dieser Arbeit wird die Frage der Anwendbarkeit des § 299 Strafgesetzbuch auf den Vertragsarzt diskutiert. Zudem werden entsprechende Lösungsansätze nach geltendem bzw. zu schaffendem Recht dargestellt. Im Ergebnis gelten die Vertragsärzte nicht als geschäftlich Beauftrage der Krankenkassen bzw. Amtsträger. Es sollte jedoch auf das besondere „Vertragsverhältnis“ zwischen Arzt und Patient, das letztlich auf Vertrauen gründet, Rekurs genommen werden. Wenn gegenseitiges Vertrauen besteht, wird sich der Arzt in seinen diagnostischen und therapeutischen Entscheidungen nicht an seinen eigenen wirtschaftlichen Interessen bzw. Vorteilen orientieren, sondern sich zum Wohle des Patienten vom Facharztstandard unter Berücksichtigung des Wirtschaftlichkeitsgebots leiten lassen.

Imposition of punishments on adults Abstract This work is focused on the topic of imposition punishments on adults. The first part defines the concept and purpose of punishment. The characteristics of these concepts are a prerequisite for understanding the following chapters. Retributive, utilitarian and mixed theories of punishment are defined here. The individual functions of punishment are also described here. Another chapter is devoted to the principles of sentencing. The core of the work deals with the gradual analysis of individual criteria that the court takes into account when imposing punishments, together with issues of mitigating and aggravating circumstances. In the final part, attention is paid to the concurrence of crimes, recidivism and their punishment. This part begins with a definition of simultaneity and further elaborates on the three main principles governing the imposition of punishment. Finally, it also provides a detailed overview of the legal concepts of concurrent and aggregate sentences. The thesis is supplemented by selected judgments of the Constitutional Court and the Supreme Court. Chovanec, Š. Criminal proceedings against legal entities Criminal proceedings against legal entities represent a significant innovation for Czech criminal procedure law. Adoption of Act nř 418/2011, about Criminal liability of legal entities and criminal proceedings against them, is considered as acceptance of the world's phenomenon of enactment of the institute of Criminal liability of legal entities. The lawmaker had chosen a special regulation for criminal proceedings against legal entities which however does not describe the issues solely. So the Penal Code is considered subsidiary applicable regardless it does regulate criminal proceedings against a natural person. The author of this text deals with risks and potential problems connected to this construct. The author of this text describes selected aspects of criminal proceedings against legal entities from its beginning to the enforcement proceeding.

La constitution du 22 janvier 2001 dispose expressément que la République du Sénégal garantit la liberté de la presse et le droit à l’information plurielle. Néanmoins, le journaliste sénégalais est resté justiciable des codes pénal et de procédure pénale, adoptés dans l’élan répressif des années 1960. Ce droit pénal commun qui intègre paradoxalement la loi française spéciale du 29 juillet 1881 sur la liberté de la presse, héritée de la colonisation, apparaît comme dépassé par l’évolution de la démocratie sénégalaise et l’aspiration du peuple à l’épanouissement et au progrès social. L’activité journalistique est une activité potentiellement délinquantielle. Il peut arriver que le journaliste abuse de la liberté d’expression en foulant au pied la loi et les règles de la déontologie de sa profession. La justice du droit pénal a vocation à lui être applicable. Mais, ce constat ne doit point occulter la nécessité dans laquelle se trouve le législateur de rendre sauve la liberté de la presse dans l’exercice de sa compétence exclusive de fixation et de détermination des abus intolérables de ladite liberté. Pour ce faire, l’adoption d’une législation spéciale, détachée de l’emprise tutélaire des codes pénal et de procédure pénale, s’impose. C’est une condition nécessaire, mais non suffisante. La prévisibilité de la loi applicable à la responsabilité pénale du professionnel de l’information, l’indépendance du juge qui l’applique, la non-ingérence du pouvoir politique dans la liberté d’informer du journaliste sont autant de conditions nécessaires à la répression des abus de la liberté de la presse. / Senegalese Constitution dated 22th January 2001 clearly provides that the country guarantees the freedom of the press and the right to multi-sourced information. And yet the Senegalese journalist remains subject to the Criminal Code and the Code of Criminal Procedure adopted in the repressive surge of the 1960’s.The local Criminal law which paradoxically includes French special 29th July 1881 Act on the freedom of the press seems outdated and overtaken by the evolution of the Senegalese democracy and the people’s yearning for development and social progress. The journalistic activity potentially brings forth offences. The journalist may take too much advantage of the freedom of the press violating thereby the law and his own deontology. Criminal law justice must therefore be applicable to them. However this must not conceal the law-maker‘s necessity to safeguard the freedom of the press. To that end it is necessary to set up a special legislation free from the Criminal Code and from the Code of Criminal Procedure. This is a necessity though insufficient. The predictability of the law applicable to the criminal liability of the journalist, the independence of the applying judges and the non-interference of the political power in the journalist’s freedom of speech are prerequisites to the repression of the abuses of the freedom of the press. Our present thesis aims on the one hand to diagnose the criminal liability regime of the Senegalese journalist and also to prove the inadequacy of the criminal law with its legal liability. We will then suggest a particular criminal liability system more respectful of the freedom of the press.

Criminal activity is mapped in this thesis, which subjects can commit in connection with insolvency proceedings. Czech Criminal Code No. 40/2009 Coll. lays down a total of six crimes, while the Swedish Criminal Code (Brottsbalk) has seven such crimes. The current legal regulation of bankruptcy offenses in the Czech Republic is analyzed in the theoretical part. In the practical part, the foreign legislation is analyzed and several proposals de lege ferenda are set on the basis of this analysis.

Public security policies are defined as pairs of a size of the police force and an average length of sentences. We propose an original micro-founded public security technology linking the level of police expenditures to the probability of arrest. This essay also contributes to the literature by proposing a dynamic equilibrium framework to evaluate public security policies. Equilibrium effects can be potentially relevant because of dynamic interactions between the classical incapacitation and deterrence effects. The model allows us to explore the optimality of policies in a way that would not be possible with reduced form empirical estimates or with the traditional, partial equilibrium, static, theoretical models of crime. We conduct an exploratory quantitative exercise calibrating the model to US property crime data from the 2000s. The calibrated model points to overspending in police protection and over incarceration in that period, when compared to the optimal public security policy. The second essay of this thesis develops a dynamic equilibrium model of crime with heterogeneous agents and several types of wrongs---actions that generate inefficiencies. Criminal codes define which wrongs are punishable by the state and penal codes define the length of the sentence if an agent is apprehended by the police committing a crime. %Agents decide at each point in time whether to commit crimes by comparing potential gains from crime to the expected loss due to the probability of apprehension and the associated cost (freedom deprivation). Criminal justice systems are defined as triplets of a criminal code, a penal code and a size of the police force. The dynamic framework with a multi-crime/multi-punishment setting, allows exploring substitution across different types of crime and might generate counter-intuitive results, mostly unexplored in the literature. The model developed in this essay also allows the endogenous definition of the set of actions that constitute crimes, as part of the welfare maximizing design of the criminal justice system. The third essay, co-authored by Braz Camardo, develops a 3-period model in which agents have time-inconsistent preferences and have access to an illiquid financial asset. The model developed in this essay studies the relationship between risk aversion and the demand for a commitment device, as represented by the illiquid asset. The main result is that, in an environment with uncertainty, a higher risk aversion implies a higher demand for the illiquid asset, due to a commitment motive. This counter-intuitive theoretical result is able to reconcile seemingly contradictory evidence found in the recent empirical literature. / No primeiro ensaio da tese, em coautoria com Rodrigo Soares, é desenvolvido um modelo dinâmico com equilíbrio e ciclo da vida com agentes heterogêneos e acúmulo de capital humano. Políticas de segurança pública são definidas como um par de gastos em força policial e tempo de pena. Neste ensaio, propomos uma tecnologia de segurança pública original e micro-fundamentada que permite que se expresse o nível de gastos com policiamento com a probabilidade de prisão. Este ensaio também contribui com a literatura ao usar um modelo dinâmico de equilíbrio capaz de avaliar políticas de segurança pública. Efeitos de equilíbrio podem ser potencialmente relevantes devido às interações dinâmicas entre os efeitos de dissuasão e incapacitação. O modelo permite a obtenção de políticas de segurança pública ótimas que seriam impossíveis de serem obtidas a partir de estimações que considerem apenas reduzidas, ou, ainda, a partir de tradicionais modelos estruturais de crime que levem em conta equilíbrio parcial ou que sejam estáticos. Por fim, este ensaio conduz exercícios quantitativos de calibração usando dados dos EUA da década de 2000. O segundo ensaio dessa tese desenvolve um modelo de equilíbrio dinâmico com agentes heterogêneos e vários tipos de ações que gerem externalidades negativas. Códigos criminais definem quais ações são consideradas como crime e, portanto, são puníveis pelo Estado e códigos penais definem o tempo de pena médio para cada crime. Sistemas de justiça criminal são definidos como a tripla de códigos criminais, códigos penais e gastos em policiamento. O ambiente dinâmico com muitos tipos de crimes e punições permite que se explore efeitos de substituição entre diferentes tipos de crime, o que pode levar a resultados contra-intuitivos que ainda não foram explorados pela literatura. Por fim, os componentes deste modelo permitem uma definição endógena do conjunto de ações que deveriam ser consideradas como crime, já que a definição do código criminal pode ser escolhida de forma a maximizar o bem-estar social. O terceiro ensaio, em coautoria com Braz Camargo, considera um modelo com três períodos em que agentes são temporalmente inconsistentes e possuem acesso a ativos ilíquidos. Este modelo estuda a relação entre aversão ao risco e demanda por mecanismos de comprometimento, representada por um ativo ilíquido. O principal resultado é que, em um ambiente com incerteza, uma maior aversão ao risco maior implica uma demanda maior por ativos ilíquidos. Este resultado teórico contra-intuitivo é capaz de conciliar resultados aparentemente contraditórios da literatura empírica.

The target of this thesis is to provide the information about the economic crime and to map the Czech legislation of chosen economic crimes. The first part deals with the concepts such as economic criminality, financial criminality and economic crimes. The second part is dedicated to the crime from the perspective of substantive law, clarifies some of the basic principles of Czech criminal law and analyses the merits of the offense in general terms. The third part is concerned with the characteristics of chosen economic crimes, gives examples from practice mediated by jurisprudence of the High Court and offers the basic statistic reviews of committed crimes from 2009 -- 2013.

The "Death penalty as a response to the growing brutality of criminal offenses" diploma thesis discusses the increasing trend of the violent and brutal criminality and the resolution possibilities of the situation. As the main goal of this thesis, the author deals with the idea whether returning the death penalty back into our justice system would be the right response to the increasing degree of brutality of violent criminals. In the theoretical part, the term "death penalty" is explained in general, as well as its history and use. Next the thesis acquaints us with the use of the death penalty on our territory in the past and its legislative question in our history. The next part of the theoretical part is a comparison of the several past years in the development of violent criminal offenses and their brutality in the Czech Republic. The empirical part of the thesis is focused on the research of the public opinion of the citizens of the Czech Republic and the USA regarding the degree of the increasing trend of brutal criminal offenses as well as their opinion on the use of the death penalty.
