Gränsöverskridande förlustutjämning inom EU : En studie med fokus på målet Marks & Spencer

Ekonomiska nackdelar som uppstår till följd av att en verksamhet bedrivs genom flera självständiga dotterbolag istället för under ett bolag med flera driftställen avhjälps normalt med lagregler om koncernbidrag. Dessa regler är emellertid endast tillämplig på nationella koncerner, dvs. koncerner där samtliga bolag har säte i ett och samma land. Problem uppstår emellertid när de olika dotterbolagen är belägna i olika länder. Denna uppsats behandlar problematiken kring gränsöverskridande förlustutjämningar inom EU. Grunden för uppsatsen är det kontroversiella målet Marks & Spencer där frågan om gränsöverskridande förlustavdrag ställdes på sin spets. Målet fick stor betydelse för rättsutvecklingen i såväl Sverige som övriga Europa.

Au sein de l’Union Européenne, les classes moyennes occupent une place charnière dans la construction politique et médiatique des processus migratoires. Entre comportements de grands mobiles aveugles aux frontières et migrations de classes populaires accusées de « profiter » de l’Europe, elles sont celles à qui l’on prête des aspirations à la réussite sociale et qui semblent le mieux incarner un idéal de libre circulation. Dans cette thèse, nous avons cherché à déconstruire l’idée d’un espace européen ouvert et ascensionnel en allant étudier ces migrations au plus près des frontières françaises, dans l’espace frontalier belge qui borde l’agglomération lilloise. Marqué par une forte continuité urbaine, une communauté de langue et une longue tradition d’entremêlement des populations, cet espace apparait comme l’un des plus intégré d’Europe. De fait, depuis les années 2000, de nombreux français passent la frontière pour mieux se loger tout en conservant un ancrage fort en France. L’examen de leurs trajectoires résidentielles et migratoires montre cependant que ces mouvements ne sont pas uniformes et éclairent au contraire des inégalités d’appropriation de l’espace européen / Middle class members are said to be those who can benefit most from migration within the EU. In this research I looked at how their migrations concretely take place in a Franco-Belgian cross-border area. There, undreds of French citizens leave their home country each year to get a new home on the other side of the border while keeping their job and many activities in France. This thesis is concerned with the actors of cross-border cooperation in the Euroregion Silva Nortica. The aim is to analyze what kind of actors affect cross-border region Silva Nortica and are involved in cross-border cooperation in this area. Another aim is to determine key areas of cross-border cooperation with its specific features within the Euroregion Silva Nortica and evaluate the selected programmes on the Czech and Austrian side of the euroregion. The first programme is the Community Initiative Programme Interreg IIIA and Disposition Fund for the period 2004-2006 and the second programme is the European Territorial Cooperation Austria-Czech Republic and Small Projects Fund under this initiative for the period 2007-2013. The theoretical part deals with the phenomenon of the border, cross-border area and the establishment of Euroregions. The practical part consists of a survey and outcomes of structured interviews. Les chemins multiples de la coopération transfrontalière franco-belge : analyse des dynamiques institutionnelles. / The different paths of French-Belgian cross-broder cooperation : analysis of institutional process

La recherche doctorale porte sur le développement de la coopération transfrontalière entre collectivités territoriales de part et d'autre de la frontière franco-belge autour des villes de Lille, Tournai et Kortrijk. Au-delà d'une interrogation sur les facteurs externes et les usages politiques de ce nouveau domaine d'action publique, cette monographie étudie le processus de construction institutionnelle à l'œuvre au sein de cet espace émergent de coopération de la fin des années 1980 à 2010. Cela passe tout d'abord par l'analyse des mécanismes de légitimation, en particulier la construction de la question transfrontalière franco-belge en tant que problème légitime d'action publique ainsi que la « fonctionnalisation » de la COPIT (Conférence permanente intercommunale transfrontalière), une des principales organisations transfrontalières franco-belges de la zone étudiée. Les approches en termes de néo-institutionnalisme historique et les travaux relatifs à l'analyse des organisations permettent ensuite d'aborder l'institutionnalisation de la coopération transfrontalière sous l'angle de la production normative et de s'interroger sur la stabilisation dans le temps des règles produites. Le regard porte alors essentiellement sur la COPIT, qui devient en 2008 l'« Eurométropole Lille-Kortrijk-Tournai », ainsi que sur les rapports de force entre les différents acteurs qui la composent, ce qui permet d'identifier les règles et valeurs partagées par ces acteurs et de comprendre leur construction à travers les représentations et les pratiques récurrentes des acteurs. Les mécanismes d'auto-renforcement des règles dans le cadre de l'organisation intercommunale transfrontalière apparaissant toutefois relativement faibles, l'analyse s'oriente finalement vers la mise en évidence d'ordres institutionnels à la fois concurrents et complémentaires à celui de la COPIT/Eurométropole : il s'agit de l'ordre institutionnel encadré par le dispositif européen INTERREG A et de la nébuleuse institutionnelle développée dans le cadre de diverses actions sectorielles. Au final, cette thèse montre la pluralité des logiques institutionnelles qui guident et caractérisent la coopération transfrontalière franco-belge ; autrement dit, la coexistence d'ordres institutionnels multiples pour un même phénomène. / L'auteur n'a pas fourni de résumé.

Migração pendular e prognóstico da infecção pelo HIV na tríplice fronteira Brasil-Paraguai-Argentina

A migração pendular consiste na mobilidade diária que pessoas fazem entre duas diferentes cidades, tradicionalmente, por motivos de trabalho e estudo, porém também ocorre para a busca por serviços de saúde. Esse movimento acontece em todo o mundo dentro dos territórios nacionais de cada país, como o movimento entre cidades pequenas com poucos recursos humanos e tecnológicos em saúde, para cidades maiores próximas que contenham esses recursos. Essa mobilidade é chamada de migração pendular regional. No entanto, ela assume diversas particularidades quando esse movimento leva as pessoas a cruzarem periodicamente uma fronteira internacional para essa finalidade, o que configura a migração pendular internacional. Esse movimento transfronteiriço pode afetar a adesão dos pacientes aos tratamentos de doenças crônicas, como é o caso da infecção pelo HIV, o que pode modificar o seu prognóstico. O objetivo desta dissertação é comparar o prognóstico de pacientes HIV+ moradores de Foz do Iguaçu que fazem acompanhamento no Serviço de Assistência Especializada (SAE), com pacientes que fazem migração pendular regional e internacional e fazem acompanhamento no mesmo serviço. / Pendulum migration is a daily mobility between two different cities that is made, traditionally, to work or study. However, it also can happen to look for healthcare. This kind of human mobility is common around the world inside the national territory of each country, like the movement between a small city with a lack of health human and technological resources and the major city next to it that contains these resources. It is called regional pendulum migration. But it has many particularities when this movement is responsible for people crossing periodically an international border for this end, which represents the international pendulum migration. This crossborder healthcare may influence the adherence to the treatment of chronic diseases like HIV infection and, for this reason, modify the prognosis of these patients. The aim of this dissertation is to compare the prognosis of HIV+ patients living in the city of Iguazu Falls that makes the follow-up in the Specialized Assistance Service (SAS) of this city with patients who makes regional and international pendulum migration for healthcare in the same health facility.

Movilidad transfronteriza de trabajadores entre Galicia y el norte de Portugal / Cross-border mobility of workers between Galicia and north of Portugal

In this paper we deal with cross-border flows of people within the Euroregion Galicia-North of Portugal, paying particular attention to those led by workers. Based on data for daily mobility between the places of residence and work (commuters), it can be defined, within this territory, the so-called Polycentric Urban Regions (PUR) of Vigo and Porto. These regions should constitute significant referents of cross-border mobility, whose importance we begin to realize by estimating the movement of passengers across border crossings linking the south of Galicia and the north of Portugal. In this context, given the non-existence of official statistics, the reports prepared by the Eures Galicia/Região Norte office provide relevant information about the flow of cross-border workers in the area, which we have complemented by conducting two surveys directed, respectively, to involved workers and companies, and data from a recent study on labour mobility in the Euroregion. The evidence demonstrates the quantitative importance achieved in the territory analyzed by this interesting phenomenon of cross-border work and allows a description of its characteristics that shows the difficulties faced by the process of construction of a European labor market. / En este trabajo, nos ocupamos de los flujos transfronterizos de personas en el seno de la eurorregión Galicia-Norte de Portugal. En este marco, se prestará especial atención a aquellos protagonizados por trabajadores. Dentro del territorio analizado, se pueden definir —a partir de los datos relativos a la movilidad diaria casa-trabajo (commuters)— las denominadas regiones urbanas policéntricas (RUP) de Vigo y Porto. Estas deberían constituir referentes significativos de una movilidad transfronteriza, cuya importancia empezamos a calibrar estimando el movimiento de pasajeros en los pasos fronterizos que unen el sur de Galicia y el norte de Portugal. En este contexto, dada la inexistencia de estadísticas oficiales, los informes elaborados por la oficina Eures Galicia/Região Norte proporcionan información relevante sobre el flujo de trabajadores transfronterizos en la zona. Ello lo hemos complementado mediante dos elementos: la realización de sendas encuestas dirigidas respectivamente a trabajadores y empresas implicadas, y los datos proporcionados por un reciente estudio sobre la movilidad laboral en la eurorregión. La evidencia obtenida demuestra la importancia cuantitativa alcanzada en el territorio analizado por este interesante fenómeno del trabajo transfronterizo. Además, esta permite realizar una caracterización del mismo, que pone de manifiesto algunas dificultades a las que se enfrenta el proceso de construcción de un mercado de trabajo europeo.
