For time, we try to initially demonstrate that society and the memory are socially constructed since the memory is not a natural given, but a choice, an ideologically determined selection. We discuss the origin of cultural heritage and its evolution to its assimilation by national states. Established, throughout the text, what is the relationship between law, culture and memory, as well as the cultural heritage is a cultural fundamental right. Understood that cultural heritage is the legal protection over a selected memory ideologically expounded the development of intangible cultural protection to the Constituent 1987, as the result of these discussions, namely the effective protection in the constitution of 1988 still approached the relationship between democracy and pluralism and the infra protection for the intangible cultural heritage. Finally, we analyze the influence of time on cultural heritage. Thus, we expose the philosophical development over time of classical thought to Hegel. Then we use Heidegger's thought and his concept of time originating in explaining how the weather affects on the protection of intangible cultural heritage, specifically how the law can manage the experience of doing / expressing the intangible cultural asset. Thus, we believe that this dissertation contributes to discussions about intangible cultural heritage in its relation with time, memory, and legal pluralism, and offers new theoretical instrument in the defense and management of cultural property. / A presente pesquisa intitulada Tempo, memória e direito: um estudo jurídico, político e filosófico sobre o patrimônio cultural imaterial trata de um estudo a respeito do patrimônio cultural imaterial e sua relação com a memória, a democracia e o tempo. Para tempo, procuramos demonstrar inicialmente que a sociedade e a memória são socialmente construídas posto que a memória não é um dado natural, mas uma escolha, uma seleção ideologicamente determinada. Discorremos sobre a origem do patrimônio cultural e sua evolução até a sua assimilação pelos Estados nacionais. Estabelecemos, ao longo do texto, qual a relação entre Direito, Cultura e Memória, assim como também que o patrimônio cultural é um direito fundamental cultural. Entendido que o patrimônio cultural é a proteção jurídica sobre uma memória selecionada ideologicamente, explanamos o desenvolvimento da proteção cultural imaterial até a Constituinte de 1987, assim como o resultado dessas discussões, ou seja, a proteção efetivada na constituição de 1988. Abordamos ainda a relação entre democracia e pluralismo e a proteção infraconstitucional sobre o patrimônio cultural imaterial. Por fim, analisamos a influência do tempo sobre o patrimônio cultural. Destarte, expomos o desenvolvimento filosófico sobre o tempo do pensamento clássico até Hegel. Depois, utilizamos o pensamento heideggeriano e seu conceito de tempo originário para explicar como o tempo repercute sobre a proteção do patrimônio cultural imaterial, mais especificamente como o Direito pode gerir a experiência do fazer/manifestar do bem cultural imaterial. Deste modo, acreditamos que essa dissertação contribui para as discussões sobre patrimônio cultural imaterial em sua relação com o tempo, a memória e o pluralismo jurídico, assim como oferece novo instrumento teórico na defesa e na gestão dos bens culturais.

This Women also known as Mangabeira's women reproduce a practice learned with their ancestors, collecting this fruit in the coastal tablelands forests and latter commercializing it in the local markets. This research uses the methodology of oral history and visual anthropology with presentation of collected images on board. It is intended to emphasize the botanical and environmental aspects of the Mangabeira plant, its ecosystem, territorial, economic and historical aspects of it, also the knowledge of this extractive practice of our immaterial culture. / O presente trabalho trata de uma pesquisa etnogr?fica realizada com mulheres coletoras de Mangaba da Vila de Ponta Negra em Natal - RN. As mulheres/mangabeiras reproduzem uma pr?tica aprendida com seus antepassados de coleta deste fruto nas matas de tabuleiros costeiros e o comercializam na capital potiguar. Utilizando as metodologias de hist?ria oral e da antropologia visual com a apresenta??o em pranchas das imagens coletadas. Pretende-se destacar os aspectos bot?nicos e ambientais da planta Mangabeira, o seu ecossistema, aspectos territoriais, econ?micos, hist?ricos e os saberes e fazeres desta pr?tica extrativista de nossa cultura imaterial.

Conselho Nacional de Pesquisa e Desenvolvimento Científico e Tecnológico - CNPq / This dissertation has the purpose of producing a regional history of the occupations of the producers of the pottery associated with the Amazonian Polychrome Tradition (TPA) in the area of the middle Solimões River. The case study of this research is the excavation and ceramic analysis of the São João site, near Lake Caiambé (Tefé-AM). To complete the objective the form and validity of the production of regional long-term indigenous histories will be discussed, a theoretical choice that will prioritize, in turn, the identification and analysis of past choices accumulated in the archaeological record and in the pottery remains. To size the scope of the research a literature review will present studies about the “TPA” category and about the archaeology and ethno-history of the Middle Solimões. The excavation and ceramic analysis of the São João site allowed a glimpse to the various forms that the producers of TPA occupied the landscape of the Solimoes River. The site and its ceramic analysis served as basis for the reinterpretation of the archaeology of the Middle Solimões and for the production of the regional history of these communities. The accumulated data led to the interpretation that this history is marked by the formation of interaction mosaics between ceramist groups. / A presente dissertação tem como propósito produzir uma história regional das ocupações de produtores das cerâmicas associadas a Tradição Polícroma da Amazônia (TPA) na área do médio rio Solimões. O estudo de caso da pesquisa é a escavação e análise cerâmica do sítio São João, próximo ao lago Caiambé (Tefé-AM). Para realizar esse objetivo será discutida a forma e validade da construção de histórias indígenas de longa duração, uma escolha teórica que priorizará, por sua vez, a identificação e análise das escolhas do passado acumuladas no registro arqueológico e nos vestígios cerâmicos. Para dimensionar o escopo da pesquisa, uma revisão bibliográfica apresentará trabalhos sobre a categoria TPA e sobre a arqueologia e etno-história do Médio Solimões. A escavação do sítio São João e sua análise cerâmica permitiram um vislumbre das variadas formas que os produtores da TPA ocuparam a paisagem do rio Solimões. A análise do sítio e de seu material cerâmico são a base para reinterpretar as pesquisas arqueológicas do Médio Solimões e produzir uma história regional dessas comunidades. Os dados acumulados levaram à interpretação que essa história é marcada pela formação de mosaicos de interações entre grupos ceramistas. / Laranjeiras, SE
