No. of bitstreams: 1 NEIVAL XAVIER.pdf: 2054256 bytes, checksum: 9c292a5dad765ecbb5539d0a25ddb08c (MD5) Previous issue date: 2015-08-10 / This course conclusion work is linked to the Programa of Pós-Graduação in Direito, Relações Internacionais and Desenvolvimento, of Pontifícia Universidade Católica de Goiás – PUC/GO, and analyzes the possibility of ensuring that the Goiás cerrado rural worker can exercise their right to turn in their work functions consciously as to its environmental and sustainable responsibility. It starts with the hypothesis that it is possible to man, if truly want, keep working and making their living from the rural areas, though this does come to indiscriminately harm the environment by simply relying on his awareness that can be achieved through a specific environmental education for the rural working class of Goias Cerrado. The research brings accurate and current, relevant to this work, by merging into the essence of the importance of rural labor for the maintenance of life, from the perspective of the satisfactory production of food for human consumption worldwide. Also not least, includes reports on the conservation of the Cerrado, one of the main members of the biosphere and of the six major biomes. The applicability of the research conducted here is evidenced in the current situation, tangent to the lack of information that do achieve that effectively deals with the rural daily life, but this is not done in order to promote some organizations that, unfortunately, take advantage of the moment to more promote themselves through different media, than actually, to do something consistent to what is the bottom line, that is, the conscious rural production. A general investigation of the cerrado biome, compared to its basic characteristics, since the object of this work are social issues arising from the relationship rural-cerrado ecosystem work was developed. The methodology used to confirm the hypotheses of the rural labor and forms of minimally serious nature, was performed using the deductive-bibliographic research method, using existing doctrines and theories. / Este trabalho de conclusão de curso vincula-se ao Programa de Pós-Graduação em Direito, Relações Internacionais e Desenvolvimento, da Pontifícia Universidade Católica de Goiás – PUC/GO, e, analisa a possibilidade de se garantir que o trabalhador rural do cerrado goiano possa exercer seu direito de ativar-se em suas funções laborais de forma consciente quanto à sua responsabilidade ambiental e sustentável. Parte-se da hipótese de que é possível ao ser humano, caso verdadeiramente queira, manter-se trabalhando e tirando o seu sustento do meio rural, sem que com isso venha a agredir indiscriminadamente o meio ambiente, bastando se fundar em sua conscientização que pode ser alcançada via de uma educação ambiental específica para essa classe trabalhista rural do Cerrado Goiano. A pesquisa traz informações precisas e atuais, pertinentes ao presente trabalho, fundando-se na essência da importância que tem o trabalho rural para a manutenção da vida, sob a ótica da necessidade da produção satisfatória de alimentos para o consumo humano mundial. Também não menos importante, apresenta relatos sobre a conservação do Cerrado, como um dos principais integrantes da biosfera e um dos seis principais biomas brasileiros. A aplicabilidade das pesquisas aqui realizadas e externadas é evidenciada, na atual conjuntura, tangente à carência de que se faça a informação alcançar a quem efetivamente lida com o cotidiano rural, mas que isso não seja feito de forma a promover algumas organizações que, lamentavelmente, se aproveitam do momento para muito mais se promoverem por meio das mais variadas mídias, do que efetivamente, se fazer algo condizente ao que é o cerne da questão, qual seja, a produção rural consciente. Foi desenvolvida uma averiguação geral do bioma cerrado, ante suas características básicas, vez que o objeto deste trabalho são questões sociais advindas da relação trabalho rural-ecossistema do cerrado. A metodologia utilizada, para confirmar as hipóteses do trabalho rural e as formas de agravar minimamente a natureza, foi realizada através do método de pesquisa dedutivo-bibliográfico, utilizando as doutrinas e teorias já existentes.

It was necessary, to deeply face this subject, a study connecting both Social Security and Work Rights, that at the two first chapters occurred as from the conception and evolution of social rights at constitutional and human rights universe. At the third chapter, it was developed a study to demonstrate the necessity of the intersection between the two areas of the right (social security and labor), overtaking public-private differences. We started the fourth chapter convinced of, to preserve the human dignity of the employee, it is necessary an interpretation that could give to the laboring incapacity, showed when talking about the individual laboring contract, the effect to suspend the development of this relation and the flow of prescription time either to the right of action, or to preserve the material rights of the employee. About the spontaneous retirement, we would like to deny the condition of extinctive cause of the job contract, defending the right of the retired employee to indemnity by not justified dismissal. Through the search developed by the logical-systematic method, we conclude to be essential to preserve the dignity of the employee that the consequences resulted from both social contingences be observed by the two sciences of the rights, labor and social security / O presente estudo foi elaborado com o fito de proceder à análise de conseqüências específicas acarretadas pela incapacidade laboral e pela aposentadoria espontânea no contrato individual de trabalho. O enfrentamento da questão demandou um estudo conjunto do Direito Previdenciário e do Direito do Trabalho, enfocados nos dois primeiros capítulos a partir da concepção e evolução dos direitos sociais na órbita constitucional e na órbita dos direitos humanos. No terceiro capítulo partimos para um estudo voltado a demonstrar a necessidade da conjugação entre os dois ramos do direito (previdenciário e trabalhista) superando a dicotomia público-privada. Entramos no quarto capítulo convictos da importância, para a preservação da dignidade humana do empregado, de uma interpretação que conferisse à incapacidade laboral, surgida no curso do contrato individual de trabalho, o efeito de suspender o desenvolvimento dessa relação e com ele o fluxo do prazo prescricional, tanto para o exercício do direito de ação, quanto para a preservação dos direitos materiais do trabalhador. Sobre a aposentadoria espontânea, rechaçamos a sua condição de causa extintiva do contrato de trabalho, defendendo o direito do empregado aposentado à indenização por dispensa injustificada. Através da pesquisa desenvolvida pelo método lógico-sistemático, concluímos ser imprescindível para a preservação da dignidade do trabalhador que as conseqüências emprestadas às duas contingências sociais ocorram sob a luz das duas ciências do direito, a trabalhista e a previdenciária

Este trabalho analisa como conflitos direta ou indiretamente relacionados ao trabalho doméstico se expressaram na Justiça Comum e na Justiça do Trabalho, em Porto Alegre, entre os anos de 1941 e 1956, e as maneiras pelas quais as trabalhadoras domésticas ou aqueles/as situados no que denominamos “fronteiras da domesticidade” buscaram no âmbito do Poder Judiciário espaços para defender seus interesses, lutar por direitos e por aquilo que consideravam justo. Para isso, reconstituímos quem eram essas trabalhadoras, seus patrões e patroas, como se estabeleciam os arranjos de trabalho e as expectativas que informavam tais relações, aspectos fundamentais para compreender as motivações que levavam esses sujeitos a buscarem seus direitos e também para avaliar as possibilidades e os limites que tais instituições ofereciam para que isso ocorresse. / This thesis analyses how conflicts directly or indirectly related to domestic work were expressed in the Common Justice and Labor Court in Porto Alegre, between 1941 and 1956, and the ways in which domestic workers or those situated in the so called "borders of domesticity" sought within the scope of the Judiciary to defend their interests, to fight for rights and for what they considered fair. For this purpose, we reconstituted who these workers and their bosses were, how the work arrangements were established and the expectations that informed these relations, that are fundamental aspects to understand the motivations that led these individuals to seek for their rights and also to evaluate the possibilities and limits that such institutions offer in order to make it happen.
