<p>Poslednjih decenija intenzivno se na univerzionalnom i regionalnim nivoima razvija pravo ljudskih prava, uključujući pravo na ravnopravnost i pravo na slobodu od diskriminacije. To je doprinelo napretku u ostvarivanju prava žena i rodne ravnopravnosti. Ukinute su formalne zakonske prepreke za žene, zatim je zabranjena diskriminacija i garantovano je pravo na ravnopravnost, &scaron;to je omogućilo de iure ravnopravnost, a nakon toga se teži ostvarivanju de facto ravnopravnosti. Međutim, su&scaron;tinska ravnopravnost između žena i mu&scaron;karaca jo&scaron; uvek nije dostignuta. Žene &scaron;irom sveta i dalje su u nepovoljnijem položaju u poređenju sa mu&scaron;karcima, diskriminisane su u svim sferama javnog i privatnog života i izložene su nasilju. Pored toga, žene su veoma heterogena grupa, a pojedine grupe žena vi&scaron;estruko su marginalizovane i izložene su većem riziku od vi&scaron;estruke diskriminacije, pa je njihov položaj mnogo lo&scaron;iji u poređenju sa ženama i mu&scaron;karcima iz većinske populacije, kao i mu&scaron;karcima iz njihove manjinske grupe. Vi&scaron;estruka diskriminacija je složen dru&scaron;tveni fenomen, kojim se bave mnoge naučne discipline, zbog čega je bilo neophodno interdisciplinarno istraživanje.<br />U radu se bavim istraživanjem fenomena vi&scaron;estruke diskriminacijom žena, kao i dometima i ograničenjima pravne za&scaron;tite žena od vi&scaron;estruke diskriminacije u Republici Srbiji i Austriji, Bugarskoj, Hrvatskoj, Francuskoj i Nemačkoj, kao odabranim državama Evropske unije. Teorijski okvir ovog rada su feminističke teorije uop&scaron;te, a posebno feministička pravna teorija koju Marta Kamalas (Martha Chamallas) defini&scaron;e kao feminističku pravnu teoriju generacije kompleksnih identiteta, a Kler Dalton (Claire Dalton) kao fazu raznovrsnosti. Podele koje su one formulisale povezane su sa pravnim teorijama jednakosti i ravnopravnosti, koje su važan deo teorijskog okvira ovog rada jer je na osnovu njih zabranjena diskriminacija, odnosno, kako je to Sandra Fredman definisala, ukinute su formalne zakonske prepreke, direktna i indirektna diskriminacija zabranjena su u svim sferama i uvedeni su mehanizmi za promovisanje ravnopravnosti. Feministička teorija intersekcionalnosti, koju je uspostavila Kimberli Kren&scaron;o (Kimberl&eacute; Crenshaw) predstavlja važan deo teorijskog okvira ovog rada, jer je za razumevanje pojma vi&scaron;estruke diskriminacije važno razumevanje vi&scaron;estrukosti identiteta i njihove međusobne zavisnosti i neodvojivosti. Teorija intersekcionalnosti nagla&scaron;ava da fokus mora da bude na jedinstvenom identitetu osobe, a obuhvata i nove koncepte u kojima se prevazilaze lična svojstva kao delovi identiteta i grupe koje se stvaraju na osnovu jednog ili vi&scaron;e ličnih svojstava, te kao sredi&scaron;no pitanje postavlja odnos moći koji deluje u odnosu na specifičan jedinstveni i nedeljivi identitet neke osobe. Predmet mog interesovanja bio je da li pravo ima odgovor na nedeljivost identiteta žena, &scaron;to znači da sam istraživala da li je u antidiskriminacionim postupcima prepoznata vi&scaron;estruka diskriminacija, kao i da li žene koje pripadaju vi&scaron;estruko marginalizovanim grupama imaju adekvatnu mogućnost efikasne i delotvorne za&scaron;tite od diskriminacije. U radu zastupam tezu da je zabrana vi&scaron;estruke diskriminacije potreban, ali ne i dovoljan uslov za adekvatnu za&scaron;titu žena od vi&scaron;estruke diskriminacije, odnosno, da samo propisivanje zabrane vi&scaron;estruke nije dovoljno da bi žene dobile adekvatnu za&scaron;titu od diskriminacije. Takođe, zastupam tezu da prepreku ostvarivanju ravnopravnosti vi&scaron;estruko diskriminisanih žena predstavlja nedostatak su&scaron;tinskog razumevanja fenomena vi&scaron;estruke diskriminacije među sudijama i advokatima, koji često odlučuju pod uticajem sopstvenih predrasuda i stereotipa, &scaron;to pravnu za&scaron;titu od diskriminacije čini nedelotvornom i dodatno marginalizuje žene. Zbog toga sam analizirala sudsku praksu i praksu nacionalnih tela za ravnopravnost u Srbiji i odabanim državama Evropske unije, kao i praksu Evropskog suda za ljudska prava i Suda pravde Evropske unije, u slučajevima vi&scaron;estruke diskriminacije žena.<br />Rezultati istraživanja pokazuju da je broj postupaka za za&scaron;titu žena od vi&scaron;estruke diskriminacije veoma mali, kao i da postoje brojni izazovi u obezbeđivanju efikasne i delotvorne pravne za&scaron;tite od vi&scaron;estruke diskriminacije žena, koji između ostalog, uključuju i određene normativne nedostatke u pravnim sistemima država, su&scaron;tinsko nerazumevanje vi&scaron;estruke diskriminacije žena, odlučivanje pod uticajem rodnih stereotipa i predrasuda, kao i te&scaron;koće u primeni pojedinih odredaba zakona.</p><p>Rad nudi uvid u prepreke i izazove u pravnoj za&scaron;titi žena od vi&scaron;estruke diskriminacije, koje je neophodno otkloniti kako bi se vi&scaron;estruko diskriminisanim ženama obezbedila efikasna i delotvorna za&scaron;tita od diskriminacije. Rezultati istraživanja mogu biti od koristi pravnim profesionalcima (sudijama i advokatima), kao i donosiocima odluka i op&scaron;toj javnosti, u cilju podizanja svesti, boljeg razumevanja fenomena vi&scaron;estruke diskriminacije žena i pobolj&scaron;anja pravne za&scaron;tite žena od vi&scaron;estruke diskriminacije.</p> / <p>In recent decades, human rights, including the right to equality and the right to freedom from discrimination, have been intensively developed at the universal and regional levels. This has contributed to progress in the realization of women&#39;s rights and gender equality. Formal legal barriers for women were abolished, discrimination was then banned and the right to equality was guaranteed, which enabled de iure equality, and subsequently sought to achieve de facto equality. However, substantive equality between women and men has not yet been achieved. Women around the world are still disadvantaged compared to men, discriminated against in all spheres of public and private life and subjected to violence. In addition, women are a very heterogeneous group, and some groups of women are marginalized and at higher risk of multiple discrimination, so their position is much worse compared to women and men in the majority population as well as men from their minority group. Multiple discrimination is a complex social phenomenon researched by many scientific disciplines, and interdisciplinary approach is necessary.</p><p>The dissertation deals with the phenomenon of multiple discrimination against women, as well as the scope and limitations of legal protection of women against multiple discrimination in the Republic of Serbia and Austria, Bulgaria, Croatia, France and Germany, as selected countries of the European Union. The theoretical framework of this paper is feminist theories in general, and feminist legal theory in particular, which Martha Chamallas defines as the feminist legal theory of the generation of complex identities, and Claire Dalton defines it as the phase of diversity. The divisions they formulate are linked to the legal theories of equity and equality, which are an important part of the theoretical framework of this dissertation because the prohibition of discrimination is based on those theories. Sandra Fredman defines it as follows: formal legal barriers are abolished, direct and indirect discrimination is prohibited in all spheres, and mechanisms have been introduced to promote equality. The feminist theory of intersectionality, founded by Kimberl&eacute; Crenshaw, is an important part of the theoretical framework of this dissertation because understanding the multiple identities and their interdependence and inseparability is important for understanding the concept of multiple discrimination. Intersectionality theory emphasizes that the focus must be on the unique identity of the person, and introduces new concepts in which separate parts of identities, and groups created on the basis of one or more personal traits should be overcame. In addition, the central question should be focused on power dynamics acting in relation to the specific unique and indivisible identity of a person. The subject of my interest was whether the legal systems have an answer to the indivisibility of women&#39;s identities, which means that I researched whether multiple discrimination was recognized in anti-discrimination proceedings, and whether women belonging to multiple marginalized groups had an adequate possibility to be efficiently and effectively protected against discrimination. In my dissertation, I argue that the prohibition of multiple discrimination is a necessary but not sufficient condition for adequate protection of women against multiple discrimination, that is, the mere introduction of a prohibition of multiple discrimination in legislation is not sufficient for women to obtain adequate protection against discrimination. I also argue that the barrier to achieving equality for multiple discriminated women is the lack of an essential understanding of the phenomenon of multiple discrimination among judges and lawyers, who often decide under the influence of their own prejudices and stereotypes, which renders legal protection against discrimination ineffective and further marginalizes women. Therefore, I have analyzed the case law and practice of national equality bodies in Serbia and selected European Union countries, as well as the practice of the European Court of Human Rights and the Court of Justice of the European Union in cases of multiple discrimination against women.<br />The results of the research show that the number of procedures for the protection of women from multiple discrimination is very small, and that there are numerous challenges in ensuring effective and effective legal protection against multiple discrimination against women, which include, among other things, certain regulatory deficiencies in the legal systems of the states, lack of understanding of multiple discrimination against women, decision making under the influence of gender stereotypes and prejudices, and difficulties in applying certain provisions of the law.</p><p>The dissertation offers insights into the obstacles and challenges in the legal protection of women against multiple discrimination, which need to be addressed in order to provide effective and efficient protection from multiple discriminated against women. The results of the research can be useful to legal professionals (judges and lawyers) as well as decision makers and the general public, with the aim of raising awareness, better understanding the phenomenon of multiple discrimination against women and improving the legal protection of women against multiple discrimination.</p>

The relationship between perceived discrimination, organisation-based self-esteem (OBSE) and job satisfaction among women at work.

The study aimed to test whether or not Organisational-based Self-Esteem (OBSE) mediated the relationship between perceived discrimination and job satisfaction. OBSE was expected to have an impact on Job Satisfaction, whilst Perceived Discrimination was argued to have an effect on OBSE. The study was conducted with a sample of 238 women as previous research indicates women are more likely to experience discrimination in the workplace. Contrary to expectations, the SEM revealed that perceived discrimination did not have a significant impact on job satisfaction. Also, the results obtained suggest that OBSE does not mediate the relationship as there was no significant relationship between perceived discrimination and OBSE. There was evidence that OBSE could be a moderator in the relationship instead. Furthermore, opposing the literature, the results supported the notion of global SE mediating the relationship between perceived discrimination and job satisfaction as it was the only significant path in the SEM. Overall, the study contributed to a body of literature and added value by suggesting that the role of perceived discrimination is underestimated as its impact extend outside of the workplace and may have deeper repercussions.

An exploration of triple whammy oppression and its role in creating unsafe environments for black women in post-apatheid South Africa : a case study of Mankweng Community, Limpopo Province

Thesis (M.A. (Political Science)) -- University of Limpopo, 2022 / During the apartheid era in South Africa, Black women were mostly oppressed members of the population. They faced the triple whammy oppression of race, sex and class which prevented them from living their lives freely. These categories of oppressions overlapped into the democratic dispensation. Although South Africa has become a democratic Republic, Black women continue to experience the triple whammy oppression of racism, sexism and classism. These oppressions are prevalent among Black women in the Mankweng community of Limpopo Province, resulting in different types of social issues. This development has motivated Black communities to employ Womanist theory or Womanism to eradicate the triple whammy oppressions and social issues that have morphed into challenges in the communities. This theory considers the element of equality from different aspects of life in the society. The aim of this study was to explore the triple whammy oppression and its role in making Mankweng Community in Limpopo Province of post-apartheid South Africa an unsafe environment. The study utilised semi-structured interviews to collect and collate data. Collected data established that Black women and men have different and similar views on the triple whammy oppression and social issues that contribute to unsafe environments for Black women in Mankweng Community of Limpopo Province. The study further established that Black women are mostly the victims of oppressions and social issues. The study further recommends that black men must be educated about the importance of women and that the philosophy of Ubuntu must be practiced in the communities of Black people in order to have safe environments for everyone.

Essays in Economics of Science

This dissertation consists of three essays in applied microeconomics on the economics of science. The first chapter contribute to the understanding of fairness and recognition in innovation systems. The second and third chapters study the effect of government policies and university relocation on science and education outcomes respectively. The first paper, coauthored with Zihao Li, studies gender difference in innovation recognition using patent citations. We propose a method to quantify under-citation, by constructing a “should-cite” list for each of over 1.5 million patents based on textual similarity, using state-of-the-art natural language processing technique. We find that female-authored patents are approximately 12% more likely to be under-cited than male-authored patents. Additionally, male inventors are far more likely to under-cite patents written by female inventors. Our findings are consistent with the testable implications of taste-based discrimination but not statistical discrimination. Welfare analysis shows that past under-citations negatively impact future patenting activities, especially for female inventors. The second paper, coauthored with Elliott Ash, Mirko Draca and David Cai studies the impact of a large-scale scientist recruitment program – China’s Junior Thousand Talents Plan – on the productivity of recruited scholars and their local peers in Chinese host universities. Using a comprehensive dataset of published scientific articles, we estimate effects on quantity and quality in a matched difference-in-differences framework. We observe neutral direct productivity effects for participants over a 6-year post-period: an initial drop is followed by a fully offsetting recovery. However, the program participants collaborate at higher rates with more junior China-based co-authors at their host institutions. Looking to peers in the hosting department, we observe positive and rising productivity impacts for peer scholars, equivalent to approximately 0.6 of a publication per peer scholar in the long run. Heterogeneity analysis and the absence of correlated resource effects point to the peer effect being rooted in a knowledge spillover mechanism. The third paper studies the long run effect on local education outcomes of the temporary exodus of Chinese universities in the Second Sino-Japanese War (1937-1945). During the war, over 80% of China’s universities, along with the top tiers of China’s educated talents were forced to relocate to inland underdeveloped areas during the war. We find that the large inflow of educated elite intellectuals and universities increased local supply of secondary schools by 6.6% during and after the war period, indicating the effect cascades to lower tiers of education. However, such trend does not persist into the People’s Republic of China (PRC) era and we find limited effect on local education outcomes in the long run. We discuss the salience of locational fundamentals and education policies in explaining the absence of persistence.

Title VII: sex discrimination in higher education

Federal employment law designed to assure equal employment opportunity for faculty has only been applicable to higher education since 1972. Prior to 1972, the higher education world, moreover, was immune from the most comprehensive federal employment law, Title VII of the Civil Rights Act of 1964. However, Title VII was amended in 1972 to include education institutions. Ever since the protection of the civil rights law was extended to higher education, faculty employment discrimination litigation has increased. The reality of this phenomenal growth in litigation is clear, the potential for judicial intervention in academic decision making is undeniable, and reliance on the judicial process is increasingly becoming common. Thus, no institution of higher education may consider itself immune from the possibilities of litigation, nor immune from the decisions handed down by the courts. The main focus of this study was a legal one, which necessitated a heavy concentration upon the historical and current state of employment discrimination law, specifically, Title VII of the Civil Rights Act of 1964. The study was conducted by using a combination of legislative analysis and legal research methods. The legal research methods used in this study included the same problem-solving processes as other traditional research methods: (1) collecting data; (2) analysis; and (3) interpretation. The main purpose of this study was to examine, analyze, and summarize legislative history and case law relevant to Title VII, and sex discrimination in higher education. In summary, although Title VII prohibits discrimination on the basis of race, color, religion, sex and national origin, the issues surrounding women faculty and sex discrimination is probably the fastest growing area of litigation for administrators on the university campus. Therefore, this study was an attempt to examine the employment discrimination issues and developments pertaining to sex discrimination only. College and university administrators may find this study useful for: (1) examining Title VII, and its amendments; (2) examining sex discrimination case law; and (3) utilizing the research for developing procedures, policies and guidelines to minimize potential lawsuits. / Ed. Änkeståndets påverkan : Hur kvinnors levnadssituationer i Vrindavan och Tiruchirappalli påverkas av deras änkestånd

Denna uppsats undersöker levnadssituationerna för kvinnor i änkestånd i städerna Vrindavan och Tiruchirappalli, Indien. Till Vrindavan vallfärdar kvinnor i änkestånd från hela landet och staden beskrivs som en ”änkornas stad”. Tiruchirappalli är hem åt många bönder med familjer och därigenom kvinnliga bönder i änkestånd vilka marginaliseras. Syftet är att problematisera och belysa det utanförskap och de svårigheter många av kvinnorna hamnar i och möter på grund av sitt änkestånd, i relation till CEDAW. Detta utifrån tre forskningsfrågor vilka undersöker hur kvinnornas levnadssituationer ser ut i relation till Iris Marion Youngs teori om förtryck, på vilket sätt kvinnornas levnadsförhållanden blir en del av deras identitet då de ofrivilligt placeras i den sociala gruppen ”änkorna”, samt vad detta har för implikationer på deras rättigheter. Youngs teori om förtryck samt Chandra Talpade Mohantys kritik kring makt och porträttering används för att svara på frågorna. Uppsatsen bygger på insamlad empiri och 14 intervjuer som förvärvats genom deltagande observation och en semi-strukturell intervjumetod. Insamling av empiri skedde genom två oberoende fältarbeten under 2018 och 2019 på två ideella organisationer i Vrindavan och Tiruchirappalli, vilka arbetar för att stärka kvinnornas roll i samhället. Resultatet konstaterar att kvinnor i änkestånd kan sägas förtryckas utifrån Youngs fem förtryckskriterier på grund av den sociala grupp de placeras i, vilket kränker deras rättigheter som kvinnor och människor. Slutsatsen kan även dras att relaterad stigmatisering håller på att försvinna vilket kan bero på förändrade samhällsnormer. / This thesis aims to gain further understanding of the living conditions for widows in the cities of Vrindavan and Tiruchirappalli in India. Widows from all over India travel to Vrindavan, known as ”the city of widows”, when they have nowhere else to go, and Tiruchirappalli is home to a high number of farmer widows whom are being marginalized. This thesis seeks to problematize and shed light upon the alienation and difficulties these women face as a result of their widowhood, in relation to CEDAW. Based on three research questions it examines how the women’s living conditions could be understood in relation to Iris Marion Young’s theory about oppression; in which ways their living conditions become part of their identity because of their involuntary placement in the social group ”the widows”; and which implications this have on their rights. Young’s theory and Chandra Talpade Mohanty’s criticism regarding power and portrayal are being used to answer these questions. Information was provided through two independent fieldwork experiences conducted 2018 and 2019 at two NGO:s in said cities, both aiming to empower widows. The information consists of 14 interviews provided by participant-observation and a semi-structured interview method. The result shows that widows are being oppressed based on Young’s five criterions of oppression because of their involuntary placement in the social group ”the widows”, which in turn violates their rights as women and humans. However, the conclusion also states that related stigmatization continues to decrease, which could be a result of changing norms.

HIV/AIDS and the role of gender inequality and violence in South African Law

South Africa has not escaped the rising prevalence and severe impact of HIV/AIDS in relation women. From an economic and social vantage point, the HIV/AIDS epidemic hits women the hardest, with underprivileged black women the most susceptible to the virus. The theoretical framework of this research focuses on the intersection between HIV/AIDS, gender inequality and gender violence, and more specifically, on certain cultural practices and customs that contribute towards and exacerbate women’s subordination and inequality, which in turn, increase women’s exposure to become infected with HIV. Relevant to this focus is inevitably an investigation of perceived threats to specific fundamental human rights as a result of some entrenched practices that continue to reinforce women’s subordinate position in society, aggravated by the high incidence of gender violence. / Constitutional, International & Indigenous Law / LL.M.
