The transformative value of international criminal law

Thesis (LLD)--Stellenbosch University, 2012. / Includes bibliography / ENGLISH ABSTRACT: The existential crisis of the international regime of criminal law is arguably a thing of the past. This is confirmed through a growing body of positive law and the existence of various international criminal courts, notably the permanent International Criminal Court which has been in operation since 2002. Moreover, it is significant that international criminal law (“ICL”) is developing towards increased domestic enforcement, in particular as a result of the complementarity regime envisioned by the Rome Statute of the International Criminal Court. States have generally been receptive and cooperative towards international criminal norms as well as the structures of international criminal justice. As a result international criminal laws are increasingly being transformed into national law and enforced by states on the domestic level. Chapter 2 provides an overview of the abovementioned developments, the characteristics of ICL and certain key concepts. In lieu of the upward trajectory of ICL’s development, the thesis aims to determine whether ICL exerts an influence which holds ‘transformative value’. Chapter 3 unpacks this concept by delineating the different meanings afforded to transformation and identifying the reticent characteristics of transformative change, especially the underlying importance of values during processes of transformation. Transformative value is conceptualised broadly as the product and potential of the type of change that holds some utility for the civitas maxima (or the community of mankind). In Part II, ICL’s transformative value is investigated from a historical and global perspective with emphasis on the purposes, values and politics of international criminal justice. Chapter 4 focuses on the Nuremberg IMT and the trial of Adolf Eichmann. It is submitted that these trials produced a paradigm shift that represents the transformative foundation of modern ICL. Chapter 5 investigates the purposes and aspirations of modern ICL with reference to its underlying assumptions as well as its objectives, the latter which may be found in positive law and the jurisprudence of international criminal courts. The research suggests that ICL is disposed towards objectives which are unique in comparison to those of domestic criminal law. While it cannot be denied that punishment under ICL is predominantly a backward-looking exercise in the tradition of domestic criminal law retributivism, ICL is somewhat removed from this paradigm due to its purpose- and value-driven nature. ICL is also expressive, normative and forward-looking in various respects. Individual criminal liability is however not universally accepted as an appropriate response to collective violence. This is partly a result of ICL’s endemic political dependency. Chapter 6 addresses the impact of politics on ICL’s transformative value. ICL is closely associated with liberal-legalist ideals which essentially promote the interests of individuals. Although it constitutes an important element of ICL’s transformative value, this political influence exposes ICL to criticism and may exert a disruptive influence on its transformative mandate. In this latter respect it is noted that ICL remains somewhat controversial and subject to the general limitations of the decentralised and state-dominated international legal system. In Part III, ICL’s transformative value is investigated using South Africa as a case study, with particular reference to its transitional- and post-transitional periods. Chapter 7 provides a domestic perspective of ICL’s transformative value by investigating the interactions of ICL and the South African legal system, particularly the value of the transformation of ICL into national law. In this regard the impact of Constitutional provisions and national legislation pertaining to ICL are considered, as well as a number of cases related to matters of international criminal justice. It is argued that international criminal norms may promote human values over state authority and political interests in the domestic context. Domestic courts may serve as ‘engine rooms’ for transformative change through more effective enforcement of those international criminal norms that have been ‘transformed’ into national law through implementation legislation. The permeation of international criminal norms into the domestic sphere represents a foray of universal values into an area traditionally dominated by sovereign might and holds potential for promoting the interests of individuals as well as for the institutionalisation of human rights. Yet, as illustrated by the current rift between the ICC and the African Union, international and regional political affiliations may influence the ability of a state to meet its obligations towards international criminal justice. In Part IV (Chapter 8), it is submitted that ICL is historically and ontologically aimed at change that is both backward-looking (repressive) and forward-looking (normative) as well as beneficial in a communitarian sense. ICL’s transformative value derives from the value-and purpose-driven nature of international criminal norms, the political nature of international criminal justice and also from the interaction between international law and domestic legal systems. ICL may be viewed as an authoritative expression of the norms and values of the international community. As such, ICL and its institutions may be viewed not only as a means of punishing the perpetrators of international crime, but also as part of the spearhead towards a desired alternative to the historical and present reality characterised by injustices which have gone unabated under the system of traditional Westphalian sovereignty. As egregious forms of the aforementioned injustices, macro criminality and impunity undermine the protection of internationally recognised individual rights. ICL seeks to remedy this through impacting on those individuals that have not yet acceded to the emergent universal consciousness of the majority in the international community. It is further argued that ICL’s transformative impact is not confined to the “hard” impact of the application of substantive ICL in international and domestic courts. The international criminal justice system as a whole also produces a normative impact through a purpose-driven association with international values and certain political preferences. This thesis offers a new way of thinking about the value, potential and limitations of the ICL regime, as well as the role of politics in international criminal justice. / AFRIKAANSE OPSOMMING: Die eksistensiële krisis van die internasionale strafregbestel is stellig iets van die verlede. Dít word bevestig deur die toenemende hoeveelheid positieweregsmateriaal en die bestaan van verskeie internasionale strafhowe, in die besonder die permanente Internasionale Strafhof wat sedert 2002 in werking is. Binnelandse howe dien moontlik as ‘enjinkamers’ vir transformerende verandering, deur daardie internasionale strafnorme wat deur inwerkingstellingswetgewing tot in die nasionale reg ‘getransformeer’ is, doeltreffender toe te pas. Die deurdringing van internasionale strafnorme tot in die binnelandse sfeer stel ’n verskeidenheid universele waardes bekend op ’n gebied wat tradisioneel deur soewereine mag oorheers is, en hou potensiaal in vir die bevordering van individuele belange sowel as vir die institusionalisering van menseregte. As sodanig, is ISR en die instellings daarvan nie net ’n middel om die plegers van internasionale misdaad te straf nie, maar ook deel van die strewe na ’n wenslike alternatief vir die historiese én huidige realiteit, wat gekenmerk word deur onregte wat ongebreideld onder die stelsel van tradisionele Wesfaalse soewereiniteit voortduur. Makrokriminaliteit en strafloosheid, synde uiterste vorme van voormelde onregte, ondermyn die beskerming van internasionaal erkende individuele regte. ISR beoog om dít reg te stel deur ’n invloed uit te oefen op daardie individue wat nóg nie die ontluikende universele bewustheid van die meerderheid in die internasionale gemeenskap openbaar nie. Daar word voorts betoog dat die transformerende impak van ISR nie tot die ‘harde’ impak van die toepassing van substantiewe ISR in internasionale en binnelandse howe beperk is nie. Die stelsel van internasionale strafregspleging in die geheel het ook ’n normatiewe impak deur middel van ’n doelgedrewe verbondenheid aan internasionale waardes en bepaalde politieke voorkeure. Investigating an alternative administrative-law system in South Africa

Thesis (LLD)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: This dissertation considers the question whether there are viable alternatives to the conceptual framework within which the South African administrative-law system operates, given that the administration now functions under new constitutional demands and new approaches to administrative engagement. The intention is not to proffer concrete recommendations for such a system, but only to propose an approach by means of which questions concerning the legal regulation of the administration and administrative function may be addressed. The dissertation introduces the concept of the contextualised administrative-law system. This concept emphasises the legal relationship between the public administration and the judiciary, but is not limited to this relationship. The administrative-law system does not operate in a vacuum, though, and is informed by the conceptual framework within which the system operates. The system is also a function of its geo-political and socio-economic context. The historical development of the doctrine of separation of powers, as one aspect of the conceptual framework, is traced. Thereby the normative, dynamic and flexible nature of the doctrine is established. On this basis, the potential and value of a fourth branch, the administration, within the separation-of-powers doctrine is assessed. By implication, the administrative function would constitute a fourth, distinct function in addition to the legislative, executive and judicial functions. The concept of the administrative-law system is consequently applied to the South African context. Firstly, the development of the South African system is outlined and, secondly, the administrative-law relationship is analysed. This discussion establishes that the system is characterised by an embryonic administrative law, the equating of administrative law and judicial review, an emphasis on the rule-of-law or “red-light” approach to administrative regulation, a rhetoric of deference, and the supremacy of the Constitution of the Republic of South Africa, 1996. Therefore, the system must be informed by the Constitution and, arguably, by Karl Klare’s project of transformative constitutionalism and Etienne Mureinik’s “culture of justification”. The content of the separation of powers is also investigated by means of an historical analysis of the considerations that rationalise the existence of an independent administrative jurisdiction in France. This entails an exposition of the Conseil d’État’s structure, organisation and dual function. Principles that describe the French system, other than the pure separation of powers, are discussed, namely, the duality of jurisdiction, the separation of administrative and judicial authorities, the separation of the administrative jurisdiction and active administration, the maxim “to judge the administration is still administering”, and the hybrid nature of administrative litigation. The legal regulation of public contracts can be regarded as a doctrinal perspective of the administrative-law system. The public contract is discussed as one form of administration, due to its conceptual ambiguity as a legal instrument on the boundary between public and private law and due to the administration’s increasing contractual activity. To an extent the contrat administratif of French law indicates that particular legal rules are an extension of the broader principles, considerations and institutional structures discussed in the preceding sections. This dissertation introduces an approach that emphasises the relationship between the administration and the judiciary as well as the conceptual framework within which the administrative-law system operates. Through the application of this approach to the South African context and to public contracting the key concepts and debates underlying an appropriate administrative-law system in South Africa are identified and investigated. This constitutes a platform for the development of a particular administrative-law system and an exposition of viable alternatives to the conceptual framework within which the system operates. / AFRIKAANSE OPSOMMING: Hierdie proefskrif ondersoek die vraag of daar lewensvatbare alternatiewe tot die konseptuele raamwerk van die huidige Suid-Afrikaanse administratiefreg-stelsel moontlik is. Dié vraag word gestel teen die agtergrond van die nuwe grondwetlike vereistes en benaderings waaraan administratiewe interaksie moet voldoen. Die bedoeling is nie om aanbevelings vir die bestaande stelsel te maak nie, maar eerder om ‘n benadering voor te stel waarin vrae oor die regulering van die administrasie en die administratiewe funksie geakkommodeer kan word. In die proses skep die proefskrif ‘n nuwe konsep: die administratiefreg-stelsel in konteks, wat die regsverhouding tussen die administrasie en die regbank beklemtoon, terwyl dit nie beperk is tot die verhouding nie. Evaluation of the international law regarding humanitarian intervention in human rights abuses not breaching international peace and security

Thesis (LLM)--Stellenbosch University,2004. / ENGLISH ABSTRACT: This study exammes, m stages of development, the existing law regarding humanitarian intervention, problems in respect of this law and cases of intervention. More specifically, intervention in human rights abuses not breaching international peace and security but rather posing a so-called threat to peace is examined. This information is used to consider whether more adequate provision can be made regarding circumstances of intervention to stop situations of grave human rights abuses sooner. From the law regarding humanitarian intervention, it is evident that the institution of intervention is illegal under the present UN legal system. Yet, in a time when the human rights culture has become so important that it forms part of the basis of international law, effective intervention is not being authorised by the Security Council. As a result, other actors have been intervening in cases of grave human rights abuses. These interventions need to be appropriate and well managed. Since the protection of human rights is as valid in non-democracies, as in any democratic state form, the study finds that human rights will benefit from dependence on legitimate authority. Attributing more importance to the Uniting for Peace Resolution could expand the role of the General Assembly. Humanitarian intervention also needs to be coupled with a commitment to address the causes of human rights abuses through conflict resolution and social reconstruction. The study concludes with some criteria/guidelines for the establishment of the legitimacy of intervention. / AFRIKAANSE OPSOMMING: Hierdie studie is - binne 'n raamwerk van ontwikkelingstydperke - 'n ondersoek na die bestaande reg aangaande humanitêre ingryping, probleme tenopsigte daarvan en gevalle van ingryping. Veral ingrypings in menseregte-skendings wat nie internasionale vrede en sekuriteit skend nie, maar eerder 'n sogenaamde bedreiging vir vrede is, word ondersoek. Die inligting wat so bekom is, word gebruik om te oordeel of meer gepaste voorsiening gemaak kan word waarvolgens situasies van growwe menseregte-skendings deur ingryping gouer beëindig kan word. Die reg aangaande humanitêre ingryping toon dat ingryping onwettig is in die bestaande regsisteem van die Verenigde Nasies. In 'n tyd waarin menseregte so belangrik geword het dat dit ten grondslag lê van internasionale reg, word effektiewe ingrypings nogtans nie gemagtig deur die Veiligheidsraad nie. Gevolglik gryp ander partye in om teen situasies van growwe menseregte-skendings op te tree. Hierdie ingrypings moet daarom gepas wees en goed bestuur word. The right of way of necessity : a constitutional analysis

Thesis (LLM)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: The right of way of necessity is a special type of praedial servitude that is established over neighbouring property in favour of landlocked property – that is, property without access to a public road. The purpose of granting the landlocked property a right of access to a public road is so that it can be put to efficient use. The servitude is created by operation of law and it binds the surrounding properties as of right at the moment when the property becomes landlocked. It can, however, be enforced only against a specific neighbouring property. This servitude can only be enforced by way of a court order, against the will of the owner of the neighbouring property. This servitude, specifically the manner in which it is established, may raise significant constitutional issues as regards the property clause of the South African Constitution. Therefore, it was necessary to investigate the constitutionality of the right of way of necessity in view of section 25 of the Constitution. To this end, the study provides an overview of the law relating to the right of way of necessity and the general principles regulating this servitude in South African law. Subsequently, the justifications for the right of way of necessity and specifically for allowing the courts to enforce this servitude are analysed in terms of public policy, jurisprudential views and law and economics theory. The conclusion is reached that, in terms of these justifications, there are sufficient policy, social, and economic reasons for having the right of way of necessity and for the courts to enforce it without cooperation and against the will of the affected servient property owner. These justifications are used to examine the constitutionality of the right of way of necessity, specifically to determine whether the enforcement of this servitude by court order constitutes a section 25(1) arbitrary deprivation or even a section 25(2) expropriation of the affected owner’s property rights. The study concludes that the granting of the right of way of necessity will not amount to an expropriation and, following the FNB methodology, does not constitute arbitrary deprivation of property either. Therefore, if all the requirements are met, the granting of a right of way of necessity will be constitutionally compliant. / AFRIKAANSE OPSOMMING: Die saaklike serwituut wat ten gunste van grond wat van openbare verkeersweë afgesny is (blokland) oor naburige eiendom gevestig word, staan bekend as noodweg. Dit kan egter slegs teen ’n spesifieke naburige eiendom afgedwing word. Die serwituut kan slegs deur middel van ’n hofbevel afgedwing word, teen die eienaar van die naburige eiendom se wil. Wat die eiendomsklousule van die Suid-Afrikaanse Grondwet betref, kan hierdie serwituut en veral die wyse waarop dit gevesig word belangrike grondwetlike vrae opper. In die lig van artikel 25 van die Grondwet was dit dus nodig om die grondwetlike geldigheid van noodweg te toets. Om hierdie doel te bereik, verskaf die studie’n oorsig van die regsbeginsels aangaande noodweg en die algemene beginsels van hierdie serwituut in die Suid-Afrikaanse reg. Met verwysing na openbare beleid, regsfilosofiese benaderings en Law and Economics-teorie analiseer die tesis vervolgens die regverdigingsgronde vir noodweg, spesifiek vir die feit dat die howe dit afdwing. Die gevolgtrekking is dat daar ingevolge hierdie regverdigingsgronde genoegsame beleids-, sosiale en ekonomiese redes bestaan vir die serwituut van noodweg en vir die howe se bevoegdheid om dit sonder die dienende eienaar se medewerking en teen sy wil af te dwing. Hierdie studie kom tot die slotsom dat die toestaan van ’n noodweg nie as ’n onteiening kwalifiseer nie en dat dit, indien die FNB-metodologie nagevolg word, ook nie op ’n arbitrêre ontneming van eiendom neerkom nie. This relationship is characterised and influenced by the qualities and attributes specific to the nature and historical development of medical care, as well as medical science in general. The doctor-patient relationship is also influenced by the social dynamics of a particular community, environmental factors, technological advances and the general social and commercial evolution of the human race. With regard to medical care and health service delivery, the doctor-patient relationship is furthermore vital to the quality of the care provided, as well as to the outcomes and relative success of the specific medical intervention or treatment. One of the distinct characteristics of the doctor-patient relationship is the power imbalance inherent in this relationship. The medical practitioner has expert knowledge and skill, while the patient finds himself or herself in an unusually dependent and vulnerable position. It is because of this important role that the doctor-patient relationship still plays in health service delivery today; the susceptibility of the relationship to a variety of influences, and the characteristic power imbalances inherent in this relationship, that a study of the doctor-patient relationship in South African medical- and health law is necessary. The characteristic power imbalances will be considered from a legal perspective in this dissertation. This study provides a comprehensive source of the doctor-patient relationship from a legal perspective. Where relevant, references are made to theories and principles from other disciplines, including sociology, economy and medical ethnomethodology. The prevalence and consequences of power imbalances in the doctor-patient relationship are identified and discussed with the aim of bringing these to the attention of both the legal fraternity, and medical practitioners. Specific problem areas are identified and solutions are offered, including the following: • The adverse consequences of power imbalances inherent in the doctor-patient relationship on the medical decision-making process are considered from various perspectives. With regard to these adverse consequences, the doctrine of informed consent is analysed and evaluated in great detail. • The influence of paternalistic notions in health service delivery; the business model of health service delivery and the effects of managed care and consumer-directed health care on the doctor-patient relationship and health service delivery in general are also analysed from a legal perspective, and specifically with regard to the power imbalances inherent in this relationship. • The role of autonomy, self-determination and dignity, as well as the principles of beneficence in medical practice, are reconsidered in an attempt to provide a solution for redressing the power imbalances inherent in the doctor-patient relationship. • The fiduciary nature of the doctor-patient relationship and the special role of trust in the relationship are emphasised throughout the dissertation as the focal point of departure in the doctor-patient relationship and the main constituent in any legal endeavor to redress the power imbalances inherent in it. / AFRIKAANS OPSOMMING: Die unieke en intieme verhouding wat bestaan tussen ‘n mediese praktisyn en ‘n pasiënt is wêreldwyd waarskynlik een van die belangrikste verhoudings wat tussen twee persone tot stand kan kom. Hierdie verhouding word gekenmerk en beïnvloed deur kwaliteite en eienskappe eie aan die besonderse aard en historiese ontwikkeling van gesondheidsorg, sowel as die mediese wetenskap in die algemeen. Die dokter-pasiënt verhouding word verder beïnvloed deur die sosiale dinamika van ‘n bepaalde gemeenskap, omgewingsfaktore, tegnologiese vooruitgang en die algemene sosiale en kommersiële ontwikkeling van die mensdom. The impact of Section 26 of the Constitution on the eviction of squatters in South African law

Section 26 of the Constitution of the Republic of South Africa, 1996 affords everyone a right of access to adequate housing. This provision is a decisive break with the apartheid past, where forced eviction banished black people to the periphery of society. The central hypothesis of this dissertation is that the Constitution envisages the creation of a society that is committed to large-scale transformation. This dissertation posits that it is impossible to realise the full transformative potential of section 26 of the Constitution in the absence of an independent and substantive understanding of what it means to have access to adequate housing. This dissertation traverses legal theory as well as the common law of evictions, constitutional law and international law. A consciously interdisciplinary approach is adopted in seeking to develop the content of section 26 of the Constitution, drawing on literature from social and political science. This dissertation develops an organising framework for giving substantive content to section 26(1) of the Constitution with reference to the International Covenant on Economic, Social and Cultural Rights; the Convention for the Protection of Human Rights and Fundamental Freedoms; the Revised European Social Charter, the American Convention on Human Rights and the African Charter on Human and Peoples’ Rights. This dissertation shows that the adjudication of eviction disputes has moved away from a position under the common law where Courts had no discretion to refuse eviction orders based on the personal circumstances of the squatters. The adjudication of the eviction of unlawful occupiers now requires a context-sensitive analysis that seeks to find concrete and case-specific solutions. These solutions are achieved by considering what would be just and equitable for both the land owner and the unlawful occupiers. This dissertation also shows that the government has a markedly different role to fulfil in post-apartheid evictions through the necessary joinder of local authorities to eviction proceedings, meaningful engagement with unlawful occupiers and the provision of alternative accommodation in terms of its constitutional and statutory obligations. / AFRIKAANSE OPSOMMING: Hierdie proefskrif ondersoek die behuisingsregte van onregmatige okkupeerders in die post-1994 grondwetlike bedeling. Artikel 26 van die Grondwet van die Republiek van Suid-Afrika, 1996 gee elke persoon die reg op toegang tot geskikte behuising. Hierdie bepaling is ‘n duidelike breuk met die apartheid-verlede waar gedwonge uitsettings swart mense na die periferie van die samelewing verban het. Administrative justice and tribunals in South Africa : a commonwealth comparison

Thesis (LLM )--Stellenbosch University, 2011. / ENGLISH ABSTRACT: In the field of administrative law, the judiciary has traditionally exercised control over the administrative actions of the executive through judicial review. However, judicial review is neither the most effective nor the most efficient primary control mechanism for systemic administrative improvement. In a country faced with a task of =transformative constitutionalism‘, and hindered with scarce resources, there is good cause to limit judicial intervention as the first response to administrative disputes. The major theme of this thesis is to investigate the feasibility of administrative tribunal reform in South Africa, using two other commonwealth countries, Australia and England, as a basis for comparison. Australia and England have been chosen for comparison because they share similar administrative law traditions and they can provide working models of coherent tribunal structures. The Australian tribunal system is well-established and consists of tribunals which fall under the control of the executive, while tribunals in England have recently undergone a significant transformation, and are now part of the independent judiciary. The South African government currently spends, indeed wastes, a significant amount of money on administrative law litigation. Due to the limitations of judicial review, even after the high costs of litigation and the long duration of court proceedings, the results achieved may still be unsatisfactory. Furthermore, judicial review is unsuited to giving effect to systemic administrative change and the improvement of initial decision-making. Australia and England have begun to move away from the traditional court model for the resolution of administrative disputes. Both have indicated a preference for the important role of tribunals in the administration of disputes. Tribunals have been shown to offer the advantage of being speedier, cheaper, more efficient, more participatory and more accessible than traditional courts, which contributes to tribunals being a more available resource for lay people or people without sophisticated legal knowledge, and provides wider access to remedies than courts. The English and Australian models indicate a few important trends which need to be applied universally to ensure a sustained tribunal reform and a system which provides a higher level of administrative redress than the over-burdened and institutionally inept courts currently do. These include co-operation among government departments and tribunals; open and accountable systemic change; the need for supervision and evaluation of the whole of administrative law by an independent and competent body; and ultimately a focus on the needs of users of state services. At the same time, there are arguments against administrative tribunal reform. These include the costs of reform; the ways to establish tribunals; and the level of independence shown by the tribunals. These arguments are especially relevant in the South African context, where the government faces huge social problems and a scarcity of resources. However, after an analysis of the valuable characteristics of tribunals and the role that they serve in the day to day administration of justice, it is difficult to see how these objections to tribunals can outweigh their potential importance in the administrative justice system. The need for sustained systematic reform in South Africa is one that cannot be ignored. Tribunals offer a valuable alternative to judicial review for the resolution of administrative disputes. Furthermore, the tribunal systems of Australia and England demonstrate how the effective creation and continued use of comprehensive tribunal structures contributes firstly to cost reduction and secondly to ease the administrative burden on courts who are not suited to cure large-scale administrative error. / AFRIKAANSE OPSOMMING: In die administratiefreg oefen die regsprekende gesag tradisioneel beheer uit oor die uitvoerende gesag deur middel van geregtelike hersiening. An evaluation of the transformation of public service delivery through the development of administrative justice in South Africa

Thesis (LLM (Public Law))--University of Stellenbosch, 2007. / In order to test whether South African public service fulfills democratic aims and objectives, this study establishes the limits to and extent of the Promotion of Administrative Justice Act 3 of 2000 (the PAJA) in promoting the right to administrative justice as a human right (the RAJAH) and thereby transforming public service delivery. To achieve above aim the background to the entrenched right to administrative justice is analysed through a study of principles underlying administrative justice. Both South African common law and Constitutional systems are analysed against the principles underlying administrative justice. Batho Pele principles contained in the White Paper on the Transformation of the Public Service (WPTPS) are also analysed to find out how the South African Public Administration interprets its constitutional duties and to establish the relevance of these principles to administrative justice principles ensconced in the PAJA. The PAJA is then analysed in order to measure the extent to which it affirms the transformation principles ensconced in the Constitution and coinciding with Batho Pele principles. As the public service is a reflection of democracy in action, the public expects it to be professional, representative and proficient. If it does not fulfil these expectations, this may be interpreted as a fundamental failure of democracy. South African democracy in particular is development oriented because it is based on the Constitution that entrenches among others the right to administrative justice. The right to administrative justice as a development tool urges the public sector to recognise and apply constitutionally recognised procedures and processes in every delivery so that the social status of citizens may be enhanced. Such steps, if effectively followed, signify that the public sector has transformed from bad governance practices of the pre constitutional era where there was no requirement for the observance of individual rights in public service delivery. Failures to the adoption of good governance principles by the public sector show the opposite of the expected standards and signify that the public sector is not yet transformed. In the light of the problems caused by the lack of protection of human rights from abuse by the executive under the common law system of parliamentary supremacy, the constitutional era was expected to have changed the position of South African administrative law drastically through its adoption of the principles underlying administrative justice. To develop insight into the extent of the transformation towards administrative justice that is expected to have occurred in South Africa since the advent of constitutionalism the implementation of the PAJA is evaluated through an examination of a selection of cases that deals with public administration decisions in the area of social assistance as a context in which members of the public are most dependent on effective state administration. As the scope of the study limits the number of cases that can be examined, only the most informative cases on social assistance that relates to the KwaZulu-Natal and the Eastern Cape provinces are analysed. The research finds that public service is not yet transformed and identifies the causal factors. It recommends steps to be followed so that the expected culture from the public sector is attained.

Lateral and subjacent support

Thesis (LLM (Public Law))--University of Stellenbosch, 2009. / ENGLISH ABSTRACT: The first part of this thesis deals with the right of lateral and subjacent support and explains how it should be applied in South African law. The thesis illustrates how the neighbour law principles of lateral support were incorrectly extended to govern conflicts pertaining to subjacent support that arose in South African mining law. From 1911 right up to 2007, these two clearly distinguishable concepts were treated as synonymous principles in both academic writing and case law. The thesis plots the historical development of this extension of lateral support principles to subjacent support conflicts. In doing so, it examines the main source of South Africa’s law of support, namely English law. The thesis then shows how the Supreme Court of Appeal in Anglo Operations Ltd v Sandhurst Estates (Pty) Ltd 2007 (2) SA 363 (SCA) illustrated how the English law doctrine of subjacent support, with all its attendant ramifications, could not be useful in resolving disputes that arise between a land surface owner and a mineral rights holder in South African mining law. The second of half of the thesis investigates the constitutional implications of the Supreme Court of Appeal’s decision in Anglo Operations in light of the systemic changes introduced by the Minerals and Petroleum Resources Development Act 28 of 2002. In terms of this new Act, all the mineral and petroleum resources of South Africa are the common heritage of the people of South Africa, and the state is the custodian thereof. This means that landowners are no longer involved in the granting of mineral rights to subsequent holders. In light of the Anglo Operations decision, landowners in the new dispensation of mineral exploitation face the danger of losing the use and enjoyment of some/all their land. The thesis therefore examines the implications of the statutory provisions in South African legislation (new and old) that have/had an impact on the relationship between landowners and mineral right holders with regard to the question of subjacent support, as well as the implications of the Anglo Operations decision for cases where mineral rights have been granted under the statutory framework. / AFRIKAANSE OPSOMMING: Die eerste deel van die tesis handel oor die reg op sydelingse en oppervlakstut en hoe dit in die Suid-Afrikaanse reg toegepas behoort te word. Die tesis wys hoe die bureregbeginsels rakende sydelingse stut verkeerdelik uitgebrei is na konflikte rakende oppervlakstut wat in die Suid-Afrikaanse mynreg ontstaan het. Vanaf 1911 en tot in 2007 is hierdie twee duidelik verskillende konsepte in sowel akademiese geskrifte en in die regspraak as sinonieme behandel. Die tesis sit die historiese ontwikkeling van die uitbreiding van laterale stut-beginsels na oppervlakstut-konflikte uiteen. In die proses word die hoofbron van die Suid-Afrikaanse reg ten aansien van steun, naamlik die Engelse reg, ondersoek. Die tesis wys uit hoe die Hoogste Hof van Appèl in Anglo Operations Ltd v Sandhurst Estates (Pty) Ltd 2007 (2) SA 363 (SCA) beslis het dat die Engelse leerstuk van oppervlakstut met al sy meegaande implikasies nie in die Suid-Afrikaanse reg sinvol aangewend kan word om dispute wat tussen die oppervlakeienaar van grond en die mineraalreghouer ontstaan, op te los nie. Die tweede helfte van die tesis ondersoek die grondwetlike implikasies van die Hoogste Hof van Appèl se beslissing in Anglo Operations in die lig van die sistemiese wysigings wat deur die Wet op Ontwikkeling van Minerale en Petroleumhulpbronne 28 van 2002 tot stand gebring is. Ingevolge die nuwe Wet is alle mineraal- en petroleumhulpbronne die gemeenskaplike erfenis van alle mense van Suid-Afrika en die staat is die bewaarder daarvan. Dit beteken dat grondeienaars nie meer betrokke is by die toekenning van mineraalregte aan houers daarvan nie. In die lig van die Anglo Operations-beslissing loop grondeienaars die gevaar om die voordeel en gebruik van al of dele van hulle grond te verloor. Die tesis ondersoek daarom die implikasies van verskillende bepalings in Suid-Afrikaanse wetgewing (oud en nuut) wat ‘n impak op die verhouding tussen die grondeienaar en die houer van die mineraalregte het, sowel as die implikasies van Anglo Operations vir gevalle waar mineraalregte onder die nuwe statutêre raamwerk en toegeken is.
