Aspectos jurídicos da confiança do investidor estrangeiro no Brasil / Legal aspects of foreign investors trust in BrazilAnna Lygia Costa Rego 31 May 2010 (has links)
Esta tese realiza um estudo a respeito da confiança do investidor estrangeiro no Brasil, identificando teórica e empiricamente os aspectos jurídicos elementares à sua formação. A pesquisa tem como intuito analisar o papel do Direito tanto na geração quanto na proteção à confiança nutrida pelos investidores no País. Faz-se assim um percurso teórico que discute os pressupostos relacionados à racionalidade do homem econômico, sendo apresentadas algumas linhas críticas do paradigma de escolha racional. Dentre tais linhas, a Economia Comportamental é escolhida como opção metodológica do trabalho por fornecer uma visão alternativa para o estudo de tomada de decisão. Assim, com base no programa pesquisa Heuristics and Biases (H&B), fundado por Daniel Kahneman e Amos Tversky, avalia-se o processo de formação da confiança no Brasil. A revisão de literatura interdisciplinar busca fornecer alicerce teórico para o estudo empreendido, ao explorar a dificuldade e a abstração do conceito. A tese, no campo jurídico, (i) contrapõe as noções de confiança e boa-fé, (ii) discute como se dá a tutela da confiança pelo Direito brasileiro e (iii) destaca aspectos da regulação dos investimentos estrangeiros capazes de tutelar ou promover a confiança. A pesquisa empírica realizada ao final do trabalho aplica o H&B à análise do Direito, destacando as variáveis jurídicas consideradas essenciais à confiança do investidor no Brasil e analisando dissonâncias cognitivas a este respeito entre residentes e não residentes. / This thesis investigates foreign investors trust in Brazil, aiming at identifying theoretically and empirically its elementary aspects. It also intends to analyze the role played by Law at the creation and preservation of investors trust. From a theoretical standpoint, it discusses the rationality assumptions attributed to the economic man and reports alternative approaches for decision making other than rational choice. The work applies Behavioral Economics methodology, more specifically the Heuristics and Biases program, founded by Daniel Kahneman and Amos Tversky. The thesis also reviews interdisciplinary literature on trust, exploring the elusiveness of its concept. In addition, from a legal research perspective, it (i) compares the notions of trust and good-faith; (ii) discusses the legal grounds for trust protection under local law and (iii) points out regulatory mechanisms deemed capable of protecting or promoting trust. The empirical research presented at the end of the thesis illustrates how H&B may be applied to the analysis of Law, by assessing its role at promoting investors trust as well as assessing cognitive dissonances found among resident and non residents.

Frivilliga fel : den sokratiska paradoxen och Platons Staten / To Err Willingly : The Socratic Paradox and Plato's RepublicJohansson, Einar January 2020 (has links)
I denna uppsats undersöker jag hur två olika tolkningar av den sokratiska frivillighetsparadoxen ingen gör fel frivilligt påverkar möjligheten att förstå Platons dialog Staten. Min hypotes är att de två tolkningarna av frivillighetsparadoxen kastar ljus över diskussionen i Staten, och att det är nödvändigt att förstå frivillighetsparadoxens roll för att förstå vad som står på spel i Staten. I uppsatsen ämnar jag visa att ett möjligt sätt att läsa Staten är att tolka Sokrates och de övriga samtalsdeltagarnas uttalanden baserat på kontexten, eftersom vissa uttalanden är polemiska i sin karaktär, medan andra är traditionella. Jag argumenterar för att såväl den traditionella synen på Sokrates som den polemiska dito är korrekta analyser av Sokrates filosofiska gärning, men inte heltäckande sådana, eftersom Sokrates ibland är polemisk – mot de som kvickt måste nedkämpas – och ibland är instruerande på traditionellt manér, mot de som kan förbättras genom det filosofiska samtalet. Detta sätt att läsa Staten skiljer sig från andra genom att läsaren bör avstå a priori-uppfattningar om Sokrates, Thrasymakos eller Glaukons och Adeimantos ståndpunkter till förmån för att tolka beteenden hos samtalsdeltagarna samt deras uppfattningar, vilka förmedlas av texten.

Results Measurement of Livelihood Interventions in the Humanitarian Field, using a Sustainable Livelihoods Framework (SLF) to analyze the Economic Rate of Return (ERR) of an income-generating activity (IGA) project in a post-disaster setting, in San Andres Osuna, GuatemalaHörmander, Olof January 2023 (has links)
There is limited evidence-based data on income-generating interventions, both within thehumanitarian and the development field. Nevertheless, there is a growing and unavoidable nexus between the two fields, and therefore also, within their methodologies for measuring project intervention results, as well as their success rates. The challenge in many cases,however, is finding a measuring system which does not only account for a project’s expenditures, but can also tell something about a project’s effectiveness, which can then be compared to similar intervention’s results, and applied in future endeavors. Hence, this study analyzes the economic effectiveness of an Income Generating Activity (IGA) project in rural Guatemala as a case study, using an Economic Rate of Return (ERR) as the basis of measurement, which is acquired using a cost-benefit analysis (CBA). The study draws on the various viewpoints of scholars on the subject, taking into account different Monitoring and Evaluation (M & E) practices, particularly in the manners carried out by the United Nations and the World Bank, as they have long histories of M & E practices in the field. It especially lays emphasis on the Sustainable Livelihoods Framework (SLF), which is a tool which is often used within humanitarian work as well as in development to determine possible economic opportunities in communities. Although the study aims at IGA programs in the humanitarian sector, data within development projects is also explored in this thesis, because longer timeframes within development, allow for more careful study of long-term results, which is usually a requirement for the evaluation of livelihood. Results within the development sector allow for more careful study of results, and more certain conclusions than within the humanitarian sector, which due to its emergency settings, usually has a more difficult time collecting data.This study then makes an ex-ante analysis of the case study in question, which is a potential aquaponic fish tank project, with economic benefits, in the unattended, post-disaster settings of San Andrés Osuna, Guatemala, following the eruption of the Volcan de Fuego, in 2018. The study reveals that the project has a potential ERR of 280 percent, compared to other WorldBank projects which tend to have an ERR ranging between 15 and 25 percent. Nevertheless, other projects which have also been explored by this study, also offer results ranging ERRs of about 280 percent as well. Many times, projects utilize cost-efficiency analysis which make them more difficult tocompare and contrast to other projects than if they had used ERR results, to measure the projects’ success. This comparison of projects can help decision makers better allocate their resources to the most efficient income generating projects in the future, which can therefore better economic livelihoods of people in post-disaster settings. The World Bank has used this ERR as an indicator for their cost-benefit analyses for the past 70 years, but is increasingly utilizing it less and less, whilst other humanitarian and financial organizations, do not use it at all; making this a possible issue within the field.

Cette thèse a pour but d’étudier l’évolution morpho-structurale et magmatique des marges distales pauvres en magma ainsi que leur réactivation. Cette étude est focalisée sur les marges fossiles distales de la Téthys Alpine. L’étude de la réactivation de ces domaines (l’Err et la Platta, Suisse) montre que les chevauchements alpins réactivent principalement d’anciennes structures de rift. L’Err peut ainsi être restaurée et correspond à un ancien domaine de croute hyper-amincie caractérisé par un système de failles de détachement qui évolue en séquence et conduit à la rupture continentale et à l’exhumation du manteau. La Platta correspond à un domaine de manteau sous continental exhumé associé à une augmentation des additions magmatiques syn-tectoniques dans les parties distales. Ce domaine est interprété comme la relique d’une structure en dôme coiffée par une faille de détachement et recoupée par des failles normales favorisant la mise en place de magma et de fluides. L’approche utilisée a permis de mieux contraindre l’architecture d’une marge distale pauvre en magma et de discuter les processus de formation et de la réactivation des limites de plaque. / The aim of this study is to investigate the morpho-structural and magmatic evolution of magma-poor distal rifted margins, as well as their reactivation. This study is focused on the fossil distal margins of the Alpine Tethys. The study of the reactivation of these domains, (Err and Platta, Switzerland) shows that alpine thrusts principally reworked former rift structures. The Err nappe can be restored as a hyper-extended domain characterized by a system of detachment faults with a complex architecture evolving in-sequence and leads to the continental crust separation and the exhumation of mantle. The Platta nappe corresponds to a subcontinental exhumed mantle domain associated to an increase of syn-tectonic magmatic additions oceanwards. The distal domain is interpreted as the relic of a dome-shaped structure capped by a detachment fault and crosscut by latter normal faults facilitating the emplacement of basalts and fluid circulations. The approach developed in this thesis enabled a better understanding of one distal and ultra-distal magma-poor rifted margin, as well as to discuss processes related to the formation and reactivation of plate boundaries.

Development aid - a perspective on the World Bank performance: Calculating the social return on investment for the least developed countriesSchäfer, Dominik 02 March 2016 (has links)
This doctoral thesis focuses on the evaluation of the World Bank (WB) performance in delivering development aid to the Least Developed Countries (LDCs). For this purpose, an extensive research was performed to analyze a set of 790 Implementation Completion and Results reports for key economic and financial indicators. Results of this research provide various insights for the appraisal and the results stage of project delivery of the LDCs in different continents. In the final part of the economic and financial analysis the minimum Social Return on Investment (SROI) of the LDCs including all project costs was calculated. This SROI ratio outcome of 1 and 1.06 in the weighted and 1.3 and 1.72 in the unweighted case indicate that projects delivered by the WB have a positive effect on the poor countries. In the second part of this research project the data set of the ICR reports was qualitatively researched for negative ratings according to 3 core assessment categories for the overall project performance: Sustainability, bank performance and borrower performance. As a result the most critical categories respectively risks were outlined. In conclusion, the research analyses and findings support the general demand to provide even more development assistance to poor countries.:Table of Tables and Figures
