Manifesting religious belief : a matter of religious freedom, religious discrimination, or freedom of expression?

Maher, Julie January 2014 (has links)
This thesis asks how manifestation of religious belief by religious individuals can best be protected in English law. It is particularly concerned with the protection available to religious individuals in the public sphere. This thesis assesses the current state of protection under religious freedom and religious discrimination models, before considering the potential for increasing protection by reconceptualising the right to manifest religious belief as an aspect of freedom of expression. This thesis asks whether the practical and conceptual limitations of a religious freedom model, and Article 9 of the European Convention on Human Rights (ECHR) in particular, can be overcome by reliance on alternative modes of protection, namely religious discrimination protections in domestic, Convention, and EU law, or through litigating religious manifestation claims as freedom of expression cases under Article 10 of the ECHR. The difficulty of communicating the harm in being denied the ability to manifest religious beliefs publicly is a key limitation of both religious freedom and religious discrimination models. Similarly, this thesis highlights the difficulty in assessing what weight should be attributed to such religious harm within a proportionality exercise balancing the rights of religious individuals with the rights and interests of other parties. The analysis in this thesis draws primarily upon the sources of law which shape domestic English law in this area, namely the ECHR and European Union law. However, this thesis also considers foreign precedent and case law from the United States in particular. This thesis contends that no one model can address the range of cases where manifestation of religious beliefs arise, and that litigants should be able to draw from religious freedom, religious discrimination, and freedom of expression protections depending on the nature of their case.

Ochrana svobody slova Evropským soudem pro lidská práva / Protection of the freedom of speech by the European Court of Human Rights

Wasilewski, Jakub January 2014 (has links)
in English Protection of the freedom of speech by the European Court of Human Rights The purpose of my thesis is to analyze multiple aspects of freedom of speech as protected by European Court of Human Rights. The reason for my research is to follow the development in this particular area and to produce basic reference material for students and other human rights enthusiasts concerning freedom of speech and its extensive case law. Svoboda náboženského vyznání v kontextu evropského a mezinárodního práva / Freedom of Religion or Belief in the Context of European and International Law

Bartoň, Daniel January 2012 (has links)
Freedom of Religion or Belief in the Context of European and International Law This PhD dissertation focuses on selected aspects of freedom of religion or belief in Europe. It aims to introduce the legal framework in which religious freedom has to operate, and to place this essential freedom into a broader cultural, religious and human rights context. The contextualisation emphasised throughout this dissertation is based on an assumption that it is not possible to establish a pure legal notion of religious freedom that would not bear any imprint of the societal, legal, cultural and religious context of its authors; in reality, each person's understanding of religious freedom is rooted in his culture, religion and experience. This should not lead, however, to a complete rejection of the possibility of a common understanding and universal protection of religious freedom. On the contrary, it should motivate each interpreter and law-maker in the area of religious freedom to study the understandings of all persons and entities involved in a particular case or situation. Having thoroughly studied all presented claims rooted in religious freedom and having taken into consideration all other rights, principles and interests involved, it should be possible for the decision-makers to resolve the case in a...

L’influence de la convention européenne des droits de l’homme sur le droit géorgien / Influence of the European Convention on Human Rights on Georgian Law

Nutsubidze, Maka 09 July 2014 (has links)
The given research unites four main questions: 1. Place of European Convention on Human Rights in Georgian Law. 2. Conformity of Georgian legislation with the European Convention on Human Rights. 3. Conformity of Constitutional Law judgments with the standards established by the European Court of Human Rights. 4. Judgments of European Court of Human Rights against Georgia. In connection to all these questions there is very little information and work in Georgia, which has made us study them better – on the ground of actuality of the given questions. We’ve considered discussing to the West European reader that Georgia is a developed country. It is located between Turkey and Russia, during its whole history it had to be orientated on the self-defense policy. History of Independent Georgia starts in 1991 by destruction of the Soviet Union. In 1999 Georgia became a member of the European Union, but National Law in Georgia and Europeanization process of State Institutions started in 2004. Human Rights European Convention represents an effective standard of Human Rights, accordingly activities of European Court of Human Rights causes great interest in Georgia. Despite all these in the legal circles, between them use of Human Rights European standards have become obligatory in the courts. It is needed that the judges, advocates, procurators and representatives of other legal professions have to actively use the existed standards of Human Rights Protection. In the framework of the given research we will investigate influence of European Convention on Human Rights with Georgian Law and starting from ratification of European Convention by Georgia – since 1999 – till February 28, 2014 included in two directions: 1. Place of Human Rights European Convention in Georgian Law (part I) and 2. Georgia against European Court of Human Rights (part II).

Le principe de non-discrimination à l'épreuve des rapports entre droits européens / The principle of non-discrimination in the context of the relations between European laws

Brillat, Manuela 10 December 2014 (has links)
Also perceived as an ideal, equality finds its legal incarnation in the non-discrimination principle. When examined through the European prism, it reveals its full meaning in terms of difficulties, but also of potential, for the relations between the two main European legal systems : the Council of Europe and the European Union. The European Court of Human Rights, the European Committee of Social Rights as well as the Court of Justice of the European Union, behind the apparent similarity displayed, harbour different realities, thus underming the non-discrimination principle and weakening its key role in the defence of European human rights law. In order to restore its full effectivness, this principle should be redefined, bearing in mind that its interpretation cannot change from one European legal system to another. This major challenge leads to the analysis of the exact implications, for Europe, of the cornerstone function played by the non-discrimination principle.

La dimension objective des droits fondamentaux européens / The objective dimension of european fundamental rights

Danova, Maria 29 January 2015 (has links)
The objective dimension is one of the main theories of the interpretation of fundamental rights in Germany. Although relatively unknown outside its national context, it exerts an influence at a European level, especially in case-law in the European Court of Human Rights, without being regarded as such. The present study aims to analyze this approach of rights at a European scale through its main characteristics drawn from German law, as well as to highlight the influence of the latter on European law. The objective dimension appears to be a teleological and total interpretation that establishes the protection of rights on certain political and moral values, and ensures their radiating effect within but also through legal systems. If it is a breakthrough in the elaboration of the theory of rights, it also carries the risk of weakening these same rights in their subjective function which is to protect personal freedom. Merci d'avance Suzanne

From final judgment to final resolution : effectiveness of the execution of judgments of the European Court of Human Rights in Finland / D'un arrêt définitif à une résolution finale : l'efficacité de l'exécution des arrêts de la Cour européenne des droits de l'homme en Finlande

Heikkilä, Satu 02 April 2016 (has links)
This study focuses on the execution of the 138 condemnatory judgments delivered so far against Finland by the European Court of Human Rights. The study showed that the Finnish execution procedure was not bureaucratic and it worked well, the overall procedural effectiveness thus being at a very advanced level. As to the payment of just satisfaction and the taking of individual measures, the study showed that the execution was fairly effective in Finland both in the temporal and material sense, the only exception being reopening of domestic proceedings. The study also revealed that although the taking of general measures in Finland was mostly effective, there was also some reluctance to take execution measures. Still most of the general measures were taken effectively in Finland, one of the best examples being the ne bis in idem cases. On the other hand, the length of proceedings cases represented a group of cases in which the temporal and material effectiveness was at its lowest.

Droits fondamentaux du contribuable dans les systèmes européens de protection des Droits de l'Homme / Taxpayer's fundamental rights within the European systems of the protection of human rights

Yakovenko, Ivan 28 September 2018 (has links)
Nowadays, the use of different provisions intended to protect human rights in general, and the ECHR, in particular, by taxpayers and their counsel does not surprise with many domestic jurisdictions increasingly making reference to the Convention in any type of tax litigation. However, it is still a difficult topic to address as it simultaneously crosses across both public and private law. The main aim of this study is to identify the position of the Court on taxation matters, when it assumes a specific role in the protection of the taxpayer’s fundamental rights and freedom. Emphasis is given to the impact that the provisions of the Convention can exert on the evaluation of substantive and procedural tax rules that are applied in several countries of the Council of Europe and the protection of the taxpayer’s rights. The study has a specific interest to provide the means for a better understating of the real value of the European Convention on Human Rights for the protection of the taxpayer’s rights propelled by its dynamic interpretation over the past years. In this regard, the originality of the study is based on a broad analysis of cases recently decided by the Court. As far as possible, a comparison with the case law of the CJEU is also undertaken.

Accès au juge et aux procédures d'asile à la lumière des droits européen, allemand et français / Access to justice and asylum procedures in the light of ECHR, EU, German and French law

Cseke, Nóra 24 September 2018 (has links)
The effectiveness of access to asylum bodies depends on a combination of several factors which are not derived solely from national law. The sine qua non of the effectiveness of such access is a harmonious reception by the various Member States of the procedural guarantees essential to it and defined at European level, which presupposes, however, a balanced relationship between ECHR law and Union law built in a spirit of dialogue. In establishing this dialogue, the EU legislator, like the European Court of Human Rights and the Court of Justice of the European Union, plays an essential role, and if this dialogue were to prove dissonant, national law could still correct any shortcomings thus noted. To this end, it is certainly necessary to establish a dialogue also at national level, not only with the EU legislator and the European courts but also between the administrative and judicial authorities at State level. Ultimately, the effectiveness of this access is also essential in a cross-border dimension in order to further approximate national legislation and to propose a European solution to the structural and systemic problems characterizing this access.
