Appreciating diversity : is the doctrine of margin of appreciation as applied in the European Court of Human Rights relevant in the African human rights system?

"The purpose of this study is to interrogate the doctrine of margin of appreciation as applied in the European Court of Human Rights and establish amenable lessos to the African human rights system. As such, the author will be able to draw appropriate and informed recommendations on the prospects of the doctrine in African context. In other words, the study proceeds from the approach that 'diversity' alone is not enough to guarantee application of margin of appreciation. Rather, a variety of factors come into consideration while weighing whether margin of appreciation should be granted to states. Indeed, such benchmarks will inform the discourse of this study, while at the same time acknowledging that a comparative study between European and African systems cannot be possible. The premise for disqualifying a comparison assumes that margin of appreciation presupposes a democratic society. Thus, while the member states of the ECHR have attained high levels of human rights records, some of their counterparts in Africa are still marred by embarrassing human rights records." -- Preamble. "Chapter one introduces the study and the context in which it is set. It highlights the basis and structure of the study. Chapter two makes reference to the connotation, origin and development of the doctrine of margin of appreciation. Le Conseil de l'Europe -créé à la suite de la Seconde Guerre mondiale afin de reconstruire un espace démocratique et juridique commun -dont les travaux sur le droit pénal des mineurs sont issus des évolutions nationales entamées au début du XXe siècle, s'attacha à valoriser l'expérience des juridictions spécialisées existantes dans quelques pays européens et grâce auxquelles les mineurs commençaient à faire l'objet d'un traitement différencié de celui des adultes. Depuis, observant les préoccupations des États membres à l'égard de la délinquance juvénile et les contours changeants de leurs politiques pénales, le Comité des Ministres du Conseil de l'Europe élabore, au moyen de recherches criminologiques et comparatives, de colloques et de conférences, des recommandations et lignes directrices conduisant à l'harmonisation des droits nationaux autour de principes directeurs. Mue par son engagement dans l'européanisation du droit pénal des mineurs, la Cour européenne des droits de l'homme intégra les instruments internationaux et européens pertinents dans sa jurisprudence. Ce qui prend un caractère primordial dans les pays où l'application de la Convention est problématique et les violations des droits de l'homme récurrentes, parmi lesquels la Turquie. En conséquence, et malgré les modifications apportées dans la législation turque depuis 2005, nous ferons apparaître dans cette étude que ce membre du Conseil de l'Europe méconnaît encore l'autonomie de l'enfant, promeut toujours la punition en modèle éducatif, use régulièrement de la détention, et appréhende finalement de manière balbutiante la primauté de l'éducation sur la répression prônée par les principes directeurs. / The work by the Council of Europe -founded following the Second World War to rebuild a common democratic and legal order-in the field of juvenile justice has been influenced by the national developments emerged in the early twentieth century and has been focusing on enhancing the experiences of the existing special judicial bodies in some European countries of which were established for distinguishing the treatment of juvenile delinquent from adults. Since then, the Comrnittee of Ministers of the Council of Europe, which observes the concerns of the member states on juvenile delinquency as well as their changing criminal justice policies, adopts recommendations and guidelines in order to establish guiding principles leading to harmonization of the national systems through organizing meetings, conferences and conducting comparative research on criminology. Similarly, the European Court of Human Rights (ECHR) gives reference to the relevant international and European instruments in its jurisprudence so as to contribute to the Europeanisation of juvenile justice. This becomes especially important in countries like Turkey-where the implementation of the ECHR is problematic and human rights violations are recurring. Consequently, this study shows that despite the legislative changes made since 2005, Turkey, which is a member of the Council of Europe, still ignores the autonomy of the child, promotes punishment like an educational method, resort to detention as a regular measure, and finally displays an reluctant and abstaining attitude in giving priority to education over punishment as established by the guidelines.

Diploma thesis "Free Movement of Services - The focus on Eastern Enlargement of the European Union" describes the development of the internal market of services of the European Union in view of the recent developments to complete liberalization of this market through the adoption of Directive 2006/123/EC of the European Parliament and of the Council of the 12th December 2006 on Services in the Internal Market. The Eastern Enlargement of ten new countries partly affected the whole development, because it caused the reestablishment of some protectionist measures in the form of the transitional periods. The aim of this thesis is to analyze the situation on the market of services in the European Union after the admission of at least eight countries from Central and Eastern Europe, and to understand each of these steps, which have lead some states to these protectionist measures. For a greater understanding of my diploma thesis, I tried to explain some important definitions and terms in the first part of the thesis, which can help the reader to easily understand the following sections of the essay. Human rights are presumed to be universal given the universal declaration on human rights by the United Nations in 1948. Half a century has passed, and private human rights such as group rights are discriminated against worldwide. This thesis studies the presumed tension between universal human rights and private human rights, and how the specific rights are discriminated against. External monitoring is part of duties assigned to civil society organisations, and organisations monitor this issue and uses various methods to create circumstances in which private rights are respected. This thesis studies the European context through the European Court of Justice and the European Convention on Human Rights, and how civil society organisations in Europe use strategic litigation for Roma human rights. The purpose of this thesis is to establish how the European Court of Justice balances the tension between universal human rights and private human rights when civil society invokes discrimination against human rights. A sub-purpose is to identify whether there is a long-term consequence of strategic litigation for Roma human rights in Europe. The thesis has dealt with two ideas of human rights: universalism and discrimination. The chosen method for the study has been descriptive analysis of ideas to show the existence of ideas in texts, and thus be able to ascertain a shift in expression. The material is obtained by the civil society organisation European Roma Rights Centre, which are rulings from the European Court of Justice. The result of the study is that the European Court of Justice has previously considered that human rights should be universal and held that discrimination is difficult to prove. In recent cases however, the European Court of Justice has ruled that discrimination is constitutional for the Roma. Lastly, it is stated that strategic litigation can be viewed as effective in reducing the tension between universal human rights and private human rights in Europe.

La tesi ha per oggetto l’autotutela amministrativa, specialmente quella c.d. decisoria “spontanea”, ovvero quell’insieme di poteri che consentono all’amministrazione di riesaminare i propri provvedimenti e di rimuoverli a vario titolo.
Di questi poteri si è indagato il fondamento dogmatico e positivo. La questione del fondamento è stata per lunghi anni affrontata dalla dottrina e dalla giurisprudenza in termini totalmente pre-critici e non problematici: l’esistenza di questi poteri era semplicemente scontata e le riflessioni sulla loro base giuridica si esaurivano perlopiù nella constatazione della loro necessità nell’immemore consenso circa la loro ammissibilità. Negli ultimi anni, invece, una parte degli Autori ha disconosciuto la natura implicita e per così dire “originaria” di questi poteri e ne ha perciò patrocinato la stretta riconduzione al principio di legalità: in altre parole, l’annullamento e la revoca non sarebbero affatto conseguenza della c.d. inesauribilità del potere amministrativo – negata da questa dottrina – e sarebbero perciò oggi ammissibili unicamente nei casi e nei modi disciplinati dalle due norme introdotte nella legge sul procedimento nel 2005. Ciò a garanzia della certezza dei rapporti giuridici e del legittimo affidamento dei destinatari dei provvedimenti ampliativi. Secondo un filone ricostruttivo in pare contrastante con il primo, altri Autori hanno inteso valorizzare gli elementi de iure condito a favore della obbligatorietà dell’avvio del procedimento di riesame, auspicandone contemporaneamente la generalizzazione, nell’ottica di una più complessiva trasformazione dell’annullamento d’ufficio in un nuovo istituto ibrido, rispondente alla funzione di alternative dispute risolution system o, se si vuole, di ricorso gerarchico. Per le stesse ragioni, l’istituto dovrebbe perdere il carattere ampiamente discrezionale, in favore di una vincolatezza totale o parziale. Questo secondo “fronte di attacco” alla ricostruzione tradizionale intende offrire soluzione al venir meno del sistema dei controlli di legalità sull’azione amministrativa. Lo studio ha sottoposto a verifica entrambi i filoni evolutivi richiamati, discostandosi dal secondo e, pur accogliendo parte delle argomentazioni ad esso sottostanti, anche dal primo. Quanto alla teoria dell’esauribilità del potere amministrativo, oggetto della prima linea evolutiva, si è ritenuto di condividere le considerazioni circa la tutela dell’affidamento degli interessati e della stabilità dei rapporti giuridici. È parsa tuttavia meglio rispondente alle categorie generali e alle esigenze del sistema (anche sulla base di una visione del diritto amministrativo quale “diritto dei terzi”, per natura volto alla tutela dell’interesse generale e non solo dell’interesse privato particolare coinvolto dall’esercizio del potere) la conservazione della tradizionale inesauribilità del potere, seppur assai mitigata, nella pratica, con riferimento all’esercizio dei poteri di ritiro degli atti favorevoli ai privati il cui affidamento sia concretamente meritevole di tutela. La natura discrezionale dell’annullamento d’ufficio (e della revoca), sottoposta a critica dalla seconda linea evolutiva, viene difesa sia sul piano del diritto positivo e pretorio (attraverso la riconduzione dei principali casi di annullamento c.d. doveroso al modello generale), sia sul piano delle categorie generali, a partire dalla natura dei poteri coinvolti e dall’analisi delle posizioni giuridiche dei soggetti interessati dai procedimenti di secondo grado. / The thesis focuses on the Italian system of so called autoprotection or selfprotection. This expression refers to the powers of public administration to revoke its own acts when deemed necessary to repair a vice of legitimacy or a vice of opportunity, without being bind to resort to the courts. Given the aim of this powers – the same of first grade powers plus a semi-judicial one – they are usually meant by judges and scholars as “widely discretionary”. Furthermore, it has always been believed that the choice to activate the correspondent proceeding is totally free for public administration; consequently, a demand of interested parties does not make binding the start of the procedure, opposite to what happens with administrative appeal proceedings. In recent years ECJ, ECHR and national case law has emboldened the limits to selfredress, making clear that legitimate expectations and the public interest to legal certainty must be taken into consideration and given sufficient protection. Lately, also the Legislator followed, making the annulment and the revocation harder to be put in effect when the first act is favorable to the addressed subject. In such cases, the revocation cannot be ordered for a mere reconsideration of already known circumstances (ius poenitendi) but only if new ones show up. At the same time, ex officio annulment is precluded after 18 months from the issuing of the first act, instead of the previous general limit of a “reasonable time”. On the other hand, the case law has apparently pointed out some hypothesis of mandatory annulment, such as for “anticomunitarian acts” and cost-producing acts. Based on these two orientation, some scholars suggested a global rethinking of the self-protection, its bases and its rules. The study analyzes the case law and the latest legislative reforms, proving that no mandatory annulment exists in the Italian legal system. Therefore, nor the ECJ principle of equivalence nor other principles require that selfredress become generally obliged. The thesis also aims to prove that selfprotection remains a discretionary power, in order to ensure that the contrasting needs (the rule of law on the one hand, and the legal certainty and legitimate expectation on the other hand) can be properly balanced in every decision, according to the Constitutional provision of article 97, which requires that both impartiality and good administration are pursued.

Svensk domstols hantering av EU-rätten : domstolens skyldigheter gentemot EU och faktiska genomförande av dessa

Sveriges inträde i EU 1995 har lett till många förändringar i det svenska rättssystemet. Svenska domstolar har därmed fått en ny arbetssituation och nya skyldigheter. Flera förändringar har skett i svensk processrätt, och grundläggande EU-rättsliga principer som de om direkt effekt och EU-rättens företräde framför nationell rätt, har ställt de nationella domstolarna inför flera utmaningar. Den mest grundläggande skyldigheten de svenska domstolarna har gentemot EU är förpliktelsen att inhämta förhandsavgörande från EU-domstolen. Sistainstansrätterna är skyldiga att göra detta närhelst de är osäkra på tolkningen och/eller tillämpningen av en EU-rättslig bestämmelse. Detta är en långtgående förpliktelse som endast har två undantag: det första är i de fall EU-domstolen redan dömt i ett identiskt fall (acte éclairé); det andra är då den nationella domstolen anser att den EU-rättsliga bestämmelsen är tillräckligt klar och tydligt för att den självständigt ska kunna tillämpa den (acte clair). Dessa skyldigheter har lett till ett flertal problem för de svenska domstolarna. Sverige har fått skarp kritik från Kommissionen för sistainstansrätternas obenägenhet att inhämta förhandsavgörande. Huruvida EU borde ta hårdare tag mot medlemsstaternas nationella domstolar eller om kriterierna för när skyldigheten att inhämta förhandsavgörande borde mjukas upp diskuteras flitigt i nuläget. Det finns företeelser som talar för en utveckling åt både det ena och det andra hållet, vilket gör detta till ett väldigt spännande ämne att studera. / Since Sweden joined EU in 1995 many things has changed in the Swedish legal order. This has led to several new obligations for the Swedish courts. There have been a number of changes in Swedish law of procedure, and fundamental principles of law set down by EU, like the principle of direct effect of EU law and its precedence over national law, has presented many challenges before the national courts. The most fundamental obligation of the Swedish courts to EU is the duty to make a reference for a preliminary ruling to the European Court of Justice (ECJ). The courts of last instance are obligated to do this in any case where they are insecure of the appropriate application of EU-law. There are only two exceptions to this rule, namely when the ECJ already has ruled in an identical matter (acte éclairé) and in cases where the national court feels that the correct interpretation of the rule of law in question is obvious (acte clair). These obligations have lead to a number of problems for the Swedish courts. The Commission has criticized Sweden because of the national courts of last instance unwillingness to request preliminary rulings. Whether EU should toughen up and take action against the national courts disobedience or if the criteria for when an obligation to make a reference for a preliminary ruling should get more flexible is constantly discussed at this time. There are several things that speaks for both of these developments and that makes this a very interesting topic to study.

IL LAVORO A TEMPO PARZIALE TRA INFLUSSI EUROPEI E ORDINAMENTO INTERNO

L’opera analizza l’evoluzione del contratto di lavoro a tempo parziale nell’ordinamento europeo e italiano. In Italia successivamente a una fase pionieristica la prima regolamentazione legislativa, l. n. 864 1983, lascia aperti numerosi problemi interpretativi. L’ordinamento europeo tenta di superare la mancanza di una specifica regolamentazione a protezione del lavoro part-time, basandosi sul principio della parità di retribuzione tra uomini e donne, come affermato dalla Corte di giustizia. Infine il part time è regolato dalla Direttiva 97/81, che da un lato rappresenta l’apice del Dialogo sociale europeo, dall’altro è tra gli istituti su cui la Strategia europea per l’occupazione fa affidamento, soprattutto per aumentare il tasso di presenza femminile al lavoro. Successivamente, la legge n. 61/2000 traspone la direttiva nell’ordinamento italiano. A partire da allora in un’ ottica di favorire l’incremento del part time, alcune clausole subiscono numerose modifiche, che oscillano tra delega alla contrattazione collettiva e all’autonomia individuale. L’incremento del part time nel corso degli ultimi anni, anche a seguito della crisi, è rappresentato da part timers involontari, che accettano questo contratto soltanto in mancanza di un impiego a tempo pieno. Infine si compie un’analisi circa i futuri sviluppi della normativa sul tempo parziale. Più nello specifico, la perenne tensione tra contrattazione collettiva e autonomia individuale, entrambe indispensabili, dovrebbe tendere ad un nuovo equilibrio regolativo. Inoltre le auspicate modifiche legislative in ordine a un pieno diritto al part time, non potranno ignorare, in un’ ottica funzionale, una armonizzazione con le regole in tema di aspettative e permessi. / The study focuses on part-time work evolution in the European and Italian systems. After a pioneering phase, the first legislative regulation in Italy, law n. 864/1983, raises a number of interpretation problems. The European System attempts to overcome the lack of a specific regulation to protect part-time work by relying on the principle of equal pay for men and women as stated by the European Court of Justice. In the end, part-time is regulated by Directive 97 /81 which, on the one hand, represents the success of the European social dialogue and, on the other hand, is one of the most important means to increase the number of women in the work market according to the European Employment Strategy. At a later stage, the law n . 61/2000 transposes the Directive into the Italian system. Since then, in a perspective of increasing part-time, some clauses in Italy undergo numerous changes which specifically range from delegation to collective bargaining and to the individual autonomy. The increased number of part-timers in recent years, partly as a result of the economic crisis, is represented by the involuntary part-timer workers, which accept contracts only in the absence of full time employment. In the end, the study anticipates future developments in part-time work regulation. More specifically, the constant tension between individual autonomy and collective bargaining, which are both crucial, should tend to a new regulative equilibrium. In addition, future advocated legislative changes related to a full right to part-time should not ignore, in a functional perspective, the harmonization with the rules regarding leaves of absences and other permitted absences.

The European Court of Justice and social policy : a mixed methods analysis of preliminary references from the EU-15, 1996-2009

Although social policy was once perceived to be solely within the purview of the nation state, there has been a move toward a more European social policy. The European Court of Justice for the European Communities (‘Court of Justice’ or ‘Court’) determines the scope of European law and how it affects national welfare states. The court’s decisions will affect not only the national law of the member states with regard to social policy but also the direction of European social policy as it expands. However, the ECJ does not choose the policy areas in which it makes its decisions, but instead reacts to the preliminary references that are sent by the national courts of the Member States. These preliminary references from the Member States will set the Court’s agenda. Preliminary references are unevenly distributed across the Member States of the EU, and some Member States’ preliminary references are concentrated in particular policy areas. The jurisprudence of the Court, and consequently the social policy of the EU, could be steered by this uneven distribution. This thesis will answer the threshold question of why scholars of social policy should care about the Court of Justice, with a legal analysis of some key themes in the Court’s decisions in the area of social policy. It will then employ a mixed methods research design to explain the variation in rates of social policy preliminary references from the EU-15. First, a Time Series Cross-Section (TSCS) model will be used to test a series of hypotheses generated from the literature, and three novel hypotheses, in a dataset of social policy preliminary references from the EU-15 from 1996 to 2009. Next, a Qualitative Comparative Analysis (QCA) (Ragin 2000) will group the variables that were found to be significant into sets of conditions, or ‘causal pathways,’ that lead to higher and lower rates of social policy preliminary references. Finally, two qualitative case studies will be conducted, in the UK and France. Analysis of documentary evidence and 25 expert interviews in the two member states and at the Court of Justice will further explain and illuminate the differing usage of preliminary reference process. The analysis of the mixed methods is integrated in the final stage. Implications for the direction of EU law related to social policy and the future development of European social policy will be considered in the concluding chapter.

Le processus d'adhésion à l'Union Européenne est-il en mesure de contribuer davantage que la Convention européenne à la protection des droits de l'homme en Turquie?

La Turquie va-t-elle adhérer à l'Union européenne? Sa candidature a toujours été sujette à critiques: droits de l'homme non respectés, restrictions des droits et libertés, notamment de la liberté d'expression, de religion et des droits politiques. Les dossiers sensibles comme le problème kurde et la question chypriote sont à l'origine des multiples plaintes contre l'État turc devant la Cour européenne des droits de l'homme. Dotée des caractéristiques essentielles d'un État moderne et laïque, le pays dispose de structures formellement démocratiques, mais sa démocratie se révèle fragile: ses politiques tant internes qu'externes sont décidées par un Conseil national de sécurité composé pour l'essentiel de militaires. En outre, l'armée qui a pris le pouvoir à maintes reprises a donné au régime une dimension autoritaire. Cela non seulement en vertu des principes fondateurs de la République (tradition centralisatrice de l'État turc), mais aussi de la priorité que l'institution militaire accorde à la sécurité, à l'unité et à l'identité nationales. En effet, les mesures d'exception (état d'urgence, cours de sûreté de l'État, loi anti-terroriste) ont contribué aux violations des droits de l'homme, d'où l'opposition entre le droit conventionnel et le droit national. De plus, le système judiciaire et administratif instauré par les militaires en 1982 n'est pas conçu dans l'intérêt des justiciables. Certes, l'accès à la modernité n'a pu se faire que sous la contrainte et le contrôle de l'armée, mais le régime en Turquie peut-il continuer à s'appuyer sur les«piliers de l'ordre» que sont l'armée, la police et la justice ? L’État semble cependant se réorganiser progressivement pour permettre au pouvoir politique d'assurer un contrôleur les forces de sécurité et pour donner une meilleure indépendance à la justice. Le processus mis en route et les critères imposés pour l'adhésion à l'UE devraient contribuer à mettre en œuvre les réformes institutionnelles capables d'harmoniser la démocratie à l'État de droit, à l'image des pays européens. En effet, les changements récents sont liés à l'agenda européen. Le gouvernement turc semble être déterminé et ambitieux dans sa vocation européenne. Les progrès réalisés pour intégrer l'UE lui sont un moteur de propulsion devant servir au pays et à sa population. / The issue of the accession of Turkey to the European Union is one of the most controversial topics as regards to human rights. The sensitive issues such as the kurdish problem and the conflict with Cyprus are the main cause of the most restrictions of the rights and freedoms and complaints lodged against the Turkish State before the European court of Human Rights. Turkey has the essential characteristics of a modern and secular state, but its democracy prove to be fragile. Thus, the powerful role of the army in many areas of political life can be explained by the malfunctioning of the democracy, giving to the régime an authoritative aspect. The Turkish army is seen as the guardian of the unity, security and identity of the nation. Indeed, the access to modernity is due to the control of the army, but the régime in Turkey needs to undertake major policy reforms to converge with European Union policies. The judicial and administrative system set by the army in 1982 does not sufficiently protect the justiciable. The exceptional measures such as state of emergency, security state courts, anti-terrorist law contributed to the violation of human rights and emphasized the contradiction between conventional law and national law. Turkey has made progress towards modifying its legal system in order to give more independence and impartiality. The accession partnership will certainly enable Turkey to review its Constitution and relevant legislation in providing basic freedoms, the rule of law and respect of human rights in conformity with the European Union's own standards. Turkey's inclusion in the enlargement process has not only increased European Union leverage over Turkish politics, but revitalized Turkey's European vocation.
