FRÅGA OM STATLIGT SJÄLVBESTÄMMANDE? : En analys av Sveriges regerings syn på migration under flyktingkrisen 2015 och 2016

Traditionally Sweden has had a liberal migration policy and has been opened to both refugees, asylum seekers and labor immigrants. In year 2015 Sweden introduced internal border controls to stop the inflow of people by reason of the overloaded asylum system, internal borders that earlier had been open for over 60 years. The purpose of this survey is to analyze the Swedish governments’ view on migration during the years 2015 and 2016 based on ideas about migration as a universal human right and the states self-determination. This is interesting because Sweden has had a liberal migration policy, and besides, calls itself for a humanitarian superpower. The questions in this survey is first how the relationship look like in the governments’ view on migration based on universal human rights and state self-determination during the refugee crisis 2015 and 2016 and how they express themselves in the various government documents. The second question is what ideas are specifically emphasized by the government in the view of who the central actor is, the view of state borders and the view of who the state should help? The method in this survey is a qualitative actor-centered and descriptive idea and ideology analysis where dimensions are used as an analysis tool. The material used in the survey is government documents from 2015 and 2016 consisting government declarations, propositions and debate articles. The result shows that both ideas of migration as a universal human right and the state self-determination can be found in the Swedish government view on migration during this years. The first idea is most prominent in the principal view of what the government wants to do in the migration politics and the second idea is most prominent in the documents about how the government actually act, such as in law suggestions. In addition, the government’s view is also different between the dimensions of the various government documents.

Human rights are presumed to be universal given the universal declaration on human rights by the United Nations in 1948. Half a century has passed, and private human rights such as group rights are discriminated against worldwide. This thesis studies the presumed tension between universal human rights and private human rights, and how the specific rights are discriminated against. External monitoring is part of duties assigned to civil society organisations, and organisations monitor this issue and uses various methods to create circumstances in which private rights are respected. This thesis studies the European context through the European Court of Justice and the European Convention on Human Rights, and how civil society organisations in Europe use strategic litigation for Roma human rights. The purpose of this thesis is to establish how the European Court of Justice balances the tension between universal human rights and private human rights when civil society invokes discrimination against human rights. A sub-purpose is to identify whether there is a long-term consequence of strategic litigation for Roma human rights in Europe. The thesis has dealt with two ideas of human rights: universalism and discrimination. The chosen method for the study has been descriptive analysis of ideas to show the existence of ideas in texts, and thus be able to ascertain a shift in expression. The material is obtained by the civil society organisation European Roma Rights Centre, which are rulings from the European Court of Justice. The result of the study is that the European Court of Justice has previously considered that human rights should be universal and held that discrimination is difficult to prove. In recent cases however, the European Court of Justice has ruled that discrimination is constitutional for the Roma. Lastly, it is stated that strategic litigation can be viewed as effective in reducing the tension between universal human rights and private human rights in Europe.

La violencia obstétrica, constituye una problemática abordada desde distintos ámbitos y regulada en muchos países a nivel internacional. Los derechos humanos vulnerados que se vinculan con actos de violencia obstétrica han sido abordados y trabajados por distintos comités, informes y protocolos dentro del Sistema Interamericano de Derechos Humanos y el Sistema Universal de Derechos Humanos. El objetivo de esta investigación es analizar la situación de la violencia obstétrica y como el estado peruano ha venido dando respuesta frente a esta problemática. Ello, a partir del caso de Eulogia Guzmán y su hijo Sergio ante la Comisión Interamericana de Derechos Humanos. Este caso engloba un conjunto de hechos vinculados con vulneraciones a los derechos humanos, tales como el derecho a la salud, derecho a la vida, derecho a la dignidad humana, derecho a la salud materna y el ejercicio de los derechos humanos de las mujeres. Pues se evidencia que nuestro país tenía obligaciones vigentes en materia de estos derechos cuando aconteció este caso. En ese sentido Eulogia termina siendo víctima de la inacción e ineficacia del estado para garantizar el ejercicio de derechos plenamente reconocidos. / Obstetric violence constitutes a problem approached from different spaces and regulated in many countries at an international level. The violated human rights linked to acts of obstetric violence have been signed and worked on by different committees, reports, and protocols within the Inter-American Human Rights System and the Universal Human Rights System. The objective of this research is to analyze the situation of obstetric violence and how the Peruvian State has been responding to this problem. This, based on the case of Eulogia Guzmán and his son Sergio vs. the Inter-American Commission on Human Rights. This case included a number of facts related to human rights violations, such as the right to health, the right to life, the right to human dignity, the right to maternal health, and the exercise of women's human rights. According to that, it is evident that our country had obligations regarding these rights when this case happened. In this sense, Eulogia ends up being a victim of the inaction and ineffectiveness of the state to guarantee the exercise of fully recognized rights. / Tesis
