Les recettes de cuisine sont partout de nos jours, dans les livres, à la télévision, sur l’Internet, ainsi que dans les restaurants et les entreprises alimentaires industrielles. Cette grande présence médiatique et économique soulève la question de savoir s’il est possible de les protéger par le droit de la propriété intellectuelle canadien. L’auteure commence par décrire les recettes et les plats, puis examine si ceux de nature traditionnelle et familiale sont des éléments de culture et s’ils peuvent constituer des savoirs traditionnels. Cela amène l’auteure à examiner si les indications géographiques peuvent procurer aux recettes et aux plats une certaine forme de protection contre leur appropriation à l’usage exclusif d’une personne.
L’auteure aborde ensuite les régimes usuels de propriété intellectuelle à l’aune de la recette et du plat de chefs ou de l’industrie. Elle examine en premier ceux de la propriété industrielle. Les recettes et les plats peuvent-ils être des marques de commerce? Peuvent-ils être des secrets de commerce? Peuvent-ils constituer des inventions brevetables? Elle se penche ensuite sur le droit d’auteur et examine si les recettes et les plats peuvent être des œuvres protégeables et s’ils se qualifieraient comme œuvres littéraires ou artistiques. Cet examen l’amène à regarder le développement de la protection des œuvres musicales pour mieux cerner les enjeux pour les recettes. Au terme de son analyse, l’auteure fait ressortir quel régime appert le plus approprié selon la nature des recettes et des pratiques des chefs et des entreprises industrielles. / Nowadays, we are surrounded by recipes; they are in books, on television, on the Web, as well as in restaurants and in industrial food businesses. This great economic and media weight naturally begs the question whether recipes can be protected under Canadian intellectual property law. The author starts by describing recipes and dishes and then examines whether traditional and family recipes and dishes are elements of culture and whether they can be considered traditional knowledge. That leads the author to consider whether geographical indications can provide recipes and dishes with some kind of protection against their appropriation by a person for his or her exclusive use.
The author then examines the usual intellectual property schemes for industrial and chefs’ recipes and dishes. She starts with industrial property schemes. Can recipes and dishes act as trademarks? Can they be trade secrets? Can they be patentable inventions? She then moves on to copyright, to examine whether recipes and dishes can be copyrightable works and, if so, whether they would be literary or artistic works. That leads her to look at how musical works came to be protected in order to better understand what is at issue for recipes. The author concludes her analysis by stating which scheme seems to be the most appropriate for recipes depending on their nature and the practices of chefs and industrial businesses.

Le Mexique a une grande variété de produits du terroir, appris et transmis aux producteurs de génération en génération, mais certains manquent de protection ou la protection est inefficace. Les producteurs du Mexique vivent souvent dans des conditions marginales, et l'imitation de leurs produits résulte en une réduction de leurs ventes. Ils sont souvent contraints à changer de métier. Cette situation met en péril le patrimoine national en raison de l’abandon des connaissances traditionnelles, lesquelles représentent l'identité et la diversité culturelle de la nation mexicaine. La « Ley de la Propiedad Industrial » (LPI) prévoit l'appellation d’origine et la marque collective en tant que mécanismes de protection; cependant, ils ne sont pas toujours adéquats pour assurer une protection efficace des produits du terroir. Notre objectif est d'analyser si l'inclusion de l’indication géographique à la LPI peut favoriser l’enregistrement des produits du terroir qui sont à risque de disparaître. Cette étude fait donc ressortir la nécessité de modifier la LPI afin qu’elle réponde mieux aux besoins et aux réalités du Mexique. / Local products occupy a privileged place in the preferences of consumers who are more and more interested in knowing the origin and the quality of the products they consume. Mexico has a great variety of “terroir products”, learned and passed on to producers from generation to generation, but some of them lack protection or their protection is ineffective. Mexican producers oftentimes live in marginal conditions, and the imitation of their products results in a reduction in sales. They are often forced to change their trade. This situation puts the national patrimony in jeopardy due to the abandonment of traditional knowledge, which represents the identity and cultural diversity of the Mexican nation. The « Ley de la Propiedad Industrial » (LPI) provides for the appellation of origin and the collective mark as mechanisms of protection; however, they are not always adequate to ensure an effective protection of “terroir products”. Our goal is to analyze whether the inclusion of the geographical indication in the LPI will strengthen the registration of “terroir products” that are at risk of disappearing. This study thus highlights the need to revise the LPI to better reflect the needs and realities of Mexico.

Previous issue date: 2009-05-29 / Geographic Indications (GI s) do not have uniform treatment in the world-wide doctrine what
is reflected in the diverse manifestations about it as demonstration of itself, therefore in each
place the institute is treated as peculiar and unique. Even in only one country GI s have,
many times, different treatments. We understand Law ex facto oritur jus (from the fact law
is born) and from that, we create our agreement of what it is happening in the domain of
the Geographical Indications. Geographical indication is a set of words that aims to transmit
only one concept, but in fact, it apparently transmits two disconnected concepts that are
not: 1 - Geographical indication is the official nomination of one certain place where a Good
of the same name occurs and is typical, regional and peculiar with guarantee of origin and
with traditional and recognized quality for the loyal, responsible and constant repetition. 2 -
Geographic indication is the typical, regional and peculiar Good, with a certain name officially
recognized as originating of a place, region or country, named differently but granting
quality, reputation and characteristic recognized for the loyal, responsible and constant
repetition. Geographic indication is for the target of this work the sort from which flows out
the two types: Indication of Source (IS) and Appellation of Origin (AO). It must be noticed
that in the same region or place the two types can coexist, that is, a same place can present
Indication of Source and Appellation of Origin, depending. An Indication of Source is a local
manifestation of more generic character; an Appellation of Origin is a local manifestation of
very typical character and, consequently, more generous. Beyond these trouble makers
factors there are others: the doctrine does not deal with and does not even mention the
several internal classifications of quality that permeate a Geographical Indication and tint it;
it insists only on the mention to Geographical Indication, Indication of Source and
Appellation of Origin as if it was enough, without informing that almost always there is a
proper qualitative internal system of each Geographical Indication, system that enlarges,
accentuates or diminishes the classic divisions into Geographical Indication and its species
Indication of Source and Appellation of Origin with which it always coexists, case by case / Indicações Geográficas (IG s) não têm tratamento uniforme na doutrina mundial o que se
reflete nas diversas manifestações a respeito fazendo do tema uma demonstração de si
mesmo, pois em cada lugar o instituto é tratado como peculiar e único. Mesmo dentro de um
país as IG s têm, muitas vezes, tratamentos diferentes. Entendemos que em Direito ex facto
oritur jus (do fato nasce o direito) e daí criamos nosso entendimento do que se passa no
domínio das Indicações Geográficas. Indicação Geográfica é um conjunto de palavras que
visa transmitir um só conceito, mas, na realidade, transmite dois conceitos aparentemente
desconexos entre si, mas que não são: 1 - Indicação Geográfica é a nomeação oficial de um
local certo em que se dá Bem do mesmo nome e que seja típico, regional e peculiar com
garantia de procedência e com qualidade tradicional e reconhecida pela repetição leal,
responsável e constante. 2 - Indicação Geográfica é o Bem típico, regional e peculiar, com
nome certo e reconhecido oficialmente como originário de local, região ou país nomeado
diferentemente, mas que lhe confere qualidade, reputação e característica reconhecida pela
repetição leal, responsável e constante. Indicação Geográfica é para o escopo deste trabalho
o gênero de que defluem as espécies Indicação de Procedência (IP) e Denominação de
Origem (DO). Remarque-se que na mesma região ou local podem conviver os dois tipos, ou
seja, um mesmo local pode apresentar IP s e DO s, dependendo. A IP é manifestação local
de caráter mais genérico; a DO é manifestação local de caráter muito típico e, assim, mais
generoso. Além destes fatores motivadores de confusão há mais outros: a doutrina não
aborda sob nenhum prisma e nem sequer menciona as diversas classificações internas de
qualidade que permeiam uma IG e dão-lhe matiz; insiste apenas na menção à IG, IP e DO,
como se isto bastasse, sem avisar que quase sempre há sistema classificatório qualitativo
interno e próprio de cada IG, sistema esse que expande ou acentua ou diminui as clássicas
divisões em IG e suas espécies IP e DO com as quais sempre convive, caso a caso

Le sujet de cette thèse est le paysage dans sa spécificité viticole analysée comme représentation spatiale dans le processus de construction de l'espace géographique de la vitiviniculture et aussi dans l'utilisation des images du paysage viticole comme l’image spatiale des vins des régions des Indications de Provenance (IP) Vale dos Vinhedos, Pinto Bandeira et Monte Belo (Brésil). Les sources théoriques sont en lien avec la Géographie Critique et la Géographie Culturelle. L'objectif a été d'expliquer le paysage viticole comme représentation spatiale des régions et d’analyser l'image du paysage viticole comme symbole spatial pour les vins des IP. L'organisation de l'espace géographique des régions des IP s'insère dans le contexte de la colonisation italienne. Le développement de la vitiviniculture régionale a occasionné des conditions de mise en place des IP, dont les associations de producteurs ont utilisé des images de paysages viticoles pour construire le lien espace-région-toponyme-vin. L'analyse des paysages a révélé six types et un sous-type avec deux formes de paysages viticoles traditionnels et cinq types de paysages viticoles modernes, y compris les éléments emblématiques naturels et construits, entre lesquels se remarquent l’Araucaria angustifolia, et l'usage des Platanus acerifolia pour soutenir les vignobles, héritage de la tradition viticole étrusque. L'analyse des images des paysages viticoles utilisées par les associations a montré qu'il y a des différences significatives et la majorité sont des paysages viticoles traditionnels. Les associations de l’IP Vale dos Vinhedos et IP Monte Belo ont établi des liaisons directes entre espace-vin-paysage, mais non celles de IP Pinto Bandeira. La recherche a montré que le paysage viticole est un symbole de la représentation de l'espace régional et du vin des IP Vale dos Vinhedos, Pinto Bandeira et Monte Belo. / The theme of this thesis is the landscape in its specificity vineyard analyzed as a spatial representation in the building process of the geographical area of viticulture growing and the use of image of vineyard landscape as spatial landscape of the wine of the regions of Geographical Indication (GI’s) Vale dos Vinhedos, Pinto Bandeira and Monte Belo, Brazil. The objective was to explain the use of vineyard landscape as spatial representation and the images of vineyard landscape as spatial symbol for the wines of GI’s. The theoretical sources to analyze are related to the Critical geography and with the Cultural geography. The organization of the geographic area of the regions of GI’s comes within the context of the Italian colonization process in which its culture was part of the cultivation of vines. The vineyard regional industry development took the conditions of implementation of GI’s, whose producers associations begun to use images of landscape wine to build wine-region-toponym. The landscape analysis revealed six types of landscapes and a sous-type of traditional wine-growing landscapes and five types of modern wine landscapes, occurring in both natural and constructed features characteristic among these was the Araucaria angustifolia and the use of Platanus acerifolia in support of the vineyards, and is the Etruscan wine growing tradition. The analysis of the landscape wine images used by associations showed that there are significant differences; the most are images of traditional wine landscape. The association of Vale dos Vinhedos and Monte Belo established direct links of wine-region- landscape, but not Pinto Bandeira. The survey showed that landscape is a representational symbol of regional area and of the wine of GI’s from Vale dos Vinhedos, Pinto Bandeira and Monte Belo.

O objetivo foi explicar a paisagem vitícola como representação espacial das regiões e analisar a imagem da paisagem vitícola como símbolo espacial para os vinhos das IP’s, cujas bases teóricas estão na Geografia Crítica e na Geografia Cultural. A organização do espaço geográfico das regiões das IP’s insere-se no contexto da colonização italiana, da qual a vitivinicultura é elemento cultural. O desenvolvimento da vitivinicultura regional levou à implementação de IP’s e ao uso de imagens de paisagens vitícolas, pelas associações de produtores, para construir o vínculo espaço/região-topônimo-vinho. A análise das paisagens das regiões revelou seis tipo e um subtipo em duas formas de paisagens vitícolas tradicionais e cinco tipos de paisagens vitícolas modernas, incluindo elementos emblemáticos naturais e construídos, entre os quais se destaca a Araucaria angustifolia e o uso do Platanus acerifolia para sustentar os vinhedos, herança da tradição vitícola etrusca. A análise das imagens de paisagens vitícolas usadas pelas associações evidenciou que há diferenças significativas sendo, a maioria, de paisagens vitícolas tradicionais. As associações das IP’s Vale dos Vinhedos e Monte Belo estabeleceram vínculos diretos entre espaço/vinho/paisagem, mas não IP Pinto Bandeira. L'analyse des paysages a révélé six types et un sous-type avec deux formes de paysages viticoles traditionnels et cinq types de paysages viticoles modernes, y compris les éléments emblématiques naturels et construits, entre lesquels se remarquent l’Araucaria angustifolia, et l'usage des Platanus acerifolia pour soutenir les vignobles, héritage de la tradition viticole étrusque. L'analyse des images des paysages viticoles utilisées par les associations a montré qu'il y a des différences significatives et la majorité sont paysages viticoles traditionnels. Les IP Vale dos Vinhedos et IP Monte Belo ont établi des liaisons directes entre espace-vinpaysage, mais non celle de IP Pinto Bandeira. La recherche a montré que le paysage viticole est un symbole de la représentation de l'espace régional et du vin des IP’s Vale dos Vinhedos, Pinto Bandeira et Monte Belo. / O tema da tese é a paisagem em sua especificidade vitícola, analisada como representação espacial no processo de construção do espaço geográfico da vitivinicultura e no uso da imagem da paisagem vitícola como imagem espacial dos vinhos das regiões das Indicações de Procedência (IP’s) Vale dos Vinhedos, Pinto Bandeira e Monte Belo, Brasil. O objetivo foi explicar a paisagem vitícola como representação espacial das regiões e analisar a imagem da paisagem vitícola como símbolo espacial para os vinhos das IP’s, cujas bases teóricas estão na Geografia Crítica e na Geografia Cultural. A organização do espaço geográfico das regiões das IP’s insere-se no contexto da colonização italiana, da qual a vitivinicultura é elemento cultural. O desenvolvimento da vitivinicultura regional levou à implementação de IP’s e ao uso de imagens de paisagens vitícolas, pelas associações de produtores, para construir o vínculo espaço/região-topônimo-vinho. A análise das paisagens das regiões revelou seis tipo e um subtipo em duas formas de paisagens vitícolas tradicionais e cinco tipos de paisagens vitícolas modernas, incluindo elementos emblemáticos naturais e construídos, entre os quais se destaca a Araucaria angustifolia e o uso do Platanus acerifolia para sustentar os vinhedos, herança da tradição vitícola etrusca. A análise das imagens de paisagens vitícolas usadas pelas associações evidenciou que há diferenças significativas sendo, a maioria, de paisagens vitícolas tradicionais. As associações das IP’s Vale dos Vinhedos e Monte Belo estabeleceram vínculos diretos entre espaço/vinho/paisagem, mas não IP Pinto Bandeira. A pesquisa evidenciou que a paisagem vitícola é um símbolo representacional do espaço regional e do vinho das IP’s Vale dos Vinhedos, Pinto Bandeira e Monte Belo. / The theme of this thesis is the landscape in its specificity vineyard analyzed as a spatial representation in the building process of the geographical area of viticulture growing and the use of image of vineyard landscape as spatial landscape of the wine of the regions of Geographical Indication (GI’s) Vale dos Vinhedos, Pinto Bandeira and Monte Belo, Brazil. The objective was to explain the use of vineyard landscape as spatial representation and the images of vineyard landscape as spatial symbol for the wines of GI’s. The theoretical sources to analyze are related to the Critical geography and with the Cultural geography. The organization of the geographic area of the regions of GI’s comes within the context of the Italian colonization process in which its culture was part of the cultivation of vines. The vineyard regional industry development took the conditions of implementation of GI’s, whose producers associations begun to use images of landscape wine to build wine-region-toponym. The landscape analysis revealed six types of traditional wine-growing landscapes and a subtype of landscapes and five types of modern wine landscapes, occurring in both natural and constructed features characteristic among these was the Araucaria angustifolia and the use of Platanus acerifolia in support of the vineyards, and is the Etruscan wine growing tradition. The analysis of the landscape vine images used by associations showed that there are significant differences; the most are images of traditional vine landscape. The association of GI’s Vale dos Vinhedos and Monte Belo established direct links of wine-region- landscape, but not IG Pinto Bandeira. The survey showed that landscape is a representational symbol of regional area and of the wine of GI’s from Vale dos Vinhedos, Pinto Bandeira and Monte Belo.

Le sujet de cette thèse est le paysage dans sa spécificité viticole analysée comme représentation spatiale dans le processus de construction de l'espace géographique de la vitiviniculture et aussi dans l'utilisation des images du paysage viticole comme l’image spatiale des vins des régions des Indications de Provenance (IP's) Vale dos Vinhedos, Pinto Bandeira et Monte Belo (Brésil). Les sources théoriques sont en lien avec la Géographie Critique et la Géographie Culturelle. L'objectif a été d'expliquer le paysage viticole comme représentation spatiale des régions et d’analyser l'image du paysage viticole comme symbole spatial pour les vins des IP's. L'organisation de l'espace géographique des régions de IP's s'insère dans le contexte de la colonisation italienne. Le développement de la vitiviniculture régionale a occasionné des conditions de mise en oeuvre des IP's, dont les associations de producteurs ont utilisé des images de paysages viticoles pour construire le lien espace-régiontoponyme- vin. The increasing competitiveness seen in various activities of the primary sector requires organizations and producers associations’ capacity of planning, elaboration and execution of strategies capable to promote the reach of the goal and objective organizational. From the understanding that this competitive scenario raises the Geographical Indication as a strategy of differentiation, this study sought to map the potential conditions of management and planning of fruit production in Marrecas Settlement in accordance with the request of Geographical Indication for the Grape. The field research was realized in a grape plantation area of variety Benitaka, to analyze the physical and chemical characteristics of the soil, as well as data collection of meteorological parameters that can affect the quality of grapes, such as temperature and relative humidity of air, rainfall and the total insolation, identified from the visit to the Conventional Meteorologic Station in São João do Piauí and supplemented by information on the website of the National Institute of Meteorology. From the point of view of management, visits were made to Marrecas Settlement to meet their organizational structures and identify the role of associations in the management and marketing of production, seeking to realize the managerial capability of future Geographical Indication for grape production. The information obtained showed that the interaction between the edaphoclimatic factors of São João do Piauí and the availability of hydrous resources for irrigation provide excellent conditions for production of different grapes, presenting certification potential for Geographical Indication, either Indication of Origin or Denomination of Origin. Furthermore, it was found that the associativism represents a strategy of effective cooperation to improve the concurrence conditions of the settlers producers, such as the Association of Producers with irrigation of the Marrecas Settlement, which develops several activities within viticulture, as elaboration of the annual planning of production, marketing and management of financial resources. The capacity planning, organization and leadership of the Association of Producers with irrigation of the Marrecas Settlement, coupled with a lean and efficient organizational structure, indicate the predisposition of association to manage the possible Geographical Indication of grape production. / A crescente competitividade observada em diversas atividades do setor primário exige das organizações e associações de produtores capacidade de planejamento, elaboração e execução de estratégias capazes de promover o alcance dos objetivos e metas organizacionais. A partir do entendimento que esse cenário competitivo eleva a Indicação Geográfica como uma estratégia de diferenciação, esse trabalho buscou mapear as condições potenciais de gestão e planejamento da produção frutífera no Assentamento Marrecas mediante solicitação de Indicação Geográfica para a Uva. A pesquisa de campo foi realizada em uma área de plantio de uva da variedade Benitaka para analisar as características físico-químicas do solo, além da coleta de dados dos parâmetros meteorológicos que podem interferir na qualidade das uvas, tais como temperatura e umidade relativa do ar, precipitação pluviométrica e insolação total, identificados a partir da visita à estação meteorológica convencional de São João do Piauí e complementada por informações no site do Instituto Nacional de Meteorologia [INMET]. Sob o ponto de vista da gestão, foram realizadas visitas ao Assentamento Marrecas para conhecer suas estruturas organizacionais e identificar o papel das associações na administração e comercialização da produção, buscando perceber a capacidade gerencial de uma futura Indicação Geográfica para a produção de uva. As informações obtidas revelam que a interação entre os fatores edafoclimáticos de São João do Piauí e a disponibilidade de recursos hídricos para irrigação proporcionam excelentes condições para uma produção de uvas diferenciada, apresentando potencial de certificação por Indicação Geográfica, seja Indicação de Procedência ou Denominação de Origem. Além disso, foi verificado que o associativismo representa uma estratégia de cooperação efetiva para melhorar as condições de concorrência dos produtores assentados, a exemplo da Associação do Produtores com Irrigação do Assentamento Marrecas [APIM], que desenvolve diversas atividades no âmbito da viticultura, como elaboração do planejamento anual da produção, comercialização e gestão dos recursos financeiros. A capacidade de planejamento, organização e liderança da APIM, somada a uma estrutura organizacional enxuta e eficiente, sinalizam a predisposição da associação para gerir a possível Indicação Geográfica da produção de uva.
