Gestión de los procesos arbitrales referidos a las controversias que guardan relación con las contrataciones a cargo de la Oficina de Servicios Generales del Ministerio Público

El objeto principal del presente trabajo de investigación es proponer alternativas de solución a fin de aumentar la eficiencia de la gestión de los procesos arbitrales referidos a las controversias que guardan relación con las contrataciones a cargo de la Oficina de Servicios Generales, procurando que los resultados obtenidos por el Ministerio Público sean favorables hacia sus derechos e intereses. De acuerdo al trabajo de investigación publicado por la Contraloría General de la República, titulado “El Arbitraje en las Contrataciones Públicas durante el periodo 2003-2013”, el setenta por ciento (70%) de los procesos arbitrales en los que el Estado ha sido parte, han culminado con resultados desfavorables para las Entidades del Estado. En el presente trabajo de investigación se analizará el procedimiento seguido en el Ministerio Público para la contestación de las demandas arbitrales, lo que involucra a todos aquellos órganos que intervienen en las fases de contratación pública; asimismo, se han analizado un total de treinta y un (31) laudos arbitrales notificados a la Procuraduría Pública durante el periodo comprendido entre enero de 2016 y junio de 2019, con el propósito de determinar si las conclusiones arribadas por la Contraloría General de la República aplican a la realidad del Ministerio Público en virtud a los resultados obtenidos en sus participaciones en procesos arbitrales. Finalmente, el presente trabajo de investigación sugiere cuatro (4) alternativas de solución frente a la realidad problemática advertida en la gestión de los procesos arbitrales referidos a las controversias que guardan relación con las contrataciones de servicios del Ministerio Público, con el propósito de reducir las controversias durante la ejecución contractual, así como hacer más eficiente la participación del Ministerio Público en los procesos arbitrales. / The main purpose of this research work is to propose alternative solutions in order to increase the efficiency of the management of arbitration processes related to disputes related to the hiring by the General Services Office, ensuring that the results obtained by the Public Ministry are favorable towards their rights and interests. According to the research work published by the Office of the Comptroller General of the Republic, entitled "The Arbitration in Public Procurement during the period 2003-2013", seventy percent (70%) of the arbitration processes in which the State has been partly, they have culminated with unfavorable results for the State Entities. In this research work, the procedure followed in the Public Ministry to answer arbitration claims will be analyzed, which involves all those bodies that intervene in the public procurement phases; Likewise, a total of thirty-one (31) arbitration awards notified to the Public Prosecutor's Office during the period between January 2016 and June 2019 have been analyzed, in order to determine whether the conclusions reached by the Comptroller General of the Republic They apply to the reality of the Public Ministry by virtue of the results obtained in their participation in arbitration proceedings. Finally, this research work suggests four (4) alternative solutions to the problematic reality observed in the management of arbitration processes related to controversies related to the contracting of services of the Public Ministry, with the purpose of reducing the controversies during the contractual execution, as well as making the participation of the Public Ministry in arbitration processes more efficient. / Trabajo de investigación

Involvement of Principals in Hiring, Professional Development, and Evaluation of Paraeducators

Previous research has found paraeducators do not receive adequate training (Giangreco,Broer, & Edelman, 2002), and are often infrequently evaluated –yearly or less often (Mueller, 2002; Morgan, Ashbaker, & Young, 2001). Little is known about principals' practices relative to paraeducator training, and evaluation. To investigate these topics, a survey was distributed to principals that worked in a large suburban/rural school district in the western United States. Fifty-eight participants completed surveys at a district principals meeting. The results of the study indicated a large majority of principals (78.95% for Title 1 paraeducators, 86.21% for special education paraeducators, and 75.86 for others) hired the paraeducators in their school and most principals (88.89% for Title 1 paraeducators, 86.21% for special education paraeducators, and 60.34% for other paraeducators) were aware of district policies regarding the hiring and/or employment of paraeducators. In contrast, the majority of principals were not aware of individual school policies pertaining to paraeducator hiring and employment. The majority of principals did not indicate that they were responsible for rating paraeducator performance. Furthermore, the majority of principals did not perform paraeducator observations, hold evaluative conferences, or link the results of paraeducator evaluation to professional development.

Stereotypes and Hiring Preferences Among Business Students as a Function of Psychologist's Attire

To study what stereotypes exist regarding psychologists by the general public and determine whether and how this affects hiring preferences, 114 undergraduate business and non-business students at a large southwestern university were asked to participate. The Gough Adjective Check List was administered to determine what stereotypes are held by persons regarding psychologists. A study of visual perception/stereotype and hiring preference as a function of attire was also conducted. Three dress styles were used as stimuli. It was hypothesized that the groups would differ in their stereotypes of psychologists both cognitively and visually. There were no significant differences between the groups as a function of college major. However, a main effect for dress style was found. Possible explanations of findings are discussed.

Disertační práce se zabývá problematikou české daňověprávní úpravy tzv. mezinárodního pronájmu pracovní síly. S ohledem na velmi široký záběr této problematiky i autorčiny zkušenosti z odborné praxe je práce zaměřena na pronájem zaměstnanců směrem ze zahraničí, konkrétně členských států Evropské unie, do České republiky. Cílem disertační práce je zejména rekapitulace stávající právní úpravy daňových aspektů mezinárodního pronájmu pracovní síly, její zhodnocení v kontextu komunitární legislativy i potřeb praxe a v relevantních případech též formulace doporučení a námětů pro základní směřování dalšího legislativního vývoje. S ohledem na skutečnost, že případné změny české legislativy mohou být inspirovány rovněž právním stavem v jiných státech, je část této disertační práce věnována též nastínění základních principů daňověprávní úpravy mezinárodního pronájmu pracovní síly ve Spolkové republice Německo, a její komparaci s českou legislativou.

The main topic of this master thesis is to analyze the development of (un)employment rate at Czech labour market between the years 1998 -- 2011 with the major focus on period after the impacts of economic crisis. Another goal of this essay is to evaluate and analyze the impact of the economic crisis on various labor market indicators together with sensitivity of each gender on the performance of the Czech economy. Theoretical part of essay will explain the basic concepts through the literature. The analysis will focus on comparing and evaluating the development of unemployment rates in selected regions and unemployment by gender. The method used is a comparative analysis of development of regional and gender unemployment which will be then interpreted with time series and geometrical interpretation. Theoretical foundations are confronted with the results of analytic work which enables to provide a comprehensive evaluation.

nÃo hà / Para a atual conjuntura social, com rÃpidas transformaÃÃes em todas as Ãreas, à importante que o conhecimento esteja integrado aos processos de negÃcios da organizaÃÃo. As instituiÃÃes federais de ensino superior necessitam de uma visÃo especial quanto à implantaÃÃo dos processos e prÃticas de GestÃo do Conhecimento (GC), devido Ãs suas particularidades em seu ambiente de ensino e tambÃm em sua Ãrea administrativa. O planejamento de aquisiÃÃes de Tecnologia da InformaÃÃo (TI) na IFES carece de ferramentas de apoio, que possibilitem a otimizaÃÃo e melhoria de suas atividades. Assim sendo, este estudo tem como objetivo geral analisar a eficiÃncia relativa das IFES do Brasil quanto ao uso da gestÃo do conhecimento no planejamento das contrataÃÃes de soluÃÃes de TI, utilizando o mÃtodo de AnÃlise EnvoltÃria de Dados (DEA), e o modelo Charnes, Cooper e Rhodes (CCR), orientados aos resultados. Ademais, sÃo apresentados os conceitos de GC, os principais modelos teÃricos acerca do tema, alguns modelos de diagnÃstico de GC voltados para a AdministraÃÃo pÃblica e suas principais prÃticas, a relaÃÃo com a Tecnologia InformaÃÃo, uma contextualizaÃÃo acerca do planejamento das contrataÃÃes de TI e a GC, bem como os principais conceitos relacionados ao mÃtodo DEA. O estudo, por ser de levantamento, caracteriza-se como sendo do tipo survey, com abordagem quantitativa. No tocante aos objetivos à uma pesquisa descritiva, no qual foi aplicado questionÃrio baseado no Instrumento para AvaliaÃÃo da GestÃo do Conhecimento na AdministraÃÃo PÃblica, modelo este criado por Batista (2006). O instrumento foi aplicado aos gestores das Ãreas de TI das 103 instituiÃÃes Federais de Ensino Superior do Brasil. Das instituiÃÃes Ãs quais o questionÃrio foi enviado, 86 enviaram as informaÃÃes solicitadas. Na anÃlise descritiva sÃo apresentados os resultados da pesquisa mostrando a caracterizaÃÃo das IFES respondentes, como funciona o processo de planejamento das contrataÃÃes de soluÃÃes de TI nas IFES pesquisadas, as iniciativas de gestÃo do conhecimento e prÃticas de gestÃo do conhecimento usadas como suporte ao planejamento das contrataÃÃes de TI das IFES que responderam à pesquisa. Dentre as 86 instituiÃÃes analisadas, de acordo com o software Frontier Analyst, 57 foram consideradas eficientes e 29 IFES foram classificadas como ineficientes. SÃo tambÃm apresentados os benchmarkings, os quais as 29 IFES consideradas ineficientes devem tomar como referÃncia para melhorar sua eficiÃncia no planejamento das contrataÃÃes de TI, bem como as potenciais melhorias que as IFES devem avaliar nos fatores de entrada e saÃda analisados, para que possam melhorar sua eficiÃncia relativa no que diz respeito ao uso da gestÃo do conhecimento como suporte ao planejamento das contrataÃÃes de soluÃÃes de TI. / In the present social conjuncture, with fast transformations in all areas, is important that the knowledge and the business tactics work together in the organization. Federal institutions of higher education need a special view about the implantation and use of knowledge management, because of their peculiarities of teaching and governance. The acquisition planning of information technology lacks the support that woud enable a great improvement in the activities. This study has as general goal analyze the efficiency of IFES in Brazil concerning the knowledge management in information technology hiring, using for this purpose the method Data Envelopment Analysis (DEA), and Charnes, Cooper e Rhodes (CCR) model results-oriented. Moreover are presented the notion of KM, the leading theorists models about the theme, some types of diagnosis of KM related for public administration, as well as the notion of DEA. The study is the kind survey with quantitative approach. Regarding the goals is a descriptive research, applying a questionnaire based in the model created for Batista (2006). The questionnaire was applied to the managers of IT of 103 organizations of higher education in Brazil. Among the institutions to whom the questionnaire were sent, 86 responded. In the descriptive analysis are presented the results of the research showing the characterization of the IFES, like how the process hiring of technology solutions works, and how the initiatives of knowledge management are used to give suport to them. Among the 86 institutions analyzed according the Software Frontier Analyst, 57 were regarded efficient and 29 were regarded as not efficient. Are presented the benchmarkings, wich the inefficients IFES must consider for the improvement of their planning in IT, as well as they ought to evaluate the factors of entry and output analyzeds always with the goal of advance in the use of knowledge of management as suport for the hiring of IT solutions.

Contratação direta: análise crítica do sistema e o caso dos serviços advocatícios / Direct hiring: critical analysis of the system and the specific case of legal services

O presente trabalho oferece uma análise crítica das hipóteses de contratação direta previstas na Lei Geral de Licitações e Contratos brasileira, Lei Federal n.º 8.666, de 21 de junho de 1993, com atenção especial para o caso da contratação direta de serviços advocatícios. A dissertação encontra-se dividida em quatro partes. A primeira delimita o tema do trabalho no estágio atual de evolução do Direito Administrativo brasileiro. A segunda parte do trabalho explora o tema da licitação e sua importância para o Direito Administrativo. Nessa etapa, são apresentados os princípios norteadores da licitação e sua importância para o ideal republicano, tal qual previsto pela Constituição Federal. A terceira parte do trabalho analisa as hipóteses de contratação direta previstas na Lei 8.666/93, procurando identificar suas possíveis razões e as características em comum que existem entre elas. Elaborou-se uma classificação própria aglutinando os incisos do artigo 24 da Lei 8.666/93 em 6 categorias, a saber: a) dispensa de licitação em função do valor do objeto contratado; b) dispensa de licitação em função de situação excepcional; c) dispensa de licitação em função de problemas em contratação anterior; d) dispensa de licitação em função dos atores envolvidos; e) dispensa de licitação em função de políticas de fomento; e f) dispensa de licitação em função de especificidades do objeto. A quarta parte do trabalho contém uma análise sobre o caso da contratação direta de serviços externos de advocacia nos tribunais superiores: o Supremo Tribunal Federal e o Superior Tribunal de Justiça. Ao olhar para as decisões proferidas por essas Cortes, espera-se alcançar dois objetivos: captar os argumentos usados pelas partes que tomam posição nesse debate e identificar o posicionamento das maiores instâncias do Poder Judiciário sobre o tema da contratação direta de serviços advocatícios e o dever de licitar. Não se trata, portanto, de uma análise de jurisprudência, que foi usada como fonte de pesquisa para identificar situações reais envolvendo a contratação direta de serviços advocatícos, suas razões, e os argumentos forenses favoráveis e contrários a ela. / This paper offers a critical analysis of the cases of direct hiring as prescribed by the Brazilian General Law of Public Bids and Contracts, i.e., Federal Law No. 8.666, of June 21, 1993, with due regard for the direct hiring of legal services. The paper is divided into four parts. The first defines the theme of the paper viewed from the current standpoint of evolution of the Brazilian Administrative Law. The second part of the paper analyzes the issue of bidding per se, and its importance to Administrative Law. At this stage the bidding guiding principles and their importance to the republican ideal are presented, as set forth in the Brazilian Federal Constitution. The third part of the paper looks into the cases of direct hiring set out under Law No. 8.666/93, seeking to identify the possible reasons therefor and the common characteristics existing among them. Under a specific classification the items of article 24 of Law number 8.666/93 were combined in order to fall under six categories: a) waiver of bidding in view of the amount of the contracted object; b) waiver of bidding due to exceptional circumstances; c) waiver of bidding due to problems occurred in previous hiring; d) waiver of bidding due to the players involved; e) waiver of bidding based on development policies; and f) waiver of bidding based on the specific characteristics of the object. The fourth part of the paper analyzes the case of external legal services directly hired, as viewed by the higher courts, i.e., the Supreme Court and the Superior Court of Justice. When looking into the decisions handed down by these courts, two goals are expected to be met: to raise the arguments used by the parties involved in this debate and identify the standing of the Judiciary Branch highest instances on the subject of directly hiring legal services, as well as and the duty to promote competitive bids. This is not an analysis of case law, which was used as a research source to identify real situations involving direct hiring of legal services, their reasons, and forensic arguments for and against them.
