The social and legal process of bankruptcy in Germany, 1815-1870

The regulation of bankruptcy poses a dilemma to societies. It needs to address two problems at once: the first concerns the balance between debtor and creditor interests; the second pertains to the question between deterrence and continuity. Up to the present day there is much disagreement about the appropriate design of bankruptcy procedures. German states in the nineteenth-century found it impossible to agree on a common insolvency regime until the 1870s. This thesis investigates the legal as well as the social process of bankruptcy in a sample of towns and states in Germany between 1815 and 1870. It focused on non-Prussian legal systems in order to shed light on those alternative solutions to bankruptcy that were not ultimately adopted in the national bankruptcy code. Bankruptcy was a social process that could take place in court as well as out of court. Creditors and debtors had strong incentives to turn to extrajudicial settlement mechanisms. Where strong local corporate organisations for merchants existed, they facilitated settlements and rule-enforcement among its members out of the official court system. Those local clubs often played the role of an arbitrator. For long, bankruptcy regulation had been part of the mercantile self-administration. Legal harmonization and processes of state formation put an end to these practises. Simultaneously, an industrializing economy devised new organisational forms that were alien to the old legal framework. Toward the second half of the century, legal harmonization gained momentum; creditor protection became the focus of lawmakers while local communities and their interests no longer played a role. As German legislators built a national and universally shared legal framework, bankruptcy regulation ceased to be local and communal. This was to the liking of businessmen, who had long complained about legal fragmentation when trying to conduct business across different German regions.

Os caminhos da instrução pública elementar em Maricá de 1834 a 1854 / The ways of public elementary instruction in Marica from 1834 to 1854

Este trabalho de pesquisa buscou compreender como ocorriam e quais eram as ações no campo das políticas públicas para a instrução primária no século XIX no município de Maricá. Escolhemos como recorte temporal o período do século compreendido entre os anos de 1834 e 1854. A escolha das duas datas se prendeu ao fato de que este período contempla algumas mudanças importantes no campo das políticas públicas para a educação e instrução. Em 1834 temos o Ato Adicional à Constituição de 1824 que delega para as províncias competências para legislar e gerir a instrução primária e secundária. Em 1849 ocorre a implantação do Regulamento Couto Ferraz na província do Rio de Janeiro e, em 1854, o então Ministro do Império encaminha a reforma do ensino na Corte. A proximidade do município com a capital da província e com a Corte pode ser considerado como um dos fatores que instigou a nossa curiosidade em verificar até que ponto esta aproximação contribuiu para o crescimento de Maricá. No decorrer da pesquisa, começamos a perceber que os ritmos de crescimento e desenvolvimento foram diferentes, a cidade continuou como rota de passagem por muitos anos, mesmo com a sua importância econômica (produção agrícola e o pescado), mercado de abastecimento regional. A proximidade com a capital da Província do Rio de Janeiro (Niterói) e a Corte não garantiu à cidade de Maricá crescimento do número de escolas públicas primárias, foio que se verificou ao longo do período analisado. Além da pesquisa bibliográfica sobre o tema utilizamos também como fonte as publicações dos memorialistas locais, os relatórios dos presidentes da província do Rio de Janeiro, assim como documentos disponíveis no Arquivo Público do Estado do Rio de Janeiro. / This research seeks to understand how did they occur and which were the actions in the field of public politics for primary education in the nineteenth century in the city of Maricá. We had chosen as the time frame the period of the century between the years 1834 and 1854. The choice of the two dates is attached to the fact that this period includes some major changes in the field of public politics for education and instruction. In 1834 we have the Additional Act to the Constitution of 1824 which delegates powers to the provinces to legislate and manage the primary and secondary education. In 1849, the implementation of Regulation CoutoFerraz in the province of Rio de Janeiro occurred and, in 1854, the Empire Minister forwarded education reform to the court. The proximity of the town with the provincial capital and the Court can be considered as one of the factors that prompted our curiosity to verify how far this approach has contributed to the growth of Maricá. During the research, we began to realize that the pace of growth and development were different, the city remained as a route throughout many years, even with its economic importance (agriculture and fisheries), regional supply market. The proximity to the capital of the Province of Rio de Janeiro (Niterói) and the Court did not ensure the city of Maricá growing number of government primary schools over the analyzed period.In addition to the literature on the subject use das a source of memoirists local publications, the reports of the presidents of the province of Rio de Janeiro, as well as documents available in the Public Archives of the State of Rio de Janeiro

Older people in Scotland : family, work and retirement and the Welfare State from 1845 to 1999

The social and economic experiences of older people in Scotland over the past two centuries provides a particularised lens through which larger themes of change and adaptation may be analysed. Older age cohorts are examined as specific identity groups within the context of a society in rapid transformation. The years c. 1845-1999 represent a period of time in which almost every sector was affected by industrialisation, urbanisation, migration, economic developments, technological and medical progress, and social reform. In combination with historical interpretations, modern sociological theory concerning the aged as a distinct social grouping provides the basis for further inquiry. Concepts such as status, social capital, interdependency, paternalism and citizenship have been of major importance in structuring this research. By means of demographic analysis, readings of written biographical documentation, and the incorporation of over fifty oral histories conducted in Dundee and Edinburgh, the role of the family in older people’s lives has been explored. Nineteenth and twentieth-century population trends have been incorporated as an area for detailed investigation of long-term familial practices. An understanding of the older person’s role in the family over time suggests a formalised socio-economic stability based upon kinship ties, gender roles, and economic and social reciprocity. Stage theory allows for examination of the economics of ageing, particularly in regard to employed and retired older people. Original research covering older people’s experiences of work in Dundee and Edinburgh provides qualitative and quantitative data on paternalistic policies in the brewing and jute industries, promotion and retirement practices, and economic status among the working elderly. The experience of being retired has been evaluated in terms of economic independence, social capital, class and gender. Analyses of the experience of retirement in the post-war era are bound with the rise of the modern welfare state. Significant government commissions and acts provide scope and sequence in an analysis of the role of the state in old age. Principally, the New Poor Law of 1845 (Scotland), the Pension Acts of 1908 and 1925, the National Insurance Act of 1946, as well as the social welfare acts of 1948 have been studied. Particular focus on the influence of the Social Work Act 1968 (Scotland) complements an overarching argument concerning Scotland’s unique practices in the modern welfare state. Emphasis is on care in the community, using statutory and voluntary services provided at the local level as case studies. Interpretations of older people in terms of their various roles in the welfare state, their communities and places of work, and within their families indicate that throughout the period, older populations have distinctively adapted to the long-term effects of modernisation in Scottish society.

Desta forma, pretende-se focar, dentro da multiplicidade de temas que o objeto fílmico contém, um assunto que pareceu predominante nos filmes no momento em questão: a militarização do corpo1. Este tema deverá agregar outros assuntos presentes e interligálos. Na verdade, a proposta de uma temática única torna a idéia de uma unidade nacional, propagada pelo Estado Novo, mais coerente. Por isso, o tema do corpo sugere a idéia de nação posta pelo estadonovista e também agrega ideologias que estavam em voga naquele contexto histórico. Para esta última, deve-se atribuir a influência estética, mesmo que indireta, de filmes, não necessariamente do mesmo tipo, produzidos por outras nações de cunho autoritário. Estas nações esperavam, de certa forma, sua regeneração ou sua "correção", através da ordem e da disciplina. Para tanto, os princípios disciplinares que compunham a instituição militar eram os mais eficientes. Ou seja, a força, a disciplina, a higiene e a audácia, que estavam embutidas no pensamento militar, deveriam servir de exemplo para a "correção" de uma sociedade "doente". Por isso, um Estado ordeiro só poderia se constituir pela disciplina militarizada da sociedade. E é neste âmbito que o corpo em "atividade física" representou, no campo imagético, a união entre o Estado e sociedade / Abstract: The aim of this dissertation is to make an analysis of the image and sonorous characteristics, which marked Cine Jornal Brasileiro, a jornal produced by the Department of the Press and Propaganda (Departamento de Imprensa e Propaganda - DIP) of the New State (Estado Novo) between 1939 till 1942. In this way, it is intended to focus, taking into account the multiplicity of subjects that the filmic object content, a subject that seemed predominant in the films at the moment in question, the militarization of the body.[1] This theme should add other subjects that are present and connect them. In Truth, the proposal of a one kind of thematic turns the idea of a national unity, propagated by the New State, more coherent. By that, the theme (subject) of the body suggests the idea of a nation proposed by the New State and also communicate ideologies that were in vogue in that historical context. For this idea, the aesthetic influence of the films, must be attributed, even if indirect and not necessarily of the same type, produced for other nations of authoritarian matrix. These nations wish, of a certain form, its regeneration or its correction through the order and discipline. For this, the principles to discipline that composed the military institution were most efficient. That is, the force, the discipline, the hygiene and the audacity that was inlaid in the military thought should be the example for the correction of a "sick" society. Therefore, an organized State only could be consisted by the militarized discipline of the society. D’une sociodicée à un savoir d’État : le service public, une tentative de mise en forme du monde social par le droit (1873-1940) / From Sociodicy to a Science of State : Public Service as an Attempt to Shape the Social World through Law (1873-1940)

Au carrefour de la socio-histoire, de la sociologie du droit et de la sociologie des élites, la thèse revient sur la genèse d’un concept-clef de l’État républicain en France : le service public. Entre 1870 et 1940, cette idée, qui préexistait à la naissance du nouveau régime, est retravaillée par différents types d’acteurs dans un sens plus démocratique, tel un aggiornamento de la pensée d’État. Dans cette opération de mise à jour figurent en première place les milieux juridiques (hauts fonctionnaires du Conseil d’État et professeurs de droit), qui vont notamment se servir de la montée en puissance du contentieux administratif pour légitimer leur position par rapport aux civilistes et imposer une vision « d’en haut » du service public, compris comme un véritable savoir de gouvernement. En retraçant les différentes étapes par lesquelles s’est constitué un récit mythique des origines autour de l’arrêt Blanco du 8 février 1873, la thèse vise donc à faire l’histoire de la construction d’une profession, celle de publiciste ou d’administrativiste, en même temps que la genèse d’un champ, le champ du « public ». Au sein de ce champ gravitent des acteurs plus éloignés du champ juridique (ingénieurs de l’État, philanthropes, théoriciens du social de tous ordres, syndicalistes de la fonction publique), qui luttent soit pour ne pas se laisser imposer une conception entièrement étatisée de la générosité publique, soit pour faire entendre le point de vue des dominé-e-s de ce champ (petits et moyens fonctionnaires, instituteurs/trices). L’enquête met donc en valeur une distribution inégale et différenciée de l’intérêt pour le « public », visible dans la compréhension des revendications démocratiques de l’époque (droit de grève et syndicalisation dans la fonction publique, municipalisme, vote de l’impôt sur le revenu), que certains des acteurs essaient constamment de retraduire dans les catégories d’un droit qu’ils aiment à voir comme seul savoir légitime sur le monde social. In fine, ce travail de socio-histoire permet, par un effort pour penser avec la mentalité des contemporains de l’époque (i.e. sans raconter l’histoire par la fin et en faisant droit aux possibles non advenus), de comprendre la métamorphose du « souci de soi » de l’État à un âge démocratique, en décrivant le point de rencontre entre une main droite traditionnellement régalienne et masculine (symbolisée par les membres du Conseil d’État) et la main gauche de l’État social et protecteur.En termes de méthodologie et de cadrage théorique, la thèse repose sur une enquête prosopographique dont le corpus est constitué par les différents sous-groupes de porteurs de l’idée de service public entre 1870 et 1940 (n = 77, des hommes à une majorité plus qu’écrasante). Elle alterne récit et analyse des données quantitatives issues de l’enquête prosopographique, et combine ethnographie sur archives (pour le Conseil d’État), analyse de correspondances et analyse de contenu (arrêts de la justice administrative, commentaires doctrinaux et ouvrages « théoriques » sur le service public). Elle s’essaie à une association raisonnée de la théorie des champs et de la sociologie des professions. Enfin, les archives dépouillées sont, outre les dossiers de carrière de chaque prosopographié-e, celles du Conseil d’État, du Tribunal des conflits, des facultés de droit (principalement Paris, Bordeaux et Toulouse), de l’agrégation de droit et des syndicats (fédérations de fonctionnaires + CGT dans ses rapports avec l’État). / At the intersection of social history, the sociology of law and the sociology of elites, the thesis goes back to the origin of a key concept of the French Republican State: public service. Between 1870 and 1940, this idea, which preceded the new regime, is reshaped by different types of actors in a more democratic sense, as an aggiornamento of state-thought. The legal circles (senior officials of the Conseil d'État and law professors) took a prime position during this update. They notably made advantage of the rise in importance of administrative litigation to legitimate their position as opposed to civil law specialists and impose a vision "from above" of public service, understood as true science of administration. By retracing the sequence of events that made a myth from the Blanco case of 8 February 1873, the thesis aims to give an account of the construction of a profession, that of a lawyer specialising in public law or in administrative law, at the same time as the creation of a “public” field. Actors distant from the legal field (state engineers, philanthropists, social theorists of all kinds, civil service trade unionists) gravitate to this field, struggling either not to let the State's conception of generosity to the public be imposed on them, or to get the point of view of those dominated in this field (lower and middle bureaucrats, primary school teachers) across. The enquiry therefore highlights the unequal and differentiated distribution of interest for the "public", visible in the understanding of the democratic claims of the time (the right to strike and unionise in the civil service, municipalism, the Act of Parliament on income tax), that certain actors consistently tried to translate into categories of law regarded favourably as the only right approach to the social world. Finally, in an effort to think within the contemporaries of the time’s mindset (i.e. without reading history backwards and by taking virtual history into consideration), this socio-historical work enables the understanding of the transformation of the "self-concern" of the State in a democratic age, by describing the encounter between a traditional, sovereign and masculine right hand (epitomised by the members of the Conseil d'État) and the left hand of the protective and social State.In terms of methodology and theoretical framework, the thesis is based on a prosopographical enquiry, the corpus of which is made from the different subgroups of exponents of the idea of public service between 1870 and 1940 (n = 77, the overwhelming majority are men). It alternates between an account and an analysis of the quantitative data drawn from the prosopographical enquiry, and combines archival ethnography (for the Conseil d'État), correspondance analysis and discourse analysis (administrative justice cases, jurisprudence and "theoretical" works on public service). It attempts a reasoned association between field theory and the sociology of professions. Also, as well as the career records of each individual in the prosopography, the archives that have been examined are those of the Conseil d'État, the Tribunal des conflits, law faculties (mainly Paris, Bordeaux and Toulouse), the “agrégation” examination in law and unions (federations of civil servants + CGT in its relation with the State).

L’étude explore comment l’État royal français institue au cœur de son dispositif de pouvoirs des structures spécialisées dans le maniement, la projection et la réception de l’écrit politique pour éteindre les troubles des guerres de Religion, gagner des positions politiques face aux corps et aux communautés, armer stratégiquement, politiquement et théoriquement les luttes et les contacts militaires et cérémoniels à l’échelle européenne. Les acteurs de ces structures nouvelles, secrétaires d’État et secrétaires, contribuent à forger dans ce contexte de crise politique d’une exceptionnelle intensité une nouvelle gouvernementalité qui prépare et annonce l’avènement de la monarchie administrative et des pré-bureaucraties du second XVIIe siècle. Cœur de l’État, matrice du vouloir royal, les secrétaires mobilisent leurs compétences professionnelles au service du souverain. Leur position fonctionnelle dans l’État croît jusqu’à en faire la pointe avancée d’une société politique en intense recomposition. Ils forment alors une société administrative aux codes, usages et pratiques parentes à ceux de leurs homologues européens, espagnols et anglais, au gré de la progressive internationalisation des guerres de Religion. Le concept heuristique de république européenne des bureaux pose à nouveaux frais les problèmes des circulations transnationales des savoirs administratifs et des transferts de modèles de gouvernement. L’attention redoublée à la matérialité du travail des bureaux à l’échelle européenne confère à l’étude la dimension d’histoire culturelle de l’État, ouverte et potentielle, centrée sur les jeux d’acteurs, d’échelles, la résolution des conflits, la collaboration et les liens au sein des réseaux d’information. / This study explores how the French Royal State establishes at the heart of its apparatus of power structures specialized in the manipulation, projection, and reception of political writing. These structures are intended to end the troubles of the Wars of Religion, to win political positions against corps and communities, and to strategically, politically, and theoretically arm both battles as well as military and ceremonial contacts across Europe. The actors in these new structures are secretaries of State and secretaries. From this exceptionally intense political crisis, they help bring about a new governmentality that prepares and announces the coming of the administrative monarchy and the pre-bureaucracies of the second part of the 17th Century. As the heart of the state and the conduit of royal desire, secretaries mobilize their professional skills in the service of the sovereign. Their functional position in the state grows into the cutting edge of a political society undergoing intense restructuring. They thus form an administrative society with codes, uses, and practices closely related to their Spanish and English European counterparts, following the increasing internationalism of the Wars of Religion. The heuristic concept of the European “Republic of bureaus” once more asks questions regarding the transnational circulation of administrative knowledge and the transfers of government models. The increased attention to the materiality of the work of government bureaus on the European scale gives this study the dimension of a cultural history of the State, centered on the games of actors and scales, the resolution of conflicts, and the collaboration and connections at the heart of networks of information.
